3.                   Proclamation Congratulating the American Civil Liberties Union of Northern California on their 75th Anniversary and Proclaiming September 21, 2009 as a day to recognize the important work of the organization. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

Agricultural Commissioner

1.                   Approval of Standard Agreement No. 09-0222, Known as the Asian Gypsy Moth Trapping Program Contract in the Amount of $7,000.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-0222, known as the Asian Gypsy Moth Trapping Program Contract with the California Department of Food and Agriculture; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department for further processing; and grant a waiver from the provisions of the Nuclear Free Ordinance.

2.                   Approval of Standard Agreement No. 09-0020, County Petroleum Products Compliance and Weighmaster Enforcement Programs Contract in the Amount of $6,825.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-0020, known as the County Petroleum Products Compliance and Weighmaster Enforcement Program Contract with the California Department of Food and Agriculture; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department for further processing, and grant a waiver from the provisions of the Nuclear Free Ordinance.

3.                   Petrolia Fire Protection District Review Schedule.

RECOMMENDATION: That the Board of Supervisors unanimously approve the policy that the Petrolia Fire Protection District shall replace their five-year audit cycle with annual financial reviews in accordance with California Government Code 26909(c)(1).

4.                   Continuation of Emergency - Redway Community Services District Local Water Emergency. (Supervisor Smith)

RECOMMENDATION: Declare that a local state of emergency, Per Resolution #09-48, remains in effect until September 1, 2009.

5.                   Letter of Appreciation to Marilyn Nemetz for Serving on the Humboldt County Alcohol and Drug Advisory Board. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

6.                   Certificate of Achievement for Eldon Kinney for Achieving the Rank of Eagle Scout. (Supervisor Duffy)

RECOMMENDATION: Ratify the Certificate of Achievement.

Community Development Services

7.                   Temporary Increase in Compensation for Senior Planner Pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Senior Planner, Martha Spencer, as if promoted to the class of Supervising Planner, effective August 23, 2009, and continuing until February 20, 2010 pursuant to Section 7 of the Humboldt County Salary Resolution. County Administrative Office

8.                   Professional Services Agreement with NCO Financial Systems, Inc. for Debt Collection Services.

RECOMMENDATION: That the Board of Supervisors, by a 4/5 vote, authorize the Chair of the Board to execute two copies of the attached Professional Services Agreement between NCO Financial Systems, Inc. and the County of Humboldt.

9.                   Supplemental Budget for Revenue Recovery (1100-114) in FY 2008-2009.

RECOMMENDATION: That the Board of Supervisors approve and direct the Auditor-Controller to supplement the budget for Fiscal Year (FY) 2008-2009 as follows: Revenue: 1100-114-615102 PC 1463.007 Offset Collection Costs $30,000; Expenditure:  1100-114-2118 Professional & Special Services $30,000.

10.               Supplemental Budget for Revenue Recovery (1100-114) in FY 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for Fiscal Year (FY) 2009-2010 in the amount of $14,000.00.

Health and Human Services - Mental Health Branch

11.               Amendments to the Humboldt County Medi-Cal Managed Health Care Adult Services Contracts with Humboldt Family Service Center, Remi Vista, Inc., Crestwood Behavioral Health, Inc.- Bridgehouse, Merced Behavioral Care Center, 7th Avenue Center and Crestwood Behavioral Health, Inc. - Mental Health Rehabilitation Center (MHRC).

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the attached Amendments to the Humboldt County Medi-Cal Managed Mental Health Care Adult Services Contracts and direct the Clerk of the Board to return two signed originals of each Amendment to Mental Health Branch Administration.

Health and Human Services - Public Health Branch

12.               Set the Date for Public Hearing on Proposed Reduction/Elimination in Health Services at Willow Creek.

RECOMMENDATION: That the Board of Supervisors set a public hearing on September 22, 2009 at 1:30 or soon thereafter; direct the Clerk of the Board to publish the Notice of Public Hearing in a newspaper of general circulation once at least 14 days before the public hearing; direct the Health and Human Services, Public Health Branch staff to post Notice of Public Hearing at the entrance to all County health care facilities at least 14 days prior to the public hearing.

13.               Approve and Authorize the Memorandum of Understanding between the Public Health Branch and Catherine L. Zane Middle School for a Student Health and Nutrition Project During the 2009-10 School Year.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chairperson to execute the Memorandum of Understanding between the Public Health Branch and Catherine L. Zane Middle School to begin on October 1, 2009 through September 30, 2010; and direct the Clerk of the Board to return one executed original to the Public Health Branch for distribution.

14.               Accept a $158,700 Grant with the California Office of Traffic Safety for the Youth Driving Safety Program - Drive 2 Stay Alive and Approve Supplemental Budget in Budget Unit 414.

