1.                   Lease Agreement for 2933 H Street Modular Building (CONSENT - MENTAL HEALTH)

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to execute the lease with Performance Modular, Inc. for the modular building located at 2933 H Street, Eureka beginning December 1, 2008; and Direct the Clerk of the Board to return one executed original of the lease to Real Property for transmittal to the Lessor.

C.                  SPECIAL PRESENTATIONS

1.                   Resolution Declaring the Third Full Week of November, 2008 in Honor of Watershed and Fisheries Restoration Workers. (Supervisor Geist and Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

2.                   Proclaim November 20, 2008 as the American Cancer Society's Great American Smokeout. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

Board of Supervisors

1.                   Letter of Appreciation to Joe Fassler for Serving on the Forestry Review Committee. (Supervisor Rodoni)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

2.                   Reappoint Jan Price to the Humboldt County Housing Authority Commission as a Tenant Commissioner for Another Two Year Term. (Supervisor Geist)

RECOMMENDATION: Reappoint Jan Price to the Humboldt County Housing Authority.

3.                   Resolution of Commendation for the Northern California Indian Development Council for sponsoring the 27h Annual Northwest Inter-Tribal Gathering and Elders Dinner. (Supervisor Woolley)

RECOMMENDATION: Ratify the Resolution.

4.                   Approval of the Board Orders - Meeting of November 4, 2008

RECOMMENDATION: That the Board of Supervisors approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

County Administrative Office

5.                   Pay Differential for Jeff Dolf, Senior Agricultural Weights and Measures Inspector

RECOMMENDATION: That the Board of Supervisors approve the continued temporary increase in compensation of 20 salary ranges for Jeff Dolf, Senior Agricultural Weights & Measures Inspector, effective November 30, 2008, through June 30, 2009, or until the Agricultural Commissioner/Sealer of Weights and measures position is filled, whichever occurs first, pursuant to Section 7 of the Humboldt County Salary Resolution.

County Counsel

6.                   Resolution Increasing Petty Cash Fund

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ increasing revolving fund for use of County Counsel and rescinding Resolution No. 90-28; and That the Clerk of the Board transmit a copy of the Resolution to the Auditor and Treasurer pursuant to Government Code 29322.

Health and Human Services - Mental Health Branch

7.                   Letter of Understanding with Medical Doctor Associates, Inc. regarding County Employment of Ruby Bayam M.D.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Mental Health Branch Director to sign the Letter of Understanding with Medical Doctor Associates, Inc.

8.                   Mental Health Branch Charge Rate Schedule

RECOMMENDATION: That the Board of Supervisors adopt the attached charge rate schedule for the Department of health and human Services - mental Health Branch as required by the State Department of Mental Health.  This schedule shall be effective July1, 2008 until amended.


Health and Human Services - Public Health Branch

9.                   Approve Puchase of a QIA Cube Robotic Workstation and Appropriation Transfer within Fund 1175, Budget Unit 455 (Emergency Preparedness and Response)

RECOMMENDATION: That the Board of Supervisors Approve of a QIA Cube robotic workstation by the Emergency Preparedness and Response Program for the use of the Public Health Laboratory, within Fund 1175, for Fiscal Year 2008-09 in the amount of $20,000; and Approve the attached appropriation transfer in Budget unit #455, Fund 1175.

10.               Approval of California Department of Public Health Emergency Preparedness Centers for Disiase Control and Prevention (CDC), State General Fund (GF) Pandemic Influenza adn health and Human Services (HHS) Hospital Preparedness program Funding Agreement for Fund 1175, Budget Unit 455 (Emergency Preparedness and Response), Fiscal Year 2008/2009

RECOMMENDATION: That the Board of Supervisors authorize the Chairperson of the Humboldt County Board of Supervisors to sign the three originals of attached Public health Emergency Preparedness Centers for Disease Control and Prevention (CDC), State General Fund (GF) Pandemic Influenza and HHS Hospital Preparedness Program Funding Agreement for funding period of August 10, 2008 through August 9, 2009; and Direct the Clerk of the Board to submit the signed documents to the Department of Health and Human Services - Public Health Branch Emergency preparedness Coordinator, Charlene Pellatz, for submission to the California Department of Public Health.

11.               Approve Extending Existing Lease for Property at 1108 Main Street in Fortuna for Supplemental Nutrition Program for Women, Infants and Children (WIC) for the term February 1, 2009 through January 31, 2012.

RECOMMENDATION: That the Board of Supervisors approve exercising the second option to extend the lease at 1108 Main Street, Fortuna for the term February 1, 2009 through January 31, 2012; Authorize Real Property to send notice to lessor that county is exercising the second option to extend the lease; and Direct the Clerk of the Board to return one executed agenda item to Real Property and Public Health Branch, Maternal Child Adolescent Health Division.

