Agricultural Commissioner

1.                   Approval of Standard Agreement No. 08-0814, Light Brown Apple Moth Trapping Contract with the California Department of Food and Agriculture in the amount of $1,985.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 08-0814, known as the Light Brown Moth Trapping Contract; and authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department for further processing; and grant a waiver from the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the attached supplemental budget for 2008-2009.

2.                   Approval of Memorandum of Agreement with Redwood National Park to Receive California Department of Food and Agriculture Weed Management Grant Funds from Humboldt County.

RECOMMENDATION: That the Board of Supervisors approve the Memorandum of Agreement between Humboldt County and Redwood National Park; and authorize the Board Chair to sign the Memorandum of Agreement; and direct the Clerk of the Board to return the signed Memorandum of Agreement to the Agriculture Department for further processing.

Board of Supervisors

3.                   Certificate of Commendation for Eagle Scout Ross Kevin Ward. (Supervisor Duffy)

RECOMMENDATION: Ratify the Certificate of Commendation.

4.                   Letter of Support for Humboldt State University's (HSU) Rangeland Resources and Wildland Soils Program. (Supervisor Lovelace and Supervisor Duffy)

RECOMMENDATION: Authorize Chair to sign letter of support.

5.                   Proclaim August 22, 2009 as Bridge Fest Day. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Proclamation.

6.                   Support for Letter Initiated by the Marine Life Protection Act Working Group. (Supervisor Smith & Supervisor Duffy)

RECOMMENDATION: Authorize Chair to sign Marine Life Protection Act Letter as submitted.

County Administrative Office

7.                   CAL-Card Credit Card Program Policy.

RECOMMENDATION: That the Board of Supervisors adopt and direct the County Administrative Office to distribute the attached CAL-Card Credit Card Program Policy.

District Attorney

8.                   Supplemental Budget in District Attorney's Budget Unit 1100 205, in the amount of $73,820 for Fiscal Year 2008-09.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget of $73,820 205 for Fiscal Year 2008-2009.

Elections

9.                   Certification of the May 19, 2009, Special Statewide Election.

RECOMMENDATION: That the Board of Supervisors accepts the certified results of the Official Canvass of the May 19, 2009, Special Statewide Election.

Health and Human Services - Public Health Branch

10.               Accept and Approve Amendment A03 to Master Agreement with California Department of Public Health and Associated Memoranda of Understanding and Approve Fiscal Year 2008-09 Budget Adjustment to Fund 1175, Budget Units 402 AIDS Information and Education and 442 Street Outreach.

RECOMMENDATION: That the Board of Supervisors approve Amendment A03 to Agreement Number 07-65050 with the California Department of Public Health; Authorize the Chair to sign the first page of the original and each of six (6) Standard Agreement Amendment Copies; authorize the Chair to sign three (3) copies of the first page of each Amendment A03 to the HIV Prevention Program MOU; direct the Clerk of the Board to return all Standard Agreement Amendment copies and all copies of amended Memorandum of Understanding to the Public Health Branch, Health Education Division; and approve and direct the Auditor-Controller to adjust Fund 1175, Budget Units 402 AIDS Information and Education and 442 Street Outreach as shown in Attachment 1.

11.               Approve the Agreement with the State Water Resources Control Board of $340,854 in Division of Environmental Health's Local Oversight Program, fund 1175, Budget Unit 432 for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Humboldt County Board of Supervisors to sign the Agreement (including three signature pages) with the State Water Resources Control Board (Agreement 09-012-250) for $340,854 in Environmental Health's Local Oversight Program, fund 1175, Budget Unit 432, for Fiscal Year 2009-2010; and direct the Clerk of the Board to submit the agreement and three signature pages to the Environmental Health Division for submission to the State Water Resources Board for their signatures.

Public Works

12.               Supplemental Budget to Fund Water Management Expenditures through the end of the FY 2008/09.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2008/09:  Revenue: 1100-251-681200 Road Labor - Other County funds Public Works $32,000 and Expenditure: 1100-251-2118 Professional & Special Services $32,000.

13.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 43.28-43.31; Project No. ER-4400(053); Contract No. 206379.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Alderpoint Road; Award the contract to Steelhead Constructors, Inc. in the amount of $142,953; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0236 and transfer $150,101 to the account per the attached appropriation transfer.

14.               First Amendment to License Agreement with Wahlund Construction, Inc.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to execute the First Amendment to License with Wahlund Construction, Inc.; direct the Clerk of the Board to return one executed First Amendment to License to Real Property for transmittal to Licensor; authorize Real Property to send a 30 day notice of termination to Licensor upon notification to Real Property by the Director of Public Works that the office is no longer needed.

15.               Construction of Maple Creek Road (F5L100) Rehabilitation and Overlay PM 1.45 - 3.20; Project No. RPL 5904 (074), Contract No. 202703.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Maple Creek Road (F51100) Rehabilitation and Overlay; award the base bid of the contract to Ford logging Inc. dba Pacific Earthscapes in the amount of $196,225; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200-321-0235 and transfer $206,036 to the account per the attached appropriation transfer.

16.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 7.6-8.1; Project No. ER-4400(038); Contract No. 206369.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract with bids to be opened on Tuesday, July 14, 2009 at 2:00 p.m.

17.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) at PM 0.30 & 0.85, Zenia Bluff Road (F8C090) at PM 2.00; Project No. ER-4400(027) & (075); Contract No. 206274, 206365, and 206412.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications; and upon receipt of construction authorization from the Federal Highway Administration (FHWA); direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, July 14, 2009 at 2:00 PM, or at a subsequent date as recommended by the Department of Public Works and determined by the Clerk of the Board.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Regional Housing Needs Plan Humboldt County.

RECOMMENDATION: That the Board of Supervisors Receive a staff report on the status of the Regional Housing Needs Allocation Plan and the most recent proposed allocation methodology included as Attachment 1; discuss and modify as necessary proposed correspondence to the Humboldt County Association of Governments and State Department of Housing and Community Development included as Attachment 2 and 3 respectively; and authorize the Chair of your Board to sign and send final versions of the letters on the County's behalf.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

F.                  DEPARTMENT REPORTS

County Administrative Office

1.                   Standing Item --- Federal and State Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

District Attorney

2.                   Authorization to Complete and Agreement between the county of Humboldt and the City of Eureka Concerning the Utilization, Maintenance, and Upgrade of their CAD and RMS System.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the attached Utilization Agreement between the County of Humboldt and the City of Eureka; Direct the Clerk of the Board to return the completed documents to the District Attorney's Office for further processing; Approve a supplemental budget in the amount of $94,465 into Budget Unit 1100 205; and Authorize and Instruct the Auditor - Controller to increase the attached fixed asset line item for Fiscal Year 2008-2009.

RECOMMENDATION: Hear report and take action, if required.

1.                   Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel. Negotiator: Personnel Director, Rick Haeg

2.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of Personnel Director pursuant to Government Code sections 54954.5 and 54957.

3.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Personnel Director pursuant to Government Code Sections 54954.5 and 54957.

4.                   Conference with Legal Counsel - Threatened, Potential or Anticipated Litigation pursuant to Government Code section 54956.9, subd.(b)(1), and subd.(b)(3) subpar.(C),(1 case); a written threat of litigation by Humboldt CPR in a letter to the Board of Supervisors dated May 28, 2009.
