RECOMMENDATION: That the Board of Supervisors authorize compensation for MichaelNiekrasz as if he had been promoted to the classification of Facility Maintenance Manager, beginning October 10, 2008 through November 15, 2008 or until such time as a new Facility Maintenance Manager is appointed, pursuant to Section 7 of the Humboldt County Salary Resolution

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim October 2008 as Domestic Violence Awareness Month in Humboldt County (Supervisor Geist)

RECOMMENDATION: Adopt the Proclamation.

Auditor-Controller

1.                   Resolution Fixing the Tax Rates for Fiscal Year 2008-09

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ fixing the tax rates for the County of Humboldt, school districts and special districts within the County for the Fiscal Year 2008-09.

2.                   Continuation of Emergency - Closure of Martin's Ferry Bridge (Supervisor Geist)

RECOMMENDATION: Declare that a local state of emergency, Per Resolution #07-08, remains in effect until October 21, 2008.

3.                   Letter of Appreciation to Sue Prine for Serving on the Area One Developmental Disability Board (Supervisor Rodoni)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

4.                   Letter of Appreciation to Henry Willey for Serving on the Humboldt County Mental Health Advisory Board (Supervisor Woolley)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

5.                   Letter of Appreciation to Miriam Hall for Serving on the Humboldt County Alcohol and Drug Advisory Board (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

6.                   Appoint DonaldA. Holt to the Humboldt County Human Rights Commission. (Supervisor Neely)

RECOMMENDATION: Approve the appointment of Donald Hold to the Humboldt County Human Rights Commission.

7.                   Appoint Kaylen Escarda to the Humboldt County Housing Authority. (Supervisor Neely)

RECOMMENDATION: Approve the Appointment of Kaylen Escarda to the Humboldt County Housing Authority.

8.                   Letter to the California State Horse Racing Board Concerning the Future of Horse Racing at the Humboldt County Fair. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter to the California Horse Racing Board in Support of Humboldt County Fair Horse Racing.

9.                   Appointment of Charles Petty to fill the Vacant Seat on the Assessment Appeals Board (Supervisor Smith)

RECOMMENDATION: Appoint Charles Petty to fill the vacant seat on the Assessment Appeals Board.

Clerk of the Board

10.               Approval of the Board Orders - Meeting of July 8, 2008

RECOMMENDATION: Approve the Board orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section.


County Administrative Office

11.               Balanced Budget Policy and Reserve Policy

RECOMMENDATION: That the Board of Supervisors adopt the Balanced Budget Policy; and Reserve Policy, as the official financial policies for the County.

12.               Title Change for Class of IT Division Coordinantor

RECOMMENDATION: That the Board of Supervisors approve the title change from IT Division Coordinator (salary range 494, class 0131) to IT Division Director (salary range 494, class 0131), effective immediately.

13.               Additional Input into Facilities master Plan Recommendations

RECOMMENDATION: That the Board of Supervisors review and approve the proposed schedule for garnering additional public and department head input into the recommendations of the Facilities Master Plan.

Health and Human Services - Mental Health Branch

14.               Agreement with St. Joseph Hospital Eureka for Fiscal Years 2008-2010

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the Agreement with St. Joseph Hospital Eureka for hospital medical services for Fiscal Years 2008-2010; Direct the Clerk of the Board to return two signed copies of the Agreement to the Mental Health Branch.

15.               Adjust Salary and Step Pursuant to Section 7 of the Humboldt County Salary Resolution

RECOMMENDATION: It is recommended that the Board of Supervisors approve an advanced step placement for Wendy Brandon, R.N. (Class 0913, position #013, Range 425) step E effective October 19, 2008 pursuant to Section 7 of the Humboldt County Salary Resolution.

Health and Human Services - Public Health Branch

16.               Continuation of Local State of Emergency - Smoke and Fire

RECOMMENDATION: That the Board of Supervisors Consider the need for continuing the local emergency declared by the Board of Supervisors on July 22, 2008 in response to the conditions of extreme peril to the safety of persons and property caused by the smoke and fires ignited by lightning on or about June 20, 2008; and adopt Resolution No. _____ extending the declaration of the existence of a local emergency for an additional fourteen days.

17.               Grant Award from the California Department of Public Health for the Noarth Coast Regional Child Death Review Project for Fiscal Years 2008-09

RECOMMENDATION: That the Board of Supervisors approve the $10,000 Grant Award from the California Department of public Health, Epidemiology and prevention for Injury Control Branch for Fiscal year 2008-09; Authorize the Chair of the Board to sign two copies of the Standard Agreement #08-85526 and the Certification of Assurance of Compliance #CCC-307; Direct the Clerk of the Board to return the two signed Standard Agreement and Certification of Assurance of Compliance Form to the Public health Branch, Maternal Child Adolescent Heath Division.


18.               Acceptance of Base Award and Food, Shelter, incentives and Enablers Allotment(FSIE) for Tuberculosis Prevention and Control in Fund 1175, Budget Unit #416, Fiscal Year 2008-09.

RECOMMENDATION: That the Board of Supervisors approve acceptance of a Base Award in the amount of $3,718 for local assistance funding and FSIE in the amount of up to $5,400 for the Public Health Nursing Division, Tuberculosis Prevention and Control, from the California Department of Public Health(CDPH), for the period of July 1, 2008 through June 30, 2009; and Direct the Chair of the Board to sign three (3) copies of the Acceptance of Award and return them to the Public Health Branch for submission to CDPH.

