A.                  NON-AGENDA ITEM

1.                   Resolution recognizing Dell'Arte Appreciation Month. (SPECIAL PRESENTATION)

RECOMMENDATION: Add resolution to 6/26/07 Board of Supervisors agenda "Special Presentations."

B.                  SUPPLEMENTAL AGENDA ITEMS

1.                   Operations and Maintenance Agreement and Consolidating Agreement of Hammond Coastal Trail (CONSENT ITEM)

RECOMMENDATION: Authorize Board Chair to Operations and Maintenance Agreement for the "Hole in the Hammond Trail" Segment of the Hammond Coastal Trail.Authorize the Board Chair to sign the Consolidating Agreement between State Coastal Conservancy, County of Humboldt, and Redwood Community Action Agency to protect the public interest in the Hammond Coastal Trail.

2.                   Construction of Storm Damage Repairs on Mattole Road (F3C010) at P.M. 40.82 & 42.00; Contract No. 203120 & 203186.

RECOMMENDATION: Receive and file the bids for Construction of Storm Damage Repairs on Mattole Road (F3C010) at P.M. 40.82 & 42.00.

Award the contract to Grant Equipment in the amount of $64,379.00.

Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance.

Direct the Auditor-Controller to establish a new contract account 1200321-0205, and transfer $67,597 to the account per the attached appropriation transfer.

3.                   Construction of Storm Damage Repairs on Mattole Road (F3C010) at P.M. 11.86; Contract No. 203182. (CONSENT ITEM)

RECOMMENDATION: Receive and file the bids for Construction of Storm Damage Repairs on Mattole Road (F3C010) at P.M. 11.86.

Award the contract to Miller Farms Nursery, Inc. in the amount of $122,544.00.

Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance.

Direct the Auditor-Controller to establish a new contract account 1200321-0206, and transfer $128,671 to the account per the attached appropriation transfer.

4.                   Agreement for Transportation Services for the Elderly and Handicapped in Southern Humboldt County (Quail) (CONSENT ITEM)

RECOMMENDATION: Authorize the Chair to sign three copies of the Amendment to Extend Term of Agreement for Transportation Services for the Elderly and Handicapped in Southern Humboldt County.

Direct the Clerk of the Board to return the signed copies of the agreement to Public Works for transmittal to Humboldt Transit Authority for execution.

5.                   Central Avenue Rehabilitation and Overlay between Pickett Rd to Babler and Airport Rd to Grange; Project No. RPL-5904(075), Contract No. 202713. (CONSENT ITEM)

RECOMMENDATION: Approve the plans and specifications.

Direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 24, 2007 at 2:00 PM.

6.                   Sutter Road Rehabilitation and overlay (Rd No. C4L810) PM 0.00 to 0.80:Project No. RPL -5904(061), Contract No. 202712. (CONSENT ITEM)

RECOMMENDATION: Approve the plans and specifications

Direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 24, 2007 at 2:00 PM.

7.                   Hiller and Pickett Road Rehabilitation and overlay (C3L080 & 4M030) at PM 0.60 to 1.46 and 0.00 to 0.40: Project No. RPL-5904(065), Contract No. 202707. (CONSENT ITEM)

RECOMMENDATION: Approve the plans and specifications.

Direct Public Contract Code with bids to be opened on Tuesday, July 24, 2007 at 2:00 PM.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of Standard Agreement No. 07-0241 with State Department of Food and Agriculture for Enforcement of California Organics Food Act

RECOMMENDATION: That the Board of Supervisors grant a waiver from the provisions of the Nuclear Free Ordinance and approve Standard Agreement No. 07-0241 for California Organics Food Act inspection s and authorize the Chair to sign both copies as well as the Contractors Certification.

2.                   Megabyte Tax System Software Upgrade

RECOMMENDATION: That the board of Supervisors approves the Megabyte Tax System Software Upgrade License Agreement.

3.                   Letter of Appreciation to Debby Bender for her service on the Humboldt County Mental Health Board. (Supervisor Neely)

RECOMMENDATION: Authorize the Chair to sign Letter of Appreciation.

4.                   Reappointment of Matthew Filar, Jean Munsee, Jack Shaffer, Richard Botzler and Byrd Lochtie to the Human Rights Commission. (Supervisor Neely)

RECOMMENDATION: Approve the reappointment.

