Auditor-Controller

1.                   Audit Contract for Fiscal Years 2009-10, 2010-11, and 2011-12.

RECOMMENDATION: That the Board of Supervisors approve the attached contract with Caporicci & Larson, CPAs, to audit the financial statements of the County of Humboldt for the fiscal years 2009-10, 2010-11, and 2011-12 and authorize the Auditor-Controller to sign engagement agreements for the 2009-10, 2010-11, and 2011-12 audits upon approval by County Counsel.

Board of Supervisors

2.                   Letter of Appreciation to Nita Brake-Mills for Serving on the Humboldt County Human Rights Commission. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

3.                   Certificate of Achievement for Daniel Luna for Achieving the Distinguished Rank of Eagle Scout. (Supervisor Smith)

RECOMMENDATION: Ratify the Certificate of Achievement.

4.                   Letter of Support for State Coastal Conservancy's Funding Proposal for Invasive Spartina Control in Humboldt Bay Region, CA and on Cox Island, Siuslaw Estuary, OR. (Supervisor Smith)

RECOMMENDATION: Ratify the Letter of Support.

5.                   Resolution Recognizing Jon Sylvia upon His Retirement. (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

6.                   Resolution Recognizing Pedro "Pete" Jimenez Upon His Retirement. (Supervisor Smith)

RECOMMENDATION: Adopt the Resolution.

7.                   Appoint Michael Hoffman to the Southern Humboldt Community Healthcare District Board of Directors. (Supervisor Clendenen)

RECOMMENDATION: Approve the Appointment.

Community Development Services

8.                   Ratification and Approval of a Contract Amendment and Authorization to the Community Development Services Director to sign the Agreement on behalf of the County.

RECOMMENDATION: That the Board of Supervisors ratifies and approves the contract amendment attached hereto and authorize the Community Development Services Director to sign the contract on behalf of the County.

County Administrative Office

9.                   Transient Occupancy Tax Agreement with Humboldt County Convention & Visitors Bureau.

RECOMMENDATION: That the Board of Supervisors approve the attached agreement with the Humboldt County Convention & Visitors Bureau and authorize the Chair and sign.

County Counsel

10.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of a vacant Senior Legal Secretary Position; Position #01 in Budget Unit 121, Salary Range 339 .

Health and Human Services - Mental Health Branch

11.               Appointment to the Humboldt County Mental Health Board.

RECOMMENDATION: That the Board of Supervisors appoint Cody Hoyt to the Humboldt County Mental Health Board.

Library Services

12.               Savings in Fund 1500, Budget Unit 621, County Library, during Fiscal Year 2009, 2010 and Supplemental Budget for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve the use of one-time savings realized during fiscal year 2009-2010 in the amount of $13,791 in Fund 1500, Budge Unit 621, County Library, to fund an additional 20 extra help staff hours per week at the Fortuna Library from July 27, 2010 through June 30, 2011. Adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorize the Auditor-controller to supplement the budget as shown in Attachment 1.


Probation

13.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of a vacant Supervising Probation Officer position; Position #04 in Budget Unit 235 - Probation, Salary Range 413.

Public Works

14.               Agreement for Airport Construction Engineering Services for Runway 1-19 and Runway 14-32 Aeronautical Survey the Airport Improvement Program Grant 03-06-0010-35, Project 919216.

RECOMMENDATION: That the Board of Supervisors authorizes the Chair to sign four copies of the Agreement for Airport Consulting with Mead and Hunt, for an amount not to exceed Eighty Four Thousand Seven Hundred Nine and 25/100 dollars ($84,709.25); direct the Clerk of the Board to return three fully executed copies to Public Works.

15.               Janes Creek Flood Control District.

RECOMMENDATION: That the Board of Supervisors authorize expenditures of up to $100,000 for the McDaniel Slough/Janes Creek flood control and habitat enhancement project.

