1.                   Resolution to Administer the Completion and Maintenance of a Pedestrian/Bicycle Path on Letz Avenue  (CONSENT)

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ ; Administer the design and construction of a class I pedestrian/bicycle path on Letz Avenue to connect existing portions of the Hammond Trail and pave portions of the trail currently left unpaved, subject to the approval of Bicycle Transportation Account (BTA) grant application; Provide a 10% match to the Bicycle Transportation Account (BTA) funding for the completion of the project.

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim December 13, 2008 as "Cleats for Kids" Day in Humboldt County. (Supervisor Woolley)

RECOMMENDATION: Adopt the Proclamation.


D.                  CONSENT CALENDAR

Board of Supervisors

1.                   Certificates of Recognition for Merel Babcock, Doris Cleaver, Carol Beaton, Blue Lake Rancheria Elder Programs, Fortuna Senior Services and PETCO for being "Friends to Seniors." (Supervisor Woolley)

RECOMMENDATION: Ratify the Certificates of Recognition.

2.                   Appoint Supervisor Geist as the Board Representative and Supervisor Woolley as the Alternate to the Redwood Coast Energy Authority (RCEA), effective December 9, 2008. (Supervisor Woolley)

RECOMMENDATION: Approve the appointment.

County Administrative Office

3.                   Lease of Space at Ferndale Fairgrounds for Cellular Antennae

RECOMMENDATION: That the Board of Supervisors approve the concept of leasing a portion of the grandstand at the Humboldt County fairgrounds in Ferndale for the installation of cellular antennae and authorize staff to proceed with the project.

4.                   Approval of Fire Protection Reimbursement Agreement (Amendment #1) between the County of Humboldt and the California Department of Forestry and Fire Protection (CalFire) to provide Fire Protection Services in County Service Area (CSA) #4 in Fiscal Year 2008-09

RECOMMENDATION: That the Board of Supervisors adopt the attached resolution authorizing the Chair of the Board to execute the Fire Protection Reimbursement Agreement (Amendment #1) with CalFire for Fire Protection Services to CSA #4, beginning July 1, 2008 through June 30, 2009; Waive the Humboldt Nuclear - Free Clause; and Direct the Clerk of the Board to submit four copies of the agreement and two copies of the Board Resolution to the Fortuna Office of the Department of Forestry and Fire Protection.

5.                   Local Fire District Allocations for Fiscal Year 2008-09 for Fieldbrook and Orick Community Services Districts and the Samoa and Fortuna Fire protection Districts

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute agreements with the Fieldbrook and Orick Community Services Districts and the Samoa and Fortuna fire protection Districts for revenue - Sharing of the County's FY 2008-09 Proposition 172 (Prop 172) Funding.

6.                   Board Meetings - Calendar Year 2009

RECOMMENDATION: That the Board of Supervisors cancel Board Meetings on the following dates in Calendar Year 2009 and direct the Clerk of the Board to notify all County Departments of these cancelled meetings: Tuesday, February 17, 2008 (Presidents Week - School Break); Tuesday, March 31 (5th Tuesday); Tuesday, June 30, (5th Tuesday); Tuesday, August 4 (Summer Break); Tuesday, August 11 (Summer Break); Tuesday, September 29 (5th Tuesday); Tuesday, November 17 (CSAC Annual Conference in Monterey); Tuesday, November 24 (Week of Thanksgiving Holiday); Tuesday, December 22 (Christmas Week); Tuesday, December 29 (5th Tuesday / Christmas Break).


Health and Human Services - Mental Health Branch

7.                   Request for Extension of Extra Help hours for Budget Unit 424

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Rebecca Laloli, Fiscal Assistant I, to 1984 hours through June 30, 2009, per Section 7 of the Humboldt County Salary Resolution.

Health and Human Services - Public Health Branch

8.                   Extension of Extra-Help Hours for two Laborers, One Mail Services Driver and One Office Assistant I Personnel Fund 1175, Budget Unit 400, Public health Branch, Fiscal Year 2008-09.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Charles Prescott, Laborer George Parlet, Laborer, Kimberly Miranda, Mail Services Driver, and Tiffanie Rieke, Office Assistant I to a maximum of 1920 hours during fiscal year 2008-09 in Fund 1175, Budget unit 400, Public Health, pursuant to Section 7 of the Humboldt County Salary Resolution effective immediately.

