B.                  MODIFICATIONS TO THE AGENDA

1.                   Letter of Support for the Salt River Ecosystem Restoration Project, Humboldt County. (CONSENT) (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign the letter.

2.                   Ratification of 2011-2013 Memorandum of Understanding between the County of Humboldt and the Humboldt Deputy Sheriffs' Organization for Representation Unit 6. (CONSENT)

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. _____approving the Memorandum of Understanding for Unit 6 (Humboldt Deputy Sheriff's Organization); and authorize the Chairman of the Board of Supervisors to execute the Memorandum of Understanding.

Board of Supervisors

1.                   Certificate of Recognition and Resolution for Dennis Hunter, Humboldt County 2010 Republican of the Year. (Supervisor Smith)

RECOMMENDATION: Ratify Certificate of Recognition.

2.                   Proclaim May 5th, 2011 as a Day of Prayer in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Ratify the Proclamation,

3.                   Letter commenting on the Pacific Coast Salmon Plan Amendment 16 Draft Environmental Assessment. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter.

4.                   Termination of Local Emergency - March 20, 2011 Severe Winter Storms. (Supervisor Lovelace)

RECOMMENDATION: That the Board of Supervisors terminate Resolution #11-20 and approve and adopt Resolution No. _______ proclaiming the termination of a local emergency - March 20, 2011 Severe Winter Storms.

Clerk of the Board

5.                   Approval of the Board orders - Meeting of May 3, 2011.

RECOMMENDATION: That the Board of Supervisors approves the Board Orders as submitted.

Personnel

6.                   3rd Amended List of Designated Classifications and Maximum number of incentives per classification for the Voluntary Separation Incentive Program (VSIP).

RECOMMENDATION: That the Board of Supervisors adopts the 3rd amended list of designated classifications and maximum number of VSIP incentives per classification to be offered per department.

Public Works

7.                   Extension of Lease Agreement for Courthouse Snack Bar.

RECOMMENDATION: That the Board of Supervisors approve by a 4/5 vote extending the Lease with Alan Sadler and Jessalyn Kunkler for the courthouse Snack Bar, through July 31, 2012; authorize Real Property to notify Lessee of approval of the extension; and direct the Clerk of the Board to return one executed agenda item to Real Property.

8.                   Dias Subdivision, Phase II, APN 017-152-011, Eureka Area.

RECOMMENDATION: That the Board of Supervisors accept and approve the subdivision map for filing the County Recorder; accept the dedications to the County of Humboldt of Parcels A, B, D, & E for public utilities, and reject Parcel A for public road purposes, all as shown on the subdivision map; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; and direct the Clerk of the Board to transmit the subdivision map and the Conveyance and Agreement to the County Recorder.

9.                   Transportation Development Act Claim.

RECOMMENDATION: That the Board of Supervisors authorizes the Chairperson to sign the attached Transportation Development Act (TDA) Claim in the amount of $2,144,492 and direct the Clerk of the Board to forward the claim to the Humboldt County Association of Governments (HCAOG).


10.               Construction Storm Damage Repairs on Sprowel Creek Road (C6B095) PM 0.30, Project No.: ER-4400(073), Contract No.: 206409.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage repairs on Sprowel Creek Road; Award the contract to Ken's Water Tender, Inc. for the total amount of $434,250.; Authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; direct the Auditor-Controller to establish a new contract account 1200321-0264 and transfer $455,963 to the account per the attached appropriation transfer.

11.               Construction Storm Damage Repairs on Alderpoint Road (F6B165) PM 45.40-45.46 & 45.64-45.65, Project No.: ER-4400 (057) & ER-4400 (056), Contract No.: 206382 & 206385.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage repairs on Alderpoint Road at PM 45.40-45.46 & 45.64-45.65; award the contract to Hambone Construction, Inc. for the total amount of $223,804; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0265 and transfer $234,994 to the account per the attached appropriation transfer.

Sheriff

12.               Fiscal Year 2011 Financial and Operating Plan for Controlled Substance Operations, between the United States Forest Services, Six Rivers National Forest and the County of Humboldt, Sheriff's Office.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board and the Sheriff to sign two originals of the FY2011, Financial and Operating Plan for Controlled Substance Operations, Agreement number 11-LE-11051360-218, modification number 02; direct the Clerk of the Board to return all documents to the Sheriff's Office, Attention Linda Modell for further processing.  A fully executed original of the agreement will be returned for the Board files.

