1.                   Advanced Step Placement (CONSENT - CHILD SUPPORT SERVICES)

RECOMMENDATION: That the board of Supervisors approve an accelerated step increase for Penny Ledoux, currently a Child Support Assistant I, step A, ($900.77 bi weekly) in budget unit 206 to Child Support Assistant I, step C, ($995.25 biweekly) pursuant to Section 7 of the Humboldt County Salary Resolution.

2.                   Board Orders from August 26, 2008 (CONSENT - CLERK OF THE BOARD)

RECOMMENDATION: Approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Code Section 25103.


3.                   Adoption of Ordinance Amending Section 311-7 of the Humboldt County Code by Reclassifying property in the Ridgewood Heights area (ZR-06-17, Jennings) from Agriculture General with a Special Building Site Combining Zone Specifying a Five Acre Minimum Parcel Size (AG-B-5(5)) to Residential One Family with a Special Building Site Combining Zone Specifying a 20,000 Square Foot Minimum Parcel Size and a Combining Zone for Greenway and Open Space (R-1-B-3/GO).  (CONSENT - COMMUNITY DEVELOPMENT SERVICES)

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ___, amending Section 311-7 of the Humboldt County Code.

Board of Supervisors

1.                   Appointment of Robert Johnson to the Fortuna Fire Protection District Board. (Supervisor Rodoni)

RECOMMENDATION: Appoint Robert Johnson to the Fortuna Fire Protection District Board

2.                   Letters of Appreciation to Mary Papsco and Ted Ostrow for Serving on the Humboldt County Alcohol and Drug Advisory Board. (Supervisor Geist)

RECOMMENDATION: Authorize Chair to Sign Letters of Appreciation.

3.                   Appoint Julie Oakes to the Humboldt County Housing Authority Commission. (Supervisor Rodoni)

RECOMMENDATION: Approve the Appointment.

4.                   Appoint Mace De Lorme and Dale Ward to the Alcohol and Drug Advisory Board (Supervisor Neely)

RECOMMENDATION: Approve the appointment of Mace De Lorme and Dale Ward to the Alcohol and Drug Advisory Board.

Community Development Services

5.                   Release from Conveyance and Agreement to Allow Construction of Secondary Dwelling Unit on Lot 9 (Currently APN 511-084-28) of the Dan Morgan Final Map Subdivision; File No.: APN 511-081-69; Case No.: FMS-02-03, McKinlyeville Area

RECOMMENDATION: That the Board of Supervisors consider the application; Authorize the Chair of the Board to execute the Quitclaim and Partial Reconveyance (for Development Restrictions) for Lot 9 of the Dan Morgan Final Map Subdivision (Attachment A; Attachment B); Direct the Community Development Services - Planning Division to record copies of the Quitclaim and Partial Reconveyance (for Development Restrictions); and Direct the Clerk of the Board to give notice of the decision to the applicant and any other interested party and to return original copies to the Planning Division.


County Administrative Office

6.                   Set Public Hearing for Adoption of Fee Updates.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to schedule a public hearing on Tuesday, September 16, 2008, at 1:30 p.m., for consideration of adoption of an Ordinance updating the Humboldt County Schedule of Fees and Charges; Direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing; two publications are required, with at least five (5) days intervening between the dates of the first and last publication, not counting such publication dates; Direct the Clerk of the Board to have the data and documentation supporting the new fees for public review at least 10 days prior to the public hearing; and Direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted [Government Code Section 25124(b)(1).

Health and Human Services - Public Health Branch

7.                   Establish a New Fixed Asset Line Item Building Modification, in budget unit #455

RECOMMENDATION: That the Board of Supervisors Establish a New Fixed Asset Line Item Building Modification, in budget unit #455 (Emergency Preparedness and Response) in fund 1175 for fiscal year 2008-09; Direct the Auditor-Controller to adjust budget unit #455 in fund 1175 as follows; 2-345 Lab Annex/Modular ($20,000); 8-998 Building Modification $20,000.

8.                   Temporary Salary Increase in Accordance with Section 7 of the Humboldt County Salary Resolution

RECOMMENDATION: It is recommended that the Board of Supervisors authorize temporary increase in pay for Valerie Lovelace, Health Program Coordinator (Class 0540, Range 336) as though she had been promoted to Senior Health Program Coordinator (class 0538, Range 352) beginning July 28, 2008 and continuing for a period of six months or until such time as the position is reclassified or filled, Pursuant to Section 7 of the Humboldt County Salary Resolution.

