B.                  SUPPLEMENTAL AGENDA ITEM

1.                   Ordinance Amending Section 521-9(a) of the Humboldt County Code Relating to Solid Waste Franchises. (Departmental - Public Works)

RECOMMENDATION: That the Board of Supervisors introduce the attached Ordinance by title, waive the first reading thereof, and schedule the Ordinance for adoption on September 22, 2009; and direct staff to post and publish in a newspaper of general circulation in Humboldt County, a summary of the ordinance at least 5 days before the date set for adoption and again 15 days after passage of the Ordinance.

2.                   Request that the Board of Supervisors Support and Affirm Implementation of the General Relief Vendor Program and Delegate to the Social Services Branch Director and Authority to sign General Relief Vendor Contracts.

RECOMMENDATION: That the Board of Supervisors support and affirm implementation of the General Relief Vendor Program; and delegate to the Director of the Social Services branch the authority to sign General Relief Vendor Contracts with retailers wishing to participate in the General Relief Vendor Program.


C.                  SPECIAL PRESENTATIONS

1.                   Proclaim September, 2009 as National Local Food Month in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

D.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of United States Department of Agriculture Wildlife Agreement No. 09-73-06-0254-RA.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-73-06-0254-RA; and authorize the Chair to sign all three (3) copies of the agreement, and return all three signed copies to the Agriculture Department for further processing; and grant a waiver of the Nuclear Free Ordinance.

2.                   Approval of Standard Agreement No. 09-0306, Nursery Inspection and Enforcement Program Contract in the Amount of $2071.00 and Corresponding Supplemental Budget for 2009-10.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-0306, Known as the Nursery Inspection and Enforcement Program Contract with the California Department of Food and Agriculture in the amount of $2071.00, and authorize the Chair to sign the original and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department for further processing; and grant a waiver from the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the attached supplemental budget for 2009-10.

3.                   Approval of Standard Agreement No. 09-0172, Humboldt Weed management Group Project Contract in the amount of $7,999.20 and Corresponding Supplemental Budget for 2009-10.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-0172, known as the Humboldt Weed Management Group Meadow Knapweed Control Project contract with the California Department of Food and Agricultural and authorize the Chair to sign the original agreement and one copy of the cover page as well as further processing; and grant a waiver from the provisions of the Nuclear Free Ordinance, and authorize the Auditor - Controller to execute the attached supplemental budget for 2009-10.

Board of Supervisors

4.                   Certificate of Commendation for Eagle Scout Michael Davenport, Jr. (Supervisor Smith)

RECOMMENDATION: Ratify the Certificate of Commendation.

5.                   Reappoint Larry Miller to the Humboldt County Human Rights Commission. (Supervisor Clendenen)

RECOMMENDATION: Reappoint Larry Miller to the Humboldt County Human Rights Commission with term expiring on June 30, 2013.


County Administrative Office

6.                   Supplemental Budget for Communications (FY 2008-09).

RECOMMENDATION: That the Board of Supervisors approve the following supplemental budget for Fiscal Year 2008-09:  Revenue – 3521-151-707140 – Transfer – Communications Trust $40,000; Expenditure – 3521-151-2112 – Maintenance - Equipment - $40,000.

District Attorney

7.                   Allocation of Victim Witness Specialist and Disallocation of Office Assistant I/II in Budget Unit 220.

RECOMMENDATION: That the Board of Supervisors approve the disallocation of Office Assistant I/II (Salary Range 231/262, Class 0180, Position 01) in budget unit 220; and Approve the allocation of one part-time (0.8 FTE) Victim Witness Specialist (Salary Range 320, Class 0689), in budget unit 220 effective upon approval.

Health and Human Services - Mental Health Branch

8.                   Disallocate one (1) vacant Activity Therapist Position, one (1) vacant Mental Health Case Manager I/II Position and one (1) vacant Senior Substance Counselor Position; and Allocate Three (3) Full-Time Program Coordinator Positions in Budget Unit 424.

RECOMMENDATION: That the Board of Supervisors disallocate one vacant activity therapist (salary range 337, class 0939, position #003); and disallocate one vacant Mental Health Case Manager I/II (salary range 330/358, class 0907 A/B, Position # 001); and disallocate one vacant Senior Substance Abuse Counselor position (salary range 349, class 0492, position # 001); and allocate three full-time Program Coordinator positions in budget unit 424 (salary range 395, class 1425) effective immediately.

