B.                  MODIFICATIONS TO THE AGENDA

1.                   Arcata-Eureka Airport Runway Safety Project (DEPARTMENTAL).

RECOMMENDATION: That the Board of Supervisors receive an update on the Arcata-Eureka Runway Safety Area Project from the Department of Public Works.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.


Agricultural Commissioner

1.                   Approval of Standard Agreement No. 10-0328, Pierce's Disease Control Program Contract in the amount of $28,000.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 10-0328, Pierce's Disease Control Program contract between Humboldt County and the California Department of Food and Agriculture; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification, and direct the Clerk of the Board to return all copies along with the Board Order to Agriculture Department for further processing; grant a waiver of the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the attached supplemental budget for 2010-11.

2.                   Approval of Standard Agreement No. 10-0483, European Grapevine Moth Program Contract in the amount of $3,641.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement NO. 10-0483, known as the European Grapevine Moth Program Contract between Humboldt County and the California Department of Food and Agriculture; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification, and direct the Clerk of the Board to return all copies along with the Board Order the Agriculture Department for further processing; grant a waiver from the provisions of the Nuclear Free Ordinance; and authorize the Auditor-Controller to execute the attached supplemental budget for 2010-11.

Board of Supervisors

3.                   Distinguished Service Award Presented to the Crew of the USS Pueblo. (Supervisor Smith & Supervisor Clendenen)

RECOMMENDATION: Ratify the Distinguished Service Award.

4.                   Memorandum of Understanding (MOU) to Establish the Intentions and Commitment by the Orick Community Services District, National Park Service Redwood National and State Parks, Humboldt State University, and County of Humboldt to Work Collaboratively on the Planning of a Wastewater Treatment Facility in the Community of Orick. (Supervisor Duffy)

RECOMMENDATION: That the Board of Supervisors reviews and signs the MOU to participate and cooperate in the collaborative project of planning a Wastewater Treatment Facility in Orick.

Community Development Services

5.                   Appointments to the Workforce Investment Board Green Employer Council. (CONSENT)

RECOMMENDATION: That the Board of Supervisors receive staff report; review membership applications for the following community members: Isaac Lyons - Humboldt Homes and Creative Conservation and Randall Hansen - Express Employment Professionals; and appoint Isaac Lyons to the Workforce Investment Board (WIB) Green Employer Council for a term of 2 years effective immediately, in accordance with the Green Employer Council bylaws.

Cooperative Extension

6.                   Supplemental Budget for Fund 1100, Budget Unit 632 Cooperative Extension for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board approves the attached supplemental budget request for Budget Unit 632.


County Administrative Office

7.                   Local Business Preference Policy

RECOMMENDATION: That the Board of Supervisors find that a local business preference policy will promote local business with in the County; find that a local business preference policy will provide local businesses with increased access to County Business; and enact the attached Local Business Preference Policy.

8.                   Humboldt County Sign Shop Settlement and Rebuilding Project.

RECOMMENDATION: That the Board of Supervisors accept and approve the Partial Proof of Loss from Lexington Insurance Company in the amount of $497,675 for the loss of the County's Sign Shop as a result of a fire on March 2, 20-3 at Second and J Street; direct the Risk Manager, on behalf of the Board of Supervisors, to execute partial and Final Proof of Loss documents; appove the new Sign Shop location at 75 Hookton Cemetery Road, Loleta; and authorize and direct the Public Works Director to develop plans and specifications to construct a replacement Sign Shop building 75 Hookton Cemetery Road, Loleta, CA. for costs not to exceed the insurance amount of $497,675.

9.                   Request for Support from the City of Albany for Vehicle Use Exemption for U.S. Highway 101 Richardson Grove Area.

RECOMMENDATION: That the Board of Supervisors send a letter to the City of Albany requesting support for future Humboldt County sponsored legislation related to the vehicle use exemption for U.S. Highway 101 Richardson Grove area.

County Counsel

10.               Resolution Amending Resolution No. 08-84 of the Conflict of Interest Code for the County of Humboldt and Rescinding Resolution No. 09-21.

RECOMMENDATION: That the Board of Supervisors adopt the Resolution Amending Resolution No. 08-84 of the Conflict of Interest Code for the County of Humboldt and Rescinding Resolution No. 09-21.

Health and Human Services - Social Services Branch

11.               Approval of Contract with Prevent Child Abuse California for the AmeriCorps Child Welfare Services (CWS) Improvement Activities Grant Agreement.

RECOMMENDATION: That the Board of Supervisors approve the Contract with Prevent Child Abuse California for the AmeriCorps for the AmeriCorps Child Welfare Services (CWS) Improvement Activities Grant; authorize the Chair to execute four copies of the Contract in blue ink as requested by the State; and direct the Board to route three copies of the contract to the Director of Department of Health and Human Services Social Services Branch.

