These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Proclamation September 29, 2001 is Community Clean-up Day in Blocksburg.The Main Stem Eel River Group (MERD) is sponsoring Community Clean-up Day in Blocksburg on Saturday, September 29, 2001 from 9:00 A.M. to 12:00 Noon.A barbecue and presentation of awards will follow. (Supervisor Rodoni)

RECOMMENDATION: Adopt Proclamation.

2.                   County of Humboldt co-host California Coastal Commission's 25th anniversary celebration.On September 13, 2001 the County was a non-financial co-host of the California Coastal Commission's celebration of its 25th anniversary and the 30th anniversary of the Coastal Initiative.The reception was also a recognition of Local Coastal Heroes. (Supervisor Woolley)

RECOMMENDATION: Ratify approval of the County's non-financial co-hosting of Coastal Commission celebration.

County Clerk-Recorder

3.                   Supplemental budget for improvements to vital records system. In order to upgrade the system of maintaining birth, death and marriage records, it is necessary that improvements be made to the method of storage for those records.Since 1999 we have been electronically scanning the recorded documents and storing them on disks.Only recently has a program been developed that will allow the records of births, deaths and marriages to be stored in a similar manner.However, the workstations currently in use throughout the office will not support the additional workload so it is necessary to upgrade the current system and add additional storage space (computer memory) in order to make the new system operate to its full capacity.The proposed purchases are within the scope of the Vital Records Improvement fund.

RECOMMENDATION: Approve supplemental budget.

District Attorney

4.                   Adoption of a new classification Child Support Programs Coordinator.On November 7, 2000 the California Department of Child Support Services began a project designed to increase local customer service in all California Child Support agencies.A key piece of this project was a requirement that each county child support agency have a person designated as an Ombudsperson.In addition to the Ombudsperson position, the State also implemented a public outreach component to this customer service project. The State provided additional funding to accomplish these activities.This funding is sufficient to pay for a half-time position.

RECOMMENDATION: Approve request and allocate two positions in Budget Unit 206.

Health and Human Services - Mental Health Branch

5.                   Agreement with Jonathan Sommers M.D. for Mental Health Physician/Psychiatrist

RECOMMENDATION: Approve agreement.

6.                   Extension of Property Lease with Don Davenport at 2830 G Street, Eureka for Mental Health Support Services through December 31, 2002.

RECOMMENDATION: Direct the Clerk of the Board to authorize Real Property to send a letter to the lessor to exercise the County's option to extend the lease for an additional one year.

7.                   Temporary pay increase for Moein El-Hertani, M H Maintenance Custodian.Moein El-Hertani is assuming the principle duties of the Sr. M H Maintenance Custodian due to the incumbent being on medical leave.Mr. El-Hertani will assume these supervisory duties until the incumbent returns from leave or until December 31, 2001 whichever comes first.

RECOMMENDATION: Approve temporary increase pursuant to AFSCME memorandum of understanding.

8.                   Temporary pay increase for Raisa Montero Sr. M H Clinician.Raisa Montero is assuming the principle duties of the Supervising M H Clinician due to the incumbent on medical leave.Ms. Montero will assume these supervisory duties until the incumbent returns from leave or until December 31, 2001 whichever comes first.

RECOMMENDATION: Approve temporary increase pursuant to AFSCME memorandum of understanding.

9.                   Employment Agreement for Mental Health Physician/Psychiatrist.The Board has authorized the Assistant Director-Administration Dept. of Health and Human Services to negotiate employment agreements with psychiatrists employed by Dept. of Health and Human Services-Mental Health.Through this Employment Agreement, Dr. Pick will be employed as 1.0 Physician/Psychiatrist in a currently vacant allocated position providing psychiatric services in DHHS programs.Dr. Pick is currently placed at Humboldt County Mental Health through a contract with Traditions Behavioral Health.By mutual agreement and pursuant to contract terms, the parties have determined that Dr. Pick shall become a County employee effective October 1, 2001.This agreement has been reviewed by the Personnel Dept. and County Counsel.

RECOMMENDATION: Approve agreement.

Health and Human Services - Public Health Branch

10.               Establish fixed asset line item for chair in Fund 1175, Public Health Budget Unit 493 California Childrens Services.

RECOMMENDATION: Approve request by establishing fixed asset line item ($910).

Health and Human Services - Social Services Branch

11.               Reallocate Data Entry Operator I/II to Office Assistant I/II in Dept. 511.The retirement of a Data Entry Operator I/II has left the Social Services Branch Hearings Unit without vital clerical support since mid-July.Merit Systems Services has approved reallocating the vacant DEO I/II position to an Office Assistant I/II position, and DHHS staff recommend the Board approve this personnel action.

RECOMMENDATION: Approve request.

Public Works

12.               Grant Agreement No. 01-056 with the California Coastal Conservancy providing $105,000 to supplement the Construction funding of six Humboldt County Fish Barrier Removal Projects.The agreement is the result of negotiations and request for assistance from the California Coastal Conservancy to supplement SB 271 funds received for six of the current barrier removal projects.Six resource enhancement projects (Sullivan Gulch, Ryan Slough, Stansberry Creek, Lindsay Creek, North Folk Anker Creeks, and Clear Creek) will be partially funded by the Conservancy if this agreement is approved subject to the conditions detailed in the "Scope of Agreement" and in the "Conditions Precedent to Commencement of Project and Disbursement", and the general terms and conditions of the Standard Agreement.

RECOMMENDATION: Approve request by adopting Resolution No. 01-75.Adopt supplemental budget.

13.               Award of Contract for Structural Modifications to South Fork Eel River Bridge.On August 14, 2001 the Board authorized the Clerk of the Board to advertise the above mentioned project for bids.

