Board of Supervisors

1.                   Continuation of Emergency - Redway Community Services District Local Water Emergency. (Supervisor Smith)

RECOMMENDATION: Declare that a local state of emergency, Per Resolution #09-48, remains in effect until September 22, 2009.

2.                   Letters of Appreciation to Susan McGee and Shilpa Mehta for Serving on the Status of Women Commission. (Supervisor Neely)

RECOMMENDATION: Authorize the Chair to sign Letters of Appreciation.

3.                   Appoint David Craig Arivett to the Humboldt County Alcohol and Drug Advisory Board. (Supervisor Neely)

RECOMMENDATION: Appoint David Craig Arivett to the Humboldt County Alcohol and Drug Advisory Board.

4.                   Appoint Bonnie Shand and Doug Renwick to the Humboldt County Alcohol and Drug Advisory Board. (Supervisor Lovelace)

RECOMMENDATION: Appoint Bonnie Shand and Doug Renwick to the Alcohol and Drug Advisory Board.

5.                   Letter of Support for the Requa Road Rehabilitation and Bridge Replacement Project. (Supervisor Smith)

RECOMMENDATION: Ratify authorization for Chair to sign letter of support.

County Administrative Office

6.                   Adoption of Ordinance: Alternative Leasing Procedure for County Property.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. _____, adding Sections 268-1 through 268-5 to the Humboldt County Code, pursuant to the attached Board Order.

7.                   Local Fire District Allocations for Fiscal Year 2009-10 for the Arcata, Blue Lake, Carlotta, Fortuna, Humboldt No. 1, Loleta, Miranda, Myers Flat, Orleans, Petrolia, Redway, Samoa Peninsula and Shelter Cove Fire Organizations. (Proposition 172 Funds).

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute agreements with the Arcata, Blue Lake, Fortuna, Humboldt 1, Loleta, Myers Flat, Petrolia, Redway and Samoa Peninsula Fire Protection Districts, and Carlotta, Miranda and Orleans Community Service Districts, and Shelter Cover Resort Improvement District for revenue-sharing for the County's FY 2009-10 Proposition 172 (Prop 172) funding.

Health and Human Services - Public Health Branch

8.                   Approve Standard Agreement Number 09-11125, for the Chlamydia Screening Project (CLaSP) and the Sexually Transmitted Disease (STD) Prevention and Control Program for Fiscal years 2009-2011.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign two (2) copies of Standard Agreement Number 09-11125, for CLaSP and STD Program, in the amount of $12,960 for the period of July 1, 2000 through June 30, 2011 and return the signed copies to the Public Health Branch for submission to the California Department of Public Health (CDPH).

9.                   Accept and Acknowledge $22,000 Grant Award from Safety Net Funding Partnership and Approve Budget Adjustment in Fund 1175, Budget Unit #420 (MCAH) for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board of Supervisors accept and acknowledge $22,000 grant award from Safety net Funding Partnership for the period of July 1, 2009 through June 30, 2010 for the MCAH Oral health Program personnel expenses; and approve and direct the Auditor-Controller to adjust budget unit #420 (MCAH) as follows: Revenue: 586-499 - State Aid Health Realignment ($22,000); 707-508 Oral Health - $22,000.

Health and Human Services - Social Services Branch

10.               Agreement for Services between Department of Health and Human Service (DHHS) and New Directions of Humboldt Foster Family Association Chapter #107.

RECOMMENDATION: That the Board of Supervisors approve the proposed agreement up to $12,915 for fiscal year 2009 - 2010 between DHHS and the New Directions of Humboldt Foster Family Association for the recruitment and training of prospective foster care providers between July 1, 2009 and June 30, 2010; authorize the Chair to execute three copies of the agreement; and direct the Clerk of the Board to route two (3) fully executed copies of the agreement to the Director, DHHS - SSB.

11.               Transitional Housing Placement Program (THPP) Agreement with Remi Vista Incorporated.

RECOMMENDATION: That the Board of Supervisors approve the proposed agreement for $197,820 for fiscal year 2009-2010 between the County of Humboldt and Remi Vista, Incorporated for the Transitional Housing Placement Program; authorize the Chair to execute three (3) copies of the agreement; and Direct the Clerk of the Board to route two fully executed copies of the agreement to the Director, DHHS - SSB.

Public Works

12.               Airport Road ARRA Overlay Project; Project No. ESPL 5904 (097); Contract No. 210010.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Airport Road ARRA Overlay Project; award the contract to Ford Logging, Inc. dba Pacific Earthscape for the total amount of $398,830; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0248 and transfer $438,713 to the account per the attached appropriation transfer.

