RECOMMENDATION: Hear the presentation and take appropriate action, if required.

C.                  SPECIAL PRESENTATIONS

1.                   Management Academy Recognition - First Class of 2009.

RECOMMENDATION: That the Board of Supervisors recognize and execute Certificates of Achievement to the second graduating class of the Humboldt County Management Academy.

2.                   Resolution of Recognition Honoring the Fortuna Rodeo, July 13th - 19th, 2009. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

D.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of Standard Agreement No. 08-0808, Detection Trapping Program Contract with the California Department of Food and Agriculture in the Amount of $28,670.00 and Corresponding Supplemental Budget.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 08-0808, known as the Detection Trapping Contract; authorize the Chair to sign the original Agreement and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department for return to the California Department of Food and Agriculture; grant a waiver from the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the attached supplemental budget for 2008-2009.

Board of Supervisors

2.                   Certificate of Recognition for Frank Jager, Coroner/Public Administrator. (Supervisor Smith)

RECOMMENDATION: Ratify authorization for chair to sign Certificate of Recognition.

3.                   Letter of Support for Area 1 Agency on Aging's 'Aging in Place' Grant. (Supervisor Smith)

RECOMMENDATION: Ratify the Letter of Support.

4.                   Resolution Authorizing Temporary Closure of Avenue of the Giants on October 18th, 2009 for the Humboldt Redwoods Marathon. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

5.                   Appoint Gerald Austin to the Ferndale Fire Protection District to Serve out the Term of Steve Breschini who Resigned in February, 2009. (Supervisor Smith)

RECOMMENDATION: Approve the appointment.

6.                   Letter of Appreciation to Greg Aslanian for Serving on the Workforce Investment Board. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to Sign Letter of Appreciation.

7.                   Letters of Appreciation to Resigning Alcohol and Drug Advisory Board Members Dawn Watkins and Thomas Nash. (Supervisor Clendenen)

RECOMMENDATION: Authorize Chair to sign Letters of Appreciation.

Community Development Services

8.                   Resolution Accepting Program Year 2009-10 Title I WIA Subgrant, Registration Number K074140; Authorizing the Chair of the Board to Sign the Subgrant; and Delegating Signature Authority for Fiscal Documents to the Community Development Services Director and for Administrative Documents to the WIB Executive Director.

RECOMMENDATION: That the Board of Supervisors receive the staff report' adopt the attached Resolution No. ___, accepting Program year 2009-10 Title I Workforce Investment Act (WIA) Subgrant, Registration Number K074140; Authorize and Direct the Chair of the Board to sign the Subgrant Agreement; Authorize and direct the Community Development Services Director to sign fiscal documents, utilizing these funds, such as contracts, after review and approval by County Counsel and Risk Management as per the Separation of Duties Assignment adopted September 27, 2005; authorize and direct the Workforce Investment Board (WIB) Executive Director to sign administrative documents as required by the State of California Employment Development Department, as per the separation of duties assignment adopted on September 27, 2005; and direct the Clerk of the Board to return the signed original SubgrantAgreement (6 copies) to WIB Administrative Secretary for Submission to the State.

County Administrative Office

9.                   Set Public Hearing for Adoption of Fee Updates.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to schedule a public hearing on Tuesday, July 28, 2009, at 1:30 p.m. or as soon thereafter as the matter may be heard, for consideration of adoption of an ordinance updating the Humboldt County Schedule of Fees and Charges; direct the Clerk of the Board to post and publish the required pre-adoption summary of the ordinance and public hearing notice for updating the Humboldt County Schedule of Fees and Charges at least ten (10) days prior to the public hearing; two publications are required, with at least five (5) days intervening between the dates of the first and last publication, not counting such publication dates; Direct the Clerk of the Board to have the data and documentation supporting the new fees for public review at least ten (10) days prior to the public hearing; and direct the Clerk of the Board to post a certified copy of the full text of the proposed ordinance in the office of the Clerk of the Board of Supervisors at least five (5) days prior to the Board meeting at which the ordinance will be adopted [Government Code Section 25124(b)(1)].

Health and Human Services - Public Health Branch

10.               Approve Fifth Amendment to Lease for Public Health Branch for Office Space Located at 317 Second Street, Eureka, California.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair of the Board to execute the fifth Amendment to lease; and direct the Clerk of the Board to return one (1) original executed Fifth Amendment to Lease to Real Property for transmittal to Lessor, and one (1) copy of the executed Fifth Amendment to Lease to the Public Health Branch, Maternal Child Adolescent Health Division.

Probation

11.               Approval of Agreement with California Department of Corrections and Rehabilitation - Division of Juvenile Justice (CDCR-DJJ) for Diagnostic Studies.

RECOMMENDATION: That the Board of Supervisors approve the attached Agreement with California Department of Corrections and Rehabilitation - Division of Juvenile Justice for Diagnostic Studies; and Execute the Attached board of Supervisors Resolution approving the Agreement and; Authorize the Chief Probation Officer to execute the Agreement; and Direct the Clerk of the Board to return the Board of Supervisors Resolution to the Humboldt County Probation Department, Attn: Doris Echeveria.

Public Works

12.               Resolution authorizing the Director of Public Works to Execute a California Office of Traffic Safety Grant Agreement for an Automated GIS -based Traffic Collision Database.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution authorizing the Director of Public Works to execute a Grant Agreement with the California Office of Traffic Safety (OTS) for an Automated GIS-based Traffic Collision Database.

13.               Transportation Security Administration Lease Agreement GS-09B-02308 for Office Space at the Arcata/Eureka Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5's vote grant a waiver of the Nuclear Free Ordinance; Authorize the Chairperson to sign and execute the attached Lease Agreement in triplicate with the Transportation Security Administration (TSA); and direct the Clerk of the Board to return the executed Lease Agreement the Land Use Division for transmittal to Lessee.

14.               Alderpoint Road (F6B165) Overlay between PM 0.10 and 1.0.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 11, 2009 at 2:00 PM.

15.               Fields Landing Boat Ramp Parking and Public Safety Enhancement Project; Contract No. 713600

RECOMMENDATION: That the Board of Supervisors approve the attached plans and specifications; and direct the Clerk of the Board to advertise the above mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 11, 2009, at 2:00 p.m.

County Administrative Office

1.                   Resolution Supporting Local to Local Broadcasting.

RECOMMENDATION: That the Board of Supervisors consider the attached Resolution supporting "local to local" broadcasting.

2.                   Standing Item --- Federal and State Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

Library

3.                   Recognition of Grant made to the Library by the Humboldt Library Foundation.

RECOMMENDATION: That the Board of Supervisors accept and recognize a grant made to the Library by the Humboldt Library Foundation in the amount of $20,000 for the purpose of purchasing new books for the Library's collection.

1.                   Humboldt Bay Municipal Water District Presentation Discussing Ongoing Efforts to Prevent the Quagga and Zebra Mussel Infestation of Local Lakes and Reservoirs. (Supervisor Lovelace and Supervisor Clendenen)

RECOMMENDATION: Hear the report and take appropriate action, if required.

2.                   2007-08 Audit Report

RECOMMENDATION: That the Board of Supervisors receive and file the audit report of Donald R. Reynolds, CPA, regarding the financial statements of the County of Humboldt for the fiscal year ended June 30, 2008.
