1.                   Resolution of Commendation for Robert G. Wade, III on his Retirement. (Supervisor Neely)

RECOMMENDATION: Adopt the Resolution.

Agricultural Commissioner

1.                   Funding for Humboldt County's Participation in the Federal/State-Mandated Oak Mortality Disease Regulatory Inspection Activities (Sudden Oak Death)

RECOMMENDATION: Approve funding agreement ($28,403) with the California Department of Food and Agriculture.

2.                   Supplemental Budget ($29,935) for Funding to Conduct a Survey for Phytophthora Ramorum, the Pathogen Known to Cause Sudden Oak Death   (Federal/State Funds)

RECOMMENDATION: Adopt supplemental budget.

Clerk of the Board

3.                   Approval of the Board Orders--Meeting of August 17, 2004

RECOMMENDATION: Approve the Board Orders.

Community Development Services (CDS)

4.                   Approval of the Headwaters Revolving Loan Fund Contract with Arcata Economic Development Corporation (AEDC) to Renew Existing Relationship   (Headwaters Fund)

RECOMMENDATION: Approve contract with AEDC to continue to serve as a Revolving Loan Fund Lender.

General Services

5.                   Supplemental Budget   (Radio Capitalization Fund)

RECOMMENDATION: Adopt supplemental budget ($1,050) as part of the rearrangement of antennas on the Courthouse roof.

Health and Human Services - Mental Health Branch (MHB)

6.                   Execution of the Final Amendment (Fiscal Year 2003-04) Combined Negotiated Net Amount and Drug Medi-Cal Contract with the State Department of Alcohol and Drug Programs (SDADP)

RECOMMENDATION: Authorize the MHB Director, acting in the capacity of the County Alcohol and Drug Administrator, to sign and submit the final amendment to the SDADP.

7.                   Services Agreements with Humboldt Child Care Council for the Provision of Mental Health, Case Management, and Therapeutic Behavioral Services to Medi-Cal Beneficiaries   (State/Federal Funds)

RECOMMENDATION: Authorize Chair to sign agreements.

Health and Human Services - Public Health Branch

8.                   Public Health Laboratory Modular Project   (Federal Funds)

RECOMMENDATION: Award contract up to $646,062 for the construction and installation of Modular Microbiology Laboratory and Office at 805 Sixth Street, Eureka, to Bio-Safe America, Corp. Project number 455-2-345.1 contingent upon acceptance of the proposal for the site work and financial package.  Authorize General Services Director to execute final contract with Bio-Safe America, Corp. contingent upon approval of County Counsel, Department of Health and Human Services, Treasurer and an acceptable

proposal to complete necessary site work.  Authorize the General Services Director to conduct an informal bid for site preparation work necessary

for the installation of the Modular Microbiology Laboratory and Office.  Authorize the General Services Director to execute a contract with the successful bidder up to $75,000 for the site preparation work for the Modular Microbiology Laboratory and Office contingent upon

approval of County Counsel, Department of Health and Human Services and Treasurer.

9.                   Base Award ($14,131) for Local Assistance Funding to Support Tuberculosis Prevention and Control Activities, and $6,000 in Food, Shelter, Incentives, and Enablers Allotment   (State Grant)

RECOMMENDATION: Accept grant from the California Department of Health Services, Tuberculosis Control Branch.

10.               Ambulance Permits   (Revenue from Permit Fees)

RECOMMENDATION: Renew existing ambulance permits for the following:  Arcata-Mad River Ambulance Service (Service Area I); Hoopa Health Association (Service Area II); City Ambulance (Service Area III); Fortuna/Garberville Rescue service (Service Area IV); and City Ambulance Garberville (Service Area V).  Renew the ambulance permit issued to Southern Trinity Health Services.

Library Services

11.               Supplemental Budget for Receiving Remaining Grant Funds from First 5 Humboldt to Enhance Services to Families with Children Up to Age Five

RECOMMENDATION: Adopt supplemental budget ($52,159).

