1.                   Ratification of 2011-2013 Memorandum of Understanding between the County of Humboldt and the Humboldt County Sheriff's Organization for Representation Unit 7 (Law Enforcement Management).

RECOMMENDATION: That the Board of Supervisors adopt Resolution No. _____ approving the Memorandum of Understanding for Unit 7 (Law Enforcement Management); authorize the Chairman of the Board of Supervisors to execute the Memorandum of Understanding.

Agricultural Commissioner

1.                   Approval of Standard Agreement No. 10-0669, Humboldt Weed Management Group Contract with the California Department of Food and Agriculture in the amount of $16,750.

RECOMMENDATION: That the Board of Supervisors approve Standard Agreement No. 10-0669, known as the Humboldt Weed Management Group contract with the California Department of Food and Agriculture; authorize the Chair to sign the original agreement; grant waiver from the provisions of the Nuclear Free Ordinance.

2.                   Certificates of Achievement for Chester Holmes, Brian Hodge, Kyle Wiegman and Skylar Stoneman for Achieving the Rank of Eagle Scout. (Supervisors Smith and Clendenen)

RECOMMENDATION: Ratify the Certificates of Achievement.

3.                   Letter of Endorsement for Continued Fiscal Support for the North Coast Emergency Medical Services' Regional Medical Director from the Bertha Russ Lytel Foundation. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letter of Support.

4.                   Letter of Support for DHHS - Children and Family Services Grant Request to Expand Access to Children's Mental Health Services Throughout Humboldt County. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letter of Support.

5.                   Proclaim May 15 - 21, 2011 as Emergency Medical Services Week in Humboldt County. (Supervisor Lovelace)

RECOMMENDATION: Adopt the Proclamation.

6.                   Letter of Support for the Yurok Tribe's Funding Request to the Public Lands Highway Discretionary Program (PLHD) for the Paving of Three Miles of Bald Hills Road. (Supervisor Sundberg)

RECOMMENDATION: Authorize Chair to sign letter of support.

RECOMMENDATION: That the Board of Supervisors approve a Budget Appropriation Transfer of $50,647 from 1380-206-1100, Salaries and Wages to: $40,332 - Computer Equipment, 1380-206-8--066, and $10,315 - Computer Software, 1380-206-2-148.

9.                   Approval of the Board Orders - Meeting of May 10, 2011.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the meeting of May 10, 2011.


Community Development Services

10.               Waiver of 960 Hour Limit for Extra Help Employees Meghan Ryan.

RECOMMENDATION: That the Board of Supervisors approve the waiver of 1440 hour limit for extra help employee, Meghan Ryan, up to 1560 hours pursuant to Section 7 of Humboldt County Salary Resolution.

Conflict Counsel

11.               Lease Agreement with Mark Carter for Office Space for the Conflict Counsel's Office at 931 Third Street.

RECOMMENDATION: That the Board of Supervisors approve the Third Amendment to Lease for 931 Third Street, Eureka, extending the lease through June 30, 2012, at a rental rate amount of $1,596.50 per month through June 30, 2012; authorize the Chairperson to execute the Third Amendment to Lease; and direct the Clerk of the Board to return one executed Third Amendment to Lease to Real Property Services for transmittal to Lessor.

County Administrative Office

12.               Local Fire District Allocation for Fiscal Year 2010-11 for the Loleta Fire Protection District.

RECOMMENDATION: That the Board of Supervisors authorize the Chair of the Board to execute an agreement with the Loleta Fire Protection District for revenue-sharing of the County's FY 2010-11 Proposition 172 (Prop 172) funding.

Health and Human Services - Public Health Branch

13.               Set Public Hearing for Public Input on Proposed Reduction in Health Services at the Eureka Public Health Clinic.

RECOMMENDATION: That the Board of Supervisors direct the Clerk of the Board to schedule and notice a public hearing on Tuesday, June 7, 2011 at 1:30 pm or soon there after as the matter may be heard, for consideration of proposed reduction in health services at the Eureka Public Health Clinic; direct the Clerk of the Board to publish the Notice of Public Hearing in a newspaper of general circulation once at least fourteen (14) days before the public hearing; and direct Health and Human Services, Public Health Branch staff to post the Notice of Public Hearing at the entrance to all County health care facilities at least fourteen (14) days prior to the public hearing.

Health and Human Services - Social Services Branch

14.               First Amendment to Lease with JLPREO, LLC to increase janitorial services by three (3) additional days per week and increase the monthly rental cost at 231 Second Street, Eureka.

RECOMMENDATION: That the Board of Supervisors approve First Amendment to Lease with JLPREO, LLC, for the Department of Health and Human Services Social Services Branch, for increased janitorial services and increased monthly rental costs at 231 Second Street, Eureka; authorize Chairperson to execute two (2) originals of the First Amendment to Lease; and direct the Clerk of the Board to return on (1) original of the fully executed First Amendment to Lease to the Public Works-Real Property Division for transmittal to Lessor.

15.               Approve first option to extend the Lease at 134 D Street, Suites 101 and 302, Eureka, CA.

RECOMMENDATION: That the Board of Supervisors approve exercising the first option to extend the lease at 134 D Street, Suites 101 and 302, Eureka, CA with JLPREO, LLC; authorize the Public Works-Real Property Division to send a notice to Lessor that County is exercising the first option to extend the lease; and direct the Clerk of the Board to return one executed agenda to Public Works-Real Property Division.