9.                   Approval of a Supplemental Budget for AIDS Drug Assistance Program, Fiscal Year 2008-09, Fund 1175, Public Health Branch, BU# 409

RECOMMENDATION: That the Board of Supervisors approve and direct the Auditor/Controller to supplement the Budget in Fund 1175, Budget Unit 409, as follows: Revenue 1175-409-514-007 ST-ADAP Admin $799.00; Expenditure 1175-409-2-114 Medical Dental and Lab Supplies $799.00.

10.               Allocate One Supervising Public Health Nurse Position in Fund 1175, Budget Unit 416, Public Health Nursing

RECOMMENDATION: It is recommended that the Board of Supervisors approve the allocation of one full-time Supervising Public Health Nurse (salary range 452, class 0514) in budget unit 416 effective upon approval.

Health and Human Services - Social Services Branch

11.               Approval of Agreement for Reimbursement of Interim Assistance Payments with California Department of Social Services.

RECOMMENDATION: That the Board of Supervisors approve the Agreement for Reimbursement of Interim Assistance with the California Department of Social Services payments pursuant to Section 1631 (g) of the Social Security Act; Authorize the Chair to execute three (3) copies of the Agreement for Reimbursement; and Direct the Clerk of the Board to route two (2) fully executed copies of the Agreement for Reimbursement to the Director of Social Services.

Personnel

12.               Implementation of Internal Revenue Code Section 414 (H) (2)

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. _____ attached authorizing the implementation of Internal Revenue Code Section 414 (H) (2).

Public Works

13.               Designation of Various Speed Zones on Briceland Thorne Road and Shelter Cove Road

RECOMMENDATION: That the Board of introduce the attached Ordinance by title, waive the first reading thereof, and set the Ordinance for adoption at least one week away; and Direct the Clerk of the Board to publish a summary at least five (5) days before the date set for adoption and again fifteen (15) days after adoption.


14.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 43.54: Project No.: ER 4400(054), Contract No. 206381

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign Contract Change Order Number 1 for the total amount of $17, 899.46; Accept the completed contract, including all change orders approved by the Public Works Department, between V& C Constriction, Contractor, and Humboldt County for the storm damage repairs on Alderpoint Road; Approve the following Supplemental Budget: Revenue 1200-321-523190  $6,169; Expenditures  1200-321-0226  $6,169; and Approve the attached Appropriation Transfer to provide funding for the Local Share.

15.               Construction of Garberville Airport Perimeter Wildlife Fence, Project No.: AIP3-06-0092-05, Contact No. 917231

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approve by the Public Works Department, between Woida Enterprises dba Arrow Fencing, Contractor, and Humboldt County for the construction of the Garberville Airport Perimeter Wildlife Fence.

16.               Allocation of One Senior Building Maintenance Custodian Position

RECOMMENDATION: That the Board of Supervisors allocated one full-time Senior Building maintenance Custodian position in budget unit 381 (salary range 291m class 0263) effective upon approval.

17.               Request  to use County Equipment in the Annual Trucker's Parade

RECOMMENDATION: That the Board of Supervisors authorizes the use of County Road Trucks and heavy equipment in the annual Trucker's Parade.

18.               Termination of Airport Lease Agreement with M&M Wright Trucking at Arcata/Eureka Airport, Murray Field Airport, Rhonerville Airport, and Kneeland Airport

RECOMMENDATION: That the Board of Supervisors approve termination of the License Agreement and authorize Public Works to send a letter of termination to Licensee, M&M Wright Trucking and direct the Clerk of the Board to send one executed agenda item to the Land Use Division.

19.               Termination of Airport License Agreement with Martinaire Aviation L.L.C. at Arcata / Eureka Airport, Kneeland Airport, Murray Field Airport, Dinsmore Airport, Rhonerville Airport and Garberville Airport.

RECOMMENDATION: That the Board of Supervisors approve termination of the Agreement and authorize Public Works to send a letter of termination to Concessioner, Martinaire Aviation, L.L.C. and direct the Clerk of the Board to send one executed agenda item to the Land Use Division.

20.               Construction of Storm Damage Repairs on Blue Slide Road (F2G100) at PM 1.60 Project No.: ER 3812 (010), Contract No. 203100

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department between Schneider Enterprises and Humboldt County for the storm damage repairs on Blue Slide Road; and Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $9,702.31.  This will bring the total amount paid to 100% of the contract.

21.               Construction of Storm Damage Repairs on Mattole Road (F3C010) at PM 7.55: Project No. ER 4400(015), Contract No. 206256

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department between Raymond M. Etter, Contractor, and Humboldt County for the storm damage repairs on Mattole Road; and Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $8,501.67. This will bring the total amount paid to 100% of the contract.

