1.                   Addition of Non-agenda Item to Agenda:  Authorization to Provide Sandbags for Protection of Private Property. (Public Works Item).

RECOMMENDATION: Approve request to add non-agenda item to today's agenda and authorize Public Works to disperse sandbags as needed to protect private property in the Dobbyn's Creek area along Alderpoint Road.

RECOMMENDATION: Ratify the Certificates of Recognition.

2.                   Letter of Appreciation to Julie Millard for Serving on the Status of Women Commission. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letter of Appreciation.

3.                   Letter to the California Public Utilities Commission (CPUC) Requesting the CPUC Encourage PG&E to Delay Installation of Smart Meters in Humboldt County. (Supervisor Smith and Supervisor Bass)

RECOMMENDATION: Authorize Chair to sign letter.

4.                   Termination of Local Emergency - March 11, 2011 Tsunami Event. (Supervisor Lovelace)

RECOMMENDATION: That the Board of Supervisors terminate Resolution #11-15 and approve and adopt Resolution No. _______ proclaiming the termination of a local emergency - March 11, 2011 Tsunami Event.

5.                   Letters of Appreciation to Stuart Altschuler and Kenna Adame for Serving on the Human Rights Commission. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letters of Appreciation.

Clerk of the Board

6.                   Board Orders of the meeting of March 22, 2011.

RECOMMENDATION: That the Board of Supervisors approve the Board orders.

Community Development Services

7.                   Approval of Recommended Humboldt County Title III Small Grant Program Awards to Local Fire Safe Councils.

RECOMMENDATION: That the Board of Supervisors approve finding for two Firewise project proposals submitted by local fire safe councils (FSCs) to the Humboldt County Title III Small Grant Program; and authorize the Community Development Service Director to sign grant agreements with the local FSCs to carry out the activities of their proposed projects, after review and approval by County Counsel and Risk Management.

County Administrative Office

8.                   Revenue Recovery - Discharge of Accountability.

RECOMMENDATION: That the Board of Supervisors approve Revenue Recovery's application for discharge of accountability for specified debt collection accounts pursuant to Government Code Sections 25257, 25258, and 25259.

Health and Human Services - Mental Health Branch

9.                   Mental Health Branch Charge Rate Schedule.

RECOMMENDATION: That the Board of Supervisors approve and adopt the attached charge rate schedule for Department of health and human Services Mental Health Branch as required by the State Department of Mental Health.  This schedule shall be effective January 1, 2011 until amended.

10.               Contract with Netsmart, Inc. for Avatar software and services.

RECOMMENDATION: That the Board of Supervisors approve the contract with Netsmart, Inc. for Avatar software and services; approve the request for budget appropriation transfer for fixed asset purchases related to this contract; authorize the Chair to sign three originals of the contract with Netsmart, Inc.; authorize Phillip R. Crandall, DHHS Director to sign the three-Party Escrow Services agreement; authorize and designate Phillip R. Crandall Director to be the authorized and designated person under the Three-Party Escrow Service Agreement whose actions will legally bind the County and who may manage the Iron Mountain escrow account; and direct the Clerk of the Board to return two signed originals to DHHS-Mental Health Branch Administration.

Health and Human Services - Social Services Branch

11.               Extension of Extra Help Hours past the 960 Hour Limit.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Chuck Prescott to 1502 hours through June 30, 2011; Melinda Johnson to 1544 hours through June 30, 2011; and Kim Miranda to 1286 hours through June 30, 2011.

Library Services

12.               Authorize transfer of funds from the Library Equipment Bequest Fund into the County Library Fund for new library server.

RECOMMENDATION: That the Board of Supervisors authorize transfer of monies from Fund 3826, Library Equipment Bequest Fund in the amount of $16,500 to Fund 1500, County Library for the purchase of a new library server, software and data migration from the old server to a server and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library for fiscal year 2010-2011.

13.               Lease Agreement with the McKinleyville Community Services District (MCSD) and County of Humboldt to use the site of the McKinleyville Branch Library.

RECOMMENDATION: That the Board of Supervisors approve the Lease agreement with MCSD for the McKinleyville Library; authorize the Chairperson to execute two original of the lease and direct the Clerk of the Board to return one executed original to Real Property for transmittal to Lessor.

