B.                  MODIFICATIONS TO THE AGENDA

1.                   Board Orders - December 14, 2010.  (CONSENT)

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the December 14, 2010 Board Meeting.

C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Clerk of the Board

1.                   Humboldt County Fair Association 2011 Operating Budget.

RECOMMENDATION: That the Board of Supervisors approve the request, and direct the Chair of the Board and the Clerk of the Board to sign the operating budget.  Direct the Clerk of the Board to return a fully executed copy of the operating budget to Stuart Titus, General Manager of the Humboldt County Fair Association, 1250 5th Street, Ferndale, CA  95536.

Community Development Services

2.                   Agreement between Humboldt County Community Development Services Economic Development and Humboldt County Department of Health and Human Services (DHHS) for the Use of Workforce Investment act (WIA) Funds to Serve Adults

RECOMMENDATION: That the Board of Supervisors receive the staff report; approve and authorize the Chairperson of the Board to sign the proposed Agreement for the provision of Workforce Investment Act funds to serve adults between the Director of the Humboldt County Community Development Services Department and the Director of the Humboldt County Department of Health and Human Services; approve and authorize the Executive Director of the Workforce Investment Board (WIB) and the Department of Health and Human Services, Social Services Branch Director to sign WIA Adult Funding Grant Implementation Plans (AFGIP) for current and any future Adult funding as it becomes available; support and affirm future collaboration between the Directors of Community Development Services and Department of Health and Human Services, in preparing similar agreements for approval by the Board for the provision of additional WIB funding allocated to DHHS.

County Administrative Office

3.                   State of California Standard Agreement No. C1000168 between the Franchise Tax Board - Court Ordered Debt (FTB-COD) Collection Program and County of Humboldt, Revenue Recovery.

RECOMMENDATION: That the Board of Supervisors authorize the County Administrative Officer to sign the State of California Standard Agreement Number C1000168 between the Franchise Tax Board-Court Ordered Debt (FTB-COD) Collection Program and County of Humboldt, Revenue Recovery.

County Clerk-Recorder

4.                   Biennial Conflict of Interest Code-Special and School Districts.

RECOMMENDATION: That the Board of Supervisors approve the recommended changes being made by Eureka City Schools, Humboldt Bay Municipal Water District, Humboldt County Office of Education, Loleta Community Services District, McKinleyville Community Services District, and Phillipsville Community Services District.

Library Services

5.                   Reallocation of Office Assistant I/II (Full Time).

RECOMMENDATION: That the Board of Supervisors approve the reallocation of the 40 hour Office Assistant I/II (salary range 250/281, class 0179) position in budget unit 1500 621, currently occupied by Heather Brogoitti, to the 37.5 hour class of Office Assistant I/II (salary range 237/268, class 0180); and that the change be effective the beginning of the biweekly pay period following approval.

Public Works

6.                   Redwood Drive (6B105) Rehabilitation and Overlay at PM 3.11 to 4.85; Project No.: ESPL 5904 (104), Contract No.: 202710.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Redwood Drive Rehabilitation and Overlay; award the contract to Mercer Fraser Company, Inc. including additive bid number 2 for the total amount of $608,458.00; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0261 and transfer $669,304 to the account per the attached appropriation transfer.

7.                   Petition to Form Permanent Road Division (PRD) No. 1000, Zone No. 006, School Ridge Subdivision, McKinleyville.

RECOMMENDATION: That the Board of Supervisors receive and file the petition, affidavit of valuation, and engineer's report for the creation of Permanent Road Division No. 1000, Zone No. 006; adopt the Resolution of INtent to establish Permanent Road Divisions No. 1000, Zone No. 006 and to Impose Parcel Charges for road maintenance; set a time and date of 1:30 PM or soon thereafter on 03/01/2011 to hold a public hearing to receive testimony of protest regarding the formation and setting of an assessment for road maintenance for the proposed Permanent Road Division No. 1000, Zone No. 006; direct the Clerk of the Board to publish the petition, notice of formation, and notice of assessment as per Streets and Highways Code 1164 and 1196; and direct the Department of Public Works to mail the notice of assessment and ballot to all landowners within the proposed zone as per Government Code 53753.

8.                   Approve Exception to the Hiring Freeze for 5.0 Correctional Officer I/II Positions and 2.0 Deputy Sheriff I/II Positions.

RECOMMENDATION: That the Clerk of the Board of Supervisors approve an exception to the hiring freeze for 5.0 full time equivalent (FTE) Correctional Officer I/II (salary range 324/344, class 0424 position numbers 13, 20, 36, 38, 58) position in budget unit 1100243, and 2.0 Deputy Sheriff I/II (salary range 379/394, class 0416, position numbers 25, 68) in budget unit 1100221 effective the first pay period following approval.

1.                   Proclaim January 2011 as National Mentoring Month in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Adopt the proclamation.

RECOMMENDATION: That the Board of Surpervisors receive an oral report from the County Administrative Officer on the Governor's Proposed State Budget, and various other topics, and take action as may be required.

1.                   Department of Health and Human Services' response to informatioal materials presented to the Board of Supervisors on August 24, 2010 regarding the health and safety risks and benefits of raw milk.

RECOMMENDATION: That the Board of Supervisors receive the Department of Health and Human Services response to the raw milk materials presented to the Board of August 24, 2010 and take action as appropriate.
