B.                  MODIFICATIONS TO THE AGENDA

1.                   Authorize the District Attorney to sign all Grant Documents Necessary to submit a Non-Competitive Application for the Anti Drug Abuse Enforecement Team Program for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors authorize the District Attorney to sign all documents necessary to submit a non-competitive grant application for the Anti-Drug Abuse Enforcement Team Program Funds.

2.                   Authorize the District Attorney to sign all Grant Documents necessary in order to submit a Proposal for the Underserved Vicitim Advocacy and Outreach Program (UV) in response to the State of California, Emergency Management Agency, Victim Services Division, Request-for-Proposal for Fiscal Year 2010-11. (CONSENT)

RECOMMENDATION: That the Board of Supervisors authorizse the District Attorney to sign all documents necessary of the submission of a proposal for Underserved Victim Advocacy & Outreach Program grant funds.


3.                   Supplemental Budget in District Attorney's Budget Units, in the amount of $49,840.44 for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget in the amount of $49,840.44 for District Attorney (1100-205) and Victim Witness (1100-208) for Fiscal Year (FY) 2009-10.

4.                   Revised Open Hours Scheduled for the Humboldt County Animal Shelter.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution amending Resolution No. 82-170 and rescinding Resolution No. 09-41 in regards to changes in office hours, in particular the open hours schedule for the Sheriff's Animal Shelter.

Auditor-Controller

1.                   Approve an exception to the hiring freeze for a Senior Accountant-Auditor, position 03, Budget Unit 111, Auditor - Controller.

RECOMMENDATION: That the Board of Supervisors approve an exception to the hiring freeze for Senior Accountant-Auditor (Salary Range 401, Class 1632, Position Number 03) in Budget Unit 111 with a starting date of on or about October 1, 2010.

Board of Supervisors

2.                   Proclaim September 17th through September 23rd, 2010 as Constitution Week in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

3.                   Letter of Appreciation to T. R. Wilson for Serving on the Humboldt County In-Home Supportive Services Advisory Board. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

4.                   Letter of Appreciation to Angelique Parry for Serving on the Humboldt County Commission on the Status of Women. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

5.                   Request to Approve Variance for ABC On Sale Liquor License for Vern Bonham III, Owner of Fairway MiniMart in Shelter Cove. (Supervisor Clendenen)

RECOMMENDATION: Approve the issuance of an on-sale Beer License for the Fairway Mini-Mart and authorize Chair to sign Part 3 of ABC Form 245.

6.                   Letter of Appreciation to Doug Rasines for Serving on the Workforce Investment Board Youth Council. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

Cooperative Extension

7.                   Supplemental Budget for Fund 1100, Budget Unit 632 Cooperative Extension for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget request for Budget Unit 632 as attached.


County Administrative Office

8.                   Transfer from General Fund Contingencies for General Relief (1100-525) in Fiscal Year (FY) 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached transfer from General Funda Contingencies for Fund 1100, Budget Unit #525 General Relief in the amount of $105,797.

9.                   Supplemental Budgets for Courthouse Construction and Criminal Justice Certificate of Participation Payment Budgt Units for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budgets to provide funding for taxes and fees associated with certificate of participation (COP) payments for FY 2009-10 from the Criminal Justice COP Payment (1410190) and Courthouse Construction COP Payment (1420190) Budget Units.

10.               Memorandum of Understanding between the County of Humboldt and Whitehorn Volunteer Fire Department for the provision of Workers' Compensation Coverage.

RECOMMENDATION: That the Board of Supervisors aprpove the attached resolution to add Whithorn Volunteer Fire Department to the County's primary and excess workers' compensation policies as a covered party/named insured; and authorize the Chair to sign the attached MOU to add Whitehorn Volunteer Fire Department to the County's workers' compensation effective August 1, 2010.

11.               Memorandum of Understanding between the County of Humboldt and Redcrest Volunteer Fire Department for the provision of Workers' Compensation Coverage.

RECOMMENDATION: That the Board of Supervisors approve the attached resolution to add Redcrest Volunteer Fire Department to the County's primary and excess workers' compensation policies as a covered party/named insured; and authorize the Chair to sign the attached MOU to add Redcrest Colunteer Fire Deparment to the County's workers' compensation effective August 1, 2010.

12.               Adoption of Ordinance: Fire District Development Impact Fees.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ______ adding Sections 3210-1 through 3210-13 to the Humboldt County Code, pursuant to the attached Board Order.

13.               Local Fire District Allocations for Fiscal Year 2010-11 for the Arcata, Blue Lake, Carlotta, Humboldt No. 1, Petrolia, Samoa, Shelter Cove, Whitehorn, Orleans, Miranda, Rio Dell, Fortuna, and Weott Fire Organizations.

