A.                  SALUTE TO THE FLAG

B.                  SUPPLEMENTAL AGENDA ITEM

1.                   Arcata-Eureka Airport (ACV) Passenger Terminal Expansion and Renovation: AIP 03-06-0010-30, Project 913270. (CONSENT)

RECOMMENDATION: That the Board of Supervisors accept the work of the general contractor, Mayan Construction, as substantially complete for their portion of the above - mentioned Project and authorize the Public Works Director to file the Notice of Completion of the above - mentioned general contractor for their portion of the project as required.

2.                   Participation in Voluntary Benefits Program and Section 125 Reimbursement Accounts with the Farmington Company.

RECOMMENDATION: That the Board of Supervisors authorize the participation in the Voluntary Benefits Program with the Farmington Company, effective September 1, 2009, authorize Risk Manager to coordinate the program and execute the agreement with the Farmington Company, and authorize the County to pay the administrative fee for the participating employees.

C.                  SPECIAL PRESENTATIONS

1.                   Resolution honoring Harry Handley, Jr. on his retirement. (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

2.                   Proclaim September 6 - 13, 2009 as Childhood Cancer Awareness Week. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

D.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Continuation of Emergency - Redway Community Services District Local Water Emergency. (Supervisor Smith)

RECOMMENDATION: Declare that a local state of emergency, Per Resolution #09-48, remains in effect until September 15, 2009.

2.                   Proclaim September 17 - 23, 2009 as Constitution Week. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

3.                   Letters of Support for Planned Installation of Middle and Last-Mile Broadband Telecommunications under the Broadband Technologies Opportunities Program (BTOP) for Humboldt, Del Norte and Trinity Counties. (Supervisor Neely and Supervisor Lovelace)

RECOMMENDATION: Ratify authorization for Chair to sign letters of support.

County Administrative Office

Library Services

4.                   Grant Award from the California State Library for Public Library Staff Education Program and Supplemental Budget (Fiscal Year 2009-2010).

RECOMMENDATION: Approve the attached Grant Award from the California State Library for the Public Library Staff Education Program, Authorize Victor Zazueta, Director of Library Services, to sign one (1) copy each of the attached Grant Award Certifications and Certifications Regarding Lobbying; Debarment, Suspension and Other Responsibility Matter; and Drug-Free Workplace Requirements, authorize Michael Giacone, Auditor-Controller, or his designee to sign one (1 copy of the attached Financial Claim and send said signed original Financial Claim to the County Library for submission to the California State Library, and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2009-2010 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 1.

Personnel

5.                   Renewal of Test Use Agreement with Cooperative Personnel Services.

RECOMMENDATION: That the Board of Supervisors authorize the Personnel Director to execute the attached Test Use Agreement with Cooperative Personnel Services.

Public Works

6.                   Humboldt County Correctional Facility Boiler Repair Project.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for the project mentioned above, award the project to the lowest responsible and responsive bidder, Niekrasz Plumbing, Inc. Eureka, California, in the amount of $63,000.00 for the base bid, authorize the Chairman to execute the agreement when staff approves the bonds and insurance, and adopt the following supplemental budget to provide funding: Revenue: 1100170-706031 Transfer from Deferred Maintenance, $80,000; Expenditure 1100170-8838 Boiler, $80,000.

7.                   Bridge over Indian Creek on Mattole Road (F3C010) AT PM 10.0: Project No. P0810518; Contract No. 204301.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for construction of bridge over Indian Creek on Mattole Road (F3C010) at PM 10.0, award the contract to G.R. Sundberg, Inc. in the amount of $587,615,00.00, authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance, and direct the Auditor-Controller to establish a new contract account 1200321-0246 and transfer $646,376.00 to the account per the attached appropriation transfer.

8.                   Lucas Street American Recovery & Reinvestment Act of 2009 (ARRA) Overlay, Project No. ESPL 5904 (101), Contract No. 210040.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for construction of Lucas Street ARRA Overlay Project, award the contract to Mercer-Fraser Company including the base bid and both additive options for the total amount of $169,260.00, authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance, and direct the Auditor-Controller to establish a new contract account 1200321-0245 and transfer $186,186.00 to the account per the attached appropriation transfer.

9.                   Alderpoint Road (F6B165) Overlay Between PM 0.1 and 1.0; Contract No. 202704.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for construction of overlay on Alderpoint Road (F6B165) between PM 0.1 and 1.0, award the contract to Granite Construction Company in the amount of $296,814.50, authorize Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance, and direct the Auditor-Controller to establish a new contract account 1200321-0247 and transfer $326,496.00 to the account per the attached appropriation transfer.

10.               Fieldslanding Boat Ramp Parking and Public Safety Enhancement Project; Project No. WC-7004TC, Contract No. 713600.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for construction of Fieldslanding Boat Ramp Parking and Safety Enhancement Project, award the contract to Mercer-Fraser Company in the amount of $249,115.00, and authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance.

1.                   Presentation of Regional Energy Efficiency Grant Opportunities. (Supervisor Smith)

RECOMMENDATION: Hear the presentation and consider appropriate action.

1.                   Standing Item --- State and Federal Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

1.                   2010 Legislative Advocacy Update and 2010 Legislative Platform Kickoff.

RECOMMENDATION: That the Board of Supervisors receive report from State legislative advocate Don Peterson, and take action as may be appropriate.

H.                  CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for Jim Kucharek, Child Support Services Director pursuant to Government Code section 54954.5.

2.                   Conference with Legal Counsel - Existing Litigation pursuant to Government Code section 54956.9(a), RDHC; LLC; Ocean View Ranches, et al v. County of Humboldt et. al, Humboldt County Superior Court, Case No. CV090564.
