6.                   Humboldt Coastal Dunes Cooperative Memorandum of Understanding (MOU) for Coordinated Ecosystem Management

RECOMMENDATION: Authorize Chair to execute MOU with the:  Wiyot Tribe; Bureau of Land Management, Arcata Field Office; Humboldt Bay National Wildlife Refuge; Redwood National Park; California State Parks, North Coast Redwoods District; California Department of Fish and Game; California Coastal Commission; California Coastal Conservancy; Manila Community Services District; City of Eureka; Center for Natural Land Management; Friends of the Dunes; and McKinleyville Land Trust.

First 5 Humboldt (Children and Families Commission)

7.                   Ordinance Amending Section 571-3(d) of Chapter 1 of Division 7 of Title V of the Humboldt County Code, Relating to Procedural Requirements of the Children and Families Commission

RECOMMENDATION: Introduce ordinance by title, waive the first reading thereof, and set the ordinance for adoption on March 15, 2005.

Health and Human Services - Mental Health Branch

8.                   Department of Mental Health State Hospital Bed Purchase and Usage Agreement for Fiscal Years 2002, 2003, and 2004

RECOMMENDATION: Authorize the Director of Mental Health Branch to sign said agreements with the State Department of Mental Health.

9.                   Inter-County Services Agreement with the County of Santa Clara for Access to Santa Clara County's Community Treatment Facility

RECOMMENDATION: Grant a waiver from the provisions of the Nuclear-Free Clause.  Ratify the placement made to Starlight Adolescent Center effective April 15, 2004.  Approve the agreement with Starlight Adolescent Center (Exhibit A of inter-county agreement).  Authorize Chair to sign inter-county agreement.

10.               Amendment to Service Agreement with Catholic Charities of the Diocese of Santa Rosa

RECOMMENDATION: Approve the First Amendment to the Service Agreement for the provision of specialty mental health services to eligible Humboldt County Medi-Cal clients needing these services for FYs 04/05 and 05/06 to amend the Administrative Fee provision to establish a dollar cap not to exceed 15% of total claims submitted by Catholic Charities per fiscal year.

11.               First Amendment to Service Agreement with Remi Vista, Inc. (Eureka and Redding)

RECOMMENDATION: Approve the First Amendment to Service Agreement for the provision of Therapeutic Behavioral Services to Medi-Cal beneficiaries for FYs 04/05 and 05/06 to amend the Administrative Fee provision to establish a dollar cap not to exceed 15% of total claims submitted by Remi Vista, Inc. per fiscal year.

12.               Amendment to Service Agreement with the Humboldt Family Service Center (HFSC)

RECOMMENDATION: Approve First Amendment to the Service Agreement for the provision of specialty mental health services to eligible Humboldt County Medi-Cal clients needing these services for FYs 04/05 and 05/06 to amend the Administrative Fee provision to establish a dollar cap not to exceed 15% of total claims submitted by HFSC per fiscal year.

13.               Amendment to Service Agreement with the Humboldt Child Care Council (HCCC)

RECOMMENDATION: Approve the First Amendment to the Service Agreement for the provision of Mental Health and Case Management Services to Medi-Cal beneficiaries for FYs 04/05 and 05/06 to amend the Administrative Fee provision to establish a dollar cap not to exceed 15% of total claims submitted by HCCC per fiscal year.

Health and Human Services - Public Health Branch

14.               Grant Award from the March of Dimes for the Best Beginnings for Moms and Babies Project

RECOMMENDATION: Accept grant award ($25,000).

15.               Supplemental Budget in Fund 1175, Budget Unit 418, Child Health and Disability Prevention Program Administrative Budget for Fiscal Year 2004-2005

RECOMMENDATION: Adopt supplemental budget ($593,414), which will allow the County budget to reflect the approved State budget for Fiscal Year 2004.

Health and Human Services - Social Services Branch

16.               Memorandum of Understanding (MOU) with the California Tribal TANF Partnership, Which Outlines the Transfer of California Work Opportunity and Responsibility to Kids (CalWORKs) Cases to the California Tribal TANF Partnership Program for Qualified Native American Households Currently Receiving, or Applying for, CalWORKs Benefits

RECOMMENDATION: Authorize Chair to execute MOU.

17.               Request for Disallocation of Six Vacant Social Worker I/II/III Positions, and Allocation of Six Social Worker IV Positions

RECOMMENDATION: Approve request.

18.               Request to Disallocate a Vacant Integrated Caseworker II Position, and Allocate an Eligibility Worker III Position

RECOMMENDATION: Approve request.

Probation

19.               Appointment to the Multi-Agency Juvenile Justice Coordinating Council

RECOMMENDATION: Appoint Stephanie Larsen, Assistant County Administrative Officer.

