Board of Supervisors

1.                   Certificate of Recognition for Ginger Vance, 2007 Business Woman of the Year and Greg and Sandy Dale, 2007 Family of the Year (Supervisor Rodoni)

RECOMMENDATION: Ratify the Certificate of Recognition.

Clerk of the Board

2.                   Approval of Board Order from October 9, 2007 Meeting

RECOMMENDATION: Approve the Board Order.

Community Development Services

3.                   Fourth Amendment to the Sublease for 520 E. Street, Eureka, with Redwood Region Economic Development Commission for the Economic Development Division and Authorization to Extend Sublease through January 31, 2009

RECOMMENDATION: That the Board of Supervisors amend existing sublease for 520 E. Street, Eureka, CA to increase the square footage and monthly rent; Authorize Real Property to send notice to Redwood Region Economic Development Commission (RREDC), Sublessor, exercising the option to extend the sublease for rental space at 520 E. Street, Eureka, CA.

County Administrative Office

4.                   Local Fire District Allocation for Fiscal Year 2007-08 for the Myers Flat and Garberville Fire Protection Districts

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute an agreement with the Myers Flat and Garberville Fire Protection Districts for revenue - sharing of the County's FY 2007-2008 Proposition 172 funding.

5.                   Workers Compensation Coverage - Phillipsville Volunteer Fire Department

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Memorandum of Understanding for adding Phillipsville Volunteer Fire Department to the program effective November 1, 2007; and Approve the Resolution to add Phillipsville Volunteer Fire Department to the County's primary and excess workers' compensation policies as a covered party/named insured.

Health and Human Services - Social Services Branch

6.                   Extension of Leases with PWM, Inc. for Properties used by the Social Services Branch

RECOMMENDATION: That the Board of Supervisors authorize Real Property to send a letter notifying PWM, Inc. that the County is exercising the option to extend the leases for offices located at 929 Koster Street, 445 West Washington Street, and 537 West Washington Street, and the lot located at 638 West Clark Street, all located in Eureka, CA.

7.                   Temporary Salary Increase in Accordance with Section 7 of the Humboldt County Salary Resolution

RECOMMENDATION: That the Board of Supervisors authorize temporary increase in compensation for Veterans Service Representative, Rena Maveety, as if promoted to Veterans Service Officer beginning September 10, 2007 and continuing until the Veterans Service Officer position is filled, pursuant to Section 7 of the Humboldt County Salary Resolution.

8.                   Lease Agreement with PWM, INC. for 555 "H" Street, Eureka

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign two originals of the lease agreement with PWM, Inc.; Adopt supplemental budget to provide for current year funding.

Public Works

9.                   Adoption of Ordinance - Stop Intersection Designations for Twelfth Street at Highway 101 & Riverwalk Drive, Designation of 35 MPH Zone on Twelfth Street, Fortuna

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ______ amending Sections 421-6 and 422-10 of Title IV of the Humboldt County Code relating to a stop sign and 35 MPH speed limit on Twelfth Street in Fortuna.

10.               Transportation Development Act Claim

RECOMMENDATION: That the Board of Supervisors authorize the Chairperson to sign the Transportation Development Act (TDA) claim in the amount of $2,388,340 and direct the Clerk of the Board to forward the claim to the Humboldt County Association of Governments (HCAOG).

11.               Agreement for Airport Consulting Services - Conducting a Runway Safety Area Study Evaluation Alternatives as Required by the Federal Aviation Administration Orders 5200.8 and 5300.9 for the Arcata/Eureka Airport, Project Number 918211, Airport Improvement Program (AIP) 03-06-0010-31

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign three (3) copies of the Agreement for Airport Consulting with Mead and Hunt, for and amount not to exceed $251,338.

D.                 SPECIAL PRESENTATIONS

1.                   Resolution of Commendation for Retiring Humboldt County Library Employee Edward Munn (Supervisor Neely)

RECOMMENDATION: Adopt the Resolution

2.                   Resolution of Commendation for Retiring Humboldt County Senior Library Assistant, Joy Moore (Supervisor Neely)

3.                   Proclamation Recognizing October 21st - 27th, 2007 as Childhood Lead Poisoning Prevention Week (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation

E.                  DEPARTMENT REPORTS

Public Works

1.                   Security Entrances Expansion and Remodel - Humboldt County Courthouse Project Number 170007

RECOMMENDATION: That the Board of Supervisors receive and file the bids for the project mentioned above; Award the project to the lowest responsible and responsive bidder, Timberworks, Mt. Shasta, California, in the amount of $563,000.00 for the base bid; Authorize the Chairman to execute the agreement when staff approves the bonds and insurance; Approve the following supplemental budget for the Administrative Office of the Courts contribution to the project: REVENUES: 1100170-525052 Courthouse Retrofit - $629,440.00; EXPENDITURES: 1100170-8967 Courthouse Modifications $629,440.00; Approve the transfer for $630,560.00 from General Fund Contingencies to provide funding for the County portion of the project.

F.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Review of County Timber Production Zone (TPZ) regulations (Humboldt County Code Sections 314-7.4 et seq.) for consistency with California Timberland Productivity Act Government Code Sections 51100 et seq. and Direction to Staff. (Supervisor Neely & Supervisor Geist)

RECOMMENDATION: Receive staff report. Receive public comment and discuss staff report and proposed revisions to County regulations.Direct staff to prepare a draft ordinance that would make residences conditionally permitted on land zoned TPZ.Refer the proposed ordinance to the Planning Commission for a public hearing and return to the Board within a time certain, to be specified by the Board.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters

2.                   Presentation by Alan Bower, new UC Cooperative Extension Livestock and Natural Resources Advisor and County Director for Humboldt and Del Norte Counties. (Supervisor Smith)

2.                   54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel.

3.                   Standing Item -- Conference with Legal Council on Pending, Threatened or Anticipated Litigation Pursuant to Government Code Section 54956.9

4.                   Standing Item -- Conference with Legal Counsel - Existing Litigation Pursuant to Government Code Section 54956.9 (a), County of Humboldt v. Robert C. Mckee; Humboldt Superior Court Case No. DR020825

5.                   Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator. It is the Intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority

6.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of County Counsel pursuant to Government Code Section 54954.5

7.                   Standing Item -- Conference with Legal Counsel - Existing Litigation Pursuant to Government Code Section 54956.9 (a), County of Humboldt v. Jan Carrico and David Doolaege

Community Development Services

1.                   Appeal of the Planning Commission's Approval of Fairhaven Cottages' Coastal Development Permit and Notice of Merger Case No. CDP-06-65A/NOM-06-13A File No. APN 400-243-12, -13

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comment; Uphold the Appeal and Deny the Project Based upon the inability to make the required findings by adopting Resolution No. ______.

County Administrative Office

2.                   Public Hearing to Consider Adoption of an Ordinance for the 2007-2008 Update of the Humboldt County Schedule of Fees and Charges

RECOMMENDATION: Open the public hearing and receive the staff report and public comments; Close the public hearing; Approve or modify the new, increased, decreased, deletedor changed fees as shown in the 2008 Humboldt County Schedule of Fees and Charges; Introduce by title , Ordinance No. ____, updating the Humboldt County Schedule of Fees and Charges for 2008, waive the first reading of the ordinance and adopt the Ordinance.
