Board of Supervisors

1.                   Certificate of Appreciation for Lost Coast 4x4s for Eel River Bar Clean-up. (Supervisor Jimmy Smith)

RECOMMENDATION: Authorize Chair to sign Certificate of Appreciation.

2.                   Letter of Inquiry to NOAA Fisheries requesting information on Potter Valley fish screens. (Supervisor Smith)

RECOMMENDATION: Ratify authorization for the Chair to sign letter to NOAA Fisheries.

3.                   Letter of Support to NOAA Fisheries for the California Department of Fish and Game's application for Pacific Coast Salmon Recovery Funding. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Letter of Support.

4.                   Letter in Support of Motion by Pacific Lumber Company for Bankruptcy Court Authorization to Pay the Severance Packages Promised to Workers Terminated in December, 2006. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to Sign Letter of Support.

Health and Human Services - Mental Health Branch

5.                   Approval of the Amendment to the Agreement between Humboldt County and Fortuna Community Services, D.B.A. "HART" for Driving under the Influence Programs

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the attached Third Amendment between Humboldt County and Fortuna Community Services, D.B.A. "HART" for Driving Under the Influence Programs.

6.                   Approval of First Amendment to the Service Agreement with Remi Vista, Inc. for the Provision of Therapeutic Behavioral Services to Medical Beneficiaries for Fiscal Years 2006/2007 and 2007/2008

RECOMMENDATION: That the Board of Supervisors authorize the First Amendment to the Service Agreement with Remi Vista, Inc. for the Provision of Therapeutic Behavioral Services to Medical Beneficiaries for Fiscal Years 2006/2007 and 2007/2008.

7.                   First Amendment to the Agreement with Crestwood Behavioral Health Inc. for Provision of Long Term Care to Chronically Mentally Ill for Fiscal Year 2006/2007

RECOMMENDATION: That the Board of Supervisors authorize the Chair to approve the First Amendment to Services Agreement with Crestwood Behavioral Health Inc., for provision of long term care to chronically mentally ill and increase contract value for Fiscal Year 2006/2007 to $1,068,000. There is no anticipated impact to the County General Fund.

Public Works

8.                   Tompkins Hill Road Rehabilitation and Overlay Between P.M. 1.8 & 2.8: Project No. RPL - 5904 (078), Contract No. 202709

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above - mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 10, 2007 at 2:00 PM.

9.                   Walnut Drive (F3J300) Rehabilitation and Overlay between Cypress and Fern Streets, Project No. RPL-5904 (085), Contact No. 202705

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 10, 2007 at 2:00 PM.

10.               Mckinleyville Avenue and Washington Avenue (C4L925) Overlay and Rehabilitation at PM 0.02 to 1.61, Project No. RPL-5904(077), Contract No. 202702

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 10, 2007 at 2:00 PM.

11.               Memorandum of Agreement between Humboldt County, Bear River Band of the Rohnerville Rancheria and Bureau of Indian Affairs

RECOMMENDATION: That the Board of Supervisors authorize the Chairman to sign three copies of the Memorandum of Agreement to allow for additional funding opportunities as well as closer inter-governmental cooperation with the Bear River Band of the Rohnerville Rancheria.

12.               Federal Apportionment Exchange and State Match Program for Regional Surface Transportation Program (RSTP) Funds

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign two copies of Agreement No. X07-5904 (088).

13.               Arcata - Eureka Airport (ACV) Passenger Terminal Expansion and Renovation Substitution Request, AIP 03-06-0010-30, Project 913270

RECOMMENDATION: That the Board of Supervisors receive and file the Notice of Subcontractor Substitution Request submitted to John H. Kruger Plastering and Drywall as requested by the General Contractor (Mayan Construction) for the project mentioned above and accept and grant the John H. Kruger Plastering and Drywall Subcontractor Substitution for cause in accordance with Public Contract Code Section 4107.

14.               Financial Assurances for Reclamation of Quarry Sites

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ___ which authorizes the annual adjustment of the funds pledged by the Public Works Department to complete reclamation of rock and gravel quarry sites.

15.               Rocky Gulch Culvert Replacement on Old Arcata Road at PM 6.19, Contract No. 205300

RECOMMENDATION: That the Board of Supervisors approve the plans specifications and direct the Clerk of the Board to advertise the above - mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 10, 2007 at 2:00 PM.

16.               Warren Creek Culvert Replacement on Warren Creek Road at PM 0.13, Contract No. 205302

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to open July 10, 2007 at 2:00 PM.

17.               Firewood Distribution Agreement between the County of Humboldt and the Humboldt Senior Resource Center

RECOMMENDATION: Authorize Sheriff Gary Philp to sign the Senior Wood Agreement between the County of Humboldt and the Humboldt Senior Resource Center outlining this year's firewood distribution process for low to moderate income senior citizens of the county.

18.               Amendment of Memorandum of Understanding between the National Park Service and County of Humboldt

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign an amendment pursuant to Section 7 of the current Memorandum of Understanding between the National Park Service Redwoods National and State Parks and Humboldt County relating to law enforcement and Public Safety within and near Redwood National and State Parks; Authorize the Sheriff to sign the amendment to the current Memorandum of Understanding.

19.               Request for Extension of Extra-Help Hours

RECOMMENDATION: That the Board of Supervisors approve the extension of extra-help hours for Stephanie Richter, Senior Office Assistant, to a maximum of 999 hours (Trust Fund # 3600-000-7000), pursuant to Section 7 of Humboldt County Salary Resolution effective immediately.

D.                  DEPARTMENT REPORTS

IHSS Public Authority

1.                   Approve Second Amendment to Agreement between the Public Authority and the Area One Agency on Aging to provide the In-Home Supportive Services Provider Registry

RECOMMENDATION: Adjourn as the Humboldt County Board of Supervisors; Convene as the Governing Board of the Humboldt County In-Home Supportive Services Public Authority and consider the following agenda: Approve Second Amendment to Agreement between the Public Authority and the Area One Agency on Aging for the In-Home Supportive Services Provider Registry and authorize the Chair to execute three (3) copies of the Agreement.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters

RECOMMENDATION: Hear Reports.

2.                   Standing Item -- Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel.

3.                   Standing Item -- Conference with Legal Council on Pending, Threatened or Anticipated Litigation Pursuant to Government Code Section 54956.9

4.                   Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator.It is the Intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority

5.                   Standing Item -- Conference with Legal Counsel - Existing Litigation Pursuant to Government Code Section 54956.9 (a), County of Humboldt v. Robert C. Mckee; Humboldt Superior Court Case No. DR020825

6.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of County Counsel pursuant to Government Code Section 54954.5

7.                   Conference with Legal Counsel - Existing Litigation Pursuant to Government Code Section 54956.9(a), Jeffrey Lytle v. County of Humboldt et al, Humboldt Superior Court Case No. DR 070339

G.                 PUBLIC APPEARANCES--1:30 P.M.

This 15-minute portion of the meeting is reserved for persons desiring to address the Board on any matter not on this agenda that is under the jurisdiction of the Board. It is requested that speakers sign the sheet at the front doors of the Chamber by 1:25 p.m.
