Agricultural Commissioner

1.                   Approval of Standard Agreement No. 09-0710, Known as the Asian Gypsy Moth Trapping Program Contract in the Amount of $8,398 and Corresponding Supplemental Budget.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 09-0710, known as the Asian Gypsy Moth Trapping Program Contract with the California Department of Food and Agriculture; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification form and return all copies to the Agriculture Department of further processing; grant a waiver from the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the corresponding supplemental budget.

2.                   Temporary Increase in Compensation for Senior Accountant/Auditor Nancy Stufflebeam.

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Senior Accountant/Auditor Nancy Stufflebeam of twenty (20) salary ranges beginning March 22, 2010 and continuing until December 25, 2010, or until the Deputy Auditor/Controller position is filled, whichever occurs firs, pursuant to Section 7 of the Humboldt County Salary Resolution.

3.                   Consider Letter of Opposition to SB 1109 (Senator Cox); California Children and Families Program Funding. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of opposition.

4.                   Letter of Appreciation to Rodney C. Thornton for Serving on the Humboldt County Mental Health Board. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

5.                   Continuation of Local Emergency - January 9, 2010 Earthquake. (Supervisor Clendenen)

RECOMMENDATION: Declare that a local state of emergency, per Resolution No. 10-03, remains in effect until May 4, 2010.

6.                   Appoint Art McClure to the Redway Community Services District Board of Directors. (Supervisor Clendenen)

RECOMMENDATION: Appoint Art McClure to the Redway Community Services District Board of Directors.

7.                   Letter of Appreciation to Jim Waldvogel upon his Retirement. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

8.                   Letter of Appreciation to Ben Fewell for Serving on the Humboldt County Workforce Investment Board. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

Child Support Services

9.                   Creation of a New Line Item for Telephone System and Transfer of Funds between accounts.

RECOMMENDATION: That the Board of Supervisors approve the creation of a new Telephone System line item, #1380206-8174 and approve the Budget Appropriation Transfer of #32,000 into the new Telephone Service line item from : Communications, #1380206-2106, in the amount of $12,000; Rents and Leases - Structures, #1380206-2121, in the amount of $20,000.

Community Development Services

10.               Approval of Allocations from the Secure Rural Schools and Community Self-Determination Act of 2000, Title III Fund to Support Local Fire Safe Council Project Proposals.

RECOMMENDATION: That the Board of Supervisors approve funding for seven Firewise and/or Community Wildfire Protection Plan (CWPP) project proposals submitted by local fire safe councils (FSCs) to the Humboldt County Title III Small Grant Program; and authorize the Community Development Service Director to sign grant contracts with the local FSCs to carry out the activities of their projects, after review and approval by County Counsel and Risk Management.


11.               Waiver of 960 Hour Limit for Extra Help Employee.

RECOMMENDATION: That the Board of Supervisors approve the waiver of 960 hour limit for extra help employee, Katherine Boham, up to 1,200 hours, pursuant to Section 7 of Humboldt county Salary Resolution.

12.               HR 2389 - Recreational and Conservation Easement Support Program - City of Arcata Funding Request (Arcata Ridge Trail Property Acquisition Appraisal Costs).

RECOMMENDATION: That the Board of Supervisors receive the staff report and approve funding request of $9,600 from the City of Arcata to provide funding for preparation and execution, associated legal expenses and appraisal costs for the Arcata Ridge Trail Property Acquisition and/or Conservation Easement.

District Attorney

13.               Workers' Compensation Grant Application - FY2010-11 Workers Compensation Insurance Fund Program (State of California).

RECOMMENDATION: That the Board of Supervisors approve the grant application; sign the resolution; and direct the Clerk of the Board to return the resolution to Chief Michael Hislop so it may be processed with the grant application.

14.               Extension of Temporary Increase in Pay for Legal Office Assistant II, Rachelle Davis as though she had been promoted to Legal Office Services Supervisor pursuant to Section 7 of the Humboldt County Resolution.

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Legal Office Assistant II, Rachelle Davis, (Class 0178, Range 290), as though she had been promoted to legal Office Services Supervisor (Class 1150, Range 352) effective retroactive to May 31, 2009 and continuing until the Legal Office Services Supervisor vacant position is filled by June 30, 2010, whichever comes first, pursuant to Section 7 of the Humboldt County Salary Resolution.

Health and Human Services - Administration

15.               Letter of Support to Restore Child Welfare Service 2009-2010 Allocation.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to send a letter to the Chairs of the State Budget Sub-Committees on health and human services requesting restoration of the Child Welfare Services funding that the Governor vetoed in last year's state budget ($80 million State General Fund; $40 million federal matching fund for a total veto of $120 million) and authorize the Department of Health and human Services Director Phillip R. Crandall to notify the coalition "Protect Our Children Protect Our Future" that the Board wishes to be added as signatory to the coalition letter requesting restoration of the Child Welfare Services finding ($80 million State General Fund; $ 120 million total veto) that was vetoed in last year's state budget.

Health and Human Services - Mental Health Branch

16.               Approve the option to extend the Lease Agreement with Rachael - Jill Hemmert.

RECOMMENDATION: That the Board of Supervisors approve the option to extend the Lease for 824 Harris Street with Rachael - Jill Hemmert for Fiscal Year 2010-2011; Direct the Clerk of the Board to return one executed Board agenda item to the Public Works - Real Property Agent; and authorize the Public Works - Real Property Agent to send a letter notifying Rachael - Jill Hemmert that the County is exercising the first option to extend the lease for an additional one year term, from July 1, 2010 through June 30, 2010.


Health and Human Services - Public Health Branch

17.               Accept and Approve Amendment A04 to Master Agreement with California Department of Public Health and Associated Memoranda of Understanding.

