B.                  MODIFICATIONS TO THE AGENDA

1.                   Agreement for Airport Construction Engineering Services Runway 32 Departure End Engineered Material Arresting System )EMAS) Installation for the Airport Improvement Program (AIP) Grant 03-06-0010-34/35, Project 919216. (CONSENT)

RECOMMENDATION: Authorize Chair to sign four (4) copies of the Agreement for Airport Consulting with Mead and Hunt, for an amount not to exceed Sixty One Thousand Six Hundred Dollars ($61,600.00). Direct the Clerk of the Board to return three (3( fully executed copies to Public Works.

2.                   Agreement for Airport Construction Engineering Services Runway 01 Safety Area Improvements for the Airport Improvement Program (AIP) Grant 03-06-0010-34/35, Project 919216. (CONSENT)

RECOMMENDATION: Authorize Chair to sign four (4) copies of the Agreement for Airport Consulting with Mead and Hunt, for an amount not to exceed Ninety Three Thousand Eight Hundred Dollars ($93,800.00). Direct the Clerk of the Board to return three (3) fully executed copies ot Pubic Works.

3.                   Approval for Sheriff to sign the attached Contract with Humboldt Bay National Wildlife Refuge and Humboldt Bay Harbor Dirstrict or One in Substantial Conformance with County Counsel Approval. (CONSENT)

RECOMMENDATION: That the Board of Supervisors give approval for Sheriff to sign a contract with Humboldt Bay Harbor District (HBHD) and Humboldt bay National Wildlife Refuge (HBNWR) for a Sheriff's Work Alternative Program (SWAP) crew to assist in eradication of Spartina Densiflora, a nonnative dense-flowered cordgrass from salt marshes within the Humboldt Bay National Wildlife Refuge in form and substance substantially similar to the agreement attached hereto as exhibit A.

4.                   Agreement between Humboldt County Community Development Services (CDS), Economic Development and Humboldt County Department of health and Human Services (DHHS) for the use of Workforce Investment Act (WIA) funds to serve Dislocated Workers. (CONSENT)

RECOMMENDATION: That the Board of Supervisors receive the staff report. Approve and authorize the Chairperosn of the Board to sign the proposed Agreement for the provision of Workforce Investment Act funds to serve dislocated workers between the Director of the Humboldt County Community Development Services Department and the Director of the Humboldt County Department of Health and Human Services. Approve and authorize the Executive Director of the Workforce Investment Board (WIB) and the Department of Health and Human Services, Social Services Branch Director to sign Dislocated Worker Grant Implementation Plans (DWGIP) for all applicable Dislocated Worker funding as it becomes available. Support and affirm future collaboration between the Directors of Community Development Services and Department of Health and Human Services, in preparing similar agreements for approval by the Board for the provision of additional WIB funding allocated to DHHS.

Board of Supervisors

1.                   Appoint James Yarnall to the North Coast Local Agency Coastal Coordination Committee Appointment. (Supervisor Smith)

RECOMMENDATION: Appoint James Yarnall to the North Coast Local Agency Coastal Coordination Committee as the second representative on the North Coast Local Agency Coastal Coordination Committee.

2.                   Request for Approval of Application for On-Sale Beer License by Sylvan Brander Jr. and Lee-Ann Lewis-Brander, owners of the Early Bird in Willow Creek. (Supervisor Duffy)

RECOMMENDATION: Approve the issuance of an On-Sale Beer License for the Early Bird, Willow Creek, CA and authorize Chair to sign Alcohol and Beverage Control form 245.

3.                   Request from the City of Rio Dell for the Consolidation of its Municipal Election with the Statewide General Election on November 2, 2010. (Supervisor Clendenen)

RECOMMENDATION: Approve request for consolidation with the condition that the City of Rio Dell reimburse the County for costs incurred pursuant to this request. Direct the Clerk of the Board to send a copy of the approved Board Order and a copy of City of Rio Dell's Resolution to the Humboldt County Elections Department.

4.                   Request from the Northern Humboldt Union High School District Ordering an Election to Authorize the Issuance of School Bonds, Establishing Specifications of the Election Order, and Requesting Consolidation with Other Elections Occurring on November 2, 2010. (Supervisor Duffy)

RECOMMENDATION: Approve the request and forward to the Elections Department for processing.