20.               Extension of Extra-Help Hours for John Roby and Eric Dick, Juvenile Corrections Officers

RECOMMENDATION: Approve extra-help extension to a maximum of 1,440 hours for Fiscal Year 2004.

21.               Extension of Extra-Help Hours for Lonny Copple, Airport Service Worker I

RECOMMENDATION: Approve extra-help extension to a maximum of 1,960 hours for Fiscal Year 2004.

22.               Construction of Security Fence at Rohnerville Airport; Project No. AIP 3-06-0083-04; Contract No. 911100

RECOMMENDATION: Return bid documents, and concur with the Director of Public Works to terminate the contract with Dynaram Construction due to procedural errors.  Direct the Clerk to re-advertise the above-mentioned project with bids to be opened on Tuesday, April 5, 2005, at 2:00 p.m.

23.               Allocation of One Full-Time Correctional Work Crew Leader

RECOMMENDATION: Approve allocation in Budget Unit 1200-325 (Road Division).

Sheriff

24.               Extension of Extra-Help Hours for Emilee Henry, Emergency Communications Dispatcher

RECOMMENDATION: Approve extra-help extension to a maximum of 1,920 hours for Fiscal Year 2004.

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim March 2005 as Women's History Month (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

2.                   Annual Report from Humboldt County's Commission on the Status of Women (Supervisor Neely)

RECOMMENDATION: Receive the report, and take appropriate action (if required).

E.                  DEPARTMENT REPORTS

Public Works

1.                   Installation of Symbolic Fencing at Clam Beach County Park

RECOMMENDATION: Receive a presentation by representatives from the U.S. Fish and Wildlife Service on the placement of symbolic fencing (colored rope supported by metal fence posts) at Clam Beach County Park for the protection of Western Snowy Plovers.  Authorize the installation of symbolic fencing in designated areas of Clam Beach County Park during the Western Snowy Plover nesting season as per Section 271-3 of the County Code.

RECOMMENDATION: Receive update, and take appropriate action (if required).

Board of Supervisors -- 10:00 A.M.

1.                   Request from the Humboldt County Fish and Game Advisory Commission for Letters to the Federal Energy Regulation Commission (FERC) Regarding the Eel and Klamath Rivers (Supervisor Smith)

RECOMMENDATION: Hear presentation, and authorize Chair to sign letters to FERC as requested by the Commission.

2.                   Standing Item--Pursuant to Government Code Section 54957.6, Review the County's Position, and Instruct Designated Representatives with Respect to the Various Forms of Compensation Provided to the County's Represented and Unrepresented Employees   (if required)

4.                   Conference with Legal Counsel--Existing Litigation Pursuant to Government Code Section 54956.9(a).  County of Humboldt v. Robert C. McKee, et al; Humboldt Superior Court Case No. DR 020825

5.                   It is the intention of the Board of Supervisors to meet in closed session to consider the public employee performance evaluation for the position of Director of Child Support Services pursuant to Government Code Section 54954.5.

6.                   Standing Item--Adjourn as County Board of Supervisors, and Reconvene as Humboldt County Public Authority.  Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator.  It is the intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority.

J.                   ADMINISTRATIVE ABATEMENT HEARINGS--1:45 P.M.

Code Enforcement Unit

1.                   Humboldt County v. Vickery & Cowan; File No. AP 512-221-020; 4346 Old Railroad Grade Road; Fieldbrook

RECOMMENDATION: Authorize the cost of abatement of the subject property be paid using funds from the Code Enforcement Trust Fund, Account No. #3440000;  and, if those costs are unpaid by the property owner, that a lien be placed against the parcel in the amount of the costs of the abatement, pursuant to the provisions of Humboldt County Code Sections 351-21 and 351-22.  Approve the transfer in the amount of $5,000 from the Code Enforcement  Trust  Fund,  Account No. 3440000  to  County  Counsel's Professional & Special Services, Account No. 1100-121-2-118, to cover the cost of cleanup.

2.                   Humboldt County v. Daugherty and Gulley; File No. AP 509-072-003; 2327 Second Avenue, McKinleyville

RECOMMENDATION: Pursuant to the provisions of Humboldt County Code Sections 351-21 and 351-22, authorize the cost of abatement to be advanced by the County of Humboldt and, if unpaid by the property owner, that a lien be placed against the parcel in the amount of the costs of the abatement.  Approve the transfer from the Code Enforcement Trust Fund, Account No. 3440000 in the amount of $7,000 to County Counsel's Professional & Special Services, Account No. 1100-121-2-118, to cover the cost of cleanup.

K.                  ADJOURNMENT