RECOMMENDATION: That the Board of Supervisors authorize the Chair fo the board to execute agreements with the Arcata, Blue Lake, Humboldt No. 1, Petrolia, Samoa, Whitehorn, Rio Dell, Fortuna Fire Protection Deistricts and Carlotta, Orleans Miranda, Weott Community Services District, and Shelter Cover Resort Improvement District for revenue-sharing of the County's FY 2010-11 Proposition 172 funding.

Health and Human Services - Administration

14.               Transfer from Contigencies for Inmate Medical Care (1100-490) in Fiscal Year (FY) 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached transfer from Contingencies for Fund 1100, Budget Unit #490 Inmate Medical Care in the amount of $11,618.


Health and Human Services - Public Health Branch

15.               Approve Agreement between Humboldt County and United Indian Health Services for the provision of needle exchange services.

RECOMMENDATION: That the Board of Supervisors aprpove and authorize the Chair to sign three original agreements with United Indian Health Services for the provision of needle exchange services; and direct the Clerk of the Board to return two executed agreements to the Public Health Branch.

16.               Increase in Full Time Equivalent (FTE) of one Medical Office Assistant II Position in Fund 1175, Budget Unit #415, Women Infant and Children (WIC) for Fiscal Year 2010-11.

RECOMMENDATION: That the Board of Supervisors approve an increase in FTE from .8 to 1.0 for one Medical Office Assistant II position (Salary Range 286, Class 0570B, position #03) in Fund 1175, budget Unit #415, Women, Infrants and Children (WIC) Program currently occupied by Cindy Veerkamp, effective the first pay period following approval.

17.               Approve a Supplemental Budget and Establish a Fixed Asset Line for Video Conference Equipment in Fund 1175, Budget Unit #415, Women, Infants and children (WIC), for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors adopt the attached supplemental budget and establish a fixed asset line for Video Conference Equipment for the WIC program in the amount of $30,000 for FY 2010-11 in Fund 1175, Budget Unit #415, WIC.

Health and Human Services - Social Services Branch

18.               Funding for Fraud Investigations and Program Integrity Efforts Related to the In Home Supportive Services (IHSS) Program Pursuant to the California Governor's Proposed State Fiscal Year 2010-2011 Budget Plan.

RECOMMENDATION: That the Board of Supervisors approve the porposed IHSS Enhanced Anit-Fraud Program Plan for submital to the California Department of Social Services; authorize the Chair person of the Board of Supervisors to sign two copies of the porposed plan; and direct the Clerk of the Board to route one copy of the approved plan to the Department of Health and Human Services - Social (DHHS-SSB) Director for forwarding to CDSS for review and approval.

19.               Budget Transfer/Adjustment to Cover Overdrafts for Fiscal Year 2009-2010 in Fund 1160, Budget Unit #599 Veterans Service Office.

RECOMMENDATION: That the Board of Supervisors approve the attached budget transfer / adjustment from Fund 1160, Budget Unit #511 Social Services to Fund 1160, Budget Unit #599 Veterans Services Office for the purpose of closing the FY 2009-10 budget.

Library Services

20.               Literacy Services Agreement with Humboldt Literacy Project.

RECOMMENDATION: That the Board of Supervisors approve the attached Literacy Services Agreement with Humboldt Literacy Project for providing literacy training for adults in HUmboldt County; authorize the Chairperson to sign the attached Literacy Services Agreement and tow additional copies of the signature page; and direct the Clerk of the Board to return the two signed signature pages of the Literacy Services Agreement to the Library.


Probation

21.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of two vacant Senior Juvenile Corrections Officer positions; Position # 03 and #04 in Budget unit 254-Regional Facility, Salary Range 343.

22.               Supplemental Budget for Fund 1100, Budget Unit 257 - Title IV-E Waiver & Resolution, for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for Fiscal Year 2009-10 for Budget Unit 257-Title IV-E Waiver & Resolution.

23.               Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approe a request for exception to the County Hiring Freezew to allow for the filling of a vacant Senior Probation Officer position; position #03, in Budget Unit 235, Salary Range 395.

Public Defender

24.               Supplemental Budget for Public Defender (1100-219) in Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget for FY 2009-10 in the amount of $3,526.00.

Public Works

25.               Supplemental Budget for Parks, Budget Unit 713 for Fiscal Year (FY) 2009-10.

RECOMMENDATION: That the Board of Supervisors approves the attached Supplemental Budget in fund 1100, budget unit 713, for FY 2009/10 in the amount of $41,287.

26.               Federal Aviation Administration (FAA) Wildlife Exclusion Fence Design Grant for the Murray Field Airport.

RECOMMENDATION: That the Board of Supervisors authorize, approve and ratify the Director of Public Works, or his desgnee, executeion of the FAA Grant Offer for Airport Improvement Program (AIP) Porject AIP 03-06-0072-08, HCO 919266, offered by the Federal Aviation Adminsitration for the Murray Field Airport in the amount of $150,812; and adopt the attached supplemental budget for FY 10/11 to correspond to the grant offer.

