1.                   Request for the County Community Development Services Department and the Public Works Department Staff conduct a review of the Rohnerville Rancherias Fee to Trust Project and the Environmental Assessment (EA) for the Project. (CONSENT) (Supervisor Smith)

RECOMMENDATION: Authorize the County Community Development Services Staff and Public Works Staff to conduct the requested review.

2.                   Letter of Condolence to the Family of Jeff Robinson, Humboldt Bay Harbor District Conservation Director (Supervisor Woolley)

RECOMMENDATION: Authorize Chair to sign letter of condolence.

3.                   Humboldt County Sign Shop Rebuilding Project

RECOMMENDATION: That the Board of Supervisors authorize County staff to pursue the viability to relocate the Sign Shop to Jacobs Avenue; Authorize Public Works to work with Winzler and Kelly Consulting Engineers on the second level analysis of Jacobs Avenue, as outlined; transfer $7150.00 from Contingency to Public Works Facilities to cover the cost of the second level analysis.

Auditor-Controller

1.                   2007/2008 Appropriation limit

RECOMMENDATION: That the Board of Supervisors adopt and approve Resolution No. ___ and schedules setting forth the 2007-2008 appropriation limits as established by Article XIIIB of the California Constitution.

2.                   Resolution declaring Saturday, September 1, 2007 as Big Foot Days. (Supervisor Geist)

RECOMMENDATION: Adopt the Resolution.

3.                   Resolution authorizing temporary closure of portion of Ave of the Giants & Mattole Road for Humboldt Redwoods Marathon on October 21, 2007. (Supervisor Rodoni)

RECOMMENDATION: Adopt the Resolution.

4.                   Resolution of Commendation for Don Leonard on his Retirement from the Humboldt County Convention & Visitor's Bureau. (Supervisor Neely)

RECOMMENDATION: Adopt the Resolution.

5.                   Letter of Support for the Trinity River Restoration Fund Act of 2007 (HR2733). (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign letter of support.

6.                   Letter of support for AB 1032 which would require site-specific permits from the Department of Fish and Game for individuals who conduct motorized instream gold dredging mining activities. (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign letter of support.

7.                   Appoint Amy Nilsen to the Access Humboldt Board of Directors for the 2007-2008 Board Year. (Supervisor Neely)

8.                   Letter of Support for Salmon Disaster Relief Compensation. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter of support.

Community Development Services

9.                   Appointments to the Humboldt County Workforce Investment Board

RECOMMENDATION: That the Board of Supervisors receive report and recommendation from the Workforce Investment Board and make appointments to the Workforce Investment Board for terms beginning effective upon your appointment through June 30, 2009.

10.               Allocation of one Administrative Analyst I/II Position

RECOMMENDATION: That the Board of Supervisors approve the allocation of one full-time Administrative Analyst I/II (Salary Range 333/366, Class 0626) in Natural Resources Division of Community Development Services (Budget Unit 1100-289) effective immediately and approve the associated supplemental budget to cover staffing costs.

County Administrative Office

11.               Local Fire District Allocation for Fiscal Year 2006-07 for the Whitethorn Fire Protection District

RECOMMENDATION: That the Board of Supervisors authorize the chair of the Board to execute a retroactive agreement with the Whitethorn Fire Protection District for revenue-sharing of the County's FY 2006-2007 Proposition 172 funding.

County Counsel

12.               Authorize the Addition of a Second Vehicle for the Code Enforcement Unit and Approve a Transfer from Contingencies of $30,000 to Fund the Purchase

RECOMMENDATION: Approve the purchase of a compact sports utility vehicle with four-well drive and establish line item 1100121-8770 Vehicle - Off Road, to facilitate the purchase; approve the transfer of $30,000 from the contingency fund, account 1100990-2010 to the new account; approve the Budget Appropriation Transfer; Approve the donation of the vehicle to the County Motor Pool for capitalization, maintenance, and insurance.

District Attorney

13.               2007-2008 Child Abuse Vertical Prosecution Block Grant Program Grant Application from the State of California in the amount of $146,981 for FY07/08 (State General Fund)

RECOMMENDATION: That the Board of Supervisors allow the District Attorney to submit application and authorize the Chair to execute continuation application for Vertical Prosecution funding, Grant Award Face Sheet (OES A301) and Certificate of Assurance of Compliance.

Health and Human Services - Mental Health Branch

14.               Agreement with Transitional Residential Treatment Facilities Inc. (TRTF) for Fiscal Year 2007-2008

RECOMMENDATION: That the Board of Supervisors Approve the Service Agreement with Transitional Residential Treatment Facilities, INC for Fiscal Year 2007-2008; and authorize the Chair to sign the attached Agreement.

15.               "5150" Resolution for Involuntary Detention, Evaluation and Treatment of Certain Mentally Disordered Persons

RECOMMENDATION: That the Board of Supervisors approve the attached "5150" Resolution for the involuntary detention, evaluation, and treatment of certain mentally disordered persons as specified in the Welfare and Institution Code, Section 5150 and rescind Resolution No. 03-17.

