1.                   Consider Sending Letter to Caltrans Expressing Citizen Concerns Regarding the Proposed Richardson Grove Road Project. (CONSENT) (Supervisor Lovelace & Supervisor Clendenen)

RECOMMENDATION: It is recommended that the Board send the attached letter to CalTrans, along with a DVD of the discussion, to capture the concerns expressed by the public, and to recommend that CalTrans provide a public presentation as a part of the roll-out of the final EIR.

Agricultural Commissioner

1.                   Renewal of Memorandums of Understanding with Del Norte and Trinity County Departments of Agriculture.

RECOMMENDATION: That the Board of Supervisors approve renewal of Memorandums of Understanding (MOU) between the Agricultural Commissioner's Office and Del Norte and Trinity County Departments of Agriculture for weights and measures services, authorize Chair to sign one original and one copy of each Memorandum, and return all four copies of the MOU along with a Board Order authorizing execution of the Agricultural Commissioner's Office for final processing and mailing to the respective counties.

Board of Supervisors

2.                   Sale of Aviation Fuel to the Collings Foundation for their Vintage Airplanes while at Arcata/Eureka Airport. (Supervisor Neely)

RECOMMENDATION: Approve the Collings Foundation request to purchase aviation fuel at the County's cost.

3.                   Letter of Support to the Bertha Russ Lytel Foundation for the North Coast EMS' Grant Request. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of support.

4.                   Certificate of Appreciation for Michael Griffin. (Supervisor Smith)

RECOMMENDATION: Ratify the Certificate of Appreciation.

5.                   Letter of Support for the Community Health Alliance of Humboldt-Del Norte (CHA) Proposal to the Center for Disease Control and Prevention's National Program to Eliminate Diabetes-related Disparities in vulnerable Populations. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of support.

6.                   Resolution Recognizing the Humboldt Art's Council and the State-Local Partnership Program. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Resolution of Support.

Community Development Services

7.                   Reappointments to the Workforce Investment Board Youth Council.

RECOMMENDATION: That the Board of Supervisors receive staff report; and reappoint the following current members of the Humboldt County Workforce Investment Board- Youth Council whose terms end as of June 30, 2010 to serve three year terms, commencing upon your action: Maura Eastman - Table Bluff Reservation Wiyot Tribe; Kelly Remington - CR Foster Parent & Kinship Care and Jon Sapper - Humboldt County Office of Education.

8.                   HR 2389 - Recreational and Conservation Easement Support Program - McKinleyville Land Trust Funding Request (CDS permit processing costs for the Chah-GAH-Cho Trail).

RECOMMENDATION: That the Board of Supervisors receive the staff report and approve funding request of $4,000 from the McKinleyville Land Trust to provide funding for the processing costs of a Coastal Development Permit and associated fees for the Chah-GAH-Cho Trail Development.

9.                   Supplemental Budget for Fund 1120, Budget Unit 287, Workforce Investment Board, FY 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Fund 1120, Budget Unit 287, Workforce Investment Board and direct the Auditor-Controller to incorporate the supplemental budget.

 

 

 

Conflict Counsel

10.               Exempt Position from Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors exempt the position of Legal Secretary I/II in Budget Unit 246, Conflict Counsel, from the hiring freeze effective May 31, 2010.

Health and Human Services - Public Health Branch

11.               Approve the Agreement with the State Water Resources Control Board for $340,887 in Fund 1175,k Budget Unit 432, Local Oversight Program, for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve and Authorize the Chair to sign the Agreement with the State Water Resources Control Board for $340,887 in Fund 1175, Budget Unit 432, Local Oversight Program, for Fiscal year 2010-11, and direct the Clerk of the Board to return the agreement and three (3) original signature pages to the Environmental Health Division for submission to the State Water Resources Control Board.

Probation

12.               Appointment to the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC).

RECOMMENDATION: That the Board of Supervisors approve the following appointment to the Multi-Agency Juvenile Justice Coordinating Council. (MAJJCC): APPOINTEE - William Damiano; CATEGORY - Probation; REPLACING - Douglas Rasines.

13.               Probation Firearms Replacement.

RECOMMENDATION: That the Board of Supervisors authorize the purchase of six Glock 23 semi automatic pistols and associated duty gear; declare the attached list of Smith & Wesson pistols, magazines and associated duty gear surplus; and authorize the Purchasing Agent to accept fair trade - in value for the Smith & Wesson pistols to offset the purchase of new pistols and dispose of the remaining equipment as appropriate.

