Agricultural Commissioner

1.                   Approval of USDA-Wildlife Services Agreement No. 09-73-06-0254-RA

RECOMMENDATION: That the Board of Supervisors grant a waiver of the Nuclear Free Ordinance; Approve Standard Agreement No. 09-73-06-0254-RA; and Authorize the Chair to sign all three (3) copies of the agreement, returning all three signed copies to the Agriculture Department for further processing.

2.                   Approval of Standard Agreement No. 08-C0011, Pesticide Use Reporting Contract in the amount of $2016.00

RECOMMENDATION: That the Board of Supervisors grant a waiver from the provisions of the Nuclear Free Ordinance; Approve Standard Agreement No. 08-C0011, known as Pesticide Use Reporting; Authorize the Chair to sign the original and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department of further processing.

3.                   Approval of Standard Agreement No. 08-0229, California Organic Program in the Amount of $11,355.00

RECOMMENDATION: That the Board of Supervisors grant a waiver from the provisions of the Nuclear Free Ordinance; Approve Standard Agreement Number 08-0229, known as the California Organic Program, and Authorize the Chair to sign the original and one copy of the cover page as well as the Contractor Certification form, and return all copies to the Agricultural Department for further processing; and Authorize the Auditor-Controller to execute the attached supplemental budget for 2008-09.

RECOMMENDATION: The Board wishes to recognize Lynda Roush, BLM Field Manager, for her hard work and many years of service and commitment to effective stewardship of public lands and congratulates her on receiving the "Take Pride in America National Award," a national award for leadership and for promoting volunteerism on public lands.

16.               Appoint Devin Theobald to the Humboldt County Fish and Game Advisory Commission (Supervisor Geist)

RECOMMENDATION: Approve the appointment.

17.               Proclaim September 17-23, 2008 as Constitution Week (Supervisor Neely)

18.               Letter of Support for Stanford University Center for Ocean Solutions and Monterey Bay Aquarium Research Center's Grant Application to fund the Climate change Adaptation Decision Tool for Coastal California (Supervisors Neely and Woolley)

RECOMMENDATION: Authorize Chair to sign Letter of Support.

Community Development Services

19.               Supplemental Budget for Fund 1120, Budget Unit 287, Workforce Investment, Fiscal Year 2007-2008

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Fund 1120, Budget 287, Workforce Investment; and direct the Auditor-Controller to incorporate the supplemental budget as follows:Revenue - 1120-287-591106 - $60,000 - WIA Dislocated Worker #2 Funds; 1120-287-591126 $370,000 -Veterans / Displaced Worker:Expense: 1120-287-3598 $60,000 - WIA Dislocated Worker #2 Funds; and 1120-287-3636 - $370,000 - Veterans / Displaced Worker.


20.               HR 2389 - Recreational and Conservation Easement Support Program - Friends of the Dunes funding request (Humboldt Coastal Nature Center Recreational Access Easement Support Funding)

RECOMMENDATION: That the Board of Supervisors receive the staff report; Approve funding request of $5,580 from the Friends of the Dunes to support planning acquisition and baseline monitoring costs for 52 acres of coastal habitat in conjunction with the Stamps Public Access and Conservation Easement Project (currently titled Humboldt Coastal Nature Center).

County Administrative Office

21.               Ratify Ordinance No. 21 of the Humboldt No. 1 Fire Protection District adopting the 2007 California Fire Code

RECOMMENDATION: That the Board of Supervisors Ratify Ordinance No. 21 of the Humboldt No. 1 Fire Protection District adopting the 2007 California Fire Code and Standards Prescribing Regulations; Transmit its determination to the District within 15 days of this determination and Direct staff to file a copy of the findings of the District, and any Findings of the County, together with the adopted ordinance, with the Department of Housing and Community Development.

RECOMMENDATION: That the Board of Supervisors approve the appropriation transfers to close out various budgets for Fiscal Year (FY 2007-08, including transfer from contingency.

23.               Supplemental Budget for Communications (FY 2007-08)

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in the Communications Internal Service Fund for Fiscal Year (FY) 2007-08, as follows:Revenue 3521-151 707140 - Transfer from Communications Trust $50,000; Expenditure - 3521-1512112 - Equipment Maintenance $50,000.

District Attorney

24.               Supplemental Budget in 1100 205, District Attorney's Budget and 1100 211, Child Abuse Services Team for Fiscal Year 2007-08

RECOMMENDATION: That the Board of Supervisors approve the supplemental budgets for Fiscal Year 2007-2008 totaling $178,896.