RECOMMENDATION: That the Board of Supervisors accept a grant in the amount of $158,700 from the California Office of Traffic Safety for the continuation of the Youth Driving Safety Program - Drive 2 Stay Alive for the period of October 1, 2009 - September 30, 2010; authorize the Chair of the Board to sign two (2) copies of the attached California Office of Traffic Safety Grant Agreement, Project Number AL1050 (Attachment 1 - Grant Agreement Page 1 and OTS - 33 Form Page 3), and return both of the signed copies of the agreement to the Public Health Branch for submittal to the State and direct Auditor-Controller to supplement Budget Unit 414 as follows: Revenue Line Item 1175-414-631-002 Youth Driving Safety Program $79,350: Expenditure Line Item 1175-414-2501 Youth Driving Safety Program $79,350.

Health and Human Services - Social Services Branch

15.               Approval of Third Party Access to the California Department of Child Support Services Child Support Enforcement.

RECOMMENDATION: That the Board of Supervisors approve Third Party Access to the California Department of Child Support Services Child Support Enforcement; and authorize the Director of the Department of Health and Human Services Social Services Branch to sign three (3) copies of the Memorandum of Agreement.

Library Services

16.               Recognition of Donations made to the Library and Supplemental Budget in Fund 1500, Budget Unit 621, County Library (Fiscal Year 2009-2010).

RECOMMENDATION: That the Board of Supervisors accept and recognize donations made to the Library in the amount of $18,139.19 in the form of a media display tower and for the purpose of supporting the library's Summer Reading Club programs, purchasing and processing materials for the Library's collection supporting the construction of a new Trinidad Branch Library, and maintaining expanded open hours at the Fortuna Branch Library; accept and recognize the donation of two paintings to the Library from Janie Clarke Walsh; accept and recognize donated services and supplies to the Library in the form of media display holders for the Eureka Library and related to painting a room in the Rio Dell Library and supporting the Library's Summer Reading Club programs; and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2009-2010 and authorize the Auditor - Controller to supplement the budget as shown in Attachment 2.

17.               Revised Class Description for Airport Groundskeeper.

RECOMMENDATION: That the Board of Supervisors approve the revised class description for Airport Groundskeeper.

18.               Amendment to Compensation Plans for Management and Confidential Employees and Elected and Appointed officials for Fiscal Years 2008-2009, 2009-2010, and 2010-2011.

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. ____ approving the Amendment to the Compensation Plans for Management and Confidential Employees and Elected and Appointed Officials for fiscal years 2008-2009, 2009-2010, and 2010-2011; and approve the revised class description and job title for Administrative Support Manager to the Board of Supervisors/Clerk of the Board (salary range 426, class 0102).

Public Works

19.               Supplemental Budget for a GIS-based Automated Traffic Collision Database.

RECOMMENDATION: That the Board of Supervisors adopts the following supplemental budget for FY 2009/10:  Revenue: 1200321-523214 CA OTS Grant $30,000; Expenditure:  1200321-8646 Traffic Collision Database $30,000.

 

 

 

 

 

20.               Budget Adjustment and Supplemental Budget to Fund Facility Management Expenditures to the end of FY 2008/09.

RECOMMENDATION: That the Board of Supervisors approves the attached Appropriation Transfer and adopts the following supplemental budget for FY 2008/09: Revenue: 1100162-621020 Services for Other Agencies $19,900; Expenditure: 1100162-2118 Professional & Special Services $9,500 1100162-2123 Special Departmental Expense $1,800 100162-2125 Transportation & Travel $8,600.

21.               Memorandums of Agreement with Federal Aviation Administration for Navigational and Communication Aids Located at Arcata/Eureka Airport, Garberville Airport, Murray Field Airport and Rohnerville Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5 vote authorize the Chairperson to sign and execute the attached Memorandum of Agreement with the Federal Aviation Administration for Arcata/Eureka Airport, Garberville Airport, Murray Field Airport and Rohnerville Airport in duplicate.

22.               Construction of Storm Damage Repair on Old Briceland Road (6B005) at PM 2.90 & 5.86; Project No. FEMA No.: PW 1449 & PW 1696; Contract No.: 206280 & 206341.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Old Briceland Road at PM 2.90 &5.86; award the Contract to GR Wilcox, Inc. in the amount of $70,055.91; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0244 and transfer $77,056 to the account per the attached appropriation transfer.

23.               Construction of Storm Damage Repairs on Bell Springs Road (8A010) at PM 0.0, 1.88 - 2.00; Project No. FEMA CA PW 2018 & PW 533; Contract No. 206282 & 206283.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Bell Springs Road at PM 0.00 & 1.88 - 2.00; award the contract to C & Z Timber Co., Inc. in the amount of $142,603.90; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0242 and transfer $156,864 to the account per the attached appropriation transfer.