5.                   Letters of Appreciation to H. Benjamin Shaeffer, Abdul Aziz and Angela Ward for their service on the Human Rights Commission. (Supervisor Neely)

RECOMMENDATION: Authorize the Chair to sign the Letters of Appreciation.

6.                   Humboldt County Fair Association 2007 Operating Budget

RECOMMENDATION: That the Board of Supervisors approve the request, and direct the Chair of the Board and the County Clerk to sign the operating budget.

Community Development Services

7.                   Resolution Accepting Program Year 2007-2008 Title I WIA Subgrant, Registration Number R865458, Authorizing the Chair of the Board to sign the Subgrant, and Delegating Signature Authority for Fiscal Documents to the Community Development Services Director and for Administrative Documents to the WIB Executive Director

RECOMMENDATION: That the Board of Supervisors receive the staff report; Adopt Resolution No. ___ accepting Program Year 2007-2008 Title I WIA Subgrant, Registration Number R865458; Authorize and direct the Chair of the Board to sign the Subgrant; Authorize and direct the Workforce Investment Board Executive Director to sign administrative documents, as required by the State of California Employment Development Department; Authorize and direct the Community Development Services Director to sign fiscal documents, including contracts, utilizing these funds, after review and approval by County Counsel and the Risk Manager.

County Administrative Office

8.                   Workers' Compensation Coverage-Petrolia Fire Protection District

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Memorandum of Understanding for adding Petrolia Fire Protection District to the program effective July 1, 2007; and approve Resolution No. ____to add Petrolia Fire Protection District to the County's primary and excess workers' compensation policies as a covered party/named insured.

9.                   Workers' Compensation Coverage - Palo Verde Fire District

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Memorandum of Understanding for adding Palo Verde Fire Department to the program effective July 1, 2007 and approve Resolution No.___ to add Palo Verde Fire Department to the County's primary and excess workers' compensation policies as a covered party/named insured.

10.               Approval of Center for Employee Advancement Funding Recommendations.

RECOMMENDATION: That the Board of Supervisors approve the Appropriation Transfer to expend $10,000 from the Center for Employee Advancement to provide employee training and Authorize the County Administrative Officer to extend the existing contract with College of the Redwoods to incorporate additional training as proposed by the Community Development Services Department.

11.               Approval of Memoranda of Understanding with State of California for Continued Use of Part - Time Branch Court Facilities

RECOMMENDATION: That the Board of Supervisors approve the four attached "Memoranda of Understanding" (MOUs) for continued use of part-time court facilities and authorize the Chair of the Board to sign the MOUs.

Health and Human Services - Mental Health Branch

12.               Approval of an Interagency Agreement with the Humboldt-Del Norte Special Education Local Plan Area (SELPA) to Facilitate the Provision of Mental Health Services

RECOMMENDATION: That the Board of Supervisors Review and approve the agreement between Humboldt County Department of Health and Human Services, Mental Health Branch and Humboldt-Del Norte SELPA; and authorize the Mental Health Branch Director of the Department of Health and Human Services to sign the agreement.

13.               Agreement with 7th Avenue Center LLC-Mental Health Rehabilitation Center (MHRC) for Residential Care and Enhanced Services for Fiscal Year 2007-2008

RECOMMENDATION: That the Board of Supervisors approve the Service Agreement with 7th Avenue Center for the provision of residential care and enhanced services to authorized beneficiaries for Fiscal Year 2007-2008 and authorize the Chair to sign the agreement.

14.               Agreement with Crestwood Behavioral Health Inc. For Long Term Care for Chronically Mentally Ill for Fiscal Year 2007/2008

RECOMMENDATION: That the Board of Supervisors approve the Agreement with Crestwood Behavioral Health Inc., for long term care to chronically mentally ill for Fiscal Year 2007/2008 and authorize the Chair to sign the Agreement.

Health and Human Services - Public Health Branch

15.               Allocate One Full-Time Office Services Supervisor in Fund 1175, Budget Unit #400, Public Health Administration

RECOMMENDATION: That the Board of Supervisors approves the allocation of one full-time Office Services Supervisor (salary range 324, class 0122) position in fund 1175, budget unit #400, Public Health Administration, effective immediately.

