RECOMMENDATION: That the Board of Supervisors approve the extension of extra-help hours for Carlie Cobine, Office Assistant I, Andrew Duncan, Office Assistant I, Christiane Gillespie, Office Assistant I, and Erika Torres, Office Assistant I, to a maximum of 1960 hours pursuant to section 7 of the Humboldt county Resolution, effective immediately.

2.                   Letter of Opposition to Governor Schwarzenegger's Proposal to Eliminate the California Conservation Corps in the 2009/2010 State Budget. (CONSENT) (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign letter of opposition.

1.                   Letter of Appreciation to Paul A. Ziegler for Serving on the Headwaters Fund Board. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation

2.                   Proclaim January 19th, 2009 as Martin Luther King Jr. Day in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Ratify the Proclamation.

3.                   Approve Board Orders from Board Meeting - December 9, 2009.

RECOMMENDATION: Approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

4.                   Approve Board Orders from Board Meeting - December 16, 2009.

RECOMMENDATION: Approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

5.                   Approve Board Orders from Board Meeting - January 6, 2009

RECOMMENDATION: Approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

6.                   Approve Board Orders from Board Meeting - January 13, 2009.

RECOMMENDATION: Approve the Board Orders, and authorize the Clerk of the Board and the Board Chair, to sign the minute book in accordance with California Government Code Section 25103.

County Administrative Office

7.                   Appointment of Law Library Trustees

RECOMMENDATION: That the Board of Supervisors appoint Kevin Robinson and Paul Gallegos to the Board of Law Library Trustees and appoint Wendy Chaitin to serve as an ex officio member of the Law Library Trustees at the request of the Chair of the Board of Supervisors

8.                   Set Public Hearing for Revision of County Fee Ordinance.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to schedule a public hearing on Tuesday, February 3, 2009, at 1:30 p.m. or as soon thereafter as the matter may be heard, for consideration of revisions to the 2008-2009 Humboldt County Schedule of Fees and Charges; Direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing; two publications are required, with at least five (5) days intervening between the dates of the first and last publication, not counting such publication dates; Direct the Clerk of the Board to have the data and documentation supporting the revised fees for public review at least ten (10) days prior to the public hearing; and Direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted [Government Code Section 25124(b)(1)].

District Attorney

9.                   Establishment of Revolving Trust Fund 3887 Real Estate Fraud Prosecution.

RECOMMENDATION: That the Board of Supervisors approve the establishment of revolving trust fund 3887 (Real Estate Fraud Prosecution) as identified in Senate Bill 1396, as amended; direct the Auditor's to create the revolving trust fund 3887, as shown in the 2008-2009 Humboldt County Schedule of Fees and Charges.

Health and Human Services - Mental Health Branch

10.               Adjust Salary and Step Pursuant to Section 7 of the Humboldt County Salary Resolution.

RECOMMENDATION: It is recommended that the Board of Supervisors approve an advanced step placement for Wendy Brandon, Psychiatric mid Level Nurse Practitioner (class 0912, position #01, Range 483) step D effective February 8, 2009 pursuant to Section 7 of the Humboldt County Salary Resolution.

Library Services

11.               Temporary Closure of the Willow Creek Branch Library

RECOMMENDATION: That the Board of Supervisors approve the temporary closure of the Willow Creek Branch Library from Wednesday, January 28, 2009 through Friday, January 30, 2009 for repairs and recarpeting.

Personnel

12.               Temporary Physical Closure of Personnel Department for 2 Days.

RECOMMENDATION: That the Board of Supervisors authorize the temporary closure of the County Personnel Department on January 23, 2009 and January 26, 2009.

Public Works

13.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 10.0: Project No.: ER 4400(039), Contract 206370

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between G.R. Wilcox Enterprises, Inc., Contractor, and Humboldt County for the storm damage repairs on Alderpoint Road; and Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $18,567.80. This will bring the total amount paid to 100% of the contract.

14.               First Amendment to the Memorandum of Understanding (MOU) between the Aviation Division of the Humboldt county Department of Public Works and the Humboldt County Sheriff's Office Regarding the Rohnerville Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5ths vote authorize the Chairperson to sign and execute the First Amendment to the MOU between the Aviation Division and the Sheriff's Office; Direct the Clerk of the Board to return a copy of the executed original to the Land Use Division of the Department of Public Works and one to the Sheriff's Office.

15.               Request for Waiver of 960 Hour Limit for Extra Help Legal Office Assistant Xia Vang, Kendall Luna, and Michael Menza (Budget Unit 1100243) Pursuant to Section 7 of the Humboldt County Salary Resolution.

RECOMMENDATION: That the Board of Supervisors approve an increase in extra help hours for Legal Office Assistant Xia Vang, Kendall Luna and Michael Menza from 960 hours to 1920 hours, pursuant to Section 7 of the Humboldt County Salary Resolution.

K.                  PUBLIC HEARINGS

Public Works

1.                   Amendments to the Franchise Agreements with City Garbage Company of Eureka for the Garberville and Holmes-Redcrest Areas.

RECOMMENDATION: That the Board of Supervisors open the public hearing; Receive public comment; Close the public hearing; Approve the amendments and associated rate increases for the Garberville and Holmes-Redcrest franchises with the City Garbage Company of Eureka; Authorize the Chair to execute the attached three original copies of the franchise amendments upon approval by the County Counsel and Risk Management; and Direct the Clerk of the Board to return two fully executed copies of the Amendments to Public Works for distribution.