24.               Construction of Storm Damage Repairs on Alder point Rd (F6B165) at PM 1.90 $2.0; Project No. ER-4400(035) & (036); Contract No. 206366 & 206367.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Alderpoint Road at PM 1.90 & 2.0; Award the contract to GR Wilcox, Inc. in the amount of $119,957; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0243 and transfer $131,953 to the account per the attached appropriation transfer.

25.               Supplemental Budget to Fund Parks Expenditures through the end of FY 2008/09.

RECOMMENDATION: That the Board of Supervisors adopt the following Supplemental Budget for FY 2008/09:

Revenue: 1100713-661010 County Parks Income $8,142: 1100713-681200 Road Labor - Other County Funds - Public Works $958; 1100713-705000 Transfer from Park Trust $6,700:  Expenditure: 1100713-2125 Transportation & Travel $13,421; 1100713-2112 Maintenance - Equipment $996; 1100713-3928 Expense Transfers $1,383.

26.               Terrace Estates Subdivision (JLF Construction) APN 510-111-56, McKinleyville.

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete and approve and accept the subdivision map for filing with the County Recorder accept the dedications to the County of Humboldt of Sandstone Street, Bluestone Street and Cobblestone Street for public utilities, Parcels U1, U2, U3, U4, for public utilities and the public utilities easement over the entirety of Parcels P2, P3, P12, P16, P21, L2, L3, L10, L16, S4, & S5; Parcels PED-1, PED-2, PED-3, and PED-4 for pedestrian purposes, all as shown on the subdivision map; authorize the Chair to execute the Conveyance and Agreement; authorize the Chair to enter in to the attached Final Map Subdivision Agreement, in triplicate, for subdivision improvements; authorize the Director of Public Works or his designee to release the agreement securities to the subdivider upon satisfaction of the requirements of the Final Map Subdivision Agreement; and direct the Clerk of the Board to transmit 2 originals of the executed Final Map Subdivision agreement to the Land Use Division for further processing.

Sheriff

27.               Establish Fixed Asset Account and Supplemental Budget in Sheriff's Budget 1100-243.

RECOMMENDATION: That the Board of Supervisors authorize the Auditor-Controller to establish a Fixed Asset Account 1100-243-8-019, Van - Jail Security Transport in the amount of $4,400; and approve attached Supplemental Budget in Sheriff's Budget 1100 243 to outfit the jail transport van with security partitions, window guards and property storage.

28.               Federal Annual Certification Report

RECOMMENDATION: That the Board of Supervisors authorize the Chair and the Sheriff to sign the Federal Annual Certification Report and instruct the Clerk of the Board to return the signed document to the Sheriff's Office for further processing.

29.               Firewood Distribution Agreement between the county of Humboldt and the Humboldt Senior Resource Center.

RECOMMENDATION: That the Board of Supervisors authorize Sheriff Gary Philp to sign the Senior Wood Agreement between the County of Humboldt and the Humboldt Senior resource Center outlining this year's firewood distribution process for low to moderate income senior citizens of the County.

RECOMMENDATION: Hear report and take action as appropriate.

F.                  DEPARTMENT REPORTS

Community Development Services

1.                   Approval of the Headwaters Fund Board's Grant Award of $50,000 to the Mid Klamath Watershed Council to Purchase the Panamnik Building.

RECOMMENDATION: That the Board of Supervisors review and approve the Headwaters Fund Board's recommended Community Investment Fund (CIF) grant of $50m000 to support the Mid Klamath Watershed Council (MKWC)'s Panamnik Building Project; and authorize the Chair of the Board to sign the grant contract when completed, after review and approval by County Counsel and Risk Management.

County Administrative Office

2.                   Standing Item --- State and Federal Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

3.                   Responses to 2008-09 Grand Jury Reports 2009-PW-02.

RECOMMENDATION: That the Board of Supervisors review and modify the 2008-09 Grand Jury draft responses from departments under the appointment authority of the Board of Supervisors; approve the documents as may be modified, as the response; direct the Clerk of the board, within five working days, to submit the final responses with an accompanying Board order, to the Presiding Judge of the Superior Court; and direct the Clerk of the Board, within five working days, to submit two copies of all responses to the County Clerk/Recorder, one of which will be forwarded to the State Archivist, together with a copy of the original report.

Library

4.                   Recognition of Donations made to the Library by the Friends of the Redwood Libraries and Supplemental Budget in Fund 1500, Budget Unit 621, County Library (Fiscal year 2009-2010).

RECOMMENDATION: That the Board of Supervisors accept and recognize donations made to the Library by the Friends of the Redwood Libraries in the amount of $24,480.04 in the form of a book truck and for the purpose of purchasing, processing and leasing materials for the Library's collection and repairing existing library materials; adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2009-2010 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 2.

RECOMMENDATION: Open the public hearing, receive a staff report and supplemental materials, including responses to items requested by the Board, and continue the item to a Special Meeting on Friday, August 21, 2009.
