Board of Supervisors

1.                   Certificates of Recognition for Fortuna Chamber of Commerce 2010 Annual Awards Recipients. (Supervisor Clendenen)

RECOMMENDATION: Ratify the Certificates of Recognition.

Child Support Services

2.                   Lease Agreement with Humboldt Partners for Space Located at 2420 Sixth Street, Eureka, occupied by the Department of Child Support Services.

RECOMMENDATION: That the Board of Supervisors approves and authorizes the Chair to execute two (2) originals of the attached lease agreement with Humboldt Partners for space located at 2420 Sixth Street in Eureka; and return one executed original to the Real Property Division of Public Works for transmittal to the Lessor.

3.                   Board Orders April 26, 2011

RECOMMENDATION: That the Board of Supervisors approves the Board Orders and authorizes the Clerk of the Board and the Board Chair to sign the minute book in accordance with California Government Code Section 25103.

Health and Human Services - Social Services Branch

4.                   Approval of Memorandum of Understanding with California Department of Social Services (CDSS) for the Permanency Innovations Initiative (PH).

RECOMMENDATION: That the Board of Supervisors approves the Memorandum of Understanding (MOU) with the California Department of Social Services to allow the Department of Health and Human Services to participate in the California Partners for Permanency project, pursuant to the federally funded Permanency Innovations Initiative; and authorizes the Director of the Department of Health and Human Services to sign the MOU and any amendments to this MOU that may occur during the term; and directs the Clerk of the Board to route one (1) fully executed agenda item to the Director of the Department of Health and Human Services, Social Services Branch.

5.                   Extension of Extra-Help Hours for Brian Bresee.

RECOMMENDATION: That the Board of Supervisors extends Brian Bresee extra-help employment hours by 400 hours to a maximum of 1,643 hours for fiscal year 2010-2011 pursuant to Section 7 of the Humboldt County Salary Resolution.

Sheriff

6.                   Agreement Number 2011-26 Between the County of Humboldt and the Drug Enforcement Administration of the United States Department of Justice and Supplement Budget in Budget Unit 1100228.

RECOMMENDATION: That the Board of Supervisors accepts the Agreement Number 2011-26 between the County of Humboldt and the Drug Enforcement Administration; authorizes the Board Chair to sign the Request for Advance or Reimbursement, Certification Regarding Lobbying; Debarment, Suspension and Other Responsibility Matters, and Drug Free Workplace Requirement, and Assurances; authorizes the Sheriff to sign Agreement number 2011-26; approves a supplemental budget in budget unit 1100228 in the amount of $70,000 as attached; and instructs the Clerk of the Board to return the signed original documents to the Sheriff's Office (attn:  Linda Modell) for further processing.

7.                   Adoption of Ordinance:  Transient Occupancy Tax Liens.

RECOMMENDATION: That the Board of Supervisors adopts Ordinance No. ____ adding Section 712-15 of Title VII to the Humboldt County Code pursuant to the attached Board Order.

1.                   Third Quarter Budget Review for Fiscal Year 2010-11 and Updated Outlook for Fiscal Year 2011-12

Provide direction to CAO regarding the transferring of Headwaters Sale Economic Division Administration Fund monies to the Economic Development Fund for cash flow purposes; and take other action as appropriate.

2.                   Consider Setting Date and Process for Appointment to Fill an At-Large Seat on the Humboldt County Planning Commission.

RECOMMENDATION: That the Board of Supervisors considers setting a date and defining a process for making an appointment to fill an At-Large seat on the Humboldt County Planning Commission.

3.                   Consider Setting Date and Process for Appointment to Fill Seat on the North Coast Railroad Authority Board.

RECOMMENDATION: That the Board of Supervisors considers setting a date and defining a process for making an appointment to fill a vacant seat on the North Coast Railroad Authority Board.

H.                  MATTERS SET FOR TIME CERTAIN

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  American Federation of State, County and Municipal Employees (AFSCME local 1684), Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit), Humboldt Deputy Sheriffs' Organization (Law Enforcement Management Unit), Elected & Appointed County Officials, and Management & Confidential Employees

Public Works

1.                   Unmet Transportation Needs Public Hearing.

RECOMMENDATION: That the Board of Supervisors opens a public hearing and receives the staff report and allows the public to comment on transit needs in the unincorporated areas of the County.  Close the public hearing and direct that the Clerk of the Board to forward meeting minutes and any recommendations to the Humboldt County Association of Governments (HCAOG) for inclusion in their hearing.

2.                   Formation of Permanent Road Division (PRD) No. 1000, Zone No. 006 and Imposition of Parcel Charges for School Ridge Subdivision, McKinleyville.

RECOMMENDATION: That the Board of Supervisors opens the continued public hearing regarding the formation of Permanent Road Division No. 1000, Zone No. 006 and imposition of parcel charges for road maintenance for the School Ridge Subdivision, receive public testimony, and close the public hearing.  Direct the Auditor-Controller to tally the ballots received to impose parcel charges for road maintenance in the School Ridge Subdivision.  Based upon the public testimony and results of the election, adopt the attached Resolution to Establish Humboldt County Permanent Road Division 1000, Zone No. 006 and to Impose Parcel Charges for Road Maintenance.  Adopt the Resolution of Acceptance to accept the rights of way for Oakdale Drive, Chelsea Way, and Duchess Road for public road purposes, and Parcel B for pedestrian easement purposes, both as shown dedicated to the County of Humboldt on Tract No. 636, filed in Book 25 of Maps, pages 11 and 12 in the office of the Humboldt County Recorder.  Approve the establishment of an interest-bearing fund for deposit of funds received from parcel assessments and direct the Auditor-Controller to set up a fund entitled Permanent Road Division No. 1000, Zone 006 with fund number 2306.  Direct the Auditor-Controller to calculate yearly the compounded inflation factor based upon the Consumer Price Index (CPI) to the parcel charges for road maintenance.

3.                   Request for Continuance of the Case Zone Reclassification/Parcel Map Subdivision Application; File Nos.: APN 309-051-69 Case No.: ZR-06-13/PMS-06-16 - Loleta Area.

RECOMMENDATION: That the Board of Supervisors continue the hearing to the May 17, 2011 Board of Supervisors meeting at 1:30 p.m., in order to allow the applicant additional time to address conditions of project approval.
