1.                   Board Orders - Meeting of November 9, 2010.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the November 9th Board Meeting.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Board of Supervisors

1.                   Resolution Authorizing Temporary Closure of Vehicle Traffic Across the Bridge in Fernbridge, CA on August 7th, 2011 for the 100th Anniversary Celebration of the Bridge. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

2.                   Humboldt County Emergency Medical Care Committee Appointments and Reappointments. (Supervisor Lovelace)

RECOMMENDATION: Approve the appointments and reappointments.

3.                   Letter of Appreciation to Jim Holdner for Serving on the Humboldt County Fish and Game Advisory Commission. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

4.                   Reappoint Tom Cleary, Harry Vaughn and Dan Doble to the Humboldt County Fish and Game Advisory Commission. (Supervisor Lovelace)

RECOMMENDATION: Approve the reappointments.

Clerk of the Board

5.                   Local Appointments List for 2011.

RECOMMENDATION: Receive said list.  Direct the Clerk of the Board to send a copy of said list to the Humboldt County Library, Eureka Main Branch, as pursuant to Government Code Section 54973,.  The Board hereby designates the Humboldt County Library, Eureka Main Branch, as the public library required to receive a copy of such list.

County Administrative Office

6.                   Appointment of County Representative to the Access Humboldt Board of Directors.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to post notice of a vacancy for a County representative on the Access Humboldt Board of Directors.

Health and Human Services - Mental Health Branch

7.                   Appointments to the Humboldt County Mental Health Board.

RECOMMENDATION: That the board of Supervisors appoint Daveid Young, Bonnie Shand, Bill Jackson and David Arrivet to the Humboldt County Mental Health Board.

8.                   Recognition of Donations Made to Healthy Moms Program, Budget Unit 1180-431, Department of Health and human Services, Alcohol and Drug Fund.

RECOMMENDATION: That the Board of Supervisors: Accept Donation of $1,000 made to the Healthy Moms Program from the Boomerang Project.

Health and Human Services - Public Health Branch

9.                   Approve Agreement with California Department of Public Health (CDPH) for the Immunization Program and Adjust Budget Unit 428, in Fund 1175 for Fiscal Year 2010- 2011.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign eight original signature pages of Standard Agreement No. 10-95371, for the Public Health Branch Immunization Program, for the period of July 1, 2010 through June 30, 2011, and one original of the Contractor Certification Clause; direct the Clerk of the Board to submit the signed originals to the Public Health Branch for Submission to the State and Direct the Auditor Controller to adjust Fund 1175, Budget unit 428, Immunization program for Fiscal year 2010-11 per Attachment A.

10.               Approve and Authorize the Department of Health and Human Services Director to sign the Teen Pregnancy Prevention (TPP) community Collaborative Member Agreement Form with the Humboldt County Office of Education.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Department and Human Services Director to sign the TPP Community Collaborative member Agreement Form with the Humboldt County Office of Education for submittal with two Teen Pregnancy Prevention Community Challenge Grant applications.


Personnel

11.               Transfer of Correctional Work Crew Leader positions from the Sheriff's Office, Custody Services Division to the Public Works Department, Facility Management Division.

RECOMMENDATION: That the Board of Supervisors approve the allocation of two full-time Correctional Worker Crew Leader (class 0427, salary range 360) positions in budget unit 162, effective the beginning of the bi-weekly pay period following approval; approve the disallocation of the vacated full-time Correctional Work Crew Leader (class 0427, salary range 360, position #01) position in budget unit 243, and the vacated full-time Correctional Worker Crew Leader (Class 0427, salary range360, position #03) position in budget unit 243, effective immediately upon the transfer of Correctional Work Crew Leaders Greg McIntosh and Nicholas Downey in the newly allocated positions.

Public Works

12.               Storm Damage Repair on Wilder Ridge Road (5B010) at PM 5.30, Project No. PW 448, Contract. No. 206250.

RECOMMENDATION: That the Board of Supervisors accept the completed contract, including all change orders approved by the Public Works Department, between G.R. Wilcox, Contractor, and Humboldt County for the storm damage repair on Wilder Ridge Road; and approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, in the amount of $4,572.69.  This will bring the total amount paid to 100% of the contract.

