Board of Supervisors

1.                   Letter of Appreciation to Robert Vevoda for his service on the Humboldt County Resource Conservation District Board of Directors. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign letter of appreciation

2.                   Appoint Gary Belli to the Humboldt County Resource Conservation District Board of Directors. (Supervisor Smith)

RECOMMENDATION: Appoint Gary Belli to the Humboldt County Resource Conservation District Board of Directors.

3.                   Request from Manila Community Services District calling for a Special Advisory Election on the issue of whether Manila residents want fluoride added to their water by the Humboldt Bay Municipal Water District. (Supervisor Woolley)

RECOMMENDATION: Approve the request and refer to the Humboldt County Elections Department.

4.                   Request from the City of Arcata to consolidate their Municipal Election with Humboldt County's Statewide Primary Election on February 5, 2008 and to place a utility users tax measure on the ballot. (Supervisor Woolley)

RECOMMENDATION: Approve the request and refer to Humboldt County Elections Department.

Clerk of the Board

5.                   Approval of the Board Order - Meeting of October 23, 2007

RECOMMENDATION: Approve the Board Orders and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

Community Development Services

6.                   HR 2389 - Recreational and Conservation Easement Support Program - City of Arcata Funding Request (Jacoby Creek Forest Lima Property Expansion, Appraisal Costs)

RECOMMENDATION: That the Board of Supervisors receive the staff report and approve funding request of $5,500 from Title III Project Funding for the City of Arcata for the appraisal cost of the 121 acre Jacoby Creek Forest Lima Property Expansion.

County Administrative Office

7.                   Local Fire District Allocations for Fiscal Year 2007-08 for the Orleans Volunteer Fire District

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute agreements with the Orleans Volunteer Fire District for revenue-sharing of the County's FY 2007-2008 Proposition 172 funding.

8.                   Funding for Tsunami Signs

RECOMMENDATION: That the Board of Supervisors approve the appropriation transfer to provide funding for purchase for tsunami hazard warning signs.

9.                   Local Fire District Allocations for Fiscal Year 2007 - 2008 for the Fortuna, Loleta and Samoa Peninsula Fire Protection Districts

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute agreements with the Fortuna, Loleta and Samoa Peninsula Fire Protection Districts for revenue - sharing of the Count's FY 2007-2008 Proposition 172 funding.

10.               Execute Extended Commitment Period of Primary General Liability Insurance (PGL) through CSAC - Excess Insurance Authority

RECOMMENDATION: That the Board of Supervisors authorize the Chairman of the Board of Supervisors to execute Addendum B of the Memorandum of Understanding between Humboldt County and the CSAC - Excess Insurance Authority to remain in the Primary General Liability (PGL) Program through June 30, 2010.

Health and Human Services - Public Health Branch

11.               Approval of Budget Revision and Amendment to Agreement between First 5 Humboldt and the County Public Health Branch, Fund 1175, Fiscal Year 2007-2008

RECOMMENDATION: That the Board of Supervisors approve the Amendment to Agreement between First 5 Humboldt and the County of Humboldt / Public Health Branch; Authorize the chair to sign three copies of the Amendment; Approve a budget.

12.               Extension of Extra - Help Hours for Two Laborer and One Mail Services Driver Personnel in Fund 1175, Budget Unit 400, Public Health Administration for Fiscal year 2007-2008

RECOMMENDATION: That the Board of Supervisor waive the 9601-hour annual limit for extra-help employees: Charles Prescott, Laborer, George Parlet, Laborer and Kimberly Miranda, Mail Services Driver, to the maximum of 1920 hours pursuant to Section II D.d. of Humboldt County Salary resolution .

Health and Human Services - Social Services Branch

13.               Authorize Temporary Increase in Pay for Senior Fiscal Assistant

RECOMMENDATION: It is recommended that the Board of Supervisors authorize temporary increase in pay for Senior Fiscal Assistant, Judy Taylor, (Class 0124, Range 303) as though she had been promoted to Fiscal Services Supervisors (Class 1149, Range 332) beginning October 21, 2007 and continuing until the position is filled. Pursuant to section 12.4.1 of the AFSCME MOU.

Library Services

14.               Peninsula Library System "Infopeople Computer Lab" Upgrade

RECOMMENDATION: That the Board of Supervisors accept the mobile computer lab equipment upgrades from the Peninsula Library System (PLS); Authorize the Director of the Library Services to sign the memorandum of Understanding between the PLS and the Humboldt County Library.

Probation

15.               Extension of Extra Help Hours Past the 960 Limit

RECOMMENDATION: It is recommended that the Board of Supervisors approve the extension of extra help hours for Rachel Snider-Marsh and Patrick Del Rosario, Juvenile Corrections Officers, to 1440 hours through June 30, 2008, per Section 7 of the Salary Resolution.

Public Works

16.               Construction of Storm Damage Repairs on East Branch Road, County Project No. 206278

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between G.R. Wilcox Enterprises, Inc., Contractor, and Humboldt County for the storm damage repairs on East Branch Road; and approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $5,897.35.  This will bring the total amount paid to 100% of the contract.

17.               Construction of Storm Damage Repairs on Mattole Road at PM 40.82 and 42.00, County Project Numbers 203120 and 203186

RECOMMENDATION: That the Board of Supervisors accepted the completed contract, including all change orders approved by the Public Works Department, between Grant Equipment, Contractor, and Humboldt County for the storm damage repairs on Mattole Road; and approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $2,747.68. This will bring the total amount paid to 100% of the contract.

