RECOMMENDATION: Adopt the Proclamation.

2.                   Resolution Recognizing the 35th Anniversary of the Eureka High School Navy Junior Reserve Officers Training Corps (NJROTC) (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

Board of Supervisors

1.                   Continuation of Emergency - Closure of Martin's Ferry Bridge. (Supervisor Geist)

RECOMMENDATION: Declare that a local state of emergency, per Resolution # 07-08, remains in effect until February 5, 2008.

2.                   Letter of Support for the City of Trinidad's New Library Project. (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign letter of support.

Clerk of the Board

3.                   Humboldt County Fair Association 2008 Operating Budget

RECOMMENDATION: That the Board of Supervisors approve the request, and direct the Chair of the Board and the County Clerk to sign the operating budget.

Community Development Services

4.                   Classification Review and Reallocation for the Administrative Services Officer Position

RECOMMENDATION: That the Board of Supervisors approve the reallocation of the vacant, full-time Administrative Services Officer position in Budget Unit 277 (salary range 383, class 0776, position #001) to the class of Business Manager (salary range 402, class 0608) effective immediately.

County Administrative Office

5.                   Lease Space for Surplus Equipment Storage

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson of the Board of Supervisors to execute the lease agreement with Jack Retzloff for 714 4th Street, Eureka, CA.  ($2000.00)

District Attorney

6.                   Donation of District Attorney Department Vehicle to the County Motor Pool for Capitalization, Maintenance, and Insurance.

RECOMMENDATION: That the Board of Supervisors approve the donation of one (1) District Attorney's Investigative Unit 2008 vehicle to the County Motor Pool for capitalization, maintenance, and insurance.

Health and Human Services - Administration

7.                   Extension of Extra Help Hours Past the 960 Hour Limit

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Angela Dematos, Fiscal Assistant II, to 1984 hours through June 30, 2008, per Section 7 of the Humboldt County Salary Resolution.


Health and Human Services - Mental Health Branch

8.                   Lease Agreement for Children, Youth and Family Services (CYFS) Program

RECOMMENDATION: That the Board of Supervisors approve and sign the Fourth Amendment to the lease for 1711 Third Street with Rosemarie Dinsmore.

9.                   Approve the Supplemental Budget for Mental Health Branch Budget Unit 1180-429, Substance Abuse Crime Prevention  Act (SACPA) Prop 36

RECOMMENDATION: That the Board of Supervisors accept the funds from the Substance Abuse Offender Treatment Program (OTP) allocation to Humboldt County Department of Health and Human Services, Mental Health Branch approved by the State Department of Alcohol and Drug Programs in the amount of $68,920; adopt the supplemental budget for fiscal year 2008-08, SACPA Prop 36 budget unit 1180-429; Establish trust fund number 3456 for these OTP funds, for the purpose of holding in trust funds to be carried over in subsequent years for the implementation of Substance Abuse Offender Treatment Program.

Health and Human Services - Public Health Branch

10.               Approval of Child Health and Disability Prevention and California Children's Services Program Plan for Fiscal Year 2007-2008

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair of the Board to sign the Certification Statements for Child Health and Disability Prevention (CHDP) and California Children's Services (CCS) Program Plan for Fiscal Year 2007-2008.

Library Services

11.               Recognition of Donations Made to the Library and Supplemental Budget in Budget Unit 1500-621, Library (Library Fund - Restricted Donations)  ($1425.00)

RECOMMENDATION: That the Board of Supervisors adopt a supplemental budget of $1425.00.

Probation

12.               Supplemental Budget of Substance Abuse Treatment

RECOMMENDATION: That the Board of Supervisors adopt the supplemental budget for budget unit 1100-258 (Substance Abuse Treatment) ($48,518)

Public Works

13.               Hiller and Pickett Road Rehabilitation and Overlay (C3L080 & 4M030) at PM 0.60 to 1.46 to 1.46 and 0.00 to 0.40: Project No. RPL-5904(065), Contract NO. 202707

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the amount of $25,590.14.

14.               Construction of Warren Creek Culvert Replacement on Warren Creek Road at PM 0.13, County Project Number 205302

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for $16,601.01 and Change Order number 2 for $32,360.00; Accept the completed contract, including all change orders approved by the Public Works Department, between Miller Farms Nursery, Inc., Contractor, and Humboldt County for the Culvert replacement on Warren Creek; Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $5,071.38. This will bring the total amount paid to 100% of the contract.


15.               Central Avenue Rehabilitation and Overlay between Pickett Rd to Babler and Airport Rd to Grange: Project No. RPL-5904(075), Contract No. 202713

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the amount of $14,375.

Treasurer-Tax Collector

16.               Statement of Annual Financial Information

RECOMMENDATION: That the Board of Supervisors receives and files the form of the Statement of Annual Financial Information and Operating Data of the County of Humboldt, California, "Annual Report" presented at this meeting.  A final report will be filed with the Clerk of the Board upon completion.  Filing of the report with the Federal authority will be made on or before January 31, 2008.

E.                  DEPARTMENT REPORTS

IHSS Public Authority

1.                   Recommendation to remove Minerva Williams from and appoint Charles Bean, Samantha Prosser, and Emma McDowell to the Humboldt County In-Home Supportive Services Advisory Board

RECOMMENDATION: That the Board of Supervisors:  1. Adjourn as Humboldt County Board of Supervisors;  2.  Convene as the Governing Board of the Humboldt County In-Home supportive Services Public Authority and consider the following agenda:  a.  Removal of Minerva Williams from the Humboldt County IHSS Advisory Board, based on recommendation of the Advisory Board;  b.  Appoint Charles Bean and Samantha Prosser as consumer representatives to the Humboldt IHSS Advisory Board;  c.  Appoint Emma McDowell as an alternate provider representative to the Humboldt County IHSS Advisory Board; d.  Public Comment;  e.  Adjourn;  3. Reconvene as the Humboldt County Board of Supervisors.

1.                   Presentation by Joe Mark, CEO of St. Joseph Health System, Humboldt County, on the Status of Construction and Seismic Retrofit Work. (Supervisor Smith)

RECOMMENDATION: Hear presentation and take appropriate action, if required.

10:00 - BOARD OF SUPERVISORS

2.                   Klamath Settlement Agreement Presentation. (Supervisor Geist)

RECOMMENDATION: Hear the presentation and continue the meeting to either February 5th or 19th, 2008.  Keep public comment open and accept the Klamath Restoration Agreement.  Direct the County Counsel's Office, with assistance from the Public Works Natural Resources Division, to review agreement and make appropriate recommendation to the Board.

Code Enforcement Unit

1.                   Cost Recovery Assessment Hearing, County v. Dale Giulieri A.P.N. 106-021-056

RECOMMENDATION: That the Board of Supervisors confirm the Findings and Orders Confirming Account and Assessment in the sum of eleven thousand nine hundred seventy dollars and eighty five cents ($11,977.85) and authorize the Chair of the Board to sign the Findings and Order confirming the Account and Assessment.

K.                  PUBLIC HEARINGS

Community Development Services

1.                   Appeal of Planning Commission Approval of the Reardon Parcel Map Subdivision/Coastal Development Permit Application File Number APN 305-021-08 et al; Case No. PMS-06-23A (Elk River)

RECOMMENDATION: That the Board of Supervisors open the public hearing in a manner prescribed by law and receive the staff report and public testimony; based on the findings in the staff report and testimony received about the project, deny the appeal and approve the Reardon Parcel Map Subdivision /Coastal Development Permit application.
