B.                  MODIFICATIONS TO THE AGENDA

1.                   Humboldt County Parks 2010 Bathroom Replacement Project - Project Numbers: 713650, 713660, 713670, 713680.

RECOMMENDATION: Receive the plans and specifications for the above mentioned project, pursuant to Section 22073 of the California Contract Code, with bids to be opened on Tuesday, October 12, 2010, at 2:00 p.m.

2.                   Location Agreement Allowing Sierra Health Foundation and Center on Juvenile and Criminal Justice to Film/Interview Selected Staff of the Northern California Regional Facility, Juvenile Hall, Probation Department, and Department of Health and Human Services. (CONSENT)

RECOMMENDATION: That the Board of Supervisors approve the Location Agreement authorizing Sierra Health Foundation, a non-profit, and Center on Juvenile and Criminal Justice, a non profit, to film and interview selected County staff from Probation and Health and Human Services as well as tours the Northern California Regional Facility and Humboldt County Juvenile Hall. Authorize the Chief Probation Officer to sign the Location Agreement.

Board of Supervisors

1.                   Letter of Support for the Wiyot Tribe's Grant application for Lamprey Restoration in the Eel River. (Supervisor Smith)

RECOMMENDATION: Ratify the Letter of Support.

2.                   Appoint John Chiv to the Humboldt County Human Rights Commission. (Supervisor Clendenen)

RECOMMENDATION: Approve the appointment.

3.                   Reappoint Members of the Fortuna Cemetery District Board of Directors to 4 year Staggered Terms. (Supervisor Clendenen)

RECOMMENDATION: Approve the reappointments of David Ansley, Robert Olsen, Shirley Bartow and Harley Baumgart to the Fortuna Cemetery District Board of Directors/Trustees.

4.                   Letter of Response to Regional Funding Proposal and Emergency Medical Services (EMS) Authority's #104. (Supervisor Lovelace)

RECOMMENDATION: Ratify Letter of Response.

5.                   Request Humboldt County Board of Supervisors Consider Adopting Resolution 10-___ Supporting Proposition 21 - the 2010 State Parks and Wildlife Conservation Initiative. (Supervisor Duffy)

RECOMMENDATION: Adopt Resolution 10-___ Supporting Proposition 21 - the 2010 State Parks and Wildlife Conservation Initiative.

6.                   Letter of Support for Small Business Jobs Creation Package for the CA Small Business Development Centers (CA SBDC). (Supervisor Clendenen)

RECOMMENDATION: Ratify the Letter of Support.

Clerk of the Board

7.                   Approval of Board Orders - Meeting of August 24, 2010.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders.

8.                   Approval of Board Orders - Meeting of July 27, 2010.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of July 27, 2010.

Community Development Services

9.                   Release from Conveyance and Agreement to allow construction of a Secondary Dwelling unit on Lot 5 (Currently APN 511-042-15) of the Myrtle Grove Final Map Subdivision File No.: APN 511-042-09; Case Nos.: FMS-0-01/CDP-04-02 & CDP-07-28; McKinleyville.

RECOMMENDATION: That the Board of Supervisors consider the application, authorize the Chair of the Board to execute the Quitclaim and Partial Reconveyance (for Development Restrictions) for Lot 5 of the Myrtle Grove Final Map Subdivision; direct the Community Development Services - Current Planning Division to record the Quitclaim and Partial Reconveyance (for Development Restrictions) and direct the Clerk of the Board to give notice of the decision to the applicant and any other interested party.

10.               Supplemental Budget for Fund 1120, Budget Unit 275, Economic Development Division, FY 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Fund 1120, Budget unit 275, Economic Development Division and direct the Auditor-Controller to incorporate the attached supplemental budget.


11.               Appointment to the Workforce Investment Board.

RECOMMENDATION: That the Board of Supervisors receive staff report; review membership application for Kelly Remington - Program Manager; Foster/Kinship Care & Independent Living College of the Redwoods and appoint Kelly Remington to the Workforce Investment Board for a term of two years effective immediately, in accordance with the WIB bylaws.

County Administrative Office

12.               Temporary Increase in Compensation for Program Coordinator Karen Clower.

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Program Coordinator Karen Clower of Twenty salary ranges beginning September 5, 2010 and continuing until March 5, 2011, unless terminated sooner by additional Board action, pursuant to Section 7 of the Humboldt County Salary Resolution. (4/5 vote required)

13.               Supplemental Budget for Forester and Warden Budget Unit for Fiscal Year 2009-10.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget in the amount of $38,754 for Fund 1100, Budget Unit #281 Forester and Warden for Fiscal Year (FY) 2009-10.