Library Services

19.               Recognition of Donations made to the Library Fund 1500, Budget unit 621, County Library, and Supplemental Budget (Fiscal Year 2008-2009) ($39,646.19)

RECOMMENDATION: That the Board of Supervisors accept and recognize donations made to the Library materials, conducting library programs open to the public and maintaining expanded open hours at the Fortuna branch Library; Adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2008 - 2009 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 2.

Probation

20.               Classification Review for Vacant Fiscal Services Supervisor Position

RECOMMENDATION: That the Board of Supervisors reallocate the vacant full-time Fiscal Services Supervisor (salary range 344, class 1149, position number 01) position in budget unit 235 to a full-time Administrative Services officer (salary range 395,class 0776) position effective immediately.

Public Works

21.               Transportation Development Act Claim

RECOMMENDATION: That the Board of Supervisors authorize the Chairperson to sign the attached Transportation Development Act (TDA) Claim in the amount of $2,381,176 and direct the Clerk of the Board to forward the claim to the Humboldt County Association of Governments (HCAOG).

Sheriff

22.               Fiscal Year 2009 Financial and Operating Plan for Controlled Substance Operations, between the United States Forest Services, Six Rivers National Forest and the County of Humboldt, Sheriff's Office.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board and the Sheriff to sign two originals of the FY 2009, Financial and Operating Plan for Controlled Substance Operations, Agreement Number 06-LE-11051360-014; Direct the Clerk of the Board to return all documents to the Sheriff's office, Attention Linda Modell for further processing.A fully executed original of each agreement will be returned for the Board files.

23.               Letter of Authorization indicating Sheriff is Entitiled to File Claim with Bureau of Unclaimed Property

RECOMMENDATION: That the Board of Supervisors approve and sign letter of Authorization, on County letterhead, indicating Gary Philp, Sheriff, is entitled to file a claim on behalf of the County for unclaimed property.


24.               Supplemental Budget in Sheriff's homeland Security budget 1100 213 for Expenditure of Funding from the FFY2008 Governor's Office of Homeland Security Grant

RECOMMENDATION: That the Board of Supervisors approve supplemental budget in the amount of $381,335 to purchase approved expenditures under the U.S. Department of Homeland Security grant through the Governor's Office of Homeland Security.

E.                  DEPARTMENT REPORTS

Auditor - Controller

1.                   2008-2009 Appropriation Limits

RECOMMENDATION: That the Board of Supervisors adopt and approve the attached resolution and schedules setting forth the 2008-2009 appropriation limits as established by Article XIIIB of the California Constitution and direct the Clerk of the Board to deliver the executed resolution to the Auditor-Controller.

Public Works

2.                   Memorialization of the Bear Gulch Bridge near Garberville

RECOMMENDATION: That the Board of Supervisors confirm that the official name for the bridge over Bear Canyon Creek is Bear Gulch Bridge; Receive testimony from representatives of the Eel River Nation of sovereign Wailaki and the InterTribal Sinkyone Wilderness Council; Deny the nomination submitted by the InterTribal Sinkyone Wilderness Council on April 4, 2005, to memorialize the Bear Gulch Bridge by naming it Shaashkok (Grizzly bear Creek); Confirm the denial by Board action on April 5, 2005 , of the nomination submitted by September Gray to name the bear Gulch Bridge Wailaki Pass; Approve the nomination submitted by the InterTribal Sinkyone Wilderness Council to memorialize the bear gulch bridge in a manner that honors the history and culture of local Indian Tribes by placing a plaque on a boulder near the bridge containing the works for Bear Creek in the languages and dialects of the surrounding tribal groups that historically lived, traveled through and traded in the Garberville area; Authorize the Intertribal Sinkyone Wilderness Council to install a boulder near the bridge with a plaque with a list of names for Bear Creek in the language of the surrounding tribes that lived in, traded with and traveled through the area; Direct the Department of Public Works to designate the location for the boulder with the plaque.

F.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Request from the Humboldt County Fish & Game Advisory Commission to Fund Two Grants; City of Arcata - James Creek Confluence Fish Habitat Restoration and the Hoopa Valley Tribe/Wildlife Conservation Society/US Forest Service - Ecology of the Fisher, a Forest Dependent Member of the Weasel Family (Total Funding Request = $5,000) (Supervisor Smith)

RECOMMENDATION: Approve grant allocations as requested.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

2.                   Conference with Legal Counsel - Existing Lititgation Pursuant to Government Code section 54956.9(a), Mercer, Fraser Co. and O&M Industries, v. County of Humboldt, United States District Court, Northern District of California, Case No. CV 08- 4098 SI.

3.                   It is the intention of the Board of Supervisors to meet in closed session to consider the public employee performance evaluation for the position of County Administrative Officer pursuant to Government Code section 54954.5.

RECOMMENDATION: That the Board of Supervisors adjourn as the Humboldt County Board of Supervisors; Convene as the Governing Board of the Humboldt County Airport Land Use Commission and consider the following agenda: a.††††††† Consistency of the construction of residential units, as described in Attachment 1A, within the Airport Business Park Subdivision in McKinleyville with the Arcata-Eureka Airport Land Use Compatibility Plan.b. Find the proposed project is inconsistent with the Arcata-Eureka Airport Land Use Compatibility Plan. c. Direct staff to notify the Humboldt County Board of Supervisors of the Airport Land Use Commission's determination. 3. Public Appearance. 4.Adjourn as the Governing Board of the Humboldt County Airport Land Use Commission. 5.Reconvene as the Humboldt County Board of Supervisors.