14.               Extension of Extra Help Hours to 2080 for Juvenile Corrections Officer Nick Farnsworth.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Juvenile Corrections Officer Nick Farnsworth, to 2080 hours through June 30, 2010, per Section 7 of the Humboldt County Salary Resolution (4/5 vote required).

15.               Memorandum of Understanding with U.S. Marshals Service.

RECOMMENDATION: That the Board of Supervisors authorize the Chief Probation Officer to sign off as a participant agency representative in a Memorandum of Understanding between the Humboldt County Probation Department and the U.S. Marshals Service.

Public Works

16.               Arcata - Eureka Airport (ACV) Runway Safety Area, Runway 01 Grading - AIP 03-06-0010-37 Project No. 919264 and Supplemental Budget Request.

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications; authorize the Director of Public Works to sign the FAA Airport Improvement Program (AIP) grant offer for AIP 03-06-0010-37; authorize the Clerk of the Board to advertise the above - mentioned project, No. 919264, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, June 15, 2010 at 3:00 PM; and adopt the attached supplemental budget for FY 2009/10.

 

 

 

 

17.               Storm damage repair on Trinidad Scenic Drive (4M310) at P.M. 0.75 & 1.00, FEMA NO.: PW 1147, Contract NO.: 206286 & 206364.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened Tuesday, June 1, 2010 at 2:00 p.m.

18.               Shayne Final Map Subdivision, APN 95-052-06, Weott.

RECOMMENDATION: That the Board of Supervisors accept and approve the subdivision map for filing with the County Recorder, accept the dedications to the County of Humboldt of Parcel A (Sewell Drive) for public road purposes, and Parcels B & C for public utilities, all as shown on the subdivision map, authorize the Chair to execute the Conveyance and Agreement, direct the Clerk of the Board to sign the subdivision map on behalf of the Board, and direct the Clerk of the Board to transmit the subdivision map and the Conveyance & Agreement to the County Recorder.

19.               Arcata-Eureka Airport Runway Safety Area Engineered Material Arresting System (EMAS) Installation - AIP 03-06-0010-35, Project No. 919216.

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications and authorize the Clerk of the Board to advertise the above-mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, June 15, 2010 at 2:00 p.m.

20.               Proposition 1B Local Streets and Roads Project List - Final Allocation.

RECOMMENDATION: That the Board of Supervisors approve the following projects for funding through the Proposition 1B Local Streets and Roads Allocation to Humboldt County for the remainder of funding remaining to be allocated to Humboldt County ($3,571,248.56): Widening of School Road (County Road No. C3L070) to create consistent road section between its intersection with Bugenig Avenue at Post Mile 0.37 and Highway 101 at Post Mile 0.68 to augment Phase I improvements to the south side of the road (previous Proposition 1B allocation) and complete Phase II of the widening project involving the north side of the road ($900,000), estimated life of project 20 years; Walnut Drive (County Road No. F3J300) overlay, striping and sidewalk project from its intersection with Hemlock Street at Post Mile 0.00 to its intersection with Fern Street at Post Mile 0.24 ($400,000), estimated life of project 20 years; Myrtle Avenue (F3K300) roadway rehabilitation, overlay and striping from Pigeon Point Road (PM 3.25) to Freshwater Road (PM 3.77) ($1,000,000). Estimated life of project 20 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Blue Slide Road (County Road F2G100) from Post Mile 0.00 to Post Mile 2.03 ($137,000) estimated life of project 10 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Blue Slide Road (County Road F2G100) from Post Mile 2.03 to Post Mile 4.27 ($151,000) estimated life of project 10 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Grizzly Bluff road (County Road F2G100) from Post Mile 4.27 to Post Mile 7.50 ($217,000) estimated life of project 10 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Pine Creek Road (County Road C7N300) from Post Mile 0.00 to Post Mile 0.2 ($10,000), estimated life of project 10 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Pine Creek Road (County Road 7N300) from Post Mile 0.00 to Post Mile 3.64 ($186,000), estimated life of project 10 years; Road rehabilitation and repair, culvert replacement and repair, chip seal surface on Kneeland Road (County Road No. F6F060) from Post Mile 28.00 to Post Mile 33.00 ($276,000), estimated life of project 10 years; Purchase Signs to meet new retro-reflectivity requirements ($175,000); estimated life of project 10 years; and Purchase and install 6 permanent radar speed feedback signs in 25 mile per hour zones on Walnut Drive, Herrick Avenue and F Street in the Cutten area ($119,248.56), estimated life of project 15 years.