18.               Callwell Drive Final Map Subdivision, APN 511-081-66, Mckinleyville

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete and accept and approve the subdivision map for filing with the County Recorder; Accept the dedications to the County of Humboldt of Parcels B and D for public utilities and Parcel E for non-vehicular access, reject Parcel B for pedestrian purposes and reject Parcel D for public road purposes, all as shown on the subdivision map;  Authorize the Chair to date and execute the Conveyance and Agreement; Authorize the Chair to date and accept the Overflight Easement Deed.

19.               Motor Pool Vehicle Purchase and Surplus Vehicles

RECOMMENDATION: That the Board of Supervisors authorize the purchase of six hybrid vehicles by the Motor Pool; Approve the attached appropriation transfer to provide funding for the acquisition; Declare Equipment # 04028, 2002 Ford Taurus, License # 1139695, Equipment 04235, 2002 Ford Taurus, License # 1132185, Equipment # 04230, 2002 Ford Taurus, License # 1132186, Equipment # 07100, 2003 Ford Crown Victoria, License # 1142397, Equipment # 07101, 2003 Ford Corwn Victoria, License # 1152528; Authorize the Purchasing Agent to dispose of the surplus vehicles when the Equipment Superintendent puts the replacements in service; Deposit the revenue from the sales in the Motor Pool fund.

20.               Rancho Del Sol, Phase 1, Final Map Subdivision  APN 511-301-10, Mckinleyville

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete and accept and approve the subdivision map for filing with the County Recorder; Accept the dedications to the County of Humboldt of Parcel B for public utilities and pedestrian access, Parcel C for public utilities, and Parcel D for public road purposes, all as shown on the subdivision map; Authorize the Chair to execute the Conveyance and Agreement.

21.               Construction of Walnut Drive (F3J300) Rehabilitation and Overlay between Cypress and Fern Streets, County Project Number 202705

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the total amount of $46,843.01; Accept the completed contract, including all change orders approved by the Public Works Department between Kernen Construction, Contractor and Humboldt County for the rehabilitation and overlay of Walnut Drive; Approve the final claim for payment, as submitted by the Public Works Department to Auditor / Controller, in the amount of $48,670.03 (this will bring total amount paid to 100% of the contract); Approve the appropriation to provide funding for the final payment.

Sheriff

22.               Approval of Lease Agreement with Brown Rentals for SCOP (Sheriff's Citizens on Patrol) Office in Willow Creek

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to execute the lease with Brown Rentals for office space located at 76 Country Club Drive, Willow Creek; Approve a supplemental budget in Sheriff's budget 1100 221 to cover costs for rent and utilities.

D.                  SPECIAL PRESENTATIONS

County Administrative Office

1.                   Legislative Update & Report from Sacramento; and Progress Report on 2007 Legislative Platform

RECOMMENDATION: It is recommended that the Board of Supervisors receive a legislative update and report from the County's legislative advocate Mr. Don Peterson; and  that the Board of Supervisors receive and file the County's legislative progress report regarding the outcomes of the County's 2007 State Legislative Platform.

J.                   ADMINISTRATIVE ABATEMENT HEARINGS

Code Enforcement Unit

1.                   Administrative Abatement Hearing Vilica LLC; A.P. # 522-012-002, 522-013-004 and 522-013-010

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22 hold an administrative hearing to determine whether a public nuisance exists on the subject property; adopt findings and issue an Order consistent with the evidence presented at the hearing.

K.                  PUBLIC HEARINGS

Community Development Services

1.                   Harvey and Jannette Carroll, General Plan Amendment, Zone Reclassification and Parcel Map Subdivision Case No. GPA-06-02 / ZR-06-12 (Freshwater Area)

RECOMMENDATION: It is recommended that the Board of Supervisors introduce the Ordinance by title and waive further reading; Open the public hearing in a manner prescribed by law; receive the staff report and public testimony; Approve Resolution No. _____, adopt the Planning Commission's findings, adopt the Mitigated Negative Declaration and approve the amendment of the Humboldt County General Plan (Freshwater Community Plan (FWCP)) land use map, by amending property in the Freshwater area [GPA-06-02, Carroll] from Timber Production to Agricultural Rural; Approve the adoption of the Ordinance No. ____ amending Section 311-7 of the Humboldt County Code by reclassifying property in the Freshwater area [ZR-06-12, Carroll] from Agriculture General with a Special Building Site Combining Zone specifying a 20- acre minimum to a 5 acre minimum (AG-B-5(5)).

2.                   Consider Extending Interim Zoning Ordinance suspending the entitlement to a building permit in lands zoned for timber production (TPZ) pursuant to Humboldt County Code Sections 314-7.4, (that allows one dwelling unit or manufactured home in timberland production zones) and 314-7.4.1.6, including subsections 6.1, 6.2, 6.3 (that allows one dwelling unit per twenty (20) acres in land zoned for timberland production (TPZ)). (Supervisor Neely & Supervisor Woolley)

RECOMMENDATION: Receive staff report.  Receive public comment.  Consider extending Interim Zoning Ordinance #2391, and take other appropriate action, if required.