Community Development Services

5.                   Healthsport Final Map Subdivision, APN 16-101-03, Eureka Area.

RECOMMENDATION: That the Board of Supervisors accept and approve the sundivision map for filing with the County Recorder; accept the dedications to the County of Humboldt of Myrtle Ave. and Pennsylvania Ave for public rads, Parcesl A, B, & F for punlic utilities, Parcel C as a pedestrian easement, Parcel D for non vehicular access, and parcel E for a traffic signal easement, all as shown on the subdivision map; authorize the Chair to enter into the attached Final Map Subdivision Agreement, in triplicate, for subdivision improvements; authorize the Director of Public Works or his designee to release the agreement secutiries to the subdivider upon satisfaction of the requirements of the Final map Subdivision Agreement; direct the Clerk of the Board to transmit 2 originals of the executed Final Map Subdivision Agreement to the Land Use Division for further processing; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; authorize the Chair to execute the Covenant and Agreement; and direct the Clerk of the Board to transmit the subdivision map, the Conveyance and Agreement, and the Covenant and Agreement to the County Recorder.

6.                   Approval of a Title III Small Grant Program Award to the Orleans/Somes Bar Fire Safe Council for a Firewise Program and Community Wildfire Protection Planning.

RECOMMENDATION: That the Board of Supervisors approve funding for the Community Wildfire Protection Plan (CWPP) and Firewise project application submitted by the Orleans/Somes Bar Fire Safe Counceil (FSC) to the Humboldt County Title III Small Grant Program; and authorize the Community Development Services (CDS) Director to sign grant agreement with the FSC to carry out the activities of their proposed project, after review and approval by County Counsel and Risk Management.

Coroner-Public Administrator

7.                   Adoption of License Agreement between County of Del Norte and County of Humboldt for use of Humboldt County Coroner's Office.

RECOMMENDATION: That the Board of Supervisors find that the License Agreement with the Countyof Del Norte is in the public interest in that the facilities and examination room (premises) will be used for autopsies. Find that the conveyance will not substantially conflict or interfere with the use of the premises by the County of Humboldt. Approve the License Agreement with the County of Del Norte for use of the premises. Authorize the Chairperson to execute each original License Agreement. Direct the Clerk of the Board to return one original executed License Agreement to Real Property for transmittal to Licensee.

County Administrative Office

8.                   Reappointment of Richard "Bud" Leonard as County Representative on the Access Humboldt Board of Directors.

RECOMMENDATION: That the Board of Supervisors reappoint Richard "Bud" Leonard as the County's representative on the Access Humboldt Board of Directors for the Period October 2010 - October 2011 and direct the County Administrative Officer to provide notice of this reappointment to Access Humboldt and Mr. Leonard.

Health and Human Services - Administration

9.                   Amend the Authorization to authorize the Director of Health and Human Services, or his designess, to waive all or part of the recruitment expenses under the employment agreements for Physicians.

RECOMMENDATION: That the Board of Supervisors amend the Board Authorization dated September 19, 2006 and Amended May 12, 2009 to additionally authorize the Director of Health and Human Services, or his designess, to agree on behalf of the County to waive all or part of the recruitment expenses under the employment agreements.

Health and Human Services - Mental Health Branch

10.               Approval of Agreement between Humboldt County and North Coast Substance Abuse Council, Inc. for Residential Services for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the Agreement for Fiscal Year 2010-11 between Humboldt County and North Coast Substance Abuse Council, Inc. for the provision of residential alcohol and drug treatment services effectrive July 1, 2010. Direct the Clerk of the Board to return two (2) executed originals of the Agreement to the Mental Health Branch for transm ittal to the contractor and for retention by the Alcohol and other Drug Programs.

Health and Human Services - Public Health Branch

11.               Approve the Agreement with the California Department of Public Health and the County of Humboldt for the Beach Act Monitoring and Notification Program Grant for $25,000 in Fund 1175, Budget Unit 406, Consumer Protection Program for October 1, 2010 through September 30, 2011.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the Agreement with the California Department of Public Health and County of Humboldt for the Beach Act Monitoring and Notification Program Grant (Agreement 10-95344) for $25,000 in Fund 1175, Budget Unit 406, Consumer Protection Program for October 1, 2010 through September 30, 2011. Direct the Clerk of the Board to return the executed Agreement and three (3) original signature pages to Division of Environmental Health.

Health and Human Services - Social Services Branch

12.               Request for Proposals (RFP) for the Operation of a Temporary Winter Shelter Serving Homeless Individuals and Families of Humboldt County.

RECOMMENDATION: That the Board of Supervisors authorize the issuance of an RFP for an outside contractor to operate and manage a temporary shelter. Authorize the Department of Health and Human Services to negotiate a contract with the selected contractor.

13.               Establish new lines and fixed asset accounts and approve the budget appropriation transfer for Department 505 Cal Works for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve and establish line items and fixed asset accounts; 1160-505-8-896 C-IV Computer Equipment. Approve the Budget Appropriation Transfer, Attachment #1.

Library Services

14.               Grant Agreement with First 5 Humboldt.

RECOMMENDATION: That the Board of Supervisors approve the Grant Agreement with First 5 Humboldt. Authorize the Chairperson to sign three (3) copies of the Agreement. Direct the Clerk of the Board to return the three (3) signed copies of the Agreement to the Library.

