A.                  SALUTE TO THE FLAG


1.                   Request to Establish a Trust Fund to Support Tsunami-Ready Efforts in the Fairhaven Area

RECOMMENDATION: Direct the Auditor-Controller to establish Trust Fund 3712, Fairhaven Tsunami-Ready Funds, for the purpose of developing a tsunami warning system, evacuation plan, public education program, and support systems.

1.                   Request for Approval of Payroll Clearing Transfer ($403,309)

RECOMMENDATION: Approve request.

Board of Supervisors

2.                   Continuation of Emergency - Transmission of Disease Through Contaminated Needle Use (Supervisor Rodoni)

RECOMMENDATION: Declare that a local state of emergency, per Resolution No. 2000-14, remains in effect until September 27, 2005, allowing the Department of Health and Human Services, Public Health Branch to continue a needle-exchange program.

3.                   Appointment of Jim Polly to the Humboldt County Fish and Game Advisory Commission. (Supervisor Geist)

RECOMMENDATION: Appoint Jim Polly to the Humboldt County Fish and Game Advisory Commission.

4.                   Letter to Governor Schwarzenegger Supporting SB 792, Funding for the North Coast Railroad Authority (Supervisor Woolley)

RECOMMENDATION: Authorize Chair to sign letter of support.

Child Support Services

5.                   Request for Allocation of an Office Assistant I/II Position; Request for Disallocation of a Legal Clerk I/II Position

RECOMMENDATION: Approve requests.

County Administrative Office (CAO)

6.                   Cox Cable Franchise Negotiations Update and Report

RECOMMENDATION: Schedule update and report for the meeting of October 4, 2005.

7.                   Scheduling of a Cox Cable Public Hearing

RECOMMENDATION: Hold joint public hearing with local participating cities with regard to the Cox Cable Franchise on Thursday, November 3, 2005, at 6:30 p.m. at the Wharfinger Building.

8.                   Request for Adoption of the Recommendations of the Overnight Vehicle Committee for Fiscal Year 2005-06

RECOMMENDATION: Approve request.

9.                   Approval of Updated Budget Adjustment Procedures

RECOMMENDATION: Rescind County Policy B-1-1, dated November 16, 1982, regarding budget adjustment procedures.  Adopt new Budget Adjustment Procedures as presented by the CAO.

10.               Workers' Compensation Coverage-Fire Districts

RECOMMENDATION: Authorize Chair to sign Memorandum of Understanding adding Myers Flat Fire Protection District to the program, effective September 1, 2005  Adopt Resolution No. 05-__ to add Myers Flat Fire Protection District to the County's primary and excess workers' compensation polices as a covered party/named insured.

11.               Oppose Senate Bill 703--Private Lender Payments of Delinquent Property Taxes

RECOMMENDATION: Send letters of opposition to State Legislature, California State Association of Counties, and Don Peterson, Humboldt County's lobbyist.

County Clerk-Recorder

12.               Supplemental Budget to Adjust Revenue and Expenditure Estimates for Fiscal Year 2004-05 to Conform to Actual Revenue and Expenditures

RECOMMENDATION: Adopt supplemental budget ($109,127).

Health and Human Services - Mental Health Branch

13.               Extension of Agreement with Crestwood Behavioral Health, Inc.

RECOMMENDATION: Extend agreement through June 30, 2006.

Health and Human Services - Public Health Branch

14.               Contract With Kevin Frank and Associates ($10,000)

RECOMMENDATION: Approve contract to complete work on existing Certified Unified Program Agency database.

15.               Request to Purchase Two Computers for the Early Intervention Program ($3,000)

RECOMMENDATION: Approve request.

16.               Amendment to Agreement No. 04-35349 With the California Department of Health Services for Various HIV/AIDS Programs

RECOMMENDATION: Approve said amendment, which decreases funding for the HIV Prevention Program Memorandum of Understanding through June 30, 2007.

17.               Request for Approval of Supplemental Budget ($5,000) and Subcontract With Public Health Institute for Project Leaders Encouraging Activity and Nutrition (Project LEAN)

RECOMMENDATION: Approve request.

