B.                  MODIFICATIONS TO THE AGENDA

1.                   Letter of Support for Resolution T-17288, which would provide $2,169,815 to Redwood Telephone LLC to help fund their Northern California Open Community Fiber Network Project. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign letter of support for Resolution T-17288.

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of Collection Agreement No. 10-CO-11051000-026 between Humboldt County and the United States Forest Service, Six Rivers National Forest.

RECOMMENDATION: That the Board of Supervisors approve USFS Collection Agreement No. 10-CO-11051000-026; and authorize the Board Chair to sign two copies of the collection agreement, and direct the Clerk of the Board to return the signed agreements to the Agricultural Department for further processing.

Auditor-Controller

2.                   Approve an Exception to the Hiring Freeze for a Senior Accountant-Auditor, Position 03, Budget Unit 111, Auditor-Controller.

RECOMMENDATION: That the Board of Supervisors approve an exception to the hiring freeze for a Senior Accountant-Auditor (Salary Range 401, Class 1632, Position Number 03) in Budget Unit 111 with a starting date of on or about October 1, 2010.

Board of Supervisors

3.                   Resolution Recognizing Jeanne Harris Upon her Retirement. (Supervisor Neely)

RECOMMENDATION: Adopt the Resolution.

4.                   Request to Consolidate the City of Ferndale's Article 34 Election with Humboldt County's General Election on November 2, 2010. (Supervisor Smith)

RECOMMENDATION: Approve request for election consolidation with the condition that the City of Ferndale reimburse the County for costs incurred pursuant to this request, and request the Clerk of the Board to forward the signed Board Order and copy of Ferndale's Resolution to the Humboldt County Elections Department.

Community Development Services

5.                   Memorandum of Understanding between Humboldt County, the U.S. Fish and Wildlife Service, ShellWind Energy, Inc., and AECOM, Inc., Relating to Preparation of NEPA Documents for the Bear River Wind Project Habitat Conservation Plan.

RECOMMENDATION: That the Board of Supervisors receive staff report; and authorize the Chairperson of the Humboldt County Board of Supervisors to execute the Memorandum of Understanding Describing the Responsibilities of the Parties for Preparation of NEPA Documents for the Bear River Wind Project Habitat Conservation Plan.

6.                   Ratification and Approval of Several Contracts and Authorization to the Community Development Services Director to Sign the Agreements on Behalf of the County.

RECOMMENDATION: That the Board of Supervisors ratify and approve the contracts attached hereto and authorize Community Development Services Director to sign these contracts on behalf of the County.

7.                   Appointment to the Workforce Investment Board.

RECOMMENDATION: That the Board of Supervisors receive staff report; review membership application for the following community member: Dennis Mullins - EDD Labor Market Information Division; and Appoint Dennis Mullins to the Workforce Investment Board for a term of two years effective immediately, in accordance with the WIB bylaws.

County Administrative Office

8.                   First Amendment to Contract between County of Humboldt and Securitas Security Services USA, Inc.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to execute the attached First Amendment to Contract between County of Humboldt and Securitas Services USA, Inc.

District Attorney

9.                   Supplemental Budget for District Attorney's Office, State Board of Control.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for State Board of Control (1100-220) in the amount $135,774 for grant reimbursed operating expenses.


Health and Human Services - Public Health Branch

10.               Approve Grant Agreement with First 5 Humboldt and Budget Adjustment in Fund 1175, Budget Unit #420, Maternal Child Adolescent Health for Fiscal Years 2010-12.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair of the Board to sign the Grant Agreement with First Five Humboldt in the amount of $31,950 for Fiscal Years 2010-12 in Fund 1175, Budget Unit 420, maternal Child Adolescent Health, Direct the Clerk of the Board to return three signed originals of the Agreement to the Public Health Branch, Maternal Child Adolescent Health Division; Approve and direct the Auditor-Controller to adjust Budget Unit #420, Maternal Child and Adolescent Health by increasing appropriations as attached.

11.               Approve the Grant Agreement with the California State Department of Fish and Game and the County of Humboldt for the Local Government Oil Spill Contingency Plan Grant for $5,000 in Fund 1175, Budget Unit 411, Hazardous Materials Program, for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign the Grant Agreement with the State Department of Fish and Game and County of Humboldt for the Local Government Oil Spill Contingency Plan Grant (Grant Agreement No. P1075015) for $5,000 in Fund 1175, Budget Unit 411, Hazardous Materials Program, for Fiscal Year 2010-11; authorize the Chair to sign the Work Commencement Authorization Disclaimer; direct the Clerk of the Board to return the executed Grant Agreement and seven original signature pages and one original Acknowledgement of Work Commencement Authorization Disclaimer of Environmental Health.