13.               Pay Differential for Brooke Epperly, Fiscal Assistant II.

RECOMMENDATION: That the Board of Supervisors authorize the continuance of the temporary increase in compensation of ten (10) salary ranges for Brooke Epperly, Fiscal Assistant II from December 25, 2010 and continuing through April 9, 2011 or until the Public Works Dispatcher returns, whichever occurs first, pursuant to Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

14.               Request to Use County Equipment in the Annual Trucker's Parade.

RECOMMENDATION: That the Board of Supervisors authorizes the use of the County Road Trucks and heavy equipment in the annual Trucker's Parade.

15.               Solid Waste Collection in the Willow Creek Area.

RECOMMENDATION: That the Board of Supervisors select Eel River Disposal to provide solid waste collection services in the Willow Creek area; and authorize the Chair to execute the Solid Waste Collection Franchise Agreement for the Willow Creek Area following sign off by County Counsel and review and approval of insurance certificates by Risk Manager.

16.               Extension of Extra Help Hours for Denton Carrick and Matthew Nelson.

RECOMMENDATION: That the Board of Supervisors extend Denton Carrick and Matthew Nelson extra-help employment hours by 960 hours to a maximum of 1,920 hours for fiscal year 2010 - 2011 pursuant to Section 7 of the Humboldt County Salary Resolution.

17.               Request for Exception to Hiring Freeze for Facility Maintenance Mechanic.

RECOMMENDATION: That the Board of Supervisors grant an exception to the hiring freeze to allow the Public Works Department to fill a vacant, full time Facility Maintenance Mechanic I position in the Facility Management budget unit.

18.               Extension of Extra Help hours for Robert Hemsted.

1.                   Proclaim December 12th, 2010 as Cleats for Kids Day. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

2.                   Resolution Recognizing the 75th Anniversary of the Scotia Band. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

E.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

2.                   Consider the request of the Southern Humboldt Community Healthcare District to appoint Corinne Stromstad to fill the vacancy on the SHCHD Board of Directors left open by the resignation of Ed Smith. (Supervisor Clendenen)

RECOMMENDATION: Consider making an appointment to fill the vacancy on the SHCHD Board of Directors left open by the resignation of Ed Smith.

County Administrative Office

1.                   Board Meetings - Calendar Year 2011.

RECOMMENDATION: That the Board of Supervisors cancel Board meetings on the following dates in Calendar Year 2011 and direct the Clerk of the Board to notify all County Departments of these cancelled meetings:

2.                   County Administrative Officer Report: Prescription Discount Card Program and Various other Topics.

RECOMMENDATION: That the Board of Supervisors receive and oral report from the County Administrative Officer on the County's Prescription Discount Card Program and various other topics and take action as may be required.


3.                   Adoption of 2011 State and Federal Legislative Platforms.

RECOMMENDATION: That the Board of Supervisors provide input and direct to staff as desired regarding the proposed state and federal legislative platforms for 2011; direct the County Administrative Officer to bring back the final state and federal legislative platform on January 4, 2011 for adoption; direct the County Administrative Officer to submit the final version of the state legislative platform to Governor Elect Jerry Brown, Assembly Member Wesley Chesbro, State Senator Noreen Evans and Peterson Consulting; direct the County Administrative Officer to submit the final version of the federal legislative platform to U.S. Representative Mike Thompson, U.S. Senators Dianne Feinstein and Barbara Boxer; and authorize and direct the County Administrative Officer to submit letters to State and Federal legislatures, as needed to support the County's legislative platform during 2011.

Humboldt County In-Home Supportive Services Public Authority

4.                   Appointment of Margaret Lewis to the Humboldt County In-Home Supportive Services Advisory Board.

RECOMMENDATION: That the Board of Supervisors adjourn as Humboldt County Board of Supervisors; convene as the Governing Board of the Humboldt County In-Home Supportive Services Public Authority and consider the following agenda: a. Approve the appointment of Margaret Lewis to the Humboldt County In-Home Supportive Services Advisory Board in the capacity of an Alternate Member; b. Adjourn; c. Reconvene as the Humboldt County Board of Supervisors.

