B.                  MODIFICATIONS TO THE AGENDA

1.                   Resolution Confirming the Existence of a Local Emergency related to the March 11, 2011 Tsunami Event. (Supervisor Lovelace)

RECOMMENDATION: Adopt a Resolution confirming the actions of the Director of the Office of Emergency Services in declaring the existence of a Local Emergency and consider requesting the Governor proclaim a State of Emergency, if necessary.  Direct the Office of Emergency Services to transmit the Resolution to the California Emergency Management Agency. Commend the work of County staff working in the County's Emergency Operations Center as well as local law enforcement and emergency response personnel for their tremendous efforts during this emergency event.


C.                  CONSENT CALENDAR

These matters are routine in nature and are usually approved by a single vote. Prior to the meeting, any member of the public may request any member of the Board to pull a particular item for further discussion.

Agricultural Commissioner

1.                   Approval of Standard Agreement Amendment No. 10-0229-1, Pest Detection Trapping Contract with the California Department of Food and Agriculture in the amount of $4,885 and Corresponding Supplemental Budget.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement Amendment No. 10-0229-1, known as the Pest Detection Trapping Program Contract; authorize the Chair to sign two copies of the amendment and return all signed copies to the Agriculture Department for further processing and authorize the Auditor-Controller to execute the attached supplemental budget for 2010-2011.

2.                   Approval of Standard Agreement No. 11-C0011, Pesticide Use Reporting Contract with the California Department of Pesticide Regulation in the amount of $1,556.

RECOMMENDATION: That the Board of Supervisors approve the Standard Agreement No. 11-C0011, known as Pesticide Use Reporting contract; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification and return all signed copies to the Agriculture Department for further processing and grant a waiver from the provisions of the Nuclear Free Ordinance.

3.                   Approval of Standard Agreement No. 11-0005, Pest Detection Trapping Program contract with the California Department of Food and Agriculture in the Amount of $15,103.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 11-0005, known as the Pest Detection Trapping Contract; authorize the Chair to sign the original agreement and one copy of the cover page as well as the Contractor Certification and return all signed copies to the Agriculture Department for further processing; and grant a waiver from the provisions of the Nuclear Free Ordinance.

4.                   Request for Extension of Extra Help Hours Past the 960 Hour Limit.

RECOMMENDATION: That the Board of Supervisors approve a request for an extension of extra-help hours for Weylan Shaw, Agricultural/Weights and Measures Inspector I to a maximum of 1600 hours through June 30, 2011, pursuant to Section 7 of the Humboldt County Salary Resolution.

Assessor

5.                   Assessor requests Board approval to provide assessment value notices on the county website.

RECOMMENDATION: That the Board of Supervisors approve the Assessor's request to adopt a resolution approving posting of annual notices for assessees of real and personal property on the county website pursuant to Revenue and Taxation Code section 621.

Board of Supervisors

6.                   Certificates of Recognition for Soroptimist International of Eureka and Soroptimist International of Humboldt Bay Annual Award Winners. (Supervisor Bass)

RECOMMENDATION: Ratify the Certificates of Recognition.

7.                   Informational report announcing the appointment of Mike Zamboni as District 5 (five) Representative on the Fish and Game Advisory Commission. (Supervisor Sundberg)

RECOMMENDATION: Receive and file the report.


Clerk of the Board

8.                   Board Orders from the meeting of March 8, 2011.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of March 8, 2011.

Cooperative Extension

9.                   Supplemental Budget for Fund 1100, Budget Unit 632 Cooperative Extension for Fiscal Year 2010-2011.

RECOMMENDATION: That the Board of Supervisors approve a supplemental budget request for Budget Unit 632 as attached.

Elections

10.               Supplemental Budget for the June 2011 Special Election.

RECOMMENDATION: That the Board of Supervisors approves the attached supplemental budget to the Election's Department for the purpose of funding the June 2011 Special Election and fund the over expenditures from the November 2010 General Election.