Personnel

15.               Test Use Agreements for Written Examinations

RECOMMENDATION: That the Board of Supervisors authorize the Personnel Director to execute test use agreements with Cooperative Personnel Services.

Public Works

16.               Turner Final Map Subdivision, APN 511-081-68, McKinleyville.

RECOMMENDATION: That the Board of Supervisors accept and approve the subdivision map for filing with the County Recorder. Accept the dedications to the County of Humboldt Parcel L for public road purposes, Parcels A, B, D & K for public utilities, a portion of Parcel C as a pedestrian easement, and Parcel J for non-vehicular access, and reject Parcel K (Callwell Drive) for public road purposes, and a portion of Parcel C as a pedestrian easment, all as shown on the subdivision map. Direct the Clerk of the Board to sign the subdivision map on behalf of the Board. Authorize the Chair to execute the Conveyance and Agreement. Direct the Clerk of the Board to transmit the subdivision map and the Conveyance and Agreement to the County Recorder.

17.               Supplemental Budget for Roads Natural Resources, Budget Unit 331.

RECOMMENDATION: That the Board of Supervisors approve the following Supplemental Budget for FY 2009/10: Revenue: 1200331-505030, Fisheries Commission Grant-Showers Pass - $24, 569; Expenditures: 1200331-2118, Professional & Special Services - $24,569.

18.               Fieldslanding Boat Ramp Parking and Public Safety Enhancement Project; Project No. WC-7004TC, Contract No. 713600.

RECOMMENDATION: That the Board of Supervisors acceptr the completed contract, including all change orders approved by the Public Works Department, between Mercer Fraser Co., Contractor, and Humboldt County for the Fieldslanding Boat Ramp Parking and Public Safety Enhancement Project. Approve the final claim for payment, as submitted by the Public Works Department to the Auditor/Controller, inthe amount of $86,518.77. This will bring the total amount paid to 100% of the contract.

19.               Construction of Storm Damage Repairs on Mattole Road (F6C010) PM 41.86: Project No.: ER-4400 (032); Contract No.: 206263.

RECOMMENDATION: That the Board of Supervisors aprpove the plans and specifications, direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Cosde with bids to be opened on Tuesday, August 10, 2010 at 2:00 p.m.

Sheriff

20.               Firewood Distribution Agreement Between the County of Humboldt and the Humboldt Senior Resource Center.

RECOMMENDATION: That the Board of Supervisors authorize Sheriff Gary Philp to sign the Senior Wood Agreement between the County of Humboldt and the Humboldt Senior Resource Center outlining this year's firewood distribution process for low to moderate income senior citizens of the County.

1.                   Fortuna Rodeo Week Presentation. (Supervisor Clendenen)

RECOMMENDATION: Hear the presentation and take appropriate action, if required.

2.                   Proclaim the Week of July 18-24, 2010 as Probation, Parole, and Community Supervision Week in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

RECOMMENDATION: Hear Report and take appropriate action.

Library

2.                   Recognitaion of Grants made to the Library by the Humboldt Library Foundation.

RECOMMENDATION: That the Board of Supervisors accept and recognize a grant made to the Library by the Humboldt Library Foundation in the amount of $20,000 for the purpose of purchasing and processing new materials for the Library's collection; and accept and recovnize a grant made to the Library by the Humboldt Library Foundation in the amount of $10,000 for the purpose of purchasing a microfilm reader for the Eureka Library.

DHHS - Social Services Branch.

3.                   Report on the Calworks/Welfare-to-Work Multiple Assistance Center (MAC), a collaborative partnership between Humboldt County Department of Health and Human Services (DHHS) and Redwood Community Action Agency (RCAA).

RECOMMENDATION: That the Board of Supervisors receive an updated report on the Multiple Assistance Center (MAC).

County Counsel - Code Enforcement Unit.

4.                   Cost Recovery Assessment Hearing - Oliver Cameron, William Cameron, and the Estate of Rodney Cameron, 1345 Hoover Street, Eureka, California; AP# 014-233-001.

RECOMMENDATION: That the board of Supervisors, pursuant to Humboldt County Code Sections 351-33 through 351-44 confirm the findings and orders confirming account and assessment in the sum of eight thousant four hundred sixty-five dollars and fifty-six cents ($8,465.56); and authorize the Chair of the Board to sign the Findings and Order confirming the account and assessment; and direct the Auditor, upon receipt of the monies assessed, to deposit the money previously advanced for the administrative abatement by Order of the Board on April 27, 2010 from the Code Enforcement Trust Fund, which was severn thousand six hundred twenty-four dollars and twenty on cents ($841.35) into the County Counsel Office revenue account number 1100-121-603-040 to recoup Code Enforcement staff time, mileage and office expenses expended enforcing the Humboldt County Code.