Public Works

12.               Award of Contract for Construction of McKinleyville Avenue Sidewalks; Project No. SR2SL 5904(056); Contract No. 202001   (Road Fund [38,650]/Grant Funds [$386,500])

RECOMMENDATION: Award the project to RAO Construction Co.

13.               Purchase of a New Computer in the Natural Resources Office   (Road Fund)

RECOMMENDATION: Approve purchase ($1,000).

14.               Overflight Easement to the County of Humboldt Executed by Peter Hewson and Elisabeth Olsen for the Benefit of the Arcata-Eureka Airport   (Enterprise Fund)

RECOMMENDATION: Accept Overflight Easement.

15.               Avigation Easement to the County of Humboldt Executed by Rex and Chloe Gott for the Benefit of the Arcata-Eureka Airport   (Enterprise Fund)

RECOMMENDATION: Accept Avigation Easement.

16.               Formation of Permanent Road Division (PRD) No. 1000, Zone No. 002 for Central Estates Subdivision, McKinleyville, Rescinding of Resolution No. 04-72, and Resetting of Public Hearing   (Costs Reimbursable to General Fund)

RECOMMENDATION: Receive and file the new petition, affidavit of valuation and engineer's report for the formation of Permanent Road Division No. 1000, Zone No. 002.  Adopt the Resolution of Intent to Establish Humboldt County Permanent Road Division No. 1000, Zone No. 002, to Impose Parcel Charges for Road Maintenance and to Rescind Resolution No. 04-72.  Set a time and date of 1:30 PM on November 9, 2004 to hold a public hearing to receive testimony of protest regarding the formation and setting of an assessment for road maintenance for the proposed Permanent Road Division No. 1000, Zone No. 002. Direct the Clerk of the Board to:  publish the petition, notice of formation and notice of assessment per Streets and Highways Code §§ 1164 and 1196.  Direct the Department of Public Works to mail the notice of assessment and ballot to all landowners within the proposed zone as per Government

Code § 53753.  Direct the Department of Public Works to post the petition, notice of formation and notice of assessment as per Streets and Highway Code

§1195.

Various County Departments--Hiring Freeze Exemptions

17.               Exemptions from the Hiring Freeze for:  Community Development Services (CDS), District Attorney (DA), Library, and Sheriff   (General Fund/Library Fund)

RECOMMENDATION: Approve an exemption for an Office Assistant I/II in CDS; a Deputy DA II, a Deputy DA IV; a Senior Library Assistant (Garberville Branch); and a Correctional Work Crew Leader.

Public Works

1.                   Tooby Park Lease Amendment and Termination   (General Fund-Parks)

RECOMMENDATION: Approve amendment terminating the lease with Southern Humboldt Community Park over Tooby Park in the Garberville area.

County Administrative Office

2.                   Standing Item--Update on Proposed State Budget

RECOMMENDATION: Receive update, and take appropriate action (if required).

G.                 MATTERS INITIATED BY BOARD MEMBERS

3.                   Nomination for the Klamath Fishery Management Council for the California Ocean Sport Fishery Representative (Supervisor Geist)

RECOMMENDATION: Submit nomination of Jimmy Smith to fill the open position on Klamath Fishery Management Council as the California Ocean Sport Fishery Representative, and authorize Chair to sign letter to Governor Schwarzenegger's Appointment Secretary recommending his appointment.

4.                   Standing Item--Adjourn as County Board of Supervisors, and Reconvene as Humboldt County Public Authority.  Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator.  It is the intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority.

Community Development Services

1.                   Randall Sand and Gravel Conditional Use Permit; APN 222-091-02 et al. (Garberville area); Case Nos. CUP-02-41/SMP-02-04/RP-02-04

RECOMMENDATION: Adopt the proposed Negative Declaration as required by Section 15074(b) of the CEQA Guidelines.  Deny the appeal, and approve the Conditional Use Permit, Surface Mining Permit, Reclamation Plan and Financial Assurance Cost Estimate subject to the recommended conditions of approval.

J.                   ADJOURNMENT
