B.                  SUPPLEMENTAL ITEMS

1.                   Amendment to Agreement for Consultant Services for a Traffic Impact Study for the Forster-Gill Project, and Supplemental Budget (277) for Community Development Services' Planning Division (CONSENT)

RECOMMENDATION: That the Board of Supervisors receive staff report; Authorize and direct the Chairperson of the Humboldt County Board of Supervisors to execute the attached First Amendment to the Adopted Three- Party Agreement for Preparation of a traffic Impact Study by a Special Services Consultant under Contract to the County.  The parties to this Agreement are the County of Humboldt , Dunn-Robinson-Forster-Gill, Inc. (Applicant), and TJKM Transportation Consultants (Consultant); authorize a trust fund account (account 3575) be used as an escrow account for depositing payments from the Applicant for consulting services and for paying expenditures of Consultant for consulting service; authorize an increase in Community Development Services - Planning Division's Professional Services Expense Account Number 1100-277-2-118 in the amount of $31,625. (This represents an increase of the original contract amount from $63,800 to $95,425); Authorize the additional costs to be offset by an increase in Community Development Services - Planning Division's Revenue Account Number 110-277-608-061 (EIR Consultant in the amount of $31,625.

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim November 2008 as National Adoption Awareness Month. (Supervisor Geist)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim November 2008 as Alzheimer's Disease Awareness Month in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Resolution Recognizing Retiring U.S. Air Force Master Sergeant Eugene E. Livingston. (Supervisor Smith)

RECOMMENDATION: Ratify the Resolution.

2.                   Resolution in Memory of John Campbell, the Mayor of Fortuna who passed away on October 19, 2008. (Supervisor Rodoni)

RECOMMENDATION: Ratify authorizatoin for Chair to sign Resolution in Memory of John Campbell.

3.                   Accept the Resignation of Dennis Sutton from the Alcohol and Drug Advisory Board. (Supervisor Geist)

RECOMMENDATION: Accept the resignation of Dennis Sutton from the Alcohol and Drug Advisory Board and authorize Chair to sign Letter of Appreciation.

4.                   Accept the Resignation of Bambi Peters from the Alcohol and Drug Advisory Board. (Supervisor Geist)

RECOMMENDATION: Accept the resignation of Bambi Peters from the Alcohol and Drug Advisory board and authorize Chair to sign Letter of Appreciation.

5.                   Reappoint John LeVey Senior to the Humboldt County Housing Authority Commission as an Elderly Tenant Commissioner for Another Two Year Term. (Supervisor Neely)

RECOMMENDATION: Approve the Reappointment of John LeVey to the Humboldt County Housing Authority.

6.                   Letter of Appreciation to Gwen LaPena for Serving on the Workforce Investment Board Youth Council. (Supervisor Geist)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

7.                   Letter of Opposition to the Pacific Fishery Management Council's Proposed Catch History Quotas. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter of opposition.

Clerk of the Board

8.                   Approval of Board Orders - Meeting of October 28, 2008

RECOMMENDATION: Approve the Board orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Code Section 25103.


Community Development Services

9.                   Approve Extension of the Sublease for 520 E Street, in Eureka, with Redwood Region Economic Development Commission for the Economic Development Division through January 31, 2010

RECOMMENDATION: That the Board of Supervisors approve exercising the option to extend the sublease and authorize Public Works - Real Property  Division to send to Redwood Region Economic Commission (RREDC), Sublessor, exercising the option to extend the sublease for rental space at 520 E Street, in Eureka, California, until January 31, 2010; and Direct the Clerk of the Board to send to the Real Property Division one of the executed agenda item, which authorizes the Real Property Division to exercise the option to extend the sublease.