27.               Construction of Storm Damage Repairs on Mattole Rd (F6C010) PM 41.86: Project No.: ER-4400(032); Contract No.: 206263.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Mattole Road (F6C010) at PM 41.86; award the contract to G.R. Sundberg, Inc. in the amount of $82,220; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance and direct the Auditor-Controller to establish a new contract account 1200321-0256 and transfer $90,442 to the account per the attached appropriation transfer.

28.               Construction of Redwood Drive Rehabilitation and Overlay at PM 3.11 to 4.85: Project No.: ESPL - 5904 (104). Contract No. 202710.

RECOMMENDATION: That the Board of Supervisors reject and return all bids for Construction of Redwood Drive Rehabiliatation and Overlay at PM 3.11 to 4.85 and instruct the Department of Public Works to obtain construction authorization and re-advertise the project.


Sheriff

29.               Supplemental Budget Unit 1100222 to Purchase Equipment approve in Executed Grant Award with the California Multi-Jurisdictional Methamphetamine Enforcement Team (CAL-MMET) Recovery Act Program.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget in the amount of $64,447 to provide funding for purchase of equipment in Cal-MMET Coastal Initiative Budget Unit.

30.               Establish Fixed Asset Account and Approve Appropriation Transfer in Sheriff's Budget 1100-243.

RECOMMENDATION: That the Board of Supervisors authorize the Auditor/Controller to establish Fixed Asset Account 1100-243-8-119, Security System in the amount of $28,981; and approve the attached budget appropriation transfer in Sheriff's budget 1100-243 to replace various compnonents of the existing security system.

Treasurer-Tax Collector

31.               Resolution authorizing the Blue Lake Union Elementary School District to Issue and sell Bonds Directly, in accordance with Education Code Section 15140.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution authorizing the Blue Lake Elementary School District to issue general obligation bonds and authorize the Chair of the Board and the Treasurer-Tax Collector and other County officials to sign the necessary documents and certificates; and direct the Clerk of the Board to provide four certified copies of the Resolution to the Treasurer-Tax Collector.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim August 8 - 14, 2010 as Community Health Center Week in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation and hear the report.

1.                   Request for Approval of the Humboldt County Fish and Game Advisory Commission's Recommendations for Project Funding from the Commission's 2010 grant Funds. (Supervisor Clendenen)

RECOMMENDATION: Approve the Humboldt County Fish and Game Advisory Commission's recommendation to fund the Department of Fish and Game Spotting Scope Optics Upgrade fully for $3807.00; the Humboldt Fish Action Council - Community Involvement - Educational Volunteer Work Days Project partially for $2096.50; and the Eel River Watershed Improvement Group - Creek Days - Eel River Environmental Education Fair partially for $2096.50; a total grant allocation of $8,000.

2.                   Consider the request of the Southern Humboldt Community Healthcare District to appoint Michael Hoffman to fill the vacancy on the SHCHD Board of Directors left open by the resignation of Mike Thompson - CONTINUED FROM THE 8/17/2010 BOARD OF SUPERVISORS MEETING. (Supervisor Clendenen)

RECOMMENDATION: Consider making an appointment to fill the vacancy on the SHCHD Board of Directors left open by the resignation of Mike Thompson.

2.                   Resolution Authorizing Submission of HOME Grant Application to the HOME Investment Partnership Program for $3,600,000 to assist Danco Communities in funding Aster Place Phase II, 2440 Myrtle Avenue, Eureka, a 16 Unit Low Income Housing Complex and Delegate Signature authority to the Community Development Services Director.

RECOMMENDATION: That the Board of Supervisors receive Staff Report and adopt the attached resolution authorizing submission of HOME Grant Application to the HOME Investment Partnership Program for up to $3,600,000 to assist Danco Communities in developing Aster Place Phase II, 2440 Myrtle Avenue, Eureka, a 16 Unit Low Income Apartment Complex; and delgate signature athority to Community Development Services Director for grant documents and contracts, after review and approval by County Counsel and Risk Management.

Community Development Services

1.                   Bertz Zone Reclassification Petition. File No.: APN 204-370-06-et seq. Case No.: ZR-09-03 Hydesville Area.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comment; close the public hearing; accept the petition by approving the attached resolution based on the findings in the staff report and testimony received about the porject; and direct the Clerk of the Board to give notice of the deciesion to the applicant, the Assessor's Office and any other interested party.

2.                   2010 Humboldt County Housing Element Revisions in Response to Comments from the State Department of Housing and Community Development (HCD).

RECOMMENDATION: That the Board of Supervisorsopen the public hearing; receive a staff report; open the Public Comment period, accept public comment; close the Public Comment period; Deliberate on the proposed revisions to the Housing Element; Review and consider the proposed addendum to the Supplemental Environmental Impact Report (SEIR) for the 2009 Housing Element Update (SCH#2009022077); and approve the addendum to the SEOR, and adopt revisions to the April 2010 housing Element to Respond to Comments from HCD by approving Resolution No. _____.
