B.                  MODIFICATIONS TO THE AGENDA

1.                   Letters to Governor in Support or Opposition to 2009-10 Legislation. (CONSENT)

RECOMMENDATION: That the Board of Supervisors authorize the County Administrative Officer to submit letters to the Governor requesting signature or veto of legislation that would impact the County and take other action as appropriate.

2.                   Temporary Increase in Compensation for Accountant/Auditor II, Charlotte Merkel.

RECOMMENDATION: That the Board of Supervisors approve a temporary increase in compensation for Accountant/Auditor II, Charlotte Merkel, of 19 (nineteen) salary ranges retroactive to July 1, 2010, and continuing until the vacant Senior Accountant/Auditor (position number 3) is filled pursuant to Section 7 of the Humboldt County Salary Resolution.

3.                   Payroll Clearing Appropriation Transfer for Fiscal Year 2009-2010.

RECOMMENDATION: That the Board approve the attached fiscal year 2009-2010 appropriation transfer for $488,595 and authorize the Auditor-Controller to make minor budget adjustments as needed to provide sufficient appropriations to cover actual expenditures for fiscal year 2009-2010.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Auditor-Controller

1.                   FY 2010-2011 Appropriation Limits.

RECOMMENDATION: That the Board of Supervisors approve the attached resolution and schedules setting forth the FY 2010-2011 appropriation limits in accordance with Article XIIIB of the California Constitution and California Government Code, Title 1, Division 9.

2.                   Distribution of Excess Proceeds from Tax Sale on June 26, 2009.

RECOMMENDATION: That the Board of Supervisors approves the distribution of that portion of the excess proceeds resulting from the June 26,2009 public auction of parcels listed on Attachment A to the claimants and in the amounts listed for each parcel.

3.                   Resolution Recognizing Leroy Gates and James Meade for Their Leadership Role in Establishing Fixed Base Operations at Rohnerville Airport. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

4.                   Approval of the Board Orders - September 7, 2010

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of September 7, 2010.

Community Development Services

5.                   Supplemental Budget for Fund 1100, Budget Unit 262, Building Inspection Division, Community Development Services FY 2009-2010.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget in Fund 1100, Budget Unit 262, Building Inspection Division of the Community Development Services Department and direct the Auditor Controller to incorporate the attached supplemental budget.

County Administrative Office

6.                   Secure Rural Schools and Community Self- Determination Act as Reauthorized by Public Law 110-343.

RECOMMENDATION: That the Board of Supervisors approve the attached letter electing to reserve 8 percent of funding for Title II projects and 7 percent for Title III projects received under the Secure Rural Schools and Community Self-Determination Act as reauthorized by Public Law 110-343.

Library Services

7.                   Grant Award from the California State Library for Public Library Staff Education Program and Supplemental Budget (Fiscal Year 2010-2011).

RECOMMENDATION: That the Board of Supervisors approves the Grant Award from the California State Library for the Public Library Staff Education Program; authorizes Victor Zazueta, Director of Library Services, to sign one (1) copy of each Grant Award Certifications and Certifications Regarding Lobbying, Debarment, Suspension and other Responsibility Matter, and Drug-Free Workplace Requirements; authorizes Michael Giacone, Auditor-Controller, or his designee to sign one (1) copy of the Financial Claim and send the original to the County Library for submission to the California State Library; and adopts a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorizes the Auditor-Controller to supplement the budget as shown in Attachment 1.

Public Works

8.                   Arcata-Eureka Airport Passenger Terminal Re-Roofing and Replace Baggage Claim: Project 913270 and Supplemental Budget for FY 2010/11.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for the project mentioned above; awards the project to the lowest responsible and responsive bidder, Sierra Single Ply, Inc., McClellan, California, in the amount of $298,000 for the base bid; authorizes the Chairman to execute the agreement with Sierra Single Ply, Inc., when staff approves the bonds and insurance, and adopts the attached supplemental budget for FY 2010/11.

9.                   Pay Differential for Brooke Epperly, Fiscal Assistant II.

RECOMMENDATION: That the Board of Supervisors authorizes the continuance of the temporary increase in compensation of ten (10) salary ranges for Brooke Epperly, Fiscal Assistant II from October 3, 2010 and continuing through December 25, 2010 or until the Public Works Dispatcher returns, whichever occurs first, pursuant to Section 7 of the Humboldt County Salary Resolution.

