Agricultural Commissioner

1.                   Approval of Collection Agreement with California State Parks to receive California Department of Food and Agriculture Weed Management Grant Funds.

RECOMMENDATION: That the Board of Supervisors approve collection agreement between Humboldt County and California State Parks; Authorize the Board Chair to sign the collection agreement; and Direct the Clerk of the Board to return the signed collection agreement to the Agriculture Department for further processing.

2.                   Correction of Supplemental Budget Approved 12/16/2008, Item D-1 for the Sudden Oak Death Program.

RECOMMENDATION: That the Board of Supervisors approve the Appropriation Transfer, as attached.

Board of Supervisors

3.                   Letter of Support to the Bertha Russ Lytel Foundation for the North Coast EMS' Grant Request. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of support.

4.                   Change the appointment status of Lynette Chen and Thomas D. Rowe on the Assessment Appeals Board. (Supervisor Smith)

RECOMMENDATION: Appoint Thomas D. Rowe as the Member and Lynette Chen as the Alternate on the Assessment Appeals Board.

5.                   Appoint Guy A. Aronoff to the Humboldt County Human Rights Commission. (Supervisor Neely)

RECOMMENDATION: Approve the appointment of Guy A. Aronoff to the Humboldt County Human Rights Commission.

6.                   Appoint Sofia Pereira to the Human Rights Commission. (Supervisor Lovelace)

RECOMMENDATION: Approve the appointment of Sofia Pereira to the Human Rights Commission.

Health and Human Services - Administration

7.                   Amend the Authorization to Negotiate Employment Agreements and Relocation Reimbursement for Physicians.

RECOMMENDATION: That the Board of Supervisors Amend the Board Authorization dated September 19, 2006 to additionally authorize the Director of Health and Human Services, or his designee, to accept waivers under the contract of the 30 day required termination notice.

8.                   Notice of Public Hearing for June 2, 2009, to Consider Transfer of State/Local Program Realignment Funds from the Social Services Branch Sub-Account to the Mental Health Branch Sub-Account for Fiscal Year 2008-2009.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to Publish a Notice of a Public Hearing to be held on Tuesday, June 2, 2009, to consider transfer of State/Local program realignment funds from Social Services Branch sub-account to mental Health branch sub-account.

Health and Human Services - Public Health Branch

9.                   Amendment A02 to Master Agreement with California Department of Public Health and Associated Memoranda of Understanding and Approve Fiscal Year 2008-09 Budget Adjustment to Fund 1175, Budget Units 409 HIV/AIDS programs, 437 Early Intervention Program, 447 High Risk Prevention Case Management, 448 Bridge Project, and 449 Peer Project.

RECOMMENDATION: That the Board of Supervisors approve Amendment A02 to Agreement Number 07-65050 with the California Department of Public Health; Authorize the Chair to sign the first page of the original and each of six (60 Standard Agreement Amendment copies; Authorize the Chair to sign three (3) copies of the first page of the following Amendments: A01- to the HIV Counseling and Testing Memorandum of Understanding, A01 - to the HIV/AIDS Surveillance Program and A02 - to the Early Intervention Program Memorandum of Understanding; Direct the Clerk of the Board to return all Standard Agreement Amendment copies and all copies of amended Memoranda of Understanding to the Public Health Branch, Health Education Division; and Approve and direct the Auditor-Controller to adjust Fund 1175, Budget Units 409 HIV/AIDS programs, 437 Early Intervention Program, 447 High Risk Prevention Case Management , 448 Bridge Project, and 449 Peer Project (HIV/AIDS) as shown in attachment 1.

10.               Approval of Medi-Cal Administrative Activities (MAA) Contract #09-86017 with the Department of Health Care Services (DHCS).

RECOMMENDATION: That the Board of Supervisors approve Agreement Number 09-86017 for Medi-Cal Administrative Activities (MAA) between the county of Humboldt and the Department of Health Care Services (DHCS) for the term of July 1, 2009 through June 30, 2012; Direct the Chair to sign four (4) Standard Agreement pages for contract number 09-86017 for Medi-Cal Administrative Activities (MAA) between the County of Humboldt and the Department of Health Care Services (DHCS), sign four (4) copies of Exhibit D(F), Certification Regarding Lobbying and return four signed Standard Agreement pages and four signed Exhibit D(F) Certification Regarding Lobbying pages to Health and Human Services, Public Health Branch for Submission to the State.

Health and Human Services - Social Services Branch

11.               Approval of Option to Extend Agreement with American Star Security Corporation.

RECOMMENDATION: That the Board of Supervisors approve the option to extend the Agreement with American Star Security Corporation, for fiscal year 2009/2010, to provide security services to the Department of Health and Human Services; and Direct the Clerk of the Board to return on executed Board Agenda Item to the Director of the Social Services Branch; and Authorize the Director of the Social Services Branch to send a letter notifying American Star Security Corporation that the County is exercising the option for an additional year, from July 1, 2009 through June 20, 2010.