Health and Human Services - Social Services Branch

9.                   Temporary Salary Increase in Accordance with Section 7 of the Humboldt County Salary Resolution

RECOMMENDATION: It is recommended that the Board of Supervisors authorize temporary increase in pay for Social Worker III Gloria Englert, (Class 0727C, Range 364) as though she had been promoted to Social Worker Supervisor I (Class 1708, Range 417) beginning June 30, 2008 and until the position is filled, not to exceed six months pursuant to Section 7 of the Humboldt County Salary Resolution.

10.               Agreement with McKinleyville Community Collaborative for the Child Abuse Prevention, Intervention, and Treatment Program (CAPIT)

RECOMMENDATION: That the Board of Supervisors award the Child Abuse Prevention, Intervention, and Treatment Program (CAPIT) Agreement to McKinleyville Community Collaborative for fiscal years 2008/2009, 2009/2010, and 2010/2011; Approve the Agreement with McKinleyville Community Collaborative for $75,000 annually for each of the next three fiscal years; Authorize the Chairperson to execute three copies of the Agreement; And Direct the Clerk of the Board to route two copies of the executed Agreement to the Director of the Social Services Branch.


Public Works

11.               Authorize the Purchase of a 3/4 Ton Crew Cab Pickup Truck and Bed Canopy for the Land Use Division

RECOMMENDATION: That the Board of Supervisors authorize the purchase of a 3/4 ton crew pickup truck and bed canopy by the Motor Pool to be assigned to the second Survey Crew; Adopt the following Supplemental Budget:  Revenue: 3500351-682050 Fund Balance Forward $23,500; Expenditure: 3500351-8000 Fixed Asset $23,500.

1.                   Report by the Health Officer on the Health Impact Assessment of the General Plan Update Plan Alternatives

RECOMMENDATION: That the Board of Supervisors hear a report on the Health Impact Assessment of the General Plan Update Plan Alternatives; support analysis of the health impact of development, with consideration of mitigations when appropriate, to offset possible negative health impacts; and Direct the Public Health Branch to continue working with the Community Development Department to implement procedures in support of that effort.

H.                  CLOSED SESSION

1.                   Conference with Legal Counsel-Existing Litigation Pursuant to Government Code section 54956.9(a), Hans K. Ashbaucher et al v. City of Arcata, County of Humboldt et al;  United States District Court, Northern District of California, San Francisco Division; Case No. EMC CV 08 2840.

K.                  PUBLIC HEARINGS

Community Development Services

1.                   RACE INVESTMENTS LLC Zone Reclassification; File Nos.: APN 017-191-03 et al; Case No.: ZR-07-01 Eureka Area

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ___ by title and waive further reading; Open the public hearing, receive and consider the staff report, the Planning Commission's findings and accept public comment; Close the public hearing; Adopt Resolution No. ___ finding the Local Coastal Program (LCOP) Amendment and Zone Reclassification (ZR) are exempt from provisions of the California Environmental quality Act (CEQA), make the required findings for approval of the rezone request, and transmit the LCP amendment to the California Coastal Commission; Approve the rezone and adopt Ordinance No. ___ amending Section 311-7 of the Humboldt County Code by reclassifying approximately 45 acres in the Eureka area [ZR-07-01, Race Riparian Corridor Protection combing zones (TC/F,R) into Timberland Production Zone with said combining zones (TPZ/F,R) and approximately 106 acres from Agriculture Exclusive (AE) into Timberland Production Zone (TPZ), to become effective upon California Coastal certification of the proposed Local Coastal Program Amendment; Transmit the LCP Amendment and ZR to the California Coastal Commission for Certification in accordance with the Coastal Act; and Direct the Community Development Services - Planning Division to prepare and file a Notice of Exemption with the County Clerk and Office of Planning and Research pursuant to CEQA; Direct the Chair of the Board to sign and the Clerk of the Board to record a Certification of Rezoning (Notice of Timberland Production Zone Status) on the parcel pursuant to Sections 51117 and 51141 of the California Government Code, after attaching a copy of the fully executed Ordinance and Map; Direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assesor's office and any other interested party, and to publish the Summary of Ordinance at least five (5) days before the date for adoption and again fifteen (15) days after passage of the Ordinance.