22.               Request for Application for the California Multi-Jurisdictional Methamphetamine Enforcement Team (Cal-MMET) Program

RECOMMENDATION: That Board of Supervisors authorize the Sheriff to sign all documents necessary for the submission of the Request for Application for the California Multi-Jurisdictional Methamphetamine Enforcement Team (Cal-MMET) Program.

E.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Interim Appointment to fill Coroner/Public Administrator Vacancy - Frank Jager.

RECOMMENDATION: That the Board of Supervisors appoint Sheriff Gary Philp as the Interim Coroner/Public Administrator; Consider consolidation of the coroner and Sheriff's Departments; and Direct staff to explore option(s) for a possible consolidation of offices and return to the Board prior to the end of the fiscal year.

2.                   Lease with AT&T Capital for Purchase of New Data and Internet Protocol Telephone Equipment

RECOMMENDATION: That the Board of Supervisors authorize the County Administrative Officer to sign the attached Proposal Summary with AT&T Capital Services, Inc.; Approve the attached Equipment Lease-Purchase Agreement with AT&T Capital Services, Inc. for Phase I of the Proposal and authorize the Chair to sign; Approve the attached separate Equipment lease-Purchase Agreement with AT&T Capital Services, Inc. for Phase II of the Proposal and authorize the Chair to sign; Authorize the County Administrative Officer to sign a Statement of Work with AT&T Corp., substantially in the form of Attachment D, which will be appended to the Cal-Net 2 Master Service Agreement 1 approved by the Board on December 11, 2007.

3.                   General Plan Update - Status Report

RECOMMENDATION: That the Board of Supervisors receive the General Plan Update; and Provide direction to staff on the proposed work plan and schedule as necessary.

2.                   Memorialization of the Bear Gulch Bridge near Garberville continued from the November 18, 2008 Board of Supervisors Meeting

RECOMMENDATION: That the Board of Supervisors receive testimony from Elders of the Eel River Nation of Sovereign, Wailaki and the InterTribal Sinkyone Wilderness Council (Council) that were unable to attend the Board meetings on October 7, 2008 and November 18, 2008; Adopt the seven recommendations contained in the Department of Public Works letter to the Board dated September 29, 2008.

H.                  CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the public employee performance evaluation for the position of County Counsel pursuant to Government Code section 54954.5.

2.                   It is the intention of the Board of Supervisors to meet in Closed Session to consider the Appointment for the position of County Counsel pursuant to Government Code section 54954.5

3.                   Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel.

1.                   New Hart Church General Plan Amendment, Zone Reclassification, Coastal Development Permit; Case Nos:GPA-07-02, ZR 07-07, CDP-07-67

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ___amending the Local Coastal Plan (LCP) and Section 311-7 of the Humboldt County Code - the Zoning Ordinance by reclassifying the existing parcel from Commercial Recreation (CR) to Public Facility (Urban)(PF-1) by title and waive further reading; Open the public hearing, receive and consider the staff report, the Planning Commission's findings and accept public comment; Close the public hearing; Adopt the Planning Commission's findings; Based on the findings in the staff report and testimony received about the project, approve the attached Resolution No. ____, and adopt Ordinance No. ___ amending the Local Coastal Plan (LCP) and Section 311-7 of the Humboldt County Code - the Zoning Ordinance by reclassifying the subject parcel from Commercial Recreation (CR) to Public Facility (Urban) (PF-1). Approve the attached Resolution No. ___ adopting the Mitigated negative Declaration, making the finding that there is no substantial evidence that the proposed project will have a significant effect on the environment as required by Section 15074(b) of the California Environmental Quality Act (CEQA) guidelines, and approving the Coastal Development Permit Subject to certain conditions, with an effective date that coincides with the certification of the proposed General Plan and Zoning Amendments to the LCP by the Coastal Commission; Direct the Clerk of the Board to give Notice of the decision to the applicant/owner, the County Assessor's office and any other interested party, and to publish the Summary of the Ordinance along with a map of the properties at lease five days before the date for adoption and again 15 days after the adoption of the ordinance by the Board, along with the names of those supervisors voting for and against the ordinance and to post in the Office of the Clerk of the Board of Supervisors a certified copy of the fill text of the adopted ordinance along with the names of the supervisors voting for and against the ordinance; Direct the Clerk of the Board to record in the minutes of the Board meeting that the ordinance has been duly published and posted, and to give notice of the decision to the Applicant and any other interested party; and Direct the Clerk of the Board to give notice of the Zone Reclassifications to the Assessor, by sending that office a copy of the executed Ordinance signed by the Chair and the Clerk of the Board.