Health and Human Services - Public Health Branch

16.               Approval of State Agreement for Ryan White Program, Fund 1175, Fiscal Years 2007-2010

RECOMMENDATION: That the Board of Supervisors approve Agreement Number 06-55750 with the California Department of Health Services and authorize the Chair to execute the first page of the complete agreement package and seven (7) additional copies, and the first page of the Contractor Certification Clauses.

Health and Human Services - Social Services Branch

17.               Exercise the Option to Extend the Lease at 930 Sixth Street, Eureka, California, for the Social Services Branch Employment Training Division

RECOMMENDATION: That the Board of Supervisors approve exercising the option to extend the lease, executed on December 16, 2003 with the California Newspapers Partnership, Inc., through November 30, 2008, for the Department of Health and Human Services, Social Services Branch, for office space located at 930 sixth Street, in Eureka, California and authorize Real Property to send a notice to Lessor that County is exercising the option to extend the lease.

18.               Exercise the Option to Extend the Lease at 231 Second Street, Eureka, California

RECOMMENDATION: That the Board of Supervisors approve the option to extend Lease at 231 Second Street, Eureka, executed September 23, 2003, for the Department of Health and Human Services, Social Services Branch and Authorize Real Property to send a notice to Lessor that County is exercising the option to extend the lease.

Personnel

19.               Amendment to MOU for Representation Unit 7 (LEM) Regarding Salary Adjustments for Certain Classifications

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ___ approving the Amendment to the MOU for Unit 7 (Law Enforcement Management) providing for salary adjustments for certain classifications and authorize the chair to execute the Amendment to the MOU

20.               Amendment to Compensation plans for Management and Confidential Employees and Elected and Appointed Officials

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ approving the amendment to the 2005-2006, 2006-2007 and 2007-2008 Compensation Plans for Management and Confidential Employees and Elected and Appointed County Officials.

21.               Amendment to MOU for Representation Units 1-4 (AFSCME) Regarding Salary Adjustments for Certain Classifications

RECOMMENDATION: Adopt Resolution No. ___ approving the Amendment to the MOU for Units 1-4 (AFSCME), providing salary adjustments for certain classifications and authorize the Chair to execute the Amendment to the MOU

22.               Amendment to MOU for Representation Unit 6 (HDSO) Regarding Salary Adjustments for Certain Classifications

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ___ approving the Amendment to the MOU for 6 (Humboldt Deputy Sheriff's Organization) providing salary adjustments for certain classifications and authorize the Chair of the Board to execute the Amendment to the MOU.

Public Works

23.               Roof Replacement Project-Fortuna Veterans Building: Project Number 170205

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications.

24.               Roof Replacement Project - Clark Complex, Eureka, California: Project Number 170206

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications

25.               Master Agreement Administering Agency-State Agreements for State-Funded Projects

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the revised Administering Agency-State Agreement No. 00058S Master Agreement for State-Funded Projects and delegate to the Director or Acting Director of Public Works the Authority to sign all Program Supplemental Agreements, Fund Exchange Agreements, Fund Transfer Agreements and/or any amendments thereto with the California Department of Transportation.

26.               Construction of Sidewalks on Central Ave. (4L800) at PM 1.76-2.63 and Murray Rd. (3M020) at PM 0.87-0.98, Project No. SR2S - 5904 (081), Contract No. 204801

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications.

27.               2007 Road Tour

RECOMMENDATION: That the Board of Supervisors take the following actions: 1. Select a date for scheduling a Road Tour of the northern portion of the County.As of this writing, the bus is available on September 12/13 or September 19/20; 2. Review the possible points of interest and suggested list of participants; 3. Discuss priority of points of interest and direct Public Works to finalize itinerary; 4. Add or delete recommended participants; 5. Authorize overnight parking at the 2nd and J Street Garage for tour participants on Wednesday evening of the dates selected.

28.               Agreement for Airport Consulting Services

RECOMMENDATION: Authorize the Chair to sign three copies of the agreement for Airport Consulting with Reynolds, Smith and Hills for an amount not to exceed $144,750.

29.               Construction of Bridge over Indian Creek on Mattole Road (F3C010) at PM 10.0 Agreement No. P0310511, Contract No. 204301

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications.

30.               Construction of McKinleyville Avenue and Washington Avenue (C4L925) Overlay and Rehabilitation at PM 0.02 to 1.61, Project No. RPL-5904 (077), Contract 202702

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of McKinleyville Avenue and Washington Avenue (C41925) Overlay and Rehabilitation at P< 0.02 to 1.61; Award the contract to Granite Construction in the amount of $677,544; Authorize the Chair to execute the project agreement upon submittal of the appropriate bonds and insurance; direct the Auditor-Controller to establish a new contract account 1200321-0207 and transfer $779,187 to the account per the appropriation transfer.