16.               Adopt Resolution Establishing and Additional Penalty Assessment for the Humboldt County Emergency Medical Services Fund

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. __ to add an additional penalty assessment rate for the Emergency Medical Services Fund.

Health and Human Services - Social Services Branch

17.               Allocate One Full-Time Legal Clerk I/II position in Budget Unit #511, Social Services Branch

RECOMMENDATION: That the Board of Supervisors approve the allocation of one full-time Legal Clerk I/II (salary range 246/269, class 351 A/351 B) position in budget unit 511 effective immediately.

18.               Agreement between DHHS and New Directions of Humboldt Foster Family Association

RECOMMENDATION: That the Board of Supervisors approve the proposed agreement for $9415 for fiscal year 2007 - 2008, with the option to extend the agreement for an additional two fiscal years, between the County of Humboldt and the New Directions of Humboldt Foster Family Association for the recruitment and training of prospective foster care providers between July 1, 2007 and June 30, 2008; Authorize the Chair to execute three (3) copies of the agreement.

19.               Approve the Memorandum of Understanding with California Statewide Automated Welfare System Consortium IV

RECOMMENDATION: That the Board of Supervisors approve the Memorandum of Understanding with California Statewide Automated Welfare System Consortium IV and Authorize the Chair to execute three copies of the Memorandum of Understanding.

20.               Agreement between Humboldt County Department of Health and Human Services Social Services Branch Public Guardian Division and Del Norte County Mental Health for Fiscal Year 2007/2008

RECOMMENDATION: That the Board of Supervisors approve the agreement between the County of Humboldt and the County of Del Norte Mental Health Department for Fiscal Year 2007/2008 and authorize the Chairperson to execute three (3) copies of the agreement.

21.               Extension of the Agreement between the County and Redwood Community Action Agency for the Operation of the Multiple Assistance Center

RECOMMENDATION: That the board of Supervisors authorize the Director of the Department of Health and Human Services, Social Services Branch to send a letter notifying Redwood Community Action Agency that the County is extending the agreement for fiscal year 2007/2008.

22.               Appointments to the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC)

RECOMMENDATION: That the Board of Supervisors approve the following appointments to the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC): Garr Nielsen - Law Enforcement - Replacing Dave Douglas; Donna Wheeler - Mental Health - Replacing Lance Morton; Dave Douglas - Community Member - Replacing Suzi Peters.

23.               Supplemental Budget in Sheriff's Budget 1100 221 for Final Payment of Computer System

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Sheriff's Budget 1100 221 for final payment of CAD/RMS project.There will be no impact to the General Fund. (Forfeiture Funds $220,823)

D.                  DEPARTMENT REPORTS

1.                   Update on County Anti-Meth Campaign. (Supervisor Smith)

RECOMMENDATION: Hear the report and take appropriate action, if required.

Health and Human Services - Social Services

1.                   Adopt Rules and Regulations Governing the General Relief Program in Humboldt County

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ___ superseding Resolution No. 03-90 Governing the General Relief Program in Humboldt County.

County Administrative Office

2.                   Adoption of FY 2007-08 County Budget

RECOMMENDATION: That the Board of Supervisors approve the attached resolution adopting the proposed budget of the County of Humboldt for FY 2007-08, including the Board-approved modifications to the proposed budget, as the final adopted budget for FY 2007-08.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters

F.                  CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Administrative Assistant to the Board of Supervisors pursuant to Government Code Section 54954.5

3.                   Standing Item -- Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel.

H.                  PUBLIC HEARINGS

Public Works

1.                   Review and Approve the Amendments to Franchise Agreements for Rate Increases Covering the Franchise Areas of Northwestern Humboldt County, Arcata, Eureka, Fortuna, Ferndale, Blue Lake/Fieldbrook, Willow Creek, Holmes/Redcrest, Weott/Meyers Flat and Garberville.

RECOMMENDATION: That the Board of Supervisors open a public hearing and receive the staff report and public comments on the proposed rate increases for sold waste collection in unincorporated Humboldt County; Close the public hearing; Approve the Amendments increasing the rates for solid waste collection in all ten of the franchise areas and modifying the non-exclusive curbside recycling programs in the Fortuna and Ferndale areas; Authorize the Chair to execute the three original copies of the Amendments upon approval by County Counsel and Risk Management.