RECOMMENDATION: That the Board of Supervisors approve Amendment A04 to Agreement Number 07-65050 with the California Department of Public Health; authorize the Chair to sign the first page of the original and each of six Standard Agreement copies; authorize the Chair to sign three copies of the first page of each Amendment A04 to the HIV Care Program MOU; and direct the Clerk of the Board to return all Standard Agreement Amendment copies and all copies of the amended Memorandum of Understanding to the Public Health Branch, Health Branch, Health Education Division.

Health and Human Services - Social Services Branch

18.               Approve a Supplemental Budget in Department 511 Social Services and Approve a Budget Transfer/Adjustment in Department 504 Older Adults.

RECOMMENDATION: That the Board of Supervisors adopt the attached Supplemental Budget in 1160-511, Social Services - Attachment 1' and approve the attached Budget Transfer / Adjustments form to increase cost apply in 1160-504, Older Adults - Attachment 2.

Probation

19.               Request for Exception to Hiring Freeze for Legal Office Services Manager.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the county hiring freeze to allow for the filling of the soon to be vacant Legal Office Services manager position; Salary Range 403, Class 235, Position #1.

20.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the county hiring freeze to allow for the filling of a vacant Probation Division Director position; Position #1 in Budget Unit 235, Salary Range 433.

Public Works

21.               Williams Street (County Road #4F070) Speed Humps, Town of Scotia.

RECOMMENDATION: That the Board of Supervisors authorize the installation of speed humps along Williams Street (County Rd. #4F070), in the Town of Scotia.

22.               Appropriation Transfer to Cover Fees for Aviation Enterprise Professional Services.

RECOMMENDATION: That the Board of Supervisors approve the attached appropriation transfer for $55,000 to cover Professional Services fees for: 1. County Project No. 381119 amounting to $35,000 for specialized legal services to clarify the status of Aviation property; 2. County Project No. 381122 amounting $20,000 for ABC Aviation Consultancy, Inc. for the preparation of Minimum Standards and leasing Policy Documents for the County's Commercial Service and five general aviation airports.

23.               Mattole Road (F3C010) Overlay between PM 14.0 & 14.75.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, May 4, 2010 at 2:00 PM.


24.               Supplemental Budget for Juvenile Hall Security Screen Replacement and Regional Facility Courtroom Modification:  Project No. 170207.

RECOMMENDATION: That the Board of Supervisors Adopt the following supplemental budget to provide funds for the following two projects:  1) Juvenile Hall Security Screen Replacement: Revenue:  1100180-706131 - Transfer from Deferred Maintenance $36,000, Expenditure: 1100170-8714 - Juvenile Hall Security Screen Replacement $36,000.  2) Regional Facility Courtroom Modification:  Revenue:  1100170-706131 - Transfer from Deferred Maintenance $25,000, Expenditure:  1100170-8891 - Regional Facility Courtroom Modification $25,000.

25.               Recyclable Material Processing for Unincorporated County Solid Waste Fanchises.

RECOMMENDATION: That the Board of Supervisors authorize the Humboldt Waste Management Authority (HWMA) to be the lead agency for a request for Porposals to process recyclable materials collected within the unincorporated County Solid Waste Franchise Areas.

Sheriff

26.               Approval of County Joint Information Center Plan.

RECOMMENDATION: That the Board of Supervisors approve the County of Humboldt Joint Information Center Plan.

1.                   Proclaim April 5th - 11th, 2010 as National Public Health Week in Humboldt County. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

Code Enforcement Unit

1.                   Administrative Abatement Hearing - Mark Creaghe - Redwood Valley Area, South of SR 299, California; AP# 316-171-013.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22, hold and Administrative Abatement Hearing to determine whether a public nuisance exists on the subject property; adopt Findings and issue an Order consistent with the evidence presented at the hearing; and authorize the Code Enforcement Unit to prepare and serve an inspection warrant for the parcel, APN 316-171-013, to determine the full extent of the violations.

L.                   PUBLIC HEARINGS

Community Development Services

1.                   Wohlfeil Zone Reclassification/Lot Line Adjustment Application File No.: APN 101-102-08 et al. Case No.: ZR-07-03/LLA-06-20 Ferndale Area

RECOMMENDATION: That the Board of Supervisors read the Ordinance by title and waive further reading; open the public hearing and receive the staff report and public comment; adopt the Planning Commission's findings (Attachment A; Attachment B); tentatively approve the adoption of the draft ordinance amending Section 311-7 of the Humboldt County Code by reclassifying lands in the Ferndale area (ZR-07-03; Wohlfeil): and approximate 184 acres into Agriculture Exclusive/Timberland Production Zone with a B=6 combining zone that fixes the lot size to that of the current lot of record (AE-B-6/TPZ-B-6) and an approximate 2.9 acres into AE-B-6, an approximate 1.5 acres of which is to be rezoned out of Timberland Production Zone (TPZ) through an immediate conversion; direct the Community Development Services - Planning Division to transmit the tentative approval for immediate rezone to the State Board of Forestry in accordance with the requirements of Article 4, Immediate Rezone, of the California Government Code, specifically Section 51133; direct Planning Division staff to resubmit the Zone Reclassification (ZR) to the Board for final adoption once the State Board of Forestry has issued approval; and direct the Clerk of the Board to give notice of the decision to the applicant, the owner, the County Assessor's Office and any other interested party.

2.                   2009 Housing Element Revisions to Address Comments by the State Department of Housing and Community Development.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive staff report; receive public comment and deliberate on the matter; and adopt modifications to the August 2009 Housing Element to Respond to Comments from HCD by approving Resolution No. ____.