13.               Construction of Maple Creek Road Rehabilitation and Overlay; Contract No. 202703.

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between Ford logging Inc. dba Pacific Earthscape, Contractor, and Humboldt County for the rehabilitation and overlay on Maple Creek Road; approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $6,933.67. This will bring the total amount paid to 100% of the contract; approve the attached Appropriation Transfer to provide for payment.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Consider Appointment of County Representative to the Access Humboldt Board of Directors. (Supervisor Lovelace)

RECOMMENDATION: Appoint a County Representative to the Access Humboldt Board of Directors.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

F.                  DEPARTMENT REPORTS

Community Development Services

1.                   Agreement for Consultant Services for an Environmental Impact Report/Environmental Impact Analysis for the Shell WindEnergy – Bear River Ridge Project, and Supplemental Budget (277) for Community Development Services – Planning Division

RECOMMENDATION: That the Board of Supervisors receive staff report; authorize the Chairperson of the Humboldt County Board of Supervisors to execute the Agreement for Preparation of an Environmental Impact Report Environmental Impact Analysis (EIR/EIS) by Consultant under Contract to County (between County and Shell WindEnergy, Inc. - Applicant and EDAW, Inc. - Consultant for Consulting Services for Preparation of an EIR/EIS; authorize the deposit of funds in the amount of $624,947 received from the Applicant to be deposited into Community Development Services - Planning Division Trust Fund #3575; adopt a supplemental budget for the Community Development Services - Planning Division (1100-277; Authorize the transfer of funds from the Community Development Services - Planning Division Trust Fund #3575 to the Community Development Services - Planning Division to provide finding for all actual Planning Division costs and consulting services; any changes in terms of the Agreement, scope of work, schedule and compensation must be reviewed by County Counsel, and approved by the Community Development Services - Planning Division, the Consultant, and the Applicant.  The County shall not incur any additional costs as a result of subsequent amendments. (Note: No amendments are contemplated).

2.                   Standing Item --- State and Federal Budget Update.

RECOMMENDATION: Hear report and take action as appropriate.

3.                   Health Officer Report on Needle Exchange in Humboldt County.

RECOMMENDATION: That the Board of Supervisors receive and file a report on needle exchange by Humboldt County Health Officer, Dr. Ann Lindsay.

1.                   ZABEL General Plan Amendment, Zone Reclassification, Parcel Map Subdivision, and Special Permit File No. APN: 522-181-01 Case No: GPA-07-03/ZR-07-09/PMS-08-03/SP-08-105 (Willow Creek Area)

RECOMMENDATION: That the Board of Supervisors open the public hearing in the manner prescribed by law; Receive the staff report and public testimony; close the public hearing; adopt the Negative Declaration and necessary findings prepared by Community Development Services - Planning Division; approve the General Plan Amendment, Zone Reclassification, Parcel Map Subdivision and Special Permit subject to the recommended conditions of approval; approve Resolution No. _____, (Attachment A) adopting the Planning Commission's findings (Attachment B); approve the amendment of the Humboldt County General Plan - Willow Creek Community Plan (WCCP) land use map, by amending property in the Willow Creek area (GPA-07-03, Zabel) from Public (P) to Residential Low Density with a density of one unit per acre (RL1); Adopt Ordinance _____, (Attachment C) amending Section 311-7 of the Humboldt County Code by reclassifying property in the Willow Creek area (ZR-07-09, Zabel) from Agriculture Exclusive (AE) to Residential Suburban (RS); direct Planning Division Staff to prepare and file a Notice of Determination with the County Clerk and Office of Planning and Research; direct the Clerk of the Board to give notice of the decision to the applicant, the County Assessor’s Office and any other interested party, and to publish summaries of the Ordinance (Attachment D) five (5) days prior to and within 15 days after adoption by the Board

2.                   Appeal of Planning Commission Approval of the Nicklas Parcel Map Subdivision / Planned Development and Special Permit Application.  File No. APN 015-121-02 Case No.: PMS-07-19A (Eureka Area)

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public testimony; Based on the findings in the Staff report and testimony received about the project, deny the appeal and approve the Nicklas Parcel Map Subdivision / Planned Development and Special Permit Application; Direct the Clerk of the Board to give notice of the decision to the appellant, the project applicant, the agent and any other interested party; and direct the Community Development Services - Planning Division to file a Notice of Determination  with the Humboldt County Recorder's Office, pursuant to the California Environmental Quality Act.
