1.                   Memorandum of Agreement between Humboldt County, Wiyot Tribe, and Bureau of Indian Affairs

RECOMMENDATION: That the Board of Supervisors authorize the Chairman to sign three copies of the Memorandum of Agreement to allow for additional funding opportunities as well as closer inter-governmental cooperation with the Wiyot Tribe; and Direct the Clerk of the Board to return the three original Agreements to Public Works for submittal to the Wiyot Tribe and the Bureau of Indian Affairs for final execution.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

District Attorney

1.                   Execution of Standard Agreement with Victim Compensation and Government Claims Board for Fiscal Year 2009-2012.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution and authorize the Chair of the Board to execute the Standard Agreement with the Victim Compensation and Government Claims Board for Fiscal Year 2009-2012 in the amount $407,322 and the Certification; Direct the Clerk of the Board to process and return one executed copy of the Resolution (with the signed certifications), 4 original Standard Agreements and the Certification to the DA's Office; and Grant a Waiver of the Nuclear Free Ordinance.

Health and Human Services - Mental Health Branch

2.                   Agreement with Transitional Residential Treatment Facilities (TRTF), Inc. for July 1, 2009 through June 30, 2010.

RECOMMENDATION: That the Board of Supervisors approve the Agreement with Transitional Residential Treatment Facilities (TRTF), Inc. for July 1, 2009 - June 30, 3010; and Authorize the Chair of the Board of Supervisors to execute three copies of the agreement effective July 1, 2009; and Direct the Clerk of the Board to return executed two copies of agreement to mental Health Branch Administration.

3.                   Agreement with Crestwood Behavioral Health, Inc. for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve the Agreement with Crestwood Behavioral Health, Inc. (CHHI) for Fiscal Year 2009-2010; Authorize the Chair to sign the attached Agreement; and Direct the Clerk of the Board to send two copies of the executed Agreement to Mental Health Branch Administration.

4.                   Agreement with Country Villa Merced Behavioral Care Center for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the Agreement with Country Villa Merced Behavioral Care Center for long-term care for the mentally ill Fiscal year 2009-2010; Authorize the Chair to sign the above described Agreement; and Direct the Clerk of the Board to return two executed copies of the Agreement to Mental Health Branch Administration.

Health and Human Services - Public Health Branch

5.                   Adoption of Resolution to Authorize submittal of grant applications for the next Five Years to the California Integrated Waste Management Board for Enforcement Assistance Grant Funding for Division of Environmental Health's Local Enforcement Agency Program, Fund 1175, Budget Unit 430.

RECOMMENDATION: That the Board of Supervisors adopt the resolution authorizing the Director of Public Health to apply for funding for the next five years (2009-2014) from the California Integrated Waste Management Board (CIWMB) and to enter into and execute grant agreements with the CIWMB for Environmental Health's Local Enforcement Agency Program.

6.                   Create Budget Unit 454, Mental Health Services Act - Prevention and Early Intervention, in Fund 1175, Public Health for Fiscal year 2008-09.

RECOMMENDATION: That the Board of Supervisors approve creation of new Budget Unit 454, Mental Health Services Act-Prevention and Early Intervention (MHSA-PEI), in Fund 1175, in the amount of $212,726 for Fiscal year 2008-09; and Direct the Auditor/Controller to create budget unit 454, MHSA-PEI, as shown in Attachment "A".

Health and Human Services - Social Services Branch

7.                   First Amendment to Agreement with Changing Tides Family Services for Stage One Child Care Services for CalWORKs/WtW Participants for Fiscal Year 2009/2010.

RECOMMENDATION: That the Board of Supervisors approve the proposed First Amendment to the Agreement with Changing Tides Family Services to provide Stage One Child Care Services to all CalWORKs recipients who are referred by Social Services Branch (SSB); Authorize the Chair to execute three copies of the Amendment; Direct the Clerk of the Board to route two fully executed originals to the Director, Department of Health and Human Services, Social Services Branch.

8.                   Approval of Contract with Prevent Child Abuse California for the AmeriCorps Child Welfare Services (CWS) Improvement Activities Grant Agreement.

RECOMMENDATION: That the Board of Supervisors approve the Contract with Prevent Child Abuse California for the AmeriCorps Child Welfare Services (CWS) Improvement Activities Grant Agreement; and Authorize the Chair to execute three copies of the Contract in blue ink as requested by the state; and Direct the Clerk of the Board to route two copies of the Contract to the Director of Department of Health and Human Services Social Services Branch.

9.                   Approval of the Agreement with County of Del Norte for the Public Guardian Office to provide Lanterman-Petris-Short Act conservator services during fiscal year 2009/2010.

RECOMMENDATION: That the Board of Supervisors approve the Agreement with County of Del Norte for the Humboldt County Public Guardian Office to provide conservator services required under the Lanterman-Petris-Short Act to Del Norte County Mental Health branch during fiscal year 2009/2010; and Authorize the Chairperson to execute four copies of the Agreement; and Direct the Clerk of the Board to route three copies of the executed Agreement to the Director of the Department of Health and Human Services Social Services Branch.

Public Works

10.               Resolution Relinquishment No. 1223 State Route 36 Near Bridgeville PM 23.7 To PM R24.1.

RECOMMENDATION: That the Board of Supervisors adopt the attached resolution approving the relinquishment of a superseded portion of State Route 36 Right - of - Way located in Bridgeville; and Direct the Clerk of the Board to return two certified copies to the Public Works Department for submittal to the California Transportation Commission.

11.               Agreement for Airport Consulting Services with Kimley-Horn Associates to Provide Complete Engineered Designs for New Ramp Areas at Garberville and Rohnerville Airports, and for Automated Weather Observation System at Garberville and Rohnerville Airports.

RECOMMENDATION: That the Board of Supervisors approve the Airport Consulting Services Agreement with Kimley-Horn Associates for engineering and design of the ramp and automated weather observation system for Garberville and Rohnerville Airport; and Delegate Authority to Director of Public Works to sign three copies of the Agreement for Airport Consulting with Kimley-Horn and Associates, for an amount not to exceed One Hundred Forty-Five Thousand, Two Hundred Ninety-Two Dollars ($145,292)

12.               Parks Recycling/Wood Sales Trust Fund Transfer and Supplemental Budget.

RECOMMENDATION: That the Board of Supervisors authorize a transfer of $18,000 from the Parks Recycling/Wood Sales Trust fund; and Approve the following supplemental budget to provide funding for two replacement electrical generators and one tractor: Revenue: 1100713-707700 Parks Recycling $18,000; Expenditures: 1100713-8760 Generators $3,000 and 1100713-8321 Tractor $15,000.

13.               Schools Combined Request for Trans Issuance.

RECOMMENDATION: That the Board of Supervisors authorize the Clerk of the Board of Supervisors to notify in writing the Arcata Elementary School District, Southern Humboldt Joint Unified School District, and Northern Humboldt Union High School District and their bond Attorneys, Orrick, Herrington & Sutcliffe that the Board of Supervisors will not on behalf of the above named districts adopt a resolution authorizing the issuance of Tax and Revenue Anticipation Notes (T.R.A.N.s). T.R.A.N.s funds to be invested through the County Treasurer's office.

Code Enforcement Unit

1.                   Administrative Abatement Hearing: Mary Songer and David Reece Jr. 40500 Hwy 36, Bridgeville, California; AP #210-191-012.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22; Hold an administrative public hearing to determine whether a public nuisance exists on the subject property and adopt Findings and issue and Order consistent with the evidence presented at the hearing.