Health and Human Services - Mental Health Branch

11.               First Option to extend the lease Agreement with Trueman Vroman for 2950 E Street, Suite B, Eureka, CA.

RECOMMENDATION: That the Board of Supervisors approve the first option to extend the lease Agreement at 2950 E Street, Suite B, Eureka, CA with Trueman Vroman for the period of July 1, 2011 through June 30, 2012; direct the Clerk of the Board to return one executed Board agenda item to the Public Works Real Property Agent; and authorize the Public Works-Real Property Agent to send a letter notifying Trueman Vroman that the County is exercising the first option to extend the lease for an additional one year term, from July 1, 2011 through June 30, 2012.

12.               Second Option to Extend the Lease Agreement with Rachael - Jill Hemmert.

RECOMMENDATION: That the Board of Supervisors approve the second option to extend the Lease Agreement at 824 Harris Street, Eureka, CA with Rachael-Jill Hemmert for the period of July 1, 2011 through June 30, 2012; direct the Clerk of the Board to return one executed Board agenda item to the Public Works Real Property Agent; and authorize the Public Works Real Property Agent to send a letter notifying Rachael-Jill Hemmert that the County is exercising the second option to extend the lease for an additional one year term, from July 1, 2010 through June 30, 2012.

13.               Appointment to the Humboldt County Mental Health Board.

RECOMMENDATION: That the Board of Supervisors appoint Tia Richardson to the Humboldt County Mental Health Board.

14.               First option to extend the Lease Agreement with Trueman Vroman for 5950 E Street, Suite A, Eureka, CA.

RECOMMENDATION: That the Board of Supervisors approve the first option to extend the Lease Agreement at 2950 E Street, Suite A, Eureka, CA with Trueman Vroman for the period of July 1, 2011 through June 30, 2012; direct the Clerk of the Board to return one executed Board agenda item to the Public Works Real Property Agent and authorizes the Public Works-Real Property Agent to send a letter notifying Trueman Vroman the County is exercising the first option to extend the lease for an additional one year term, from July 1, 2011 through June 30, 2012.


Health and Human Services - Public Health Branch

15.               Approve Option to extend the Lease at 317 Second Street, Eureka.

RECOMMENDATION: That the Board of Supervisors approve exercising the first option to extend the lease at 317 Second Street, Eureka, CA with Al Abrahamsen, Alice F. Abrahamsen, Kent H. Pryor and Alice Pryor; Authorize Public Works - Real Property Division to send a notice to Lessor that County is exercising the first option to extend the lease; direct the Clerk of the Board to return one executed agenda to Public Works-Real Property Division.

Health and Human Services - Social Services Branch

16.               First Amendment To Lease with Fred Lundblade for Office, Storage, and Document Imaging Space Located at 790 West Clark Street, Eureka, CA.

RECOMMENDATION: That the Board of Supervisors approves the First Amendment To Lease (Attachment 1) with Fred Lundblade for office, storage, and document imaging space located at 790 West Clark Street, Eureka, CA; authorizes the Chair to sign the First Amendment To Lease with Fred Lundblade; and directs the Clerk of the Board to return one original of the executed First Amendment To Lease to Public Works-Real Property Division for transmittal to Lessor.

Probation

17.               Memorandum of Understanding between Probation Department of Health and Human Services, Social Services Branch relating to Foster Care and Title IV-E claims.

RECOMMENDATION: That the Board of Supervisors approve the proposed Memorandum of Understanding between the Probation Department and Department of Health and Human Services, Social Services Branch, relating to Foster Care and Title IV-E claims; and authorize the Chief Probation Officer, and Department of Health and Human Services Director to sign the Agreement.