10.               Supplemental Budget Request for the Bicycle Transportation Account Project in FY 2010/11.

RECOMMENDATION: That the Board of Supervisors adopts the following supplemental budget for FY 2010/11: Revenue: 1150715-523215, Bicycle Transportation Account, $8,500, Expenditure: 1150715-2118, Professional and Special Service, $8,500, Source of Funding: Bicycle and Trailways (1140715) - Bicycle Transportation Account.

11.               Supplemental Budget for Water Management - Fiscal Year 2010/11.

RECOMMENDATION: That the Board of Supervisors approves the following Supplemental Budget: Revenue: 1100251-707010, Miscellaneous Revenue, $3,371. Expenditure: 1100251-2123, Special Departmental Expense, $3,371.

12.               Construction of Storm Damage Repairs on Alderpoint Road (6B165) at PM 36.98: Project No. ER-4400 (045); Contract No. 206374.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Construction of Storm Damage Repairs on Alderpoint Rd (6B165) at PM 36.98; awards the contract to GR Wilcox Enterprises, Inc. for the total amount of $325,255.25; authorizes the Chair to execute the project agreement upon submittal of the appropriate bonds and insurance; and directs the Auditor-Controller to establish a new contract account 1200321-0258 and transfer $341,518.00 to the account per the attached appropriation transfer.

13.               Storm Damage Repair on Lower Cappell Road at PM 1.3 & PM 2.5 and Upper Cappell Road at PM 2.5, Project No. PW-717 &PW-1146, Contract No. 206207 & 206296.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Storm Damage Repair on Lower and Upper Cappell Roads at PM 1.3 & 2.5 and PM 2.5; awards the contract to Kapel Construction, Inc. for the total amount of $112.880.00; authorizes the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and directs the Auditor-Controller to establish a new contract account 1200321-0259 and transfer $118,524.00 to the account per the attached appropriation transfer.

14.               Storm Damage Repair on Sprowel Creek Road (6B095) at PM .060: Project No. ER-4400(074), Contract No. 206410.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Storm Damage Repair on Sprowel Creek Road at PM 0.60; awards the contract to Ken's Water Tender, Inc. for the total amount of $32,720; authorizes the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and directs the Auditor-Controller to establish a new contract account 1200321-0257 and transfer $35,992 to the account per the attached appropriation transfer.

15.               Freshwater Park Rehabilitation and Access Project; Project No. C-0207588; Contract No. 713690.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Freshwater County Park Rehabilitation and Access Project; awards the contract to GR Sundberg, Inc. for the total amount of $165,642.10; and authorizes the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance.

16.               Storm Damage Repair on Mattole Road (F3C010 ) at PM 35.91; Project No. ER-4400 (070); Contract No. 206406.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Storm Damage Repair on Mattole Road at PM 35.91; awards the contract to GR Sundberg, Inc. for the total amount of $146,480; authorizes the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance and directs the Auditor-Controller to establish a new contract account 1200321-0260 and transfer $153,804 to the account per the attached appropriation transfer.

1.                   Proclaim September 2010 as National Recovery Month in Humboldt County. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

RECOMMENDATION: That the Board of Supervisors receives and files this supplemental report.

1.                   2010 Legislative Advocacy Update and 2011 Legislative Platform Kickoff.

RECOMMENDATION: That the Board of Supervisors receives a report from State legislative advocates Paul Yoder and Karen Lange, and take action as may be appropriate; approves the attached Legislative Platform Timeline and directs department heads to participate in the development of the Legislative Platform in cooperation with the County Administrative Officer and legislative advocates.

2.                   St. Joseph Health System, Humboldt County Presentation on Addressing Childhood Obesity. (Supervisor Clendenen)

RECOMMENDATION: Hear the presentation and take appropriate action, if required.

Auditor-Controller

1.                   Resolution Adopting 2010-11 Budgets for Special Districts Governed by the Board of Supervisors.

RECOMMENDATION: That the Board of Supervisors adjourns and reconvenes as the Board of Directors of those Special Districts governed by the Board of Supervisors and opens the public hearing, receives reports from staff, receives testimony from public, closes the public hearing, and approves and adopts the 2010-11 budgets for Special Districts governed by the Board of Supervisors.