Probation

14.               Extension of Extra Help Hours to 1840 for Juvenile Corrections Officer Tim Kindley.

RECOMMENDATION: That the Board of Supervisors approve the extension of extra help hours for Juvenile Corrections Officer Tim Kindley to 1840 hours through June 30, 2011, per Section 7 of the Humboldt County Salary Resolution.

Public Works

15.               Assignment of Don Morris as Facilty Maintenance Supervisor.

RECOMMENDATION: That the Board of Supervisors approve the temporary increase in compensation for Don Morris, Facility Maintenance Mechanic II, as if promoted to the class of Facility Maintenance Supervisors, from March 20, 2011 through June 25, 2011 or until such time as the Facility Maintenance Supervisor returns, whichever occurs first, pursuant to Section 7 of the Humboldt County Salary Resolution.

16.               Construction of School Road (C3L070) Sidewalk and Realignment Project (Phase I) between Bugenig Avenue and Highway 101 (PM 0.37 to 6.9); Contract 209801.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for School Road (C3L070) Sidewalk and Realignment Project (Phase I); award the contract to GR Sundberg, Inc. including additive option "B" for the total amount of $485,149; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0262 and transfer $533,664 to the account per the attached appropriation transfer.

17.               Supplemental Budget and Appropriation Transfer for Arcata-Eureka Airport.

RECOMMENDATION: That the Board of Supervisors adopts the attached Supplemental Budget for FY 2010/11.

18.               Storm Damage Repairs on Alderpoint Road (F6B165) PM 41.0, 45.78-46.15, 46.95, Project No.: ER 4400(047), (058),(059), Contract No.: 206416, 206420, 206387.

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with bids to be opened on Tuesday, May 3, 2011 at 2:00.

19.               Extension of Extra-Help Hours.

RECOMMENDATION: That the Board of Supervisors extend extra help hours for Maria Herrera, Darren Victorine and Christopher Mitchell to a maximum of 1480 hours for fiscal year 2010-2011 pursuant to Section 7 of the Humboldt Counmty Salary Resolution.

20.               Humboldt County Parks 2010 Bathroom Replacement Project.

RECOMMENDATION: That the Board of Supervisors accept the work of Sequoia Construction Specialties as substantially complete for their portion of the Humboldt County Parks 2010 Bathroom Replacement Project; authorize the Public Works Director to file the Notice of Completion for Seqoia Construction Specialties' portion of the porject as required; and authorize the Public Works Director to sign the attached Change Order No. 2.1 for $19,848.80 cost increase.

21.               Assignment of Dieter Jauernig, Automotive Mchanic II as SR. Automotive Mechanic.

RECOMMENDATION: That the Board of Supervisors authorize compensation for Dieter Jauernig as if he had been promoted to the classification of Senior Automotive Mechanic from March 14, 2011 through April 30, 2011, pursuant to Section 7 of the Humboldt County Salary Resolution.

22.               Construction of Herrick Avenue Sidewalk Project from Bay Point Court to City of Eureka.

RECOMMENDATION: That the Board of Supervisors receive bids, award the contract to RAO Construction Company ofr the amount of $244,690 and authorize the Chairman to execute the project agreement upon submittal.

23.               Annual Revisions to the County of of Humboldt Maintained Road System.

RECOMMENDATION: That the Board of Supervisors adopt the resolution for annual revisions in the County Maintained Road System 2010-2011 and direct the Clerk of the Board to provide a certified copy of the Board order and resolution to the Department of Public Works for submittal to California Department of Transportation (CalTrans).

24.               Storm Damage Repairs on Alderpoint Road (F6B165) PM 12.0 - 12.2 Project No.: ER 4400(040), Contract No.: 206371

RECOMMENDATION: That the Board of Supervisors approve the plans and specifications and direct the Clerk to advertise the above-mentioned project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, May 3, 2011 at 2:00 PM.