Health and Human Services - Social Services Branch

14.               Clarify and Ratify Salary Step Increases for American Reinvestment and Recovery Act (ARRA) Grant Positions.

RECOMMENDATION: That the Board of Supervisors clarify Board actions taken on October 6, 2009 and October 27, 2009 in relation to ARRA grant positions and receipt of benefits "as any full-time county employee" to include salary step increases; and ratify salary step increases for eligible ARRA grant positions.

Library Services

15.               Donations made to the Library and Supplemental Budget in Fund 1500, Budget Unit 621, County Library.

RECOMMENDATION: That the Board of Supervisors accept donations made to the Library in the amount of $53,276.79 in support of the Library's programs and services, and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 1.

Personnel

16.               Approve an exception to the hiring freeze for the Assistant Personnel Director position in budget unit 130, Personnel.

RECOMMENDATION: That the Board of Supervisors approve an exception to the hiring freeze for the Assistant Personnel Director (salary range 488, class 0651, position 01) position in Budget unit 130 with a starting date not prior to October 18, 2010.

Public Works

17.               Agreement for Services for Redway Monument Preservation Fund Survey.

RECOMMENDATION: That the Board of Supervisors approve the agreement with Barry Kolstad, Professional Land Surveyor, to complete the Redway Monument Preservation Fund Project; authorize the Chair to execute the attached agreement in duplicate; direct the Clerk of the Board to transmit both copies of the executed agreement to the Land Use Division for further processing; approve the attached supplemental budget.

18.               Agreement for Engineering Design Services for Runway 14 Bluff Stabilization at the Arcata/Eureka Airport: Airport Improvement Program Grant 03-06-0010-38, Project No. 919265.

RECOMMENDATION: That the Board of Supervisors authorize, approve and ratify the Director of Public Works' execution of the FAA Grant Offer for design of the Runway 14 Bluff Stabilization Project AIP 03-06-0010-38 for $387,737 to provide funding Project as offered by the Federal Aviation Administration (FAA); Authorize the Chair to sign four copies of the agreement for Airport Consulting with mead and hunt, for an amount not to exceed Two Hundred Nineteen Thousand Dollars ($219,000); direct the Clerk of the Board to return three fully executed copies to Public Works; adopt the attached supplemental budget for FY 2010/11.

Sheriff

19.               Supplemental Budget in Sheriff's Homeland Security Budget 1100 213 for Expenditure of Funding from the FFY 2010 Governor's Office of Homeland Security Grant.

RECOMMENDATION: That the Board of supplemental budget in the amount of $470,266 to purchase approved expenditures under the U.S. Department of Homeland Security grant through the Governors Office of Homeland Security.

20.               Approve a Supplemental Budget in Sheriff's Budget 1100 221 for FY 2010/2011 in the amount of $63,670 for Fingerprint Trust Fund Costs.

RECOMMENDATION: That the Board of Supervisors approve the attached supplemental budget in budget unit 1100-221 in the amount of $63,670 for costs no longer payable directly through the trust.

Treasurer-Tax Collector

21.               Classification Audit-Administrative Services Officer.

RECOMMENDATION: That the Board of Supervisors approve the disallocation of the vacant full-time Assistant Treasurer-Tax Collector (salary range 475, class 0682, position #01) in budget unit 112 effective immediately; approve the allocation of one full time Administrative Services Officer (salary range 409, class 0776) in budget unit 112 effective immediately; and exempt the newly allocated Administrative Services Officer position for the hiring freeze effective immediately.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim September 2010 as Local Food Month in Humboldt County. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim September 2010 as Thyroid Cancer Awareness Month. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

3.                   Proclaim the Week of September 5th - 11th as Suicide Prevention Week. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

4.                   Proclaim September 2010 as Prostate Cancer Awareness Month. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

5.                   Presentation on the Bat n' Rouge Benefit for the Arcata Ridge Trail Project. (Supervisor Lovelace)

RECOMMENDATION: Hear the presentation and take appropriate action, if required.

F.                  MATTERS INITIATED BY BOARD MEMBERS

1.                   Standing Item--Reports on Board Member Travel at County Cost, Meeting Attendance, and Supervisorial District Matters.