Sheriff

21.               Approve contract with Keefe Group to provide commissary services to inmates of the Humboldt County Correctional Facility.

RECOMMENDATION: That the Board of Supervisors authorize Chair to execute three (3) copies of the contract with Keefe Commissary Group for services to inmates as provided under Penal Code Section 4025, upon approval of County Counsel, as to form, and the Risk Manager for insurance purposes, and direct the Clerk of the Board to return all documents to the Sheriff's Office, attention Linda Modell for further processing. A fully executed original of the agreement will be returned to the Clerk of the Board for the Board's files.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim May 2010 as Older Americans Month in Humboldt County. (Supervisors Clendenen)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim May 2010 as Bike Month in Humboldt County. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

3.                   Proclaim May 2010 as Mental Health Month in Humboldt County. (Supervisor Neely)

1.                   Request an Update from Kirk Girard, Community Development Services Director on the Timeframe for the Planning Commission's Hearings on the General Plan Update. (Supervisor Lovelace)

RECOMMENDATION: Hear the report and provide direction to staff regarding the schedule and timeframe for the Planning Commission to complete their review of the General Plan Update.

County Administrative Office

1.                   Responses to 2009-10 Grand Jury Reports 2010-AF-01 and 2010-PW-01

RECOMMENDATION: That the Board of Supervisors review and modify the draft 2009-10 Grand Jury responses from departments under the appointment authority of the Board of Supervisors; review and modify the proposed Grand Jury responses from the Board of Supervisors; approve the documents, as may be modified, as the response; direct the Clerk of the Board, within five working days, to submit the final responses with an accompanying Board Order, to the Presiding Judge of the Superior Court; and direct the Clerk of the Board, within five working days, to submit two copies of all responses to the County Clerk/Recorder, one of which will be forwarded to the State Archivist, together with a copy of the original report.

2.                   Standing Item - State and Federal Budget Update.

3.                   Contract for Headwaters Fund Workforce Challenge Grant Initiative.

RECOMMENDATION: That the Board of Supervisors review and approve the Headwaters Fund Workforce Challenge Grant Initiative contract with the Humboldt County Office of Education and authorize the Chair of the Board to sign the grant contract when completed, after review and approve by County Counsel and Risk Management.

1.                   RACE Investments LLC Local Coastal Program Amendment and Zone Reclassification File Nos.: APN 017-191-03 et al. Case No.: ZR-07-01 Eureka Area

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ______ by title and waive further reading; open the public hearing, receive and consider the staff report, the applicant's response letter dated May 6, 2010 and public comment, and close the public hearing; adopt resolution No. ______ finding the local Coastal Program (LCP) amendment and Zone Reclassification (ZR) are exempt from the provisions of the California Environmental Quality Act (CEQA), and make required findings for approval of the project consistent with the LCP Amendment as approved by the California Coastal Commission (CCC) on March 11, 2010; adopt Ordinance no. _____, amending Section 311-7 of the Humboldt County Code by reclassifying approximately 39 acres in the Eureka area [ZR-07-01, Race Investments LLC] from Coastal Commercial Timberland with Flood Hazard Areas and Streams and Riparian Corridor Protection combining zones (TC/F,R) into Timberland Production Zone with said combining zones (TPZ/F,R) and approximately 106 acres from Agriculture Exclusive (AE) into TPZ, consistent with the LCP Amendment as approved by the CCC on March 11, 2010, and rescinding Ordinance No. 2398; direct the Community Development Services - Planning Division to prepare and file a Notice of Exemption with the County Clerk and office of Planning and Research pursuant to CEQA; direct the Community Development Services - Planning Division to Transmit to the CCC the necessary Documentation for effective certification of the LCP amendment as outlined in the March 12, 2010 letter from the CCC; direct the Clerk of the Board to record an amendment Certification of Rezoning (Notice of Timberland Production Zone Status) on the parcel pursuant to Sections 51117 and 51141 of the California Government Code, after attaching a copy of the fully executed ordinance and map; and direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor's Office and any other interested party and to publish the Post-Adoption Summary of Ordinance fifteen days after passage of the Ordinance.