Health and Human Services - Mental Health Branch

25.               Approval of a Memorandum of Understanding with Redwood Coast Regional Center to provide Mental Health Services to Clients with Developmental Disabilities.

RECOMMENDATION: That the Board of Supervisors review and approve the agreement between Humboldt County and Redwood Coast Regional Center; and Authorize the Mental Health Branch Director of the Department of Health and Human Services to sign the attached agreement.

26.               Donation of Mental Health Branch Vehicle to the County Motor Pool for Capitalization, Maintenance, and Insurance.

RECOMMENDATION: That the Board of Supervisors approve the donation of one Mental Health Services Act, Rural Outreach Services Enterprise (ROSE) program 2008 Universal Specialty Vehicle to the County Motor Pool for capitalization, maintenance, and insurance.


27.               Adoption of the Resolution Approving Humboldt County's FY 2008-2009 Plan for Substance Abuse and Crime Prevention Act of 2000 (SACPA) Program and approval of Application for Offender Treatment Program (OTP) Funds.

RECOMMENDATION: That the Board of Supervisors approve Humboldt County's FY 2008-2009 Plan for the Substance Abuse and Crime Prevention Act of 2000 (SACPA) Program as attached; Approve related Humboldt County's FY 2008-2009 Offender Treatment Program application for SACPA clients; Adopt Resolution No. indicating approval of the plan and Offender Treatment Program application, agreeing to comply with all provisions of ACT, and assuring maintenance of a trust fund for funds received pursuant to the Act; Direct the Clerk of the Board to send a certified copy of the resolution to Mental Health Branch/ AID-SACPA Program upon Board approval.

28.               Increase in Compensation for Physician/Psychiatrists and Medical Director to Reflect Salary Increases for Humboldt County Employees.

RECOMMENDATION: It is recommended that the Board of Supervisors authorize the Director of Health and Human Services to sign employment agreement amendments for salary increases as follows: 1. All Physician/Psychiatrists (class 037) from salary range 650 to salary range 662 effective June 29, 2008, to range 670 effective June 28, 2009 and to range 676 effective June 27, 2010; 2. Medical Director (class 0902) from salary range 681 to salary range 693 effective June 29, 2008, to range 707 effective June 27, 2010.

Health and Human Services - Public Health Branch

29.               Continuation of Local State of Emergency - Smoke and Fires.

RECOMMENDATION: That the Board of Supervisors consider the need for continuing the local emergency declared by the Board of Supervisors on July 22, 2008 in response to the conditions of extreme peril to the safety of persons and property caused by the smoke and fires ignited by lightning on or about June 20, 2008; and adopt Resolution No. ___ extending the declaration of the existence of a local emergency for an additional fourteen (14) days.

Library Services

30.               Amendment to Grant Agreement with First 5 Humboldt.

RECOMMENDATION: That the Board of Supervisors approve the Amendment to Grant Agreement with First 5 Humboldt; Authorize the Chairperson to sign three copies of the Amendment; Direct the Clerk of the Board to return the three signed copies of the Amendment to the Library.

Personnel

31.               Test Use Agreement for Board of Corrections Examinations

RECOMMENDATION: That the Board of Supervisors authorize the Personnel Director to execute the attached Test Use Agreement for Board of Corrections Examinations with Cooperative Personnel Services.

Probation

32.               Supplemental Budget for Fund 1100, Budget Unit 234, Juvenile Hall, Fiscal Year 2007-08.

RECOMMENDATION: That the Board of Supervisors approve the following supplemental budget for Fiscal Year 2007-2008 in Fund 1100, Budget Unit 234, Juvenile Hall:Revenue - 1100-234-525409 - Healthy Returns Initiative - California Endowment Grant Funds - $8,386: Expenditure - 1100 234-2108 Food - $5,713 - 1100-234-2110 Insurance - $2,673.


Public Works

33.               Wallan & Johnson Final Map Subdivision, APV 223-135-03, Garberville

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete and accept and approve the subdivision map for filing with the County Recorder; Accept the dedication to the County of Humboldt of Parcel MM for public road purposes as offered for dedication on a previous subdivision phase and as shown on the subdivision map; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; Direct the Clerk of the Board to transmit the subdivision map and the Conveyance and Agreement to the County Recorder.

34.               Aviation Surplus Vehicles

RECOMMENDATION: Declare the following six vehicles/equipment surplus: Equipment # 10653, 1995 Chevy S10, License #E012486; Equipment # 10650, 1947 Oshkosh Fire Truck # E701002; Equipment # 10662, 1970 Chevy Flatbed; Equipment #10660, 1962 Ford Tractor; Equipment # 10661, 1970 Baker Forklift; Equipment # 10648, Mobile Air Traffic Control Tower; Authorize the Purchasing Agent to dispose of the surplus vehicles; Deposit the revenue from the sales in the Aviation Division fund.