Public Works

18.               Dump Truck Purchase and Surplus Wrecked Truck.

RECOMMENDATION: That the Board of Supervisors authorize the purchase of one 10 yard dump truck; approve the appropriation transfer to fund the purchase; declare one wrecked 10 yard dump truck surplus; authorize the Purchasing Agent to dispose of the surplus property and deposit the revenue from the sale in the Roads Heavy Equipment Internal Service Fund (ISF).

19.               Establishment of Proposition 1B Trust Fund.

RECOMMENDATION: That the Board of Supervisors direct the Auditor-Controller to establish trust fund Proposition 1B Local Streets and Roads Allocation to set aside monies that have been received for infrastructure improvements.

D.                 SPECIAL PRESENTATIONS

1.                   Proclaim the Week of March 20th - 26th, 2011 as Tsunami Preparedness Week in Humboldt County. (Supervisor Smith & Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

County Administrative Office

1.                   County Administrative Officer Report:  Update on the County’s Fiscal Year (FY) 2011-12 Budget Process, Report on State Budget and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on the County’s FY 2011-12 budget process, the State budget and various other topics; adopt the schedule and format for community outreach meetings on the FY 2011-12 budget detailed on Attachment 1; authorize the Risk Manager to increase the County’s self-insured retention limits for general liability insurance; and take other action as may be required

County Counsel

2.                   2010 Code Enforcement Unit Annual Report.

RECOMMENDATION: That the Board of Supervisors receive the Code Enforcement Unit's 2010 annual report.

Personnel

3.                   Adoption of Voluntary Separation Incentive Program (VSIP).

RECOMMENDATION: That the Board of Supervisors approve the Voluntary Separation Incentive Program (VSIP) and supporting documents, and authorize Department Heads to utilize the program as presented.

Probation

4.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of a vacant Juvenile Corrections Officer I/II position; Position #07 in Budget Unit 234-Juvenile Hall, Salary Range 303-323.

4.                   Installation of Temporary Symbolic Fencing at Clam Beach County Park and Letter to U.S. Fish and Wildlife Service Regarding Predator Management to support Western Snowy Plovers within Humboldt County.

RECOMMENDATION: That the Board of Supervisors receive a Public Works staff report regarding the status of western snowy plovers at Clam Beach County Park and the use of temporary symbolic fencing as a protective measure; receive comments from U.S. Fish and Wildlife Service staff and the interested public; authorize the installation of symbolic fencing from March 15, 2011, through September 30, 2011, in designated areas of Clam Beach County Park, and the temporary closure of the fenced area to beach users and dogs, in accordance with Section 271-3 of the County Code and Resolution No. 03-57; and authorize the Chair of the Board to sign the attached letter to U.S. Fish and Wildlife Services requesting a decision whether or not to implement a predator management program to address crow and raven impacts on western snowy plovers within Humboldt County.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comment; accept the petition by approving the attached resolution based on the findings in the staff report and testimony received about the project; and direct the Clerk of the Board to give notice of the decision to the applicant, the Assessor's Office and any other interested party.


2.                   CASE Zone Reclassification/Parcel Map Subdivision Application File Nos.: APN 309-051-69  Case No.: ZR-06-13/PMS-06-16.

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ____ by title and waive further reading; open public hearing, and receive and consider the staff report and public testimony; adopt Resolution No.____ adopting the Mitigated Negative Declaration as required by Section 1507(b) of the California Environmental Quality Act (CEQA) Guidelines and making the required findings for approving the proposed Zone Reclassification and Parcel Map Subdivision application based on the submitted evidence; approve the rezone and adopt Ordinance No. _____ amending Section 311-7 of the Humboldt County Code by reclassifying an approximate 71 acres of land currently zoned Unclassified into Agriculture Exclusive with a B-6 Special Building Site Combining Zone that sets the lot size per the parcel map of record; direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor's Office and any other interested party; direct the Clerk of the Board to publish the Post-Adoption Summary of Ordinance within 15 days after passage by the Board; and direct the Community Development Services - Current Planning Division to file a Notice of Determination pursuant to CEQA.