12.               Approve Grant Agreement with the Governor's Office of Emergency Services for a 2009 Hazardous materials Area Plan Exercise and Budget Adjustment in Fund 1175, Budget Unit 411, Hazardous Materials Program, for Fiscal Year 2008-2009

RECOMMENDATION: That the Board of Supervisors approve and Authorize the Public Health Branch Director to sign the Assistance Agreement Number HMECA8033160 between the Governor's Office of Emergency Services and the Department of Health and Human Services, Humboldt County Public health branch, Division of Environmental Health for $20,695 for the period of October 1, 2008 through September 30, 2009; and Direct the Auditor to increase the revenue and expenditure lines in the amount of $16,505 in BU 411, Hazardous Materials Program, FY 2008-09 as follows

Health and Human Services - Social Services Branch

13.               Approval of First Amendment with the California Newspapers Partnership, Inc. for Lease at 930 Sixth Street, Eureka, California, for the Social Services Branch Employment Training Division

RECOMMENDATION: That the Board of Supervisors approve First Amendment with the California Newspapers Partnership, Inc., for Agreement originally executed on December 16, 2003, for the Social Services Branch Employment Training Division, for office space located at 930 Sixth Street, Eureka, CA; Authorize the Chairperson to execute two (2) originals of the First Amendment to Lessee; and Direct the Clerk of the Board to return on (1) executed original to Real Property for Transmittal to Lessor.

14.               Adjusted Library Hours of operation for November 26, December 24 and December 21, 2008

RECOMMENDATION: That the Board of Supervisors approve the following change in open hours for the library branches noted for Wednesday, November 26, 2008, Wednesday, December 24, 2008 and Wednesday, December 31, 2008:

15.               Extension of Extra Help Hours to 1980 Hours

RECOMMENDATION: Tha tthe Board of Supervisors approve the extension of extra help hours for Jessica Cyphers and Amber Smith, Juvenile Corrections Officers, to 1980 hours through June 3, 2009, per Section 7 of the Humboldt County Salary Resolution.

Public Works

16.               Hiller and Pickett Road Rehabilitation and Overlay (C3L080 & 4M030) at PM 0.60 to 1.46 and 0.00 to 0.40: Project No. RPL - 5904 (065), Contract No. 202707

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between mercer Fraser Co., Contractor, and Humboldt County for the rehabilitation and overlay repairs on Hiller and Pickett Road; Approve the following Supplemental Budget:  Revenues  1200-321-523190  $32,474.00; Expenditures  1200-321-0214  $32474.00; and Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $32,473.81.  This will bring the total amount paid to 100% of the contract.

17.               Agreement fo Airport Consulting Services to Provide Runway Safety Area (RSA) Improvement Environmental Deocumentation for each Runway End (14/32 and 01/19) and a 30% Design for the Bluff Stabilaztion at the approach end of Runway 14 under CFR Chapter 14, Far Part 139 for the Arcata/Eureka Airport A Cerficated Airport. Project Number 919213, Airport Improvement Program (AIP) Grant 03-06-0010-33.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign three copies of the Agreement for Airport Consulting with Mead and Hunt, for an amount not to exceed $171,166.00; and Direct the Clerk of the Board to return two fully executed copies to Public Works.

18.               Assignment of Jay Levitt, Traffic Control Maintenance Worker as Traffic Control Maintenance Supervisor

RECOMMENDATION: That the Board of Supervisors authorize the continued compensation for Jay Levitt as if he had been promoted to the classification of Traffic Control Maintenance Supervisor from November 23, 2008 through April 18, 2009, or until such time as the Traffic Control maintenance Supervisor returns, pursuant to Section 7 of the Humboldt County Salary.


19.               Construction of Residential Units within the Airport Business Park Subdivision in mckinleyville with the Arcata-Eureka Airport Land Use Compatibility Plan, APN 511-461-15, ET AL

RECOMMENDATION: That the Board of Supervisors receive the 10/01/2008 inconsistency determination of the Airport Land Use Commission regarding the above project; and Direct staff to forward the Airport Land Use Commission's determination to the Planning Commission for consideration of the conditions under which the project would be consistent.

E.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Local Fire District Allocations for Fiscal Year 2008-09 for the Carlott, Miranda, Shelter Cove and Weott Community Services Districts and the Arcata, Blue Lake, Humboldt No.1, Loleta Myers Flat, Petrolia, Redway, and Rio Dell Fire Protection Districts

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to executed agreements with the Carlotta, Miranda, Shelter Cove, and Weott Community Services Districts and the Arcata, Blue Lake, Humboldt No. 1, Loleta, Myers Flat, Petrolia, Redway, and Rio Dell Fire Protection Districts for revenue-sharing of the County's FY 2008-09 Proposition 172 (Prop 172) Funding.

Public Works

2.                   Placement of Speed Tables on Fieldbrook Road

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works take appropriate steps to proceed with the placement of Speed Tables on Fieldbrook Road.

3.                   Memorialization of the Bear Gulch Bridge near Garberville (CONTINUED FROM OCTOBER 7, 2008 BOARD OF SUPERVISORS MEETING)

RECOMMENDATION: That the Board of Supervisors receive testimony from Elders of the Eel River nation of Svereign Wailaki and the InterTribal Sinyone Wilderness Council (Council) that were unable to attend the October 7, 2008 Board Meeting; and Adopt the seven recommendations contained in the Department of Public Works letter to the Board dated September 29, 2008.


H.                  CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the public employee performance evaluation for the position of Executive Assistant/Clerk of the Board pursuant to Government Code section 54954.5.