D.                  SPECIAL PRESENTATIONS

1.                   Proclaim May 14th, 2011 as National Association of Letter Carrier's Food Drive Day in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Adopt the Proclamation.

2.                   Proclaim May 2011 as Bike Month in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Adopt the Proclamation.

3.                   Resolution Recognizing the 158th Anniversary of the Establishment of the County of Humboldt. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

4.                   Proclaim May 6 - 12, 2011 as Nurse's Week in Humboldt County. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

5.                   Proclaim May 2011 as Teen Pregnancy Prevention Month in Humboldt County. (Supervisor Bass)

RECOMMENDATION: That the Board of Supervisors: Approve an exception to the hiring freeze for the position of IT Applications Analyst Supervisor (class 0644, position 01, salary range 456) in budget unit 118; Disallocate 1.0 vacant Fiscal Assistant I/II (class 0177, position 01, salary range 279/305) in budget unit 115, effective immediately; Authorize the end of daily internal mail services between County facilities located in Eureka, effective May 27, 2011; Approve an exception to the hiring freeze for the position of Senior Buyer (class 0665, position 01, salary range 366) in budget unit 115; Allocate 1.0 full-time equivalent (FTE) Senior Office Assistant (class 0135, salary range 316) in budget unit 115, effective June 26, 2011, pursuant to the classification review conducted by the Personnel Department (Attachment 2); Approve an exception to the hiring freeze for the position of Senior Office Assistant (class 0135, position 01, salary range 316) in budget unit 115; Pursuant to Section 8 of the Humboldt County Salary Resolution, approve differential pay for working out of class in excess of 20 days for Deputy County Administrative Officer Amy Nilsen, as if promoted to the class of Risk Manager (class 0700, salary range 510); Disallocate the vacant Program Coordinator position (class 1425, position 01, salary range 401) in budget unit 103, effective June 25, 2011, in lieu of holding one position frozen for three years pursuant to the terms of the Voluntary Separation Incentive Program; Reallocate 1.0 Assistant County Administrative Officer position (class 0601, position 01, salary range 554) currently underfilled as Deputy County Administrative Officer (class 0599, salary range 493) in budget unit 103 to the classification of Deputy County Administrative Officer (class 0599, salary range 493, unit 08), effective June 26, 2011; Disallocate 1.0 Assistant County Administrative Officer position (class 0601, position 02, salary range 554) currently underfilled as Deputy County Administrative Officer (class 0599, salary range 493) in budget unit 103, effective June 26, 2011; Delete the management classification of Assistant County Administrative Officer (class 0601, salary range 554, unit 08) from the classification plan, effective June 30, 2011; Adopt the new unclassified position of Assistant County Administrative Officer (salary range 554), as described in Attachment 3, effective July 1, 2011; Direct the Personnel Director to prepare an amendment to Resolution No. 78-142 to reflect this change and bring the amended resolution to the Board for final action; Allocate 1.0 unclassified Assistant County Administrative Officer position (salary range 554) in budget unit 103, effective July 1, 2011; Approve an exception to the hiring freeze for the unclassified position of Assistant County Administrative Officer (salary range 554) in budget unit 103; Approve an exception to the hiring freeze for the position of Senior Administrative Analyst Trainee (class 0605D, position 01, salary range 373) in budget unit 103; and Approve an exception to the hiring freeze for the position of Revenue Recovery Officer I/II (class 1197, position 04, salary range 305/333) in budget unit 114.

County Counsel

2.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request fro exception to the County hiring freeze to allow for the filling of a Deputy County Counsel I-IV; Position #11, in Budget Unit 121, Salary Ranges $4,400 - $8,758 monthly.

1.                   Yurok Tribe Presentation on Proposed Legislation which will Transfer Park Land back to the Yurok Tribe. (Supervisor Sundberg)

1.                   U.S. Fish and Wildlife Presentation on the Proposal to Expand Snowy Plover Critical Habitat Areas in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Hear the presentation and take appropriate action, if required.

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks.