Sheriff

25.               Ordinance Amending Section 2210-2 through 2210-4 and 2210-7 through 2210-16 of Title II to the Humboldt County Code Relating to Emergency Organization and Functions of the Humboldt County Disaster Council.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ____ amending section 2210-2 through 2210-4 and 2210-7 through 2210-16 of the Title II of the Humboldt County Code related to emergency organization and functions of Humboldt County Disaster Council.

26.               Application for State - Off-Highway Vehicle Grant.

RECOMMENDATION: That the Board of Supervisors adopt a resolution approving the application for State Off-Highway Vehicle Grant and direct the Clerk of the Board to return the completed documents to the Sherriff's Office, Attention Linda Modell, for submission to the State.

1.                   Proclaim April 2011 as Sexual Assault Awareness Month in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Adopt the Proclamation.

RECOMMENDATION: Adopt the Resolution.

3.                   Proclaim April 2011 as Child Abuse Prevention Month in Humboldt County. (Supervisor Sundberg)

RECOMMENDATION: Approve an exception to the hiring freeze for a Senior Accountatnt-Auditor (Salary Range 401, Class 1632, Position Number 03) in Budget Unit 111 effective the first bi-weekly following approval.

County Administrative Office

2.                   Policies for Board Appointments.

RECOMMENDATION: That the Board of Supervisors consider the options identified in this report for changes to Board Appointment procedures; select the option(s) preferred by the Board and direct staff to return to the Board with a written policy incorporating those options, together with any changes in resolutions or ordinances required to be effectuate those options.

County Counsel

3.                   Cost Recovery Assessment Hearing - Garry Barrick - Fieldbrook, California; AP# 512-121-031.

RECOMMENDATION: That the Board of Supervisors, pursuant to Humboldt County Code sections 351-33 through 351-44 approve a supplemental budget in the amount of $970 and increase revenue account 1100-121-603-040 in the amount of $970; approve the transfer from the Code Enforcement Trust Fund, account #344000 in the amount of $970 to revenue account #1100-121-0603-040, to cover the additional cost of the abatement; confirm the Findings and Orders confirming Account and Assessment in the sum of fourteen thousand six hundred eighty-seven dollars and seventy-two cents ($14,687.72); authorize the Chair of the Board to sign the Findings and Order Confirming the Account and Assessment; direct the Auditor, upon receipt of the monies assessed, to deposit the money previously advanced for the administrative abatement by this order and by the order of the Board on December 14, 2010 from the Code Enforcement Trust Fund, which was twelve thousand four hundred sixty nine dollars and twenty four cents ($12,469.24) back into the Code Enforcement Trust Fund account number 3440000; and direct the Auditor , upon receipt of the monies assessed, to deposit two thousand two hundred eighteen dollars and forty eight cents ($2,218.48) into the County Counsel Office revenue account number 1100-121-603-040 to recoup Code Enforcement staff time, mileage and office expenses incurred enforcing the Humboldt County Code.

DHHS - Social Services

4.                   Adopt the Merit System Services classifications for Public Education and Information Manager and Graphic Arts Technician; Allocate one full time Public Education and Information manager position and one full time Graphic Arts Technician position.

RECOMMENDATION: That the Board of Supervisors adopt the new Merit System Services classification of Public Education and Information Manager (salary range 456, class 0146, unit 8) into the classification plan effective immediately; approve the allocation of one full-time Public Education and Information Manager (salary range 456, class 0146) in budget unit 516 effective the beginning of the bi-weekly pay period following approval; adopt the new Merit System Services Classification of Graphic Arts Technician (salary range 376 class number 0319, unit 1) into the classification plan effective immediately; approve the allocation of one full-time Graphic Arts Technician (salary range 376, class 0319) in budget unit 516 effective the beginning of the bi-weekly pay period following approval; and approve the disallocation of one vacant full-time Program Manager (salary range 479, class 0934A, position #01) in budget unit 424 effective at the beginning of the bi-weekly pay period following approval; and approve the disallocation of one vacant full-time Community Health Outreach Worker (salary range 316, class 0511A, position#07) in budget unit 416 effective at the beginning of the bi-weekly pay period following approval.

5.                   Designated classifications and Maximum Number of Incentives per Classification for the Voluntary Separation Incentive Program (VSIP).

