A.                  SALUTE TO THE FLAG

1.                   Humboldt Folklife Performance and Resolution of the 31st Annual Humboldt Folklife Festival July 17th -25th, 2009. RECOMMENDATION:  Hear the performance and adopt the Resolution. (Supervisor Cliff Clendenen and Supervisor Duffy)

B.                  SUPPLEMENTAL AGENDA ITEMS

1.                   Approval of the Board Orders - Meeting of July 7, 2009.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders and authorize the Clerk of the Board and the Board Chair to sign then Minute Book in accordance with California Government Code Section 25103.

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim July 19-25, 2009 as Probation, Parole, and Community Supervision Week. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

D.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Letter thanking CalTrans for work completed on Highway 255 near Woodley Island. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter.

2.                   Appoint Angelique Parry to the Humboldt County Status of Women Commission as an At-Large Representative. (Supervisor Neely)

RECOMMENDATION: Approve the appointment of Angelique Parry to the Humboldt County Status of Women Commission.

3.                   Appoint David Heise to the Human Rights Commission as a Representative of District 5. (Supervisor Duffy)

RECOMMENDATION: Approve the appointment of David Heise to the Human Rights Commission.

4.                   Support for the Ducks Unlimited Application to the North American Wetlands Conservation Act for Funding. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign the Partner Contribution Statement.

Community Development Services

5.                   Wilke Joint Timber Management Plan and Guide; File No. APN 222-083-01; Case No.: JTMP-08-03 - Briceland Area.

RECOMMENDATION: That the Board of Supervisors approve the division of the Wilke parcel zoned Timberland Production Zone (TPZ) into two parcels each containing 80 acres for which a Joint Timber Management Plan (JTMP) and Guide have been prepared pursuant to Section 51119.5 of the C.G.C. (Attachment A); direct the Community Development Services - Planning Division to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; direct the Clerk of the Board to give notice of the decision to Ben Wilke, the County Assessor's Office and any other interested party.

County Administrative Office

6.                   Clean Renewable Energy Bonds (CREBs) - Project Applications.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to execute project applications for solar panel installation projects utilizing Clean Renewable Energy Bonds at the following County building locations: Information Technology Office Building, Eureka; County Jail/Courthouse, Eureka; Probation Juvenile Regional Center, Eureka; Agricultural Center Office, Eureka (Humboldt Hill); Public Works Main Office Building, Eureka; Clarke Complex, Eureka; and Animal Shelter, Mckinleyville.

Health and Human Services - Mental Health Branch

7.                   State Department of Mental Health State Hospital Bed Purchase and Usage Agreement.

RECOMMENDATION: That the Board of Supervisors approve the State Hospital Bed Purchase and Usage Agreement with the State Department of Mental Health for fiscal year 2008-2009; authorize the Mental Health Branch Director to sign the attached State Hospital Bed Purchase and Usage Agreement with the State Department of Mental Health; and direct the Clerk of the Board to provide the Department of Health and Human Services, Mental Health Branch with one certified copy of this Board Order.

Health and Human Services - Public Health Branch

8.                   Approval of the Contract with the California Department of Public Health for the Beach Act Monitoring and Notification Program Grant for Environmental Health's Consumer Protection Program, Fund 1175, Budget Unit 406, for the period of October 1, 2009 through September 30, 2010.

RECOMMENDATION: That the Board of Supervisors approve contract 9-11372 between the California Department of Public Health and Humboldt County for the Beach Act Monitoring and Notification Program Grant for the period October 1, 2009 through September 20, 2010 in the amount of $25,000; Authorize the Chairperson to sign three signature pages; and direct the Clerk of the Board to return three signature pages and contract to Environmental Health Division for execution.

Personnel

9.                   Test Use Agreement for Board of Corrections Examinations.

RECOMMENDATION: That the Board of Supervisors authorize the Personnel Director to execute the attached Test Use Agreement for Board of Corrections Examinations with Cooperative Personnel Services.

Public Works

10.               Courthouse Snack Bar Lease.

RECOMMENDATION: That the Board of Supervisors approve by a 4/5 vote of extending the lease to Tamara Wright and Eric Bywater, Lessee, for one year, through September 30, 2010; authorize Real Property to notify Lessee of approval of the extension; and direct the Clerk of the Board to return one executed agenda item to Real Property.

11.               Resolution for Federal Funding Under the American Recovery and Reinvestment Act of 2009-Grants for Transportation Investment Generating Economic Recovery "Tiger" discretionary Grants for Bald Hills.

RECOMMENDATION: That the Board of Supervisors adopt the attached resolution in support of an application for Federal funding for the improvement of Bald Hills Road.