Public Works

12.               Supplemental Budget for Agricultural Building Floor Repair/Replacement.

RECOMMENDATION: That the Board of Supervisors adopts the attached supplemental budget for FY 2010/11.

13.               Approve the Amendments to Solid Waste Franchise Agreements with Arcata Garbage Company and Eel River Disposal and Resource Recovery, Inc.

RECOMMENDATION: That the Board of Supervisors find that 1.1 extension of each of the listed franchise agreements is necessary for public health, safety, and well-being; and 1.2 the existing contract holders have substantially complied with the terms of the existing franchise agreements; approve


14.               License Agreement with Timothy E. Frost DBA Grounds Keeper Landscape Maintenance, Arcata/Eureka Airport.

RECOMMENDATION: That the Board of Supervisors by a 4/5's vote authorize the Chairperson to terminate the current License Agreement with Timothy E. Frost dba Grounds Keeper Landscape Maintenance; approve and authorize the Chairperson to execute the attached License Agreement with Timothy E. Frost dba Grounds Keeper Landscape Maintenance in duplicate; and direct the Clerk of the Board to return, in duplicate, the executed License Agreement to the Land Use Division.

Sheriff

15.               Approve exception to the Hiring Freeze for one Correctional Cook Position and two Legal Office Assistant I/II Positions.

RECOMMENDATION: That the Board of Supervisors approves an exception to the hiring freeze for one full time Correctional Cook (salary range 274/296, class 0178, and position numbers 02 and 03) positions in budget unit 243, effective immediately.

16.               Supplemental Budget in the amount of $38,993 in BU 1100243 (Sheriff-Jail) for Implementation of Spartina Densiflora Eradication.

RECOMMENDATION: That the Board of Supervisors approves a supplemental budget in the amount of $38,993 in budget unit 1100243 to implement contract with Humboldt Bay National Wildlife Refuge and Humboldt bay Harbor District to eradicate Spartina densiflora.

17.               Establish Budget Unit 1100264 in the amount of $61,585 Public Safety Interoperable Communications (PSIC) Grant.

RECOMMENDATION: That the Board of Supervisors approve the establishment of budget unit 110264, Public Safety Interoperable Communications in the amount of $61,585 as attached.

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim October 2, 2010 as Apple Harvest Day in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

2.                   Distinguished Service Award for Pamela McKnight. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign Distinguished Service Award.

1.                   Discussion of the Humboldt Bay Harbor, Recreation and Conservation District Resolution 2010-14 Endorsing the Unified Marine Protected Area Array. (Supervisor Smith)

RECOMMENDATION: Take appropriate action, if required.

County Administrative Office

1.                   Standing Item - State and Federal Budget Update.

RECOMMENDATION: Hear report and take appropriate action.


Community Development Services

2.                   Approval of the Headwaters Fund Board's Recommended 2010-11 Grant Fund Awards for the July 1, 2010 Grant Round.

RECOMMENDATION: That the Board of Supervisors review and approve the slate of Grant Fund Competitive Awards recommended for approval by the Headwaters Fund Board (HFB) (Attachment 1; Attachment 2); and authorize the Chair of the Board to sign the grant contracts when completed, after review and approval by County Counsel and Risk Management.

In Home Supportive Services Public Authority

3.                   Appointment of Andrew R. Buschkamp to the Humboldt County In-Home Supportive Services Advisory Board.

RECOMMENDATION: That the Board of Supervisors adjourn as Humboldt County Board of Supervisors and Convene as the Governing Board of the Humboldt County In-Home Supportive Services Public Authority and consider the following agenda: a. Approve the appointment of Andrew Bushkamp to the Humboldt County In-Home Supportive Advisory Board in the capacity of a Recipient Representative, b. Adjourn; Reconvene as Humboldt County Board of Supervisors.

Library

4.                   Temporary Closure of the Trinidad Branch Library.

RECOMMENDATION: That the Board of Supervisors authorize the temporary closure of the Trinidad Branch of the Humboldt County Library following its final day of services on Saturday, October 2, 2010, resulting from the notice of cancellation of the County's license agreement from the Trinidad Unified School District, and further approve the suspension of operation hours at the Trinidad Branch of the Humboldt County Library until an alternative site to provide library services can be found, an agreement for occupancy achieved, and library services resumed to the community of Trinidad.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22; hold an administrative hearing to determine whether a public nuisance exists on the subject property and adopt findings and issue an Order consistent with the evidence presented at the hearing.

2.                   Administrative Abatement Hearing Cyndra Ball, Phillipsville Loop Road, Phillipsville, California: AP# 214-061-007.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-21 and 351-22; hold an administrative hearing to determine whether a public nuisance exists on the subject property; adopt Findings and issue and Order consistent with the evidence presented at the hearing.