K.                  PUBLIC HEARINGS

County Administrative Office

1.                   Public Hearing to Consider Implementation of Senate Bill (SB) 863 to Establish New Williamson Act Contracts.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comments; close the public hearing; find that the County of Humboldt received less than one0half of its forgone property tax revenues in Fiscal Year (FY) 2009-2010 pursuant to Government Code Sections 16142(e)(1) and 16142.1 (d)(1); Opt into the SB 863 program, which will provide for a reduced Williamson Act contract term of 9  or 18 years in exchange for the Williamson Act contract holder giving up an amount equal to 10% of their existing net benefit under the Williamson Act; approve modifications to the Humboldt County Williamson Act Guidelines to indicate that the duration of a Williamson Act contract is 10 or 20 years, unless the Board of Supervisors otherwise authorizes a 9 or 18 year contract term as a result of opting into the SB 863 program; approve a modification to Humboldt county's Williamson Act Non-renewal Guidelines at Section 14(A) to allow landowners to file a 60 day notice of non-renewal to be effective in calendar year 2011 as a result of the Board opting into the SB 836 program; and direct Community Development staff to notify all contracted landowners of the final decision of the Board of Supervisors regarding SB 863 and the resulting changes to the Williamson Act Guidelines after the conclusion of today's public hearing.

Community Development Services

2.                   BAER Land Conservation Contract and Farmland Security Zone (New Enrollment) Case No. AGP-09-09; File No. APN-201-311-17  Alton Area

RECOMMENDATION: That the Board of Supervisors open a public hearing in the manner prescribed by law; receive a staff report, consider the application and receive public testimony; adopt the necessary findings prepared by Community Development Services 0 Current Planning Division staff; adopt Resolution No.___ establishing the Agricultural Preserve; authorize the Chair of the Board to execute the Land Conservation Contract for a Farmland Security Zone (Attachment B); direct the Current Planning Division Staff to prepare and file a Notice of Exemption with the County Clerk and Office of Planning and Research; direct the Clerk of the Board to record copies of the Resolution and Land Conservation Contract with the County Recorder; and direct the Clerk of the Board to give notice of the decision to the applicant, the Assessor's Office, County Counsel, Current Planning Division, the California Office of Land Conservation, and any other interested party.


3.                   McCanless Land Conservation Contract (New Enrollment) and Rezone - Case No.: AGP-09-04 and ZR-09-05; File No. 106-081-02 and 106-061-52 Ferndale Area.

RECOMMENDATION: That the Board of Supervisors open a public hearing in the manner prescribed by law; receive a staff report, consider the application, and receive public testimony; introduce Ordinance No. ___ by title and waive further reading; adopt the necessary findings prepared by Community Development Services - Current Planning Division Staff; adopt Ordinance No.___ amending Section 311-7 of the Humboldt County Code by reclassifying property in the Ferndale area, i.e. those lands currently zoned  Unclassified within Assessor Parcel Numbers (APNs) 106-081-02 and 106-061-52 to Agriculture Exclusive with a Special Building Site combining zone specifying a minimum lot size of 160 acres (AE B-5(160))(Attachment A; direct the Clerk of the Board to publish a summary of the zoning changes within 15 days of the date of the hearing (Attachment B); adopt Resolution No. ___ establishing the Agricultural Preserve (Attachment C); authorize the chair of the board to execute the Land Conservation contract (Attachment D); direct Current Planning Division staff to prepare and file a Notice of Exemption with the County Clerk and Office of Planning and Research; direct the Clerk of the Board to record copies of the Resolution and Land Conservation Contract with the County Recorder; and direct the Clerk of the Board to give notice of the decision to the applicant, the Assessor's Office, County Counsel, Current Planning Division, the California Office of Land Conservation, and any other interested party.