12.               Construction of Bridge over Indian Creek on Mattole Road (FC3C010) at PM 10.0, Agreement No. P0810518, Contract No. 204301.

RECOMMENDATION: Approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, August 11, 2009 at 2:00 PM.

13.               General Agreement on Maintenance of Hiltons Road, Davison Road and Red Park Road by Redwood National and State Parks.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to execute the attached General Agreement Number R8486-08-044 pertaining to Hiltons Road No. 4Q050, Davison Road No. 4R400 and Red Park Road No. 4S100 on behalf of the County in triplicate; and direct the Clerk of the Board to return the executed General Agreements to the Department of Public Works for further processing.

14.               Lucas Street Arra Overlay, Project No. ESPL 5904 (101), Contract No. 210040.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 11, 2009 at 2:00 PM.

15.               Jones Avenue Subdivision, APN 510-191-03, McKinleyville

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete, and accept and approve the subdivision map for filing with the County Recorder, Accept the dedication to the County of Humboldt of Parcel A for public utilities, reject Parcel B for pedestrian purposes, and reject Parcel C as a public road, all as shown on the subdivision map; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; direct the Clerk of the Board to transmit the subdivision map and the Conveyance & Agreement to the County Recorder.

16.               Purchase of Engineered Material Arresting System (EMAS) for the Arcata-Eureka Airport Runway Safety Area, Airport Improvement Program (AIP) grant 03-06-0010-34, Project No. 919216.

RECOMMENDATION: That the Board of Supervisors authorize the Director of Public Works to sign the attached Purchase Requisition and direct the County Purchasing Agent to issue a purchase order for the EMAS blocks to the vendor Engineered Arresting System Corporation (ESCO); authorize the Director of Public Works to sign three original contract documents for the materials and for the technical support of the EMAS Block with ESCO.

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

F.                  DEPARTMENT REPORTS

Community Development Services

1.                   Approval of Amendment to the Headwaters Fund Revolving Loan Fund Loan Lender Agreement with Arcata Economic Development Corporation to Increase the Revolving Loan Fund allocation from $1.5 million to $3 million.

RECOMMENDATION: That the Board of Supervisors receive staff report; review and approve the amendment to the Headwaters Fund Revolving Loan Fund (RLF) lender agreement with the Arcata Economic Development Corporation (AEDC) to increase the RLF allocation from $1.5 million to $3 million; and authorize and direct the Chair of the Board to sign the lender amendment between the County and AEDC.

County Administrative Office

2.                   Standing Item --- Federal and State Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

3.                   Humboldt County Film and Digital Media Commission -Transient Occupancy Tax Management Agreement.

RECOMMENDATION: That the Board of Supervisors approve the attached one-year Management Agreement with the Humboldt County Film and Digital Media Commission, at a 10% reduced funding level for Fiscal Year 2009/2010.

4.                   Discussion of Clean Water Restoration Act (S. 787) Amending the Federal Water Pollution Control Act.

RECOMMENDATION: That the Board of Supervisors deliberate and take appropriate action.

5.                   Resolution Declaring a Local Water Emergency - Redway Community Services District.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution declaring that a Local Water Emergency exists in the Community of Redway.

1.                   Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel. Negotiator: Personnel Director, Rick Haeg.

1.                   Hainaut General Plan Petition; File No.: APN 211-302-19, Case No.: Gpp-08-03 Fruitland Area.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comment; based on the findings in the staff report and testimony received about the project, accept the Petition by approving the attached resolution; and direct the Clerk of the Board to give notice of the decision to the applicant, the Assessor's Office and any other interested party.

2.                   Mahoney Zone Reclassification/Final Map Subdivision/Lot Line Adjustment Application File Nos.: APN 216-102-02 et al. Case No.: ZR-05-10/FMS-05-09/LLA-04-16 Rancho Palo Verde Area.

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. _____ by title and waive further reading; open the public hearing and receive and consider the staff report and public testimony; adopt Resolution No. _____ adopting the Mitigated Negative Declaration as required by Section 15074(b) of the California Environmental Quality Act (CEQA) Guidelines and making the required findings for approving the proposed Zone Reclassification, Final Map Subdivision (FMS) and Lot Line Adjustment (LLA) application based on the submitted evidence; approve the Zone Reclassification and adopt Ordinance No. ____, amending Section 311-7 of the Humboldt County Code by reclassifying an approximate 450 acres of land currently zoned Agriculture Exclusive into Agricultural General with a Special Building Site Combining Zone specifying a 60- acre minimum; direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor's Office and any other interested party; direct the Clerk of the Board to publish the Post-Adoption Summary of Ordinance within 15 days after passage by the Board; direct the Community Development Services - Planning Division to file a Notice of Determination pursuant to CEQA.
