1.                   Adoption of Ordinance Amending Section 311-7 of the Humboldt County Code by Reclassifying Approximately 45 Acres in the Eureka Area from Coastal Commercial Timberland with Flood Hazard Areas and Streams and Riparian Corridor Protection Combining Zones into Timberland Production Zone with Said Combining Zones and Approximately 106 Acres from Agriculture Exclusive into Timberland Production Zone, to Become Effective upon California Coastal Commission Certification of the Proposed Local Coastal Program Amendment (CONSENT - CONSENT).

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. _______, amending Section 311-7 of the Humboldt County Code, pursuant to the attached Board order.

2.                   Mad River Streambank Protection Project - Director's Action Report.

RECOMMENDATION: That the Board of Supervisors Receive this Public Works update on actions taken by the Director of Public Works under Resolution No. 08-68 adopted by the Board of Supervisors on August 5, 2008 and in accordance with Section 22050 of the Public Contract Code.


1.                   Resolution of Recognition to Lost Coast 4x4's for their 9th Annual River Bar Clean-up Event (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

2.                   Resolution Recognizing the 150th Anniversary of the City of Arcata. (Supervisor Woolley)

RECOMMENDATION: Adopt the Resolution.

3.                   Proclaim the Week of September 7 - 13th, 2008 as Suicide Prevention Week. (Supervisor Woolley)

RECOMMENDATION: Adopt the Proclamation.

1.                   Continuation of Emergency - Closure of Martin's Ferry Bridge. (Supervisor Geist)

RECOMMENDATION: Declare that a local state of emergency, Per Resolution #07-08, remains in effect until September 23, 2008.

2.                   Letters of Support for CalTrans Richardson's Grove and Highway 197/199 Projects. (Supervisor Rodoni)

3.                   Reallocation of Position in Communications Division

RECOMMENDATION: Approve the reallocation of the Fiscal Assistant I/II position in budget unit 151 currently occupied by Vanessa Ericksen to Administrative Secretary.

4.                   Supplemental Budget in Courthouse Construction Fund (FY 2007-08)

RECOMMENDATION: Approve the following supplemental budget for Fiscal Year (FY) 2007-08:Revenue 1410-190-682050 Fund Balance Forward $780; and Expenditure 1410-190-3298 COP Payments Courthouse Remodel $780.

District Attorney

5.                   Supplemental Budget in District Attorney's Budget Unit 1100 205, in the amount of $17,980 and establish a fixed Asset Account for Fiscal Year 2008-09 (Fund 3921 - Asset Forfeiture)

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget of $17,980 into Budget Unit 1100 205 and direct the Auditor-Controller to transfer $17,980 into Revenue Account 1100-705-031, District Attorney Forfeited Funds, and transfer $17,980 from Account 3921-807-921, District Attorney Trust Seized Funds; and Authorize and instruct the Auditor-Controller to increase the following line item 8989 in Budget Unit 1100 205 for Fiscal Year 2008-2009.

6.                   Continuation of Local State of Emergency - Smoke and Fires

RECOMMENDATION: Consider the need for continuing local emergency and adopt Resolution No. _____ extending declaration of the existence of a local emergency for additional fourteen (14) days.

7.                   Approval of Second Amendment to Agreement between First 5 Humboldt and the Public Health Branch, Fund 1175, Fiscal Year 2008-2009

RECOMMENDATION: Approve Second Amendment to agreement, authorize Chair to sign Amendment, and direct Clerk of the Board to return signed copies of Amendment to Public Health Branch.

8.                   Approval of Resolution Providing for an Administrative Review Process for Civil Orders of Work Exclusion for Tuberculosis Clients

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ___ Providing for an Administrative Review Process for Civil Orders of Work Exclusion for Tuberculosis issued by the Humboldt County Health Officer.

9.                   Approval of Childe Abuse Prevention Coordinating Council of Humboldt County (CAPCC) Children's Trust Fund Grants

RECOMMENDATION: That the Board of Supervisors approve the Childe Abuse prevention Coordinating Council

10.               Recognition of Donations made to the Library in Fund 1500, Budget Unit 621, County Library, and Supplemental Budget (Fiscal Year 2008-2009)

RECOMMENDATION: Accept and recognize donation to the Library in the amount of $17,657.81.Adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library for fiscal year 2008-2009.

11.               Resolution Amending Resolution No. 82-170 and Rescinding Resolution No. 08-49 in Regards to Changes in Office Hours (Revised Open Hours Schedule for Blue Lake Branch Library)

RECOMMENDATION: Adopt Resolution amending Resolution No. 82-170 and rescind Resolution No. 08-49.


12.               Renewal of Bilingual Test Use Agreement with Cooperative Personnel Services

RECOMMENDATION: Authorize Personnel Director to execute the Bilingual Test Use Agreement with Cooperative Personnel Services.

Public Works

13.               Termination of Airport License with Timothy Russell Massage Therapist

RECOMMENDATION: Approve termination of the License Agreement, authorize Public Works to send letter of termination to Timothy Russell and direct Clerk of the Board to send executed agenda item to Land Use Real Property.


14.               2009 Annual Operating Plan for Cooperative Patrol Operations Between Humboldt County Sheriff's Office and the Six Rivers National Forest

RECOMMENDATION: Authorize the Sheriff to sign FY2009 Operating and Financial Plan for Cooperative Patrol; and direct the Clerk of the Board to return all documents to Sheriff's Office for further processing.

E.                  DEPARTMENT REPORTS

Community Development Services

1.                   Approve Amended Agreement for Consultant Services for the Forster-Gill Project and Supplemental Budget for (277) for Community Development Services - Planning Division

RECOMMENDATION: That the Board of Supervisors authorize the Chairperson of the Humboldt County Board of Supervisors to execute an Amended Three Party Agreement for Preparation of an Environmental Impact Report by a Consultant under Contract to the County (amended Agreement) (Attachment 1). The parties to this Agreement are the County of Humboldt (County), Dunn-Robinson-Forster-Gill, Inc. (Applicant) and Roberts Environmental and Conservation Planning, LLC (Consultant); Authorize a trust find account (account no. 3575) be used as an escrow account for depositing payments from the Applicant for consulting services and for paying expenditures of Consultant for consulting service; Authorize an increase in Community Development Services - Planning Division's Professional Services Expense Account Number 1100-277-2-118in the amount of $88,100; Authorize the costs to be offset by an increase in Community Development Services - Planning Division's Revenue Account Number 110-277-608-061 (EIR Consultant) in the amount of $88,100; Authorize the deposit of $22,960 into Community Development Services - Planning Division's Planning Services Revenue Account Number 1100-277-608-000, by the Applicant to reimburse the County for estimated staff costs to be incurred in processing the proposed project; Authorize the Director of Community Development Services to execute for the County subsequent amendments to the Agreement as follows:

Changes in Scope of Services consistent with the overall project description

Changes in Schedule of Performanceamending interim completion dates and final completion date;

Changes in Agreement for Special Services not to exceed 30%of the amountof the original agreement;

Changes in consultants, assuming the scope remains substantially the same.†† Any Changes in terms of the Agreement, Scope of Services, Schedule of Performance, and Agreement for Special Services must be reviewed by County Counsel, and approve by Community Development Services - Planning Division, Consultant, and Applicant.The County shall not incur any additional costs as a result of subsequent amendments. (Note: amendments are contemplated).