Health and Human Services - Public Health Branch

10.               Approve One Year Lease Extension for Department of Health and Human Services Public Health Branch, Environmental Health Office Space, 100 H Street, with Rynecki and Rynecki, LLC and the One Year Lease Extension for Parking Lot, 2nd and H Street, with Second and H Street, LLC Managed by Alex Rynecki

RECOMMENDATION: That the Board of Supervisors approve exercising the option to extend the lease for one year between the County of Humboldt and Rynecki and Rynecki, LLC, managed by Alex Rynecki, Inc. for office space located at 100 H Street, Eureka, CA for the Department of Health and Human Services, Public heath branch, Environmental Health Division, at a monthly cost of $8,352.59; Approve exercising the option to extend the lease for one year between the county of Humboldt and Second and H Street, Eureka, CA for the Department of Health and Human Services, Public Health Branch, Environmental health Division's exclusive use at a monthly rent of $667.65; Authorize Real Property to send a notice to Lessor that county is exercising the option to extend the leases; and Direct the Clerk of the Board to return one executed agenda item to Real Property.

Public Works

11.               Construction of Storm Damage Repairs on Blue Slide Road (F2G100) at PM 1.60: Project No.: ER 3812 (010), Contract No. 203100

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contact Change Order Number 1 for the total amount of $29,392.31; Approve the following Supplemental Budget: Revenue - 1200-321-523190 - $7,548.00; Expenditures - 1200-321-0220 - $7,548.00; and Approve the attached Appropriation Transfer from Road Fund Contingencies to fund Local Share.

12.               Construction of Dinsmore Airport Runway 9/27 Rehabilitation: Project No. AIP -3-06-0361-05, Contact No. 917221

RECOMMENDATION: That the Board of Supervisors authorize the Directro of Public Works to sign Contract Change Order Number 1 for the total amount of $90,007.35.

13.               Rancho Del Sol, Phase 2, Final Map Subdivision APN 511-031-08, McKinleyville

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete and accept and approve the subdivision map for filing with the County Recorder; Accept the dedications to the County of Humboldt of parcel D for public utilities, as shown on the subdivision map; Direct the Clerk of the Board to sign the subdivision map on behalf of the Board; Direct the Clerk of the Board to transmit the subdivision map to the county Recorder for filing.

14.               Termination of Local Emergency at Martins Ferry Bridge due to Structural Instability

RECOMMENDATION: That the Board of Supervisors terminate Resolution No. 07-87 and approve and adopt Resolution No. ____ proclaiming the termination of a local emergency - Closure of Martins Ferry Bridge.

Treasurer-Tax Collector

15.               Appointment of Board of Directors - Humboldt County Public Property Leasing Corporation

RECOMMENDATION: That the Board of Supervsiros appoint the following individuals as Directors of the Humboldt County Public Property Leasing Corporation for the 2008 year:  Sam B. Merryman, Jr., Raymond Flynn and Ray Jerland.

E.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Legislative Update and Report from Sacramento; and Progress Report on 2008 Legislative Platform

RECOMMENDATION: That the Board of Supervisors receive a legislative update and report from the County's legislative advocate Mr. Don Peterson; and That the Board of Supervisors receive and file the County's legislative report regarding the outcomes of the County's 2008 State Legislative Platform.

2.                   U.S. Forest Service Funding (HR 2389)

RECOMMENDATION: That the Board of Supervisors elect to receive a share of the "State Transition Payment" under the Secure Rural Schools and Community Self - Determination Act as reauthorized by Public Law 110-343, and authorize the Chair to sign a letter to the U.S. Forest Service to this effect; Elect to reserve 8 percent of funding received for Title II projects and 7 percent for Title III projects; Direct staff to continue exploring options for the Resource Advisory Committee required under Title II and report back to the Board no later than the mid-year budget review; and Direct the Auditor - Controller to set up new trust find (s) as may be required to separately account for revenues received for Title II and III projects under Public Law 110-343.

Library

3.                   Recognition of Donations made to the Library and Supplemental Budget in Fund 1500, Budget Unit 621, County Library (Fiscal Year 2008-2009)

RECOMMENDATION: That the Board of Supervisors accept and recognize donations made to the Library in the amount of $37,275.68 for the purpose of purchasing and leasing new library materials, conducting library programs open to the public and rebuilding the Fortuna Branch Library; and Adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2008-2009 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 2.