16.               School Ridge Subdivision, APN 508-351-40, McKinleyville.

RECOMMENDATION: That the Board of Supervisors accept and approve the subdivision map for filing with the County Recorder; accept the dedications to the County of Humboldt of Parcel A (School Road) for public road purposes, Oakdale Drive, Chelsea Way, Duchess Road and parcels C & D for public utilities, and Parcel E for a non-vehicular access easement, and reject Parcel B as a pedestrian easement, and Oakdale Drive, Chelsea Way, and Duchess Road for public road purposes, all as shown on the subdivision map; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; and direct the Clerk of the Board to transmit the subdivision map and the Conveyance and Agreement to the County Recorder.

Sheriff

17.               Federal Annual Certification Report.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board of Supervisors and the Sheriff to sign the Federal Annual Certification Report; and instruct the Clerk of the Board to return the signed document to the Sheriff's office for further processing.

Treasurer-Tax Collector

18.               Resolution to Auction Tax-Defaulted Properties.

RECOMMENDATION: That the Board of Supervisors approve resolution # ________ for sale of properties tax-defaulted, subject to sale; give approval for the Treasurer-Tax Collector (TTC) to re-offer unsold parcels in accordance with Revenue and Taxation Code, section 3698.5; and direct the Clerk of the Board of Supervisors to provide the TTC four certified copies of the Resolution by August 19, 2010.

D.                 SPECIAL PRESENTATIONS

1.                   Recognition of Loretta Nickolas Management Academy Graduates.

RECOMMENDATION: That the Board of Supervisors recognize the graduates of the Loretta Nickolaus Management Academy and authorize the Chair and the County Administrative Officer to execute and present certificates to the graduates.


2.                   Proclaim August 21, 2010 as Bridge Fest Day. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Proclamation.

3.                   Resolution Recognizing the 65th Anniversary of the End of World War II. (Supervisor Smith & Supervisor Clendenen)

RECOMMENDATION: Authorize Chair to sign Resolution.

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

G.                 DEPARTMENT REPORTS

County Administrative Office

1.                   Standing Item - State and Federal Budget Update.

RECOMMENDATION: Hear report and take appropriate action.

2.                   Fire District Development Impact Fees.

RECOMMENDATION: That the Board of Supervisors introduce title, Ordinance No. _____, adding Sections 3210-1 through 3210-13 to the Humboldt County Code, and waive the first reading of the Ordinance; set the Ordinance for adoption at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance, and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five days prior to the Board meeting at which the Ordinance will be adopted. [Government Code Section 25124 (b)(1)]; and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post adoption summary of the ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the ordinance [Government Code Section 25124 (b)(1)].

County Counsel

3.                   Supplemental Report for Administrative Abatement Funding; Mark Creaghe; AP#316-171-013.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code section 351-31, authorize the cost of abatement to be advanced by the County of Humboldt and, if unpaid by the property owner, that a lien be placed against the parcel in the amount of the costs of abatement pursuant to Humboldt County Code Sections 351-33-44; approve the transfer from the Code Enforcement Trust Fund, account #3440000 in the amount of $4,500 to the County Counsel's Professional and Special Services, account #1100-121-2-118, to cover the cost of cleanup; approve a supplemental budget in the amount of $4,500 and increase revenue account 1100-121-603-040 in the amount of $4,500 and increase the appropriation of 1100-121-2-118 to $4,500; and approve the Code Enforcement Unit applying to the Court for an abatement warrant for the parcel, APN 316-171-013, in the event the property owner does not consent to the Code Enforcement Abatement.

Community Development Services

1.                   Approve Issuance of Revenue Bonds by the CA Statewide Communities Development Authority for the Development of 39 Affordable Housing Units Located at 2440 Myrtle Avenue, Eureka.

RECOMMENDATION: That the Board of Supervisors receive the staff report, open the public hearing and receive public testimony; close the public hearing and adopt the Resolution (attachment A) approving the issuance of bonds by the CA Statewide Communities Development Authority (CSCDA) for the development of 39 affordable housing units located at 2440 Myrtle Avenue, Eureka, CA.
