RECOMMENDATION: Approve Department's action taken to construct 3 minor repair sites by day labor/force amount in order to complete them prior to winter weather; adopt supplemental budget in amount of $46,014; and approve transfer from Road Contingency in amount of $5,962.

14.               Public Hearing to Consider Adoption of General Plan Amendment to Chapter Four, Public Facilities of Framework General Plan, Section 4600, Et. 1.                   Report on Status of Humboldt County Codes Related to Land Use (Supervisor Neely)

RECOMMENDATION: Direct Planning and Building to prepare report on how to deal with outdated ordinances, including an estimate of staff time and potential litigation costs.

2.                   Library Contract--Substitution of Subcontractors

RECOMMENDATION: Hold a hearing and receive evidence on the issue of whether F. L. Houston (subcontractor) after having had a reasonable opportunity to do so, refused to execute a written contract when that written contract was presented to it by the prime contractor (RESCO); find that the circumstances to fail within the situation described by Section 4107(a) (1) of the Public Contract Code; and consent to the substitution if the situation referred to in Section 4107(a) (1) has occurred.

Eel River Court

1.                   Appointment of New Marshall, Municipal Court, Eel River Division

RECOMMENDATION: Reschedule for the meeting of February 8, 1994.

Planning and Building

2.                   Matters Pertaining to Gravel Extraction Operations in Humboldt County

RECOMMENDATION: No action required.

3.                   Waiver of 480 Hour Limit for Extra-Help Employee Doris Hickerson

RECOMMENDATION: Approve waiver.

4.                   Kramer et al and Humboldt Fire District 1 Expedited Implementation of Plan Amendments and Zone Reclassifications; Myrtletown

RECOMMENDATION: Adopt Ordinance Nos. 2027, 2028, 2029 and 2030 implementing previously approved zone reclassifications; and adopt Resolution No. 94-10 through 94-12 for submittal to the Coastal Commission.

Probation

5.                   Supplemental Budget in the Amount of $141,237 for Regional Facility (RF) Project (continued from January 18, 1994)

RECOMMENDATION: Approve budget; authorize Chair to sign agreement with BAR-O-Boys Ranch; approve in concept draft agreement for 4-county RF; and approve in concept RF project to be built upon; and if possible as an addition to, existing Probation Department complex.

6.                   Supplemental Budget of $47,775 for Marijuana Unit with Offsetting Revenue and Transfer from Contingency Fund in the Amount of $39, 096

RECOMMENDATION: Continue to February 1, 1994.

RECOMMENDATION: Acknowledge the withdrawal of the Starpage, Inc. application.