12.               Approve agreements between Humboldt County and the Mobile Medical Office and Redwoods Rural Health Center for the provision of needle exchange services .

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign three original agreements each with the Mobile Medical Office and Redwoods Rural Health Center for the provision of needle exchange services and direct the Clerk of the Board to return two executed agreements for each contracting provider to the Public Health Branch.

Health and Human Services - Social Services Branch

13.               Request for Proposals for the Operation of a Temporary Winter Shelter Serving Homeless Individuals and Families of Humboldt County.

RECOMMENDATION: That the Board of Supervisors authorize the issuance of an RFP for an outside contractor to operate and manage a temporary shelter and authorize the Department of Health and Human Services to negotiate a contract with the selected contractor.

Library Services

14.               Donations made to the Library and Supplemental Budget in Fund 1500, Budget Unit 621, County Library, Fiscal year 2010-2011.

RECOMMENDATION: That the Board of Supervisors accept donations made to the Library in the amount of $35,299.62 in support of the Library's programs and services; and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 1.


15.               California State Library Opportunity Online Broadband Grant and Supplemental Budget in Fund 1500, Budget Unit 621, County Library, Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve and ratify the action of the County Director of Library Services in completing and signing the attached Grant Agreement from the California State Library Opportunity Online Broadband Grant Pilot Program and in delivering the Grant Agreement to the California State Library on or before the grant deadline of July 12, 2010 and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 1.

Probation

16.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the county hiring freeze to allow for the filling of a vacant Deputy Probation Officer I/II position; Position #11 in Budget Unit 235, Salary Range 346/378.

17.               Request for Exception to the Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County Officer I/II position; Position #04 in Budget Unit 234 - Juvenile Hall, Salary Range 303-323.

18.               Resolution authorizing submission of Juvenile Accountability Block Grant (JABG) Best Practices Approach Initiative (BPAI) Application for Technical Assistance.

RECOMMENDATION: That the Board of Supervisors adopt the attached Board of Supervisors Resolution authorizing the Chief Probation Officer to sign and submit the 2010 Best Practices Approach Initiative application to the California Department of Corrections and Rehabilitation - Corrections Standards Authority (CSA), and agreeing the County will abide by the statutes and regulations governing the JABG program as well as the terms and conditions of the grant application as set forth by the CSA; direct the Clerk of the Board to return the Board Resolution to the Humboldt County Probation Department attn: Jody Green.

Public Works

19.               Assignment of Don Morris as Facility Maintenance Supervisor.

RECOMMENDATION: That the Board of Supervisors approve the continuation of the temporary increase in compensation for Don Morris, Facility Maintenance Mechanic II, as if promoted to the class of Facility Maintenance Supervisor, retroactive to July 25, 2010 through October 2, 2010 or until such time as the Facility Maintenance Manager returns to his assignment pursuant to Section 12.4 of the American Federation of State, County and Municipal Employees Memorandum of Understanding.

20.               Lease Termination Agreement and lease Agreement for Operation of the Courthouse Snack Bar.

RECOMMENDATION: That the Board of Supervisors approve the Lease Termination Agreement of the lease dated September 12, 2006, with Tamara Wright and Eric Bywater for operation of the Courthouse Snack Bar and authorize the Chairman of the Board to execute the attached Lease Termination Agreement; approve and authorize the Chairman of the Board to execute the attached Lease Agreement with Alan Sadler and Jessalyn Kunkle for operation of the Courthouse Snack Bar from August 1, 2010 through July 31, 2011; and direct the Clerk of the Board to return one each of the original executed lease Termination Agreement and Lease Agreement to Real Property.


21.               Storm Damage Repairs on Sprowel Creek Road at P.M. 0.60: Project No.: ER-4400 (074); Contract No.: 206410.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 24, 2010 at 2:00 PM.

22.               Supplemental Budget for Juvenile Hall Security Screen: Project No. 170207 for FY 2010/11.

RECOMMENDATION: That the Board of Supervisors adopts the attached supplemental budget in FY 2010/11 to provide funds for the Juvenile Hall Security Screen Replacement.

23.               Freshwater Park Rehabilitation and Access Project No.: 713690.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 24, 2010 at 2:00 PM.

24.               License Agreement for Equipment Storage and Stockpile Site - Monument Borrow Site, APN 205-031-049 and APN 205-031-051.

RECOMMENDATION: That the Board of Supervisors grant a waiver of the Nuclear Free Ordinance; authorize the Chairperson to execute, in duplicate, the License Agreement with Humboldt Redwood Company and direct that both executed License Agreements be returned to the Land Use Division for further processing.

25.               Storm Damage Repair on Wilder Ridge Road (5B010) at PM 5.30, Project No. PW 448, Contract No. 206250.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Storm Damage Repair on Wilder Ridge Road at PM 5.30; Award the contract to G.R. Wilcox Enterprises, Inc. for the total amount of $94,867.30; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0255 and transfer $104,353 to the account per the attached appropriation transfer.