12.               Extension of Child Welfare Improvement Activities Grants awarded to Community/Family Resource Centers.

RECOMMENDATION: That the Board of Supervisors approve Third Amendment to Grant Agreements, totaling $100,000 with the Community/Family Resource Centers participating in the Child Welfare Improvement Activities Grant Projects, extending the Agreement with each center for fiscal year 2009/2010; and Authorize the Director of the Department of Health and Human Services (DHHS) to execute Amendments to the Grant Agreements substantially in the form of the attached sample upon proof of insurance.

13.               Extension of CalWORKS Grants awarded to Community / Family Resource Centers.

RECOMMENDATION: That the Board of Supervisors approve Second Amendment to Grant Agreements, totaling $300,000, with the Community/Family Resource Centers participating in the CalWORKS Grant Projects extending the agreements with each center for fiscal year 2009/2010; and Authorize the Director of the Department of Health and Human Services (DHHS) to execute grant agreements substantially in the form of the attached sample upon proof of insurance.

Library Services

14.               Recognition of Bequest made to the Library from the Estate of John Vito Martucci.

RECOMMENDATION: That the Board of Supervisors accept and recognize a bequest made to the Library from the Estate of John Vito Martucci in the amount of $50,000.00 for the purpose of purchasing new library materials.

Public Works

15.               Parkland Dedication (Quimby) Fees to Fund Clam Beach Park Improvements.

RECOMMENDATION: That the Board of Supervisors find that the funds will be used consistent with Quimby Act Requirements; Direct that $71,770, which represents the County's share of parkland dedication fees collected for the coastal and inland portions of McKinleyville, be committed for continued development of Clam Beach County Park; Direct the2009/2010 Parks budget include an expenditure allocation and offsetting revenue appropriation for $71,770 to fund Clam Beach improvements from Quimby Act fees currently on deposit.

16.               Application for Technical Assistance from the California Energy Commission.

RECOMMENDATION: That the Board of Supervisors approve the attached Resolution authorizing the Director of Public Works to sign an application for technical assistance from the California Energy Commission.

17.               Federal Apportionment Exchange and State Match Program for Regional Surface Transportation Program (RSTP) Funds.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign three copies of the Agreement No. X09-5904(096); and Direct the Clerk of the Board to return two signed copies of the agreement and the authorizing Board Order to the Department of Public Works for transmittal to California Department of Transportation (Caltrans).

18.               Construction of Storm Damage Repairs on Thomas Road at PM 2.70: Project No.: FEMA CA DR 1628 PW-2078, Contract No. 206211.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Thomas Road at PM 2.7; Award the contract to GR Sundberg, Inc. in the amount of $460,583.50; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and Direct the Auditor-Controller to establish a new contract account 1200-321-0233 and transfer $483,614 to the account per the attached appropriation transfer.

19.               Construction of Storm Damage Repairs on Benbow Drive at PM 0.95: Project No.: FEMA CA DR 1628 PW-1595, Contract No. 206268.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Benbow Drive PM 0.95; Award the contract to Leonardo Logging & Construction, Inc. in the amount of $93,105; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and Direct the Auditor-Controller to establish a new contract account 1200-321-0234 and transfer $97,760 to the account per the attached appropriation transfer.

20.               Second Amendment to Lease for Public Works Sign Shop and Vehicle Storage.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to sign Second Amendment to Lease with Charlene J. Lundblade and Ron B. Lundblade for property located at 112 W Third Street, Eureka, CA; and Direct the Clerk of the Board to return one original executed Second Amendment to lease to Real Property for transmittal to Lessor.

1.                   Freshwater Pulp Company Economic and Environmental Update. (Supervisor Neely)

RECOMMENDATION: Hear the report and take appropriate action, if required.

2.                   Letter of Recommended Edits to the Revised North Coast Railroad Authority (NCRA) Rail-with-Trail Guidelines. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter to NCRA.

Community Development Services

1.                   Amend Circulation Element of the Humboldt County Framework Plan and Section 3.22 B (3) (Public Roadway Projects) of the Humboldt Bay Area Local Coastal Plan (LCP) to Allow a Future Humboldt Hill Road Extension to Tompkins Hill Road.

RECOMMENDATION: Open the public hearing and receive staff report and public testimony; Close the public hearing; Review and deliberate on the proposed Framework Plan and LCP amendments; Adopt Resolution No. ____, make the required findings as set forth in the Staff Report and Resolution and adopt the amendment to the Circulation Element of the Humboldt County Framework Plan and the amendment to Section 3.22 B (3) (Public Roadway Projects) of the Humboldt Bay Area Local Coastal Plan to allow and add a future Humboldt hill Road Extension to Tompkins Hill Road to become effective upon certification by the California Coastal Commission; Direct staff pursuant to the Resolution to submit the proposed amendments to the California Coastal Commission for certification; and Direct the Clerk of the Board to give notice of the decision to the property owner and any other interested party.

2.                   Final Report on 2006 Community Development Block Grant Planning & Technical Assistance Grant for Broadband Middle Mile Fiber Feasibility Studies and Business Plan.

RECOMMENDATION: That the Board of Supervisors receive staff report summarizing two previous broadband reports and three new reports, which were funded by the State of California Community Development Block Grant (CDBG) Planning & Technical Assistance (PTA) grant, number 06-EDBG-2508; Open the public hearing and receive public testimony; Close the public hearing; and Direct the Staff to submit final closing documents and draw the final 10% holdback funds.
