Board of Supervisors

1.                   Request from City of Arcata to Consolidate the Election of two Arcata City Councilmembers with the Humboldt County Municipal Election on November 2, 2010. (Supervisor Lovelace)

RECOMMENDATION: Approve the request to consolidate the election of two Arcata City Councilmembers with the Humboldt County November 2, 2010 Municipal Election. Send approved and signed Board of Supervisors meeting agenda item and Resolution No. 101-08 to Humboldt County Elections for processing.

2.                   Letter of Appreciation to David Perry for Serving on the Workforce Investment Board. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

3.                   Letter Requesting Modification of the July 6, 2010 Federal Housing Financial Agency (FHFA) Statement to allow PACE Programs to proceed without concerns of violating the terms of the Fannie Mae or Freddie Mac Uniform Mortgage Instruments. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter.

4.                   Letter of Support for Naming the CalTrans Highway 36 Alton Interchange Project in Memory of Former Second District Supervisor, Roger Rodoni. (Supervisor Clendenen & Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter of support.

5.                   Letter of Support to the Economic Development Administration for the Orick Community Services District Wastewater Project. (Supervisor Duffy)

RECOMMENDATION: Authorize Chairman to sign letter of support.

Community Development Services

6.                   Approve Bylaws for a Green Employer Council and the Slate of Nominees as Proposed by the Humboldt County Workforce Investment Board.

RECOMMENDATION: That the Board of Supervisors receive the staff report; review and approve the bylaws for the Green Employer Council (GEC) (Attachment A), a subcommittee of the Humboldt County workforce Investment Board (HC-WIB); review membership applications for the slate of members proposed (Attachment B); appoint the slate of members to the GEC for a term of three years effective immediately in accordance with the GEC bylaws.

County Clerk-Recorder

7.                   Grant Receipt of $468.00 and Contract for HAVA Funds, Contract 09G30310.

RECOMMENDATION: That the Board of Supervisors approve this order authorizing the County to receive the sum of $468.00 in HAVA funding to assist or reimburse the County in complying with Section 303 (a) of the Help America Vote Act of 2002 for activities related to the VoteCal Statewide Voter Registration System Project, and authorize Carolyn Crnich to execute any necessary documents and the Attached contract to carry out the purpose of the Board's order.

8.                   Approval of Contract Amendment to Extend Term of Contract No. 07G30107 through December 31, 2011.

RECOMMENDATION: That the Board of Supervisors authorizes the County to amend Contract No. 07G30107 with the California Secretary of State extending the agreement for HAVA funding through December 31, 2011, and further authorizes Carolyn Crnich to execute any necessary documents and the contract amendment to carry out the purpose of the Board's Order.

County Counsel

9.                   Administrative Abatement Funding - Mark Creaghe - AP# 316-171-013.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code Section 351-31, authorizes the cost of abatement to be advanced by the County of Humboldt and, if unpaid by the property owner, that a lien be placed against the parcel in the amount of the costs of abatement pursuant to Humboldt County Code Sections 351-33-44; approve the transfer from the Code Enforcement Trust Fund, account # 3440000 in the amount of $4,500 to the County Counsel's Professional and Special Services, account #1100-121-2-118, to cover the cost of cleanup; approve a supplemental budget in the amount of $4,500 and increase the appropriation of 1100-121-2-118 to $4,500; Approve the Code Enforcement Unit applying to the Court for an abatement warrant for the parcel APN 316-171-013, in the event the property owner does not consent to the Code Enforcement Abatement.

Health and Human Services - Public Health Branch

10.               Approve an Agreement with First 5 Humboldt for the Department of Health and Human Services, Public Health Branch, Family Violence Prevention Program in Fund 1175, Budget Unit 488, for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve Agreement with First 5 Humboldt in the amount of $7,500 for the period of July 1, 2010 through June 30, 2011, in Fund 1175, Budget Unit 488 (Family Violence Prevention Program); authorize the Chair to sign three originals of the Agreement; and direct the Clerk of the Board to return the three originals of the Agreement to the Public Health Branch.

Public Works

11.               Supplemental Budget for Heavy Equipment and Sale of Surplus Trucks.

RECOMMENDATION: That the Board of Supervisors approve the following Supplemental Budget for FY 2010/11: REVENUE: 3530330-682050 Fund Balance Forward - $424,611; EXPENDITURES: 3540330-8320 Dump Trucks $340,000; 3540330-8811 Truck Emission Retrofit $84,611; declare two low bed trucks surplus; and authorize the Purchasing Agent to dispose of the surplus property and deposit the revenue from the sale in the Roads heavy Equipment Internal Service Fund. (ISF)

12.               Surplus Parks Division Equipment-Used Camp Trailer.

RECOMMENDATION: That the Board of Supervisors declares a used camper trailer within the Parks Division as surplus equipment; authorize the Humboldt County Purchasing Agent to sell the identified surplus item; deposit revenue from the sales into the miscellaneous revenue account of the Parks Division fund (1100713-707010).