RECOMMENDATION: Award project to Parnum Paving Inc.

14.               Proposed vacation of a portion of Simpson Mill Road, County Road No. 4L570 in the Arcata area.The portion proposed for vacation is the western most 300 feet more or less located at the end of Simpson Mill Road.One private property owner, Sun Valley Floral Farms surrounds this portion of Simpson Mill Road.The area proposed for vacation includes existing public utilities for PG&E and Pacific Bell.A public utility easement has been requested to be reserved for these utility companies.

RECOMMENDATION: Adopt Resolution No. 01-76 scheduling a public hearing for October 23, 2001.

15.               Allocation of two Supervising Airport Service Worker positions in the Aviation Division

RECOMMENDATION: Approve allocation.

Sheriff

16.               Request for declaration of County Civil Defense (C-D-10) fire truck as surplus property and authorization to sell the truck to the Yurok Tribe.The Willow Creek Fire Protection District has possession of Humboldt County Civil Defense fire truck #C-D-10.It is a 1944 Ford, VIN#G8T176534, License #E95805, registered to Humboldt County Civil Defense.The Willow Creek Fire Protection District has used it for many years but it is now obsolete for their uses and they want to return it to the County's possession.The truck is fully operational; however, it doesn't meet current minimum fire apparatus standards as it pumps at 700 gallons per minute versus the minimum required 750 gallons per minute.

RECOMMENDATION: Approve request and sell vehicle to the Yurok Tribe for one dollar ($1.00).

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim October 1-31, 2001 as Buy Local Month.The North Coast Co-op requests the Board proclaim October 1-31, 2001 as Buy Local Month and encourage all citizens to support the local economy through the purchase of locally produced goods. (Supervisor Woolley)

RECOMMENDATION: Adopt the proclamation.

2.                   Proclamation September 29, 2001 National Public Lands Day.Redwood National and State Parks will benefit from National Public Lands Day on September 29, 2001.National Public Lands Day is the largest volunteer effort for Public Lands.On September 29 volunteers will gather at Prairie Creek Redwoods State Park to remove Crocosmia from an area at the end of the Ah-Pah Interpretive Trail.The Board wishes to support this event by proclaiming September 29 as National Public Lands Day.(Supervisor Woolley)

RECOMMENDATION: Adopt the proclamation.

E.                  DEPARTMENT REPORTS

Public Works

1.                   Change Orders over $10,000 on Public Works Projects.(None)

RECOMMENDATION: Approve change orders as recommended by Public Works.

2.                   Advertisement or Award of Public Works Projects.(None)

Auditor-Controller

3.                   Adoption of 2001-02 budgets for Special Districts governed by the Board of Supervisors.Garberville Lighting District, Hydesville Lighting District, Loleta Lighting District, Myers Flat Street Lighting Maintenance District, Rohnerville Lighting District, Redcrest Street Lighting Maintenance District, Weott Street Lighting Maintenance District, Pacific Manor Street Lighting Maintenance District, Humboldt County Flood Control District Subzone 1-1, Janes Creek Storm Drain Maintenance District, Fortuna Fire Protection District, Loleta Fire Protection District, Whitethorn Fire Protection District for the Fiscal Year 2001-2002.

RECOMMENDATION: Adopt Resolution No. 01-77.

4.                   Adoption of 2001-02 County Budget.Resolution of the Humboldt County Board of Supervisors adopting budget of County of Humboldt for the Fiscal Year 2001-02.

RECOMMENDATION: Adopt Resolution No. 01-78.

5.                   Resolution adopting 2001-02 budgets for Special Districts governed by the Board of Supervisors.The Board of Supervisors sitting as the Board of Directors of those special districts governed by the Board of Supervisors has compiled with all of the legal requirements for the adoption of a budget for each special district enumerated in the accompanying resolution.

RECOMMENDATION: Adopt Resolution No. 01-79.

F.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Presentation of recommended nearshore fishery testimony to California Fish and Game Commission.Supervisors Jimmy Smith and Paul Kirk will present to the Board the recommended testimony to be given to the California Fish and Game Commissionís Nearshore Fishery Public Hearing on Saturday, September 29, 2001 at the Veterans Hall in Eureka.(Supervisors Kirk and Smith)

RECOMMENDATION: Hear presentation and take appropriate action.

2.                   Reports on Board Member Travel at County Cost and Meeting Attendance (No Action)

3.                   Potential or proposed Big Box Retail Development in Humboldt County.(None)

G.                 MATTERS SET FOR TIME CERTAIN

Time Certain 19:30 A.M.

1.                   AB 1682 Employer of Record Recommendations.AB 1682 requires that by January 2003 all counties designate an "employer of record" for IHSS/PCSP individual providers for purposes of collective bargaining for wages, benefits, terms and conditions of employment.The bill requires that the Board establish an Advisory Committee on the In-Home Supportive Services Program, which the Board did on January 9, 2001 by adopting Resolution No. 01-05.The committee has been meeting monthly with DHHS involvement (a Deputy Director is a member) since March 2001.

RECOMMENDATION: Direct DHHS to develop a plan for the designation and implementation of a Public Authority as the "employer of record."

Approve in concept the Board acting as the governing body of the Public Authority.

Approve in concept the Public Authority will have the ability to contract for services.

H.                  CLOSED SESSION

1.                   Report from Prior Closed Session.(None)

2.                   Pursuant to Government Code Section 54957.6 for the purpose of reviewing the County's position and instructing its designated representatives with respect to the various forms of compensation provided to the County's represented and unrepresented employees.(None)

4.                   It is the Board of Supervisors' intention to meet in Closed Session to consider Public Employee appointment for position of County Administrative Officer pursuant to Govt. Code Section 54954.5.(Continue to Monday, October 1, 2001)
