B.                  MODIFICATIONS TO THE AGENDA

1.                   Approval of Resolution Encouraging the Marine Life Protection Act Initiative Blue Ribbon Task Force and California Fish and Game to Support and Adopt the Regional Stakeholder Group Marine Protected Area (MPA) Array Proposal (Unified MPA Array).

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution encouraging the Marine Life Protection Act Initiative Blue Ribbon Task Force and California Fish and game commission to support and adopt the Unified Marine Protected Area Array Proposal that was developed by the Regional Stakeholder Group during round three of the North Coast Marine Life Protection Act Initiative process.

Board of Supervisors

1.                   Letter of Appreciation to Cynthia Sutcliffe for Serving on the Humboldt County Status of Women Commission. (Supervisor Duffy)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

2.                   Letter of Appreciation to John Chiv for Serving on the Humboldt County Status of Women Commission. (Supervisor Neely)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation

3.                   Salt River Ecosystem Restoration Project, Humboldt County Letter of Support. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter of support.

Community Development Services

4.                   Appointments to the Workforce Investment Board and Youth Council.

RECOMMENDATION: That the Board of Supervisors reviews membership applications for the following community members: Mark Greenleaf, California State University Employee's Union and Connie Lorenzo, Humboldt County DHHS Employment Training Division; and appoint Mark Greenleaf to the Humboldt County Workforce Investment Board (WIB) for a term of two years and Connie Lorenzo to the WIB Youth Council (WIB-YC) for a term of three years, effective immediately, in accordance with WIB bylaws.

Health and Human Services - Mental Health Branch

5.                   Approval of Revised Agreement Between Humboldt County and Netsmart Technologies, Inc.

RECOMMENDATION: That the Board of Supervisors approves and authorizes the Chair to sign the revised Agreement (Attachment 1) with Netsmart Technologies and approves and authorizes the DHHS-Mental Health Branch Director to terminate the existing Agreement (Attachment 2) with Netsmart Technologies as per Section 14, Term and Termination, subsection (c).

Public Works

6.                   Request for Proposals from Engineering Firms to Perform Construction Management Services for the Retrofit and Rehabilitation of Martin's Ferry Bridge.

RECOMMENDATION: That the Board of Supervisors authorizes the Director of Public Works to advertise and distribute the Request for Proposal (RFP) from qualified firms for construction management services during the retrofit and rehabilitation of Martin's Ferry Bridge (AC007) on Bald Hills Road; and further authorizes the Director to negotiate with the selected firm to develop a contract for review and authorization by the Board of Supervisors.

7.                   Supplemental Budget for FY 2010/11 for the Rohnerville Airport Ramp Design Aviation Capital Project 919262, AIP Grant 03-06-0083-08.

RECOMMENDATION: That the Board of Supervisors adopts the following supplemental budget for FY 2010/11: Revenue: 1490170-532034 - Rohnerville Airport - $43,795; 1490170-532032 - Local Share - $2,305; Expenditure: 1490170-8889 - Rohnerville Improvements - $46,100.

Sheriff

8.                   Establish Fixed Asset Account and Approve Appropriation Transfer.

RECOMMENDATION: That the Board of Supervisors approves the establishment of fixed asset account 8976 (Camera-Digital) and approves the attached Budget Appropriation Transfer (BAT).

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim October 3rd through October 9th, 2010 as National 4-H Week in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim October 2010 as United Way Month in Humboldt County. ((Supervisors Smith and Neely)

RECOMMENDATION: Adopt the Proclamation.

3.                   Domestic Violence Awareness Month Proclamation. (Supervisor Neely)

RECOMMENDATION: Adopt the Proclamation.

4.                   Proclaim the Week of October 4 - 15, 2010 as Binational Health Week in Humboldt County. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Proclamation.

5.                   The Great California Shake Out Proclamation. (Supervisor Smith and Supervisor Duffy)

RECOMMENDATION: Adopt the Proclamation.

6.                   Proclaim October 6, 2010 as Walk to School Day in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Adopt the Proclamation.

County Administrative Office

1.                   Standing Item - State and Federal Budget Update.

RECOMMENDATION: Hear report and take appropriate action.

Department of Health and Human Services - Public Health Branch

2.                   Adoption of Ordinance Amending Sections 551-2, 551-4, 551-5, 551-8, 551-9, 551-10, and 551-11 of Title V of the Humboldt County Code Relating to Emergency Services System and Regulation of Ambulance Service.

RECOMMENDATION: That the Board of Supervisors introduce by title, Ordinance No. _____ (Attachment 1), changing Sections 551-2, 551-4, 551-5, 551-8, 551-9, 551-10, and 551-11 of the Humboldt County Code and waive the first reading of the Ordinance; set the Ordinance for adoption at least one week away; and direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance (Attachment II), and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five days prior to the Board meeting at which the Ordinance will be adopted per GC Section 25124(b)(1), and direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post-adoption summary of the Ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance per GC Section 25124(b)(1); and confirm designation of Humboldt County Health Officer as the Permit Officer for County Emergency Medical Services System and Regulation of Ambulance Service pursuant to Humboldt County Code Section 551-2(r).

1.                   Presentation/Report on the American Recovery and Reinvestment Act of 2009, Temporary Assistance for Needy Families - Emergency Contingency Fund Activities within Humboldt County.

RECOMMENDATION: That the Board of Supervisors receives a report on the American Recovery and Reinvestment Act of 2009, Temporary Assistance for Needy Families - Emegency Contingency Fund activities with Humboldt County.

I.                     CLOSED SESSION

1.                   Conference with Legal Counsel - Initiation of Litigation pursuant to Government Code section 54956.9(c), (one case).

RECOMMENDATION:

2.                   It is the intention of the Board of Supervisors to meet in closed session to consider the Public Employee Performance Evaluation for the position of County Administrative Officer pursuant to Government Code. sections 54954.5 and 54957.