31.               Construction of Rocky Gulch Culvert Replacement on Old Arcata Road at PM 6.19, Contract NO. 205300

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Rocky Gulch Culvert Replacement on Old Arcata Road at PM 6.19; Award the contract to Wahlund Construction in the amount of $145,660; authorize the Chair to execute the project agreement upon submittal of the appropriate bonds and insurance; Direct the Auditor-Controller to establish a new contract account 1200321-0211 and transfer $167,500 to the account per the appropriation transfer.

32.               Construction of Tompkins Hill Road Rehabilitation and Overlay Between PM 1.8 & 2.8: Project No. RPL-5904(078), Contact No. 202709

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Tompkins Hill Road Rehabilitation and Overlay between PM1.8 & 2.8; Award the contract to Mercer-Fraser in the amount of $437,470; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0209, and transfer $503,090 to the account per the attached appropriation transfer.

33.               Construction of Walnut Drive (F3J300) Rehabilitation and Overlay between Cypress and Fern Streets, Project NO. RPL-5904 (085), Contract No. 202705

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Walnut Drive (F3J300) Rehabilitation and Overlay between Cypress and Fern Streets; Award the Contract to Kernen Construction in the amount of $341,580; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; Direct the Auditor - Controller to establish a new contract account 1200321-0208, and transfer $375,000 to the account per the attached appropriation transfer.

34.               Warren Creek Culver Replacement on Warren Creek Road at PM 0.13, Contract No. 205302

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Warren Creek Culvert Replacement on Warren Creek Road at PM 0.13, Contract No. 205302; Award the contract to Mercer-Fraser in the amount of $325,154; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0210, and transfer $374,000 to the account per the attached appropriation transfer.

35.               Speed Bump Policy

RECOMMENDATION: That the Board of Supervisors approve the Speed Hump Policy for the County of Humboldt.

36.               Mitigated Negative Declaration for Central Avenue and Murray Road Safe Route to Schools Project

RECOMMENDATION: That the Board of Supervisors adopt the Mitigated Negative Declaration for sidewalk construction and shoulder widening along portions of Central Avenue and Murray Road in McKinleyville, and direct staff to post a Notice of Determination with the Humboldt County Clerk/Recorder.

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim the week of August 5-11, 2007 as National Health Center Week. (Supervisor Neely)

RECOMMENDATION: Adopt the proclamation.

E.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Solid Waste Franchise Contracting Process

RECOMMENDATION: That the Board of Supervisors re-affirm its previous direction to staff to seek competitive bids for all franchise areas no later than June 30, 2010; give staff authority to use discretion to bring to the Board interim contract extensions (not extending current contracts past June 30, 2010) for the purpose of modifying contract areas; direct staff to work with the Board's Solid Waste Sub-Committee to develop a new model contract based on the findings of the needs assessment presented to the Board on June 19, 2007; Direct staff to negotiate with existing holders of contracts for container site and transfer station operation to extend those contracts until after June 30, 2010.

2.                   County Facilities Tower Leases

RECOMMENDATION: That the Board of Supervisors remove the limitation on use of the Courthouse roof towers to licensed County systems for law enforcement and local government; those not licensed to County but directly related to public safety and health; and those indirectly supporting public safety and health as adopted on November 13, 2001; authorize the County Administrative Office, Communications Division, to release a Request for Proposal (RFP) to lease space on the towers on the Courthouse and other County facilities to commercial vendors for cellular towers and wireless internet connections in consultation with the Public Works Department and County Counsel; authorize the County Administrative Office to use any revenue generated from the lease of tower space or space at a facility for installation of a tower to improve the County's communication systems including radio, telephone, and wide-are network for County Networks.

3.                   Adoption of Revised North Coast Integrated Regional Water Management Plan

RECOMMENDATION: Adopt the revised North Coast Integrated Regional Water Management Plan.

4.                   Adopt Resolution No. ___ Authorizing the Submittal of a HOME Grant Application to the State of California Department of Housing and Community Development for a First-Time Homebuyer Infill Construction Program and for an Owner Occupied Rehabilitation Program

RECOMMENDATION: That the Board of Supervisors receive Staff Report; adopt Resolution No. ___, authorizing submission of an $800,000 HOME grant application for a First-Time Homebuyer Infill Construction Program and an Owner Occupied Rehabilitation Assistance Program for persons earning less than 80% of median income; and authorization for the Community Development Services Director to sign Grant paperwork, contracts and subrecipient agreements, after review and approval by County Counsel and Risk Management to carry out the activities of the grant; Adopt updated Guidelines -- Owner Occupied Rehabilitation Assistance Program - Design and Process; First Time Homebuyer Infill Construction Program - Design and Process; Rental Project Long Term Asset Management Monitoring Policy and Procedures.

5.                   No Parking Ordinance - Sutter Road

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ___ by title waive the first reading thereof, and set the Ordinance for adoption at least one week away.