2.                   Status Update on Discussions Regarding Humboldt County's Allocation of Water from the Trinity Reservoir Pursuant to the 1955 Trinity River Act. (Supervisor Lovelace)

RECOMMENDATION: That the Board of Supervisors discuss and reaffirm the County's commitment to obtaining the annual release of no less than 50,000 acre/feet of water from the Trinity Reservoir; designate Supervisors Duffy and Lovelace as the contact persons for any further discussions with any parties relative to this issue; and authorize Chair to sign letter to the Bureau of Reclamation reaffirming the County's commitment, informing them of the designated contact persons, and calling upon the Bureau to finally honor its long-standing contractual obligation to Humboldt County.

G.                 DEPARTMENT REPORTS

County Administrative Office

1.                   Standing Item - State and Federal Budget Update.

RECOMMENDATION: Hear report and take appropriate action.

Sheriff

2.                   Supplemental Budget, Exception to the Hiring Freeze and Revised Open Hours Schedule for the Humboldt County Animal Shelter.

RECOMMENDATION: That the Board of Supervisors approves a supplemental budget in the amount of $25,360; approves an exception to the hiring freeze for one (1) Office Assistant I/II position number 01, class 0179, range 250/281, effective immediately; approves a amendment to Resolution No. 82-170 rescinding Resolution No. 09-41 in regards to changes in Office hours, in particular the open hours schedule for the Sheriff's Animal Shelter by adopting either (a) Tuesday through Saturday, 10:00 a.m. - 4:00 p.m. or (b) Monday, Wednesday and Friday, 10:00 a.m. - 4:00 p.m. and Tuesday and Thursday 10:00 a.m. - 7:00 p.m.; and allow the Sheriff the ability to temporarily close the facility when staffing levels fall below adequate staffing levels to provide extended hours of service.

In Home Supportive Services

3.                   Delegating Authority to Act on Behalf of Humboldt County In-Home Supportive Services Public Entity (IHSS) with regard to Official Matters of California State Association of Counties Excess Insurance Authority. (CSAC-EIA)

RECOMMENDATION: That the Board of Supervisors adjourn as Humboldt County Board of Supervisors; convene as the Governing Board of the Humboldt County In-Home Supportive Services Public Authority and consider the following agenda: a. approve the attached resolution to delegate authority to the Humboldt County Risk Manager and the Executive Director Humboldt County In-Home Supportive Services Public Authority to act on behalf of In-Home Supportive Services (IHSS) on matters related to the California State Association of Counties Excess Insurance Authority (CSAC-EIA); adjourn as Governing Board of the Humboldt County In-Home Supportive Services Public Authority and convene as Humboldt County Board of Supervisors.

1.                   Resolution Recognizing the Arcata-Camoapa Sister City Project and Welcoming Visitors from Camoapa, Nicaragua. (Supervisor Lovelace)

RECOMMENDATION: Greet visitors and adopt the Resolution.

10:30 A.M. - PUBLIC WORKS

2.                   Feasibility Study for Regional Community Forest System.

RECOMMENDATION: That the Board of Supervisors receive a staff report from Public Works and comments from representatives of an informal working group regarding the concept of a regional community forest system; receive additional comments from the interested public; and authorize the Chair of the Board to sign the attached support letter for a proposal to the Wyerhauser Family Foundation for grant funds to assess the feasibility of developing and managing a Humboldt Bay Region Community Forest.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public testimony; close the public hearing; make the necessary findings prepared by Community Development Services - Current Planning Division Staff; approve the General Plan Amendment , Zone Reclassification and Special Permit subject to the recommended conditions of approval; adopt resolution No. ___, adopt the Planning Commissions findings, and approve the amendment of the Humboldt County General Plan (Garberville, Benbow, Alderpoint Community Plan (GRBAP)) land use map, by amending property in the Garberville area (GPA-09-03, Chautauqua Natural Foods) from Residential Multiple Family to Commercial General (CG); adopt ordinance No. ____ amending Section 311-7 of the Humboldt County Code by reclassifying property in the Garberville area from Apartment Professional to Community Commercial with an "S" Development Standard combing zone; direct current Planning Division Staff to prepare and file a Notice of Exception with the County Clerk and Office of Planning and Research; direct the Clerk of the Board to give notice of the decision to the applicant, the County Assessor's Office and any other interested party, and to publish summaries of the Ordinance five days prior to and 15 days after adoption by the Board.