35.               Storm Damage Repairs on Briceland Thorne Road (5A010) at P.M. 4.0: Project No. HC-19, Contract No. 206210.

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the total amount of $11,287.00.

36.               Supplemental Budget for Fields Landing Boat Ramp and River Parkways Grant Projects.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2008/09; Revenue: 1100713-661037 - River Parkways Grant - $264,652; 1100713-661038 - Wildlife Conservation Board - $564,906: Expenditure: 1100713-8186 - River Parkways Improvements $264,652; 1100713-8826 - Fields Landing Public Access - $564,906.

37.               Assignment of Wade Rocha, Bridge Maintenance Worker as Bridge Crew Supervisor.

RECOMMENDATION: That the Board of Supervisors authorize the continued compensation of Wade Rocha as if he had been promoted to the classification of Bridge Crew Supervisor retroactive from August 24, 2008 through October 4, 2004, or until such time as a new Bridge Crew Supervisor is appointed, pursuant to Section 7 of the Humboldt County Salary Resolution.

38.               Construction of Indianola Cutoff Rehabilitation and Overlay Between Eureka City Limit and Myrtle Ave:Project No. RPL 5904(062), Contract No. 202711.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Indianola Cutoff Rehabilitation and Overlay; award the contract to Mercer Fraser Company in the amount of $196,002.00.Authorize the Chair to execute the project agreement upon submittal of the appropriate bonds and insurance; direct the Auditor-Controller to establish a new contract account 1200321-0231 and transfer $299,130.00 to the account per the appropriation transfer.

39.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 19.95: Project No.: 4400 (041), Contract No. 206353.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 19.95; Award the contract to G.R. Wilcox Enterprises, Inc. for the total amount of $100,402.22; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; Direct the Auditor-Controller to establish a new contract account 1200321-0230 and transfer $110,442.00to the account per the attached appropriation transfer.

40.               Construction of Storm Damage Repairs on Trinidad Scenic Dive (4M310) at PM 1.14: Project No.: FEMA Ca. Dr. 1628 HC 13; Contract No. 206287.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Trinidad Scenic Drive; Award the contract to Van Meter Logging, Inc. for the base bid, plus additive option "b" for the total amount of $310,620; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; Direct the Auditor-Controller to establish a new contract account 1200321-0229 and transfer $326,151 to the account per the attached appropriation transfer.

41.               Construction of Storm Damage Repairs on Mattole Road (F3C010) P> 7.55: Project No.: ER 4400(015), Contract No. 206256.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of storm Damage Repairs on Mattole Rd. at PM 7.255; Award the contract to Raymond M. Etter in the amount of $75,962.20; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; Direct the Auditor-Controller to establish a new contract account 1200321-0232 and transfer $83,558 to the account per the attached appropriation transfer.

42.               Supplemental Budget for 07/08 Motor Pool

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2007/2008: Revenie - 3500350 0238 - Charges for Services - $24,000; Expenditure 3500350 2312 - Fuel $24,000.

43.               Approve Advanced Step for Deputy Sherriff II Joseph Marsh per Section 7 of the Humboldt County Salary Resolution.

RECOMMENDATION: That the Board of Supervisors approve advance step at range 368, Step C for Deputy Sheriff II Joseph Marsh (position 1100 221 0416 70) per Section 7 of the Humboldt County Salary Resolution, effective August 24, 2008.

44.               Approve Supplemental Budget for Drug Enforcement Unit (Budget Unit 1100228) in the Amount of $27,175 for Fiscal 2007/2008.

RECOMMENDATION: That the Board of Supervisors authorizes a supplemental budget in the amount of $27,175 in Budget Unit 1100228 for fiscal year 2007/2008.

Community Development Services

1.                   Report on June 16, 2008 Affordable Housing Workshop.

RECOMMENDATION: Receive the staff report; Proved direction to CDS staff on specific action items.

2.                   Receive and Accept the Revised Annual Report on the Status and Implementation of the 1984 Framework Plan (General Plan) for 2007.

RECOMMENDATION: Receive and accept the staff report and the revised Annual Report on the Status and Implementation of the 1984 Framework Plan (General Plan) for 2007 (Attachment A and Attachment B.Direct CDS staff to submit the revised Annual Report on the Status of the 1984 Framework Plan (General Plan) for 2007 to the State Office of Planning and Research (OPR) and the State Department of Housing and Community Development (HCD).