26.               Construction of Storm Damage Repairs on Alderpoint Road (F6B165) PM 36.98: Project No.: ER-4400 (045); Contract No.: 206374.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 24, 2010 at 2:00 PM.

27.               Storm Damage Repairs on Mattole Road (F3C010) PM 35.94: Project No.: ER-4400 (070); Contract No.: 206406.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 24, 2010 at 2:00 PM.

28.               Amendment to the Agreement with Eel River Disposal and Resource Recovery, Inc. for the Collection of Surcharge Fee.

RECOMMENDATION: That the Board of Supervisors approve the attached Amendment to the Redway Transfer Station Agreement with Eel River Disposal and Resource Recovery, Inc. to incorporate a provision for the collection of surcharge fee effective August 9, 2010 to cover waste disposal costs associated with County - authorized


29.               Arcata-Eureka Airport (ACV) Passenger Terminal Expansion and Renovation: AIP 03-06-0010-30, Project 913270.

RECOMMENDATION: That the Board of Supervisors receive the plans and specifications and authorize the Clerk of the Board to advertise the above-mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, August 31, 2010 at 2:00 PM.

30.               School Road Sidewalk and Realignment Project Phase 1 Contract No.: 209801.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk of the Board to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, August 24, 2010 at 2:00 PM.

31.               Professional Services Agreement for Redwood Creek Levee Geotechnical Evaluation Project

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign the attached professional services agreement with CGI Technical Services, Inc. to perform consulting services for the Redwood Creek Levee Geotechnical Evaluation Project.

Sheriff

32.               Governing Body Resolution and Certification and Grant Assurances for the FFY 10 Homeland Security Grant Program.

RECOMMENDATION: That the Board of Supervisors authorize the Chair to sign, in blue ink, the Governing Body Resolution and Certification for a grant request to the State for the FFY10 Homeland Security Grant Program.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim August 2010 as 'Backpacks for Kids' Month in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

2.                   Resolution Commending Detective Troy Garey Upon His Retirement. (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

2.                   Appointment of a County Representative & Alternate to the Klamath River Settlement. (Supervisor Duffy)

RECOMMENDATION: Discuss and appoint an interim supervisor as the County Representative until January 2011 and designate Supervisor Duffy as the Alternate to the KBCC, KBAC, Hank Seemann of Public Works to the TCC, affirm Humboldt County's commitment to the agreements and moving forward through the Secretarial Determination process and implementation.

G.                 DEPARTMENT REPORTS

County Administrative Office

1.                   Standing Item - State and Federal Budget Update.

RECOMMENDATION: Hear report and take appropriate action.


2.                   Response to the 2009-10 Grand Jury Reports 2010-CD-01, 2010-HESS-02, 2010-HESS-03 and 2010-Jails-01.

RECOMMENDATION: That the Board of Supervisors review and modify the proposed 2009-10 Grand Jury responses from departments under the appointment authority of the Board of Supervisors; approve the document, as may be modified, as the response; direct the Clerk of the Board, within five working days, to submit two copies of all responses to the County Clerk/Recorder, on of which will be forwarded to the State Archivist, together with a copy of the original report.

Community Development Services

3.                   RLF Redwood Properties Joint Timber Management Plan Application File No.: APN 101-291-14, 106-151-01 and-06 Case No.: JTMP-09-01.

RECOMMENDATION: That the Board of Supervisors approve the division of assessor parcel, which are zoned Timber Management Plan and Guide with the JTMP and direct the Clerk of the Board to give notice of the decision to RLF Redwood Properties, the County Assessor's office and any other interested party.

Code Enforcement Unit

1.                   Administrative Abatement Hearing; Mikhail and Lena Baklashov; 1075 Spring Road, Shelter Cover, California: AP# 109-181-046.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22: Hold an administrative hearing to determine whether a public nuisance exists on the subject property and adopt Findings and issue an order consistent with the evidence presented at the hearing.


L.                   PUBLIC HEARINGS

Community Development Services

1.                   New Heart Church General Plan Amendment, File No. APN 511-401-39 Case No: GPA 07-02; Response to Coastal Commission's requirements to Amend the McKinleyville coastal Plan to add Public Facilities to the List of Urban Plan Designations, and Amend the Land Use Map for the Subject Property to Delete the Commercial Recreation designation and add a Public Facilities designation.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report; receive public comment; lose the public hearing; based on the findings in the staff report and testimony received about the project, approve the attached Resolution No. _____ amendment the Local Coastal Plan to add PF to the list of urban plan designations, and amend the land use map for the subject property to delete the CR designation and add a PF designation and direct the Clerk of the Board to give notice of the decision to the applicant.