13.               Storm Damage Repair on Upper Cappell Road (7Q301) at P.M. 2.50 and Lower Cappell Road (7Q302) at PM 1.30 and 2.50, FEMA No.: PW 1146&717, Contract No.:206296 & 206207.

RECOMMENDATION: That the Board of Supervisors approves the plans and specifications and directs the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 17, 2010 at 2:00 pm.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim the Week of July 25, 2010 as Americans with Disabilities Act 20th Anniversary Week in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

2.                   Resolution Recognizing the Fortuna Redwood AutoXpo July 23 - July 25, 2010. (Supervisor Clendenen)

RECOMMENDATION: Authorize Chair to sign Resolution.

3.                   Humboldt Folklife Performance and Resolution in Recognition of the 32nd Annual Humboldt Folklife Festival July 16th - 24th, 2010. (Supervisor Clendenen)

RECOMMENDATION: Hear the performance and adopt the Resolution.

2.                   Consider Request from the Humboldt County Planning Commission to Further Extend the Public Comment Period beyond July 31, 2010 on the Environmental Impact Report (EIR) of the Ridgewood Village Development (Forester-Gill) Project. (Supervisor Smith)

RECOMMENDATION: Consider extending the comment period for the Proposed Ridgewood Village Development Project (Forester-Gill) an additional 30 days ending August 31, 2010.

RECOMMENDATION: That the Board of Supervisors approve by a 4/5ths vote Miller Joint Timber Management Plan/Lot Line Adjustment (Case No. LLA-09-21), and approve the division of assessor parcels portions of which are zoned Timberland Production zone (TPZ) and for which a Joint Timber Management Plan (JTMP) and Guide have been prepared pursuant to Section 51119.5 of the California Government Code (C.G>C); direct the Community Development Services - Current Planning Division staff to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; and Direct the Clerk of the Board to give notice of the decision to the applicant, County Assessors Office, and any other interested party.

3.                   OSTROW Joint Timber Management Plan/Lot Line Adjustment Application File No.: APN 222-153-01 and -05; Case No.: JTMP-09-06/LLA-09-20 (Redway Area).

RECOMMENDATION: That the Board of Supervisors approve the Ostrow Lot Line Adjustment (LLA) to result in Parcels 1 and 2 of approximately 156 and 214 acres, respectively, and approve the division of assessor parcels, portions of which are zoned Timberland Production Zone (TPZ) and for which a Joint Timber Management Plan (JTMP) and Guide have been prepared pursuant to Section 51119.5 of the California Government Code (C.G.C.); Direct the Community Development Services - Current Planning Division staff to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; and direct the Clerk of the Board to give notice to of the decision to the applicant, the County Assessor's Office and any other interested party.

4.                   MAYBEE Joint Timber Management Plan/Lot Line Adjustment Application; File No.: APN 215-062-01 and 220-231-07; Case No.: JTMP-09-02/LLA-09-07.

RECOMMENDATION: That the Board of Supervisors approve the Maybee Lot Line Adjustment (LLA) to result in Parcels 1 and 2 of approximately 40.9 and 221.6 acres, respectively, and approve the division of assessor parcels, portions of which are zoned Timberland Production Zone and for which a Joint Timber Management Plan and Guide have been prepared pursuant to Section 51119.5 of the California Government Code; direct the Community Development Services - Current Planning Division staff to record a Declaration of Covenants, Conditions and Restrictions Implementing the JTMP and Guide with the JTMP; and direct the Clerk of the Board to give notice of the decision to the applicant, County Assessor's Office, and any other interested party.

Community Development Services

1.                   BLAIR General Plan Amendment Petition; File No.: APN 403-081-23 Case No.: Freshwater Area.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comment; close the public hearing; accept the petition by approving the attached resolution based on the findings in the staff report and testimony received about the project; and direct the Clerk of the Board to give notice of the decision to the applicant, County Assessor's Office, and any other interested party.

2.                   WOHLFEIL Zone Reclassification and Lot Line Adjustment Application File Nos.: APN 101-102-08 et al. Case Nos.: ZR-07-03/LLA-06-20 Ferndale Area

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ____ by title and waive further reading; open the public hearing, receive and consider the staff report, and accept public comment; close the public hearing; approve the Zone Reclassification and adopt Ordinance No. ___, amending Section 311-7 of the Humboldt County Code by reclassifying lands in the Ferndale area [ZR-07-03 Wohlfeil], and approximate 184 acres into Agriculture Exclusive/Timberland Production Zone through an immediate conversion; and approve the Lot Line Adjustment to result in Parcels A,B, and C of approximately 2.9, 184, and 80 acres, respectively; direct the Chair of the Board to sign and the Clerk of the Board to a Certification of Rezoning (Notice of Timberland Production Zone Status) on the parcel pursuant to Sections 51117 and 51141 of the California Government Code, after attaching a copy of the fully executed Ordinance and map; and direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor's Office and any other interested party, and to publish the Post-Adoption Summary of Ordinance at fifteen days after passage of the Ordinance.