3.                   Authorize Submission of Grant Proposal to the Western Wildland Urban Interface Grant Program to Fund the Firesafe Homes and Forests Cost-Share Program.

RECOMMENDATION: That the Board of Supervisors receive staff report; Authorize the submittal of an application to the Western Wildland Urban Interface Grant Program; Authorize, if the program is selected for funding, the Community Development Service Director, in the name of the applicant, to execute a standard agreement, required documents necessary to participate in the grant program and subgrantee agreements with local Fire Safe Councils and Fire Departments to carry out the activities of this grant, after review and approval by County Counsel and Risk Management; Approve the allocation of $45,000 of Title III, Secure Rural Schools and Community Self Determination Act funds into the Local Fire Safe Council Fire Planning and Education project to be used as a grant match.

4.                   Adoption of Ordinance Amending Sections 521-6 and 521-8 of the Humbodlt County Code Relating to Solid Wast Franchises

RECOMMENDATION: That the Board of Supervisors, pursuant to Humbodlt county Code sections 351-21 and 351-22 hold an administrative hearing to determine whether a public nuisance exists on the subject property and adopt Findings and issue an Order consistent with the evidence presented.

2.                   Administrative Abatement Hearing - Michael Duclo and Carolyn Morgan, 360 Boy Scout Camp Road, Myers Flat, CAAP#081-051-027.

RECOMMENDATION: That the Board of Supervisors pursuant to Humboldt County Code sections 351-21 and 351-22, hold an administrative hearing to determine whether a public nuisance exists on the subject property and adopt findings and issue an Order consistent with the evidence presented at the hearing.

Community Development Services

1.                   Kramer General Plan Amendment Petition, File No. APN 017-032-03 et al., Case No. GPP-07-02, Cutten Area.

RECOMMENDATION: That the Board of Supervisors open the public hearing continued from May 13, 2008 and receive this staff report and public comment and accept the Petition by approving the attached resolution based on the findings in the May 13, 2008 staff report, supplemental information and testimony received about the project (Attachment 1, Attachment 2, and Attachment 3).

2.                   Adopt Ordinance Establishing Procedures and Requirements for Consideration of Development Agreements (Development Agreement Enabling Ordinance).

RECOMMENDATION: That the Board of Supervisors introduce the ordinance Establishing procedures and Requirements for Consideration of Development Agreements (development Agreement Enabling Ordinance) by title and waive reading; Open the public hearing, receive and consider the staff report and proposed determination of non-project status under CEQA, and accept public comment; Close the public hearing; Adopt the resolution certifying compliance with CEQA; Adopt Ordinance No. ____ Establishing Procedures and Requirements for Consideration of Development Agreements by adding Title II, Division 17, Chapter 1, Section 2171-1 through 2171 - 18 to the Humboldt County Code; Direct the Clerk of the Board to give notice of the decision to the applicant and any other interested party and to publish summaries of the ordinance 5 days prior to and within fifteen days after adoption by the Board; Direct the Clerk of the Board to return signed copies of the resolutions and adopted ordinance to Community Development Services - Planning Division; Direct Planning Division Staff to file a Determination of Non-Project Status within 15 days of the Board's adoption of the Ordinance.

RECOMMENDATION: That the Board of Supervisors open the public hearing in the manner prescribed by law, and receive the staff report and public testimony; Introduce Ordinance No. ____ by title and waive further reading; adopt the Negative Declaration and necessary findings prepared by Planning Division Staff; Approve the General Plan Amendment, Zone Reclassifications, Parcel Map Subdivision and Lot Line Adjustment subject to the recommended conditions of approval; Approve Resolution No. ___ adopt the Planning Commission's findings and approve the amendment of the Humboldt County General Plan (Eureka Community Plan (ECP)) land use map, by amending property in the Ridgewood Heights area (GPA-06-04, Jennings) from Agricultural Rural, one unit per five acre density (AR-5) to Residential Low Density (RL).

Any written materials related to an item on this agenda submitted to the Board of Supervisors less than 72 hours prior to the Board meeting, and that are public records subject to the Public Records Act, are available for public inspection in the Office of the Clerk of the Board at 825 5th Street, Suite 111, Eureka (476-2384), during normal business hours.

Persons wishing to file documentation on any agenda item for the official record must submit an original and nine (9) copies of each document to the Clerk of the Board of Supervisors, Room 111 of the County Courthouse, 825 5th Street in Eureka (476-2384). Documentation includes, but is not limited to, written correspondence, audio and video tapes, maps, photographs, and petitions. Failure to submit the required number of copies will result in the document/s not being placed in the official record. (Per Board of Supervisors' policy adopted on March 21, 1995.)