RECOMMENDATION: That the Board of Supervisors adopt the list of designated classificatinos and maximum number of VSIP incentives per classificaiont to be offiered per Department (List of Designated VSIP Classifications - Attachment A)

Probation

6.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of a vacant Juvenile Corrections Officer I/II 0.5 Full Timr Equivalency position; Position #08 in Budget Unit 254-Regional Facility, Salary Range 303-323.

Public Works

7.                   Request for Exception to hiring Freeze for Park Caretaker in Parks Division.

RECOMMENDATION: That the Board of Supervisors grant an exception to the hiring freeze to allow the Public Works Department to fill a vacant, full-time park Caretaker position (class 272, salary range 289) in the Parks Budget Unit (713).

County Administrative Office

1.                   Public Hearing to Consider Adoption of a Fire District Development Impact Fee Ordinance for Humboldt No. 1 Fire Protection District.

RECOMMENDATION: That the Board of Supervisors open the public hearing and receive the staff report and public comments' close the public hearing, introduce by title, Ordinance No. ______, approving and adopting a Fire District Development Impact Fee for the Humboldt No. 1 Fire Protection District (HFD), waive the firs reading of the Ordinance and adopt the Ordinance, direct the Clerk of the Board, within 15 days, to publish a post-adoption summary of the ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting for and against the Ordinance [Government Code Section 25214 (b)(1)]; approve a Notice of Exemption under the California Environmental Quality Act (CEQA) as contained in Exhibit B to Attachment 1 and direct the County Administrative Officer to file the NOE with the County Recorder; approve the Agreement with HFD and authorize the Chair to sign; and request the County Auditor to impound 3% of the fees collected by the County and 1.5% of the fees collected by HFD as the administrative charge authorized by Humboldt County Code Section 3210-9 and the Agreement with HFD as the administrative charge authorized by Humboldt County Code Section 3210-9 and the Agreement with HFD; direct staff to track their actual costs of administering the Fire District Development Impact Fee to establish baseline data to support the administrative charge; if after twelve months the actual administrative costs are less than the impounded amount the Auditor is directed to return the excess impound amount to the HFD Development Impact Fee account and to deposit the remainder into the County's General Fund.

Community Development Services

2.                   CASE Zone Reclassification/Parcel Map Subdivision Application File Nos.: APN 309-051-69  Case No.: ZR-06-13/PMS-06-16. (CONTINUED FROM MARCH 15, 2011)

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ____ by title and waive further reading; open public hearing, and receive and consider the staff report and public testimony; adopt Resolution No.____ adopting the Mitigated Negative Declaration as required by Section 1507(b) of the California Environmental Quality Act (CEQA) Guidelines and making the required findings for approving the proposed Zone Reclassification and Parcel Map Subdivision application based on the submitted evidence; approve the rezone and adopt Ordinance No. _____ amending Section 311-7 of the Humboldt County Code by reclassifying an approximate 71 acres of land currently zoned Unclassified inot Agriculture Exclusive with a B-6 Special Building Site Combining Zone that sets the lot size per the parcel map of record; direct the Clerk of the Board to give notice of the decision to the applicant/owner, th County Assessor's Office and any other interested party; direct the Clerk of the Board to publish the Post-Adoption Summary of Ordinance within 15 days after passage by the Board; and direct the Community Development Services - Current Planning Division to file a Notice of Determination pursuant to CEQA.

M.                 AFTERNOON DEPARTMENTAL ITEMS

1.                   County Administrative Officer Report: State Budget Update and Various Other Topics.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on the State's budget and various other topics, and other topics, and take action as may be required.

2.                   Headwaters Fund Board's Grant Award of $100,000 to the North Coast Health Information Network, Inc. to Build a Health Information Exchange for Humboldt County. (COMMUNITY DEVELOPMENT)

RECOMMENDATION: That the Board of Supervisros review and approve the Headwaters Fund Board's recommended Community Investment Fund (CIF) grant of $1000,000 to the North Coast Health Information Network, Inc. (NCHIN) for a Health Information Exchange project and authorize the Chair of the Board to sign the grant contract after review and approval by County Counsel and Risk Management.

N.                  ADJOURNMENT