Public Works

9.                   Arcata - Eureka Airport (ACV) Passenger Terminal Expansion and Renovation; AIP 03-06-0010-30, Project 912370.

RECOMMENDATION: That the Board of Supervisors authorize the Public Works Director to sign Change Order No. 6.0 for a $22,527 cost credit and for 74 additional calendar days to the current contract completion date.  The net effect of the additional calendar days will result in an adjusted contract completion date of December 23, 2008.

10.               Supplemental Budget to Fund Parks Expenditures throught the End of the FY 2008/09.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2008/09: REVENUE: 1100713-661010 County Parks Income $8,142; 1100713-681200 Road Labor-Other County Funds-Public Works $958.; 1100713-705000 Transfer from Park Trust $4,966; 1100713-705701 Transfer from Parkland Dedication Trust $2,734; Total $16,800.:  EXPENDITURE: 1100713-2125 Transportation & Travel  $13,421; 1100713-2112 Maintenance-Equipment $1,996; 1100713-3928 Expense Transfers $1,383; Total $16,800.

11.               Transfer from Road Fund Contingencies to Purchase a Computer Server for the Public Works Department (4/5 vote required).

RECOMMENDATION: That the Board of Supervisors approve the attached fund transfer in the amount of $5,000 from the Road Fund Contingencies to support the purchase of a Computer Server for the Public Works Department.

12.               Supplemental Budget to Fund Remaining Water Truck Expenses for FY 2009/10.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2009/10:  REVENUE: 3540330-682839 Depreciation Reserve $68,600; EXPENDITURE: 3540330-8771 Vehicle - Truck $68,600.

13.               Appropriation Transfer to Cover Overdrafts for FY 2008/09.

RECOMMENDATION: That the Board of Supervisors, for the purpose of closing the FY 08/09 budget, approve the attached appropriation transfer for $34,200 from the Land Use Budget (1100166) to the Solid Waste Budget (1100438).

14.               Courthouse Emergency Generator and Information Technology HVAC System Projects.

RECOMMENDATION: That the Board of Supervisors adopt the following supplemental budget for FY 2009/10: REVENUE: 1100170-706131 Transfer from Deferred Maintenance $194,985: EXPENDITURE: 1100170-8846 Courthouse Emergency Generator  $161,000; 1100170-8428 Information Technology HVAC System (Heating, Ventilation and Air-conditioning) $33,985.

15.               Construction of Storm Damage Repairs on Mattole Road (F3C010) at PM 23.70; Project No. ER-4400(065); Contract No. 206399.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, September 15, 2009 at 2:00 PM.

16.               Harris Street Arra Overlay (3K320) (from Harrison to Hall), Project No.: ESPL-5904 (098)), Contract No.: 210030.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications, and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, September 15, 2009 at 2:00 PM.

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of Director of Health and Human Services pursuant to Government Code section 54954.5.

Community Development Services

1.                   CDBG Enterprise Fund Application for Micro-Enterprise Technical Assistance

RECOMMENDATION: That the Board of Supervisors receive staff report; open the public hearing and receive public testimony; close the public hearing; adopt Resolution No. 09-    authorizing the submission of a $300,000 application for the 2009/2010 Community Development Block Grant (CDBG) Economic Development Enterprise Fund for Micro-Enterprise  Technical Assistance; and delegate signature authority to the Community Development Services Director for grant paperwork, and any contracts or subrecipient agreements to implement the grant after review and approval by County Counsel and Risk Management.

2.                   Continued Public Hearing on the Adoption of the 2009 Update of the Housing Element of the County's General Plan.  CONTINUED FROM AUGUST 21, 2009.

RECOMMENDATION: 1.  Open the pubic hearing.

2.  Receive a staff report and supplemental materials.

3.  Approve the EIR Findings of Fact, approve the EIR Statement of Overriding Considerations, certify the EIR by approving Resolution of Approval #1 (This Resolution and Resolution of Approval #2 for Recommendation #5 below are under review by County Counsel, and will be delivered to the Board prior to the August 25, 2009 meeting).

4.  Vote on the balance of the policies, standards and implementation measures. 

5.  Approve, as modified by the above votes, the Planning Commission recommended Housing Element by adopting Resolution of Approval #2.