Health and Human Services - Social Services Branch

18.               Compliance Certificates Endorsing Participation in the Medi-Cal Cost-Avoidance Program and the Subvention Program

RECOMMENDATION: Authorize Chair to sign certificates, and direct staff to file same with the California Department of Veterans Affairs.

19.               Resolution in Support of Three-Year Plan for the Child Abuse Prevention, Intervention, and Treatment/Community-Based Child Abuse Prevention Programs, and Promoting Safe and Stable Families Program Three-Year Plan for 2005-2008

RECOMMENDATION: Adopt Resolution No. 05-__.

Library Services

20.               Supplemental Budget ($32,533)

RECOMMENDATION: Adopt supplemental budget to account for remaining grant funds from First 5 Humboldt.

Public Works

21.               Purchase of a 3/4-Ton Cargo Van, Approximately $20,000, for the Library

RECOMMENDATION: Approve purchase.

22.               Jackson Overflight Easement; Assessor's Parcel No. 511-052-001, McKinleyville Area

RECOMMENDATION: Accept Overflight Easement for the benefit of the Arcata-Eureka Airport.

23.               Construction of Storm Damage Repairs to Mattole Road; County Project No. 971072

RECOMMENDATION: Accept the completed contract with Mercer Fraser Co., Contractor, and approve claim for payment ($21,571.95).

24.               Construction of General Aviation Ramp at Arcata-Eureka Airport; Project No. AIP 3-06-010-25; Contract No. 913250

RECOMMENDATION: Adopt Mitigated Negative Declaration and Initial Study for said project.  Approve plans and specifications.  Hold bid opening on Tuesday, October 4, 2005, at 2:00 p.m.



25.               Pay Differential for Craig Wilson, Facility Maintenance Supervisor

RECOMMENDATION: Authorize the continuation of the temporary increase in compensation of ten (10) salary ranges beginning September 12, 2005, and continuing through April 22, 2006--or until the classification audit of Mr. Wilson's position is completed, whichever occurs first.


26.               Memorandum of Understanding (MOU) With the U. S. Department of the Interior, National Park Service

RECOMMENDATION: Approve MOU relating to law enforcement and public safety within, and near, Redwood National and State Parks.


1.                   Proclaim September 2005 as Emergency Preparedness Month (Supervisor Rodoni)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim September 11-17, 2005 as Assisted Living Week (Supervisor Neely)

1.                   Subcommittee Relating to California Department of Fish and Game's Consideration of Marine-Protected Areas (Supervisor Smith)

RECOMMENDATION: Establish a subcommittee relating to Marine-Protected Areas, and appoint two Board Members.

2.                   Humboldt County Fish and Game Advisory Commission Report on the Formation and Membership of the Northern California Fish, Game, and Resources Association (Supervisor Rodoni)

RECOMMENDATION: Approve Humboldt County Fish and Game Advisory Commission's membership in the Northern California Fish, Game, and Resources Association.

3.                   Request from the California Department of Housing and Community Development Requests for a Joint Meeting with the County, Humboldt Economic and Land Plan (HELP), and the Healthy Humboldt Coalition (Supervisor Neely)

RECOMMENDATION: Consider two Board Members to participate, and take appropriate action.

5.                   Standing Item--Adjourn as County Board of Supervisors, and Reconvene as Humboldt County Public Authority.  Pursuant to Government Code Section 54957.6, Conference with Labor Negotiator.  It is the intention of the Board of the Humboldt County Public Authority to meet in Closed Session to have a conference with its Labor Negotiator to review and instruct designated representatives with respect to the various forms of compensation provided to represented and unrepresented personnel of the Humboldt County Public Authority.

RECOMMENDATION: Accept the withdrawal of the appeal by the applicant's agent.

2.                   Resolution Adopting a Revised CDBG Program Income Reuse Plan; Authorization to Transfer Funds Between Revolving Accounts and Open Grants; and Authorization for the Community Development Services Director to Execute Contracts and Sub-Recipient Agreement to Carry Out the Activities (After Review and Approval by County Counsel and the Risk Manager)

RECOMMENDATION: Adopt Resolution No. 05-__.
