B.                  SUPPLEMENTAL AGENDA ITEM

1.                   Agreement between First 5 Humboldt and Public Health Branch, Family Violence Prevention Program, Budget Unit 1175-488, for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the Agreement between First 5 Humboldt and the Public Health Branch; authorize the Chair to sign three copies of the Amendment; and direct the Clerk of the Board to return the three signed copies of the Amendment to the Public Health Branch.

2.                   Arcata-Eureka Airport Runway Safety Area, Project No. 919216  (PUBLIC WORKS - CONSENT)

RECOMMENDATION: That the Board of Supervisors receive and file the bids for the project mentioned above; award the project to the lowest responsible and responsive bidder, Mercer-Fraser Company, Eureka, California, in the amount of $3,855,698.25 for the base bid and accept the bid Alternate for $391,875.00, for the grand total of $4,247,573.25.  The award is conditioned upon the FAA approving the corresponding grant funds identified in recommendation 4; authorize the Chairman to execute the agreement with Mercer-Fraser Company when staff approves the bonds and insurance and the FAA approves the subject grant funds; and authorize the Director of Public Works to sign Grant offer AIP 03-06-0010-35 Part B for $2,369,274 to provide additional funding for the Runway Safety Area (RSA) Project when offered by the Federal Aviation Administration.

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim the Week of September 6 - 12, 2009 as Suicide Prevention Week. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

D.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of New Memorandum of Understanding with the Humboldt Weed Management Area.

RECOMMENDATION: That the Board of Supervisors approve the Memorandum of Understanding with the Humboldt Weed Management Area; and authorize the Board Chair to sign two copies of the Memorandum of Understanding signature; and direct the Clerk of the Board to return the signed Memorandum of Understanding pages to the Agriculture Department for submittal to the Humboldt Weed Management Area.

Auditor-Controller

2.                   Payroll Clearing Appropriation Transfer for Fiscal Year 2008-2009.

RECOMMENDATION: Approve the attached appropriation transfer FOR $1,296,854, and authorize the Auditor-Controller to make minor budget adjustments as needed to provide sufficient appropriations to cover actual expenditures for fiscal year 2008-2009.

County Administrative Office

3.                   Humboldt County Convention and Visitors Bureau Transient Occupancy Tax - Management Agreement.

RECOMMENDATION: That the Board of Supervisors approve the attached one-year management agreement with the Humboldt County Convention and Visitors Bureau, at a 10% reduced funding level for Fiscal Year 2009-2010.

District Attorney

4.                   Allocate One Full-Time Deputy District Attorney I/II/III/IV in Fund 1100, Budget Unit, District Attorney.

RECOMMENDATION: That the Board of Supervisors allocate 1.0 FTE full-time Deputy District Attorney I/II/III/IV (salary range 398/433/464/497, Class 602) in fund 1100, budget unit 205, effective immediately.

Health and Human Services - Administration

5.                   Department of Health and Human Services Request for Proposals for Provision of Security Guard Services and for the Provision of Transportation Services.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Department of Health and Human Services (DHHS) to release two Requests for Proposals (RFP) : one for the Provision of Security Guard Services and another for the provision of Transportation Services for DHHS Clients and patients; Direct the County Purchasing Department, with support from DHHS, to post the Request for Proposals and any responses to questions about the RFPs, on the County website and to disseminate the RFP using other methods as necessary; authorize DHHS to respond to written inquiries from potential Offerors regarding the RFP; and direct the DHHS staff to return to the Board of Supervisors with a recommendation for award of two contracts.

Public Works

6.                   Assignment of Charles Schoonmaker, Road Maintenance Worker III as Road Maintenance Supervisor.

RECOMMENDATION: That the Board of Supervisors authorize compensation for Charles Schoonmaker as if he had been promoted to the classification of Road Maintenance Supervisor from September 13, 2009 through October 31, 2009, or until such time as a new Road Maintenance Supervisors is appointed, pursuant to Section 7 of the Humboldt County Salary Resolution.

7.                   Construction of Storm Damage Repairs on Benbow Drive at PM 0.95; Project No. FEMA CA DR 1628 PW-1595 Contract No. 206268.

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between Leonardo Logging and Construction, Contractor, and Humboldt County for the storm damage repairs on Benbow Drive; approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $12,991.  This will bring the total amount paid to 100% of the contract; and approve the attached Appropriation Transfer to provide for payment.

8.                   Mahoney Final Map Subdivision, APN 216-102-02 Rancho Palo Verde Area (Southern Humboldt County).

RECOMMENDATION: That the Board of Supervisors declare the subdivision as complete, and accept and approve the subdivision map for filing with the County Recorder, Accept the dedication to the county of Humboldt parcel C for public road purposes; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; and direct the Clerk of the Board to transmit the subdivision map and the Conveyance and Agreement to the County Recorder.

9.                   Supplemental Budget to Fund Projects under the Federal Highway Administration American Recovery and Reinvestment Act (ARRA) of 2009: Airport Road, Project No. ESPL-5904 (097), Contact No. 210010; Bald Hills Road, Project No. ESPL-5907 (105), Contract No. 210020; Harris Street, Project No. ESPL-5904 (098), Contract No. 210030; Lucas Street, Contract No. ESPL-5904 (101), Contract No. 210040.

RECOMMENDATION: That the Board of Supervisors adopt the following Supplemental Budget: Revenue: 1200321-525710 - American Recovery & Reinvestment Act Funds $2,080,000; Expenditure: 1200321-2118 Professional & Special Services $2,080,000.

10.               DHHS, Mental Health Branch HVAC System Repair Project; Project No. 170114.

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications; and authorize the Clerk of the Board to advertise the above-mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, October 13, 2009 at 2:00 PM.

Treasurer-Tax Collector

11.               Resolution authorizing Final 415 Regulations Mandatory Compliance Amendment to the Humboldt County 401 (a) Plan.

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. _______. Final Code 415 of Internal Revenue Services Regulations into the County's 401 (a) Plan.  This authorizes the Chair of the Board of Supervisors to sign the plan amendment and file with the Treasure Tax Collector as Plan Administrator.

1.                   Consider the Appointment of a Subcommittee to Research Medical Marijuana Management Alternatives. (Supervisor Smith & Supervisor Lovelace)

RECOMMENDATION: Appoint a subcommittee to research medical marijuana management alternatives.

2.                   Letter to Governor Schwarzenegger Requesting Restoration of Open Space Subvention Funding. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign letter.

3.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

Community Development Services

1.                   Results of Headwaters Fund Board Reconsideration of Humboldt State University (HSU) Nursing Program Grant Fund Request.

RECOMMENDATION: That the Board of Supervisors review and approve the Headwaters Fund Board (HFB) recommendation to deny Headwaters Grant Funds for the HSU Nursing Program Request.

County Administrative Office

2.                   Alternative Leasing Procedure for County Property.

RECOMMENDATION: That the Board introduce by title, Ordinance No. ______ adding Sections 268-1 through 268-5 to the Humboldt County Code, and waive the first reading of the Ordinance Set the Ordinance for adoption at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board both publication and posting to be done at least five (5) days prior to the Board meeting at which the ordinance will be adopted. [Government Code Section 25124(b) (1)]; and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post-adoption summary of the ordinance with the names of the Supervisors voting for and against the ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the ordinance. [Government Code Section 25124 (b) (1)].
