1.                   Resolution Recognizing T. Scott Kelly for his Service to the Citizens of Humboldt County.(CONSENT) (Supervisor Duffy)

RECOMMENDATION: Adopt the Resolution.

C.                  SPECIAL PRESENTATIONS

1.                   Proclaim November 2009 as National Adoption Awareness Month. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim November 19th, 2009 as the American Cancer Society's Great American Smokeout in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

Community Development Services

1.                   Carrington Joint Timber Management Plan and Guide File No. APN 314-222-02 and -223-04Case No: JTMP-09-03 Kneeland Area.

RECOMMENDATION: That the Board of Supervisors approve the division of the Carrington assessor parcels zoned Timberland Production Zone (TPZ) for which a Joint Timber Management Plan (JTMP) and Guide have been prepared pursuant to Section 51119.5 of the C.G.C.; Direct Community Development Services - Planning Division to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; direct the Clerk of the Board to give notice of the decision to Francis and Carole Carrington, the County Assessorís Office and any other interested party.

2.                   RLF Redwood Properties Joint Timber Management Plan/Lot Line Adjustment Application File No.:APN 211-352-06 et al. Case No.: JTMP -07-07/LLA-08-04Miranda Area

RECOMMENDATION: That the Board of Supervisors approve the RLF Redwood Properties Lot line Adjustment (LLA) to result in Parcels A and B of approximately 80 and 215 acres, respectively, and approve the division of assessor parcels, portions of which are zoned Timberland Production Zone (TPZ) and for which a Joint Timber Management Plan (JTMP) and Guide have been prepared pursuant to Section 51119.5 of the C.G.C.; direct the Community Development Services - Planning Division staff to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; direct the Clerk of the Board to give notice of the decision to RLF Redwood Properties the County Assessor's Office and any other interested party.

District Attorney

3.                   Accept the Grant Funding for Automobile & Worker's Compensation Insurance Fraud Program (State of California - Department of Insurance Funds).

RECOMMENDATION: That the Board of Supervisors accept Grant Award for Workers Compensation and Automobile Insurance Fraud for Fiscal year 2009-10; and approve a supplemental budget in the District Attorney's budget 1100-205-515042, in the amount of $290,478.

4.                   Advance Step Appointment for Jack Bernstein, Investigator (District Attorney).

RECOMMENDATION: That the Board of Supervisors approve an Advanced Step appointment for Jack Bernstein, Investigator (District Attorney) to Step E, effective September 21, 2009,pursuant to Section 7 of the Humboldt County Salary Resolution.

Health and Human Services - Public Health Branch

5.                   Temporary Authority for the Department of Health and Human Services, Public Health Branch Director to Sign Memoranda of Understanding with Humboldt County Private Schools to Provide School Age Children at Private Schools H1N1 Vaccinations Expiring June 30,2010.

RECOMMENDATION: That the Board of Supervisors: Temporarily authorize the Department of Health and Human Services (DHHS), Public health branch Director to sign Memoranda of Understanding (MOU) with private schools in Humboldt County to provide H1N1 vaccination clinics to school age children until June 30, 2010.The terms and conditions of the MOU are as provided in the attached MOU.

Public Works

6.                   Agreement for Airport Consulting to Provide Runway Safety Area Construction Engineering Services for the Airport Improvement Program (AIP) Grant 03-06-0010-34/35, Project 919216.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign four copies of the Agreement for Airport Consulting with Mead and Hunt for an amount not to exceed Six Hundred Twenty-five Thousand Dollars ($625,000.00) and direct the Clerk of the Board to return two fully executed copies to Public Works.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Termination of Redway Community Services District (RCSD) Local Water Emergency Declaration/Resolution. (Supervisor Smith)

RECOMMENDATION: Approve termination of Resolution #09-48 declaring Redway Community Services District Local Water Emergency.

2.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

F.                  DEPARTMENT REPORTS

Community Development Services

County Administrative Office

1.                   Consideration Fire Protection District, Development Impact Fees; and Humboldt Fire District No. 1 - Development Impact Fees - HFD Proposal.

RECOMMENDATION: That the Board of Supervisors consider the adoption of an enabling ordinance for Fire Protection District Development Impact Mitigation Fees; and if desired consider the adoption of an ordinance for a Development Impact Fee on behalf of Humboldt Fire District No. 1; and if desired direct Staff to develop the necessary documents for implementation of the Fire Protection District Development Impact Mitigation Fee project.This includes but is not limited to an enabling ordinance and necessary CEQA documentation; an indemnification agreement; a reimbursement agreement for the costs incurred by the County in the development by the County Administrative officer, Treasurer and Auditor Controller of a method of reimbursement of costs incurred by the County for collection of the Impact Fee; and the preparation of an ordinance to update the County fees schedule, to include the new development impact fees; and direct the Community Development Service Director and the Public Works Director to review the HFD No. 1 Impact Fee study for compliance with Government Code 66000 et seq., as set forth in the staff report.

H.                  CLOSED SESSION

1.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for Agriculture Commissioner pursuant to Government Code section 54954.5.

2.                   Pursuant to Government Code Section 54957.6, Review the County's Position and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Personnel. Negotiator: Personnel Director, Rick Haeg.

3.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of County Administrative Officer pursuant to Government Code Sections 54954.5 and 54957.

4.                   It is the intention of the Board of Supervisors to meet in closed session to consider the appointment for the position of Personnel Director pursuant to Government Code Sections 54954.5 and 54957.

Community Development Services

1.                   Sweet Appeal of Planning Director's Decision on the Sweet Lot Line Adjustment File No.: APNs220-272-22 and -311-04 Case No.: LLA-08-06A.

RECOMMENDATION: That the Board of Supervisors Continue the project to a date certain, December 1,2009; and direct the Clerk of the Board to give notice of the decision to the owner, his agent and any other interested party.