Probation

16.               Approval of Agreement with Graphic Control System, Inc (GCSI) for the installation of a Programmable Logic Controller (PLC) to upgrade the security system for the Northern California Regional Facility and the continuation of Maintenance Services Agreement.

RECOMMENDATION: That the Board of Supervisors approves agreement with Graphic Control System, Inc. (GCSI) for the installation of a Programmable Logic Controller (PLC) to upgrade the security system for the Northern California Regional Facility and for the continuation of Maintenance Service Agreement .  Instruct Auditor-Controller to transfer $31,560 from Juvenile Regional Facility Trust, Fund 3782, to Budget Unit 254, as shown in the attached Supplemental Budget and Establish Fixed Asset Line 1100 254 8-989 (Miscellaneous Equipment) for the purchase of equipment needed for the new security system.

Public Works

17.               Appropriation Transfer for Relocating and Reassembling Airport Division Portable Building to the Garberville Road Maintenance Yard.

RECOMMENDATION: Approve the Department of Public Works Road Division to relocate and reassemble the Airport Division's portable building to the Garberville Road Maintenance Yard and replace the dilapidated existing maintenance crew office building and approve the attached Appropriation Transfer.

18.               Supplemental Budget for FY 2010-11 for Jet Fuel Truck.

RECOMMENDATION: That the Board of Supervisors adopts the attached supplemental budget for FY 2010/11.

19.               Arcata/Eureka Airport Runway 14 Bluff Stabilization Improvements, Airport Improvement Program (AIP) Grant 03-06-0010-39, Project No. 919265.

RECOMMENDATION: That the Board of Supervisors award the project to the lowest responsible and responsive bidder, Wahlund Construction, Inc., Eureka, California, in the amount of $1,390,080 for the base bid.  The award is conditioned upon the Federal Aviation Administration (FAA) approving the corresponding grant funds identified in Recommendation #3; Authorize the Chairman to execute the agreement with Wahlund Construction, Inc., when staff approves the bonds and insurance, and the FAA approves the subject grant funds; and authorize the Director of Public Works to sign AIP Grant Offer 03-06-0010-39 when the grant is offered by FAA to fund the above project.

RECOMMENDATION: That the Board of Supervisors receive an oral report from the County Administrative Officer on the May revision to the Governor's proposed State budget, the results of community budget meetings and various other topics and take action as may be required.

2.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of one full time equivalent Accountant/Auditor I/II position.

County Counsel - Code Enforcement

3.                   Cost Recovery Assessment Hearing - Troy Beattie - Wells Fargo Bank dba America's Servicing Company - 6360 Longview Drive, Eureka, CA

RECOMMENDATION: That the Board of Supervisors confirm the Findings and Orders confirming Account and Assessment in the sum of $3,361.60; authorize the Chair of the Board to sign the Findings and Order confirming the Account and Assessment; direct the Auditor, upon receipt of the monies assessed, to deposit the money used for the administrative abatement, consisting of $1,295 back into the Code Enforcement Trust Fund account number 3440000; and direct the Auditor, upon receipt of the monies assessed, to deposit $2,066.60 into the County Counsel Office revenue account number 1100-121-603-040 to recoup Code Enforcement staff time, mileage and office expenses incurred enforcing the Humboldt County Code in this matter.

4.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to County Hiring Freeze to allow for the filling of a soon to be vacant Legal Office Business Manager position; Position # 01 in Budget Unit 235, Salary Range 441.

5.                   Request for Exception to Hiring Freeze.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County hiring freeze to allow for the filling of a vacant Supervising Juvenile Corrections Officer position ; Position #04 in Budget Unit 254- Regional Facility, Salary Range 366.

Public Works

6.                   Ordinance amending sections 431-48, 431-60, 431-76, and adding sections 431-87 and 431-108.5 relating to Parking on Harris Street, Hubbard Lane, Myrtle Avenue, Pennsylvania Avenue and Walford Avenue to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors introduce the attached Ordinance by title and waive the first reading; set the Ordinance for adoption on May 24, 2011 or at least one week away; direct the Clerk of the Board to publish the pre-adoption summary of the Ordinance and to post a certified copy of the full text of the proposed Ordinance in the office of the Clerk of the Board, both publication and posting to be done at least five (5) days prior to the Board meeting at which the Ordinance will be adopted; direct the Clerk of the Board, within 15 days after adoption of the Ordinance, to publish a post-adoption summary of the ordinance with the names of the Supervisors voting for and against the Ordinance, and to post in the office of the Clerk of the Board a certified copy of the full text of the adopted Ordinance and amendments along with the names of those Supervisors voting and against the Ordinance, direct Public Works to file the attached Notice of Exemption with the County Clerk in accordance with the California Environmental Quality Act.

RECOMMENDATION: That the Board of Supervisors open the public hearing, receive staff report and take public testimony; close public hearing; adopt attached Resolution approving an application and contract execution for funding from the Planning and Technical Assistance Allocation of the State Community Development Block Grant (CDBG) Program and authorizing the execution of a grant agreement and any amendments thereto with the State of California for Planning and Technical Assistance (PTA) Program by the Community Development Services Director; direct the Clerk of the Board to return a certified Resolution to the Community Development Services Department - Economic Development Division (CDS-EDD) by May 20, 2011; and authorize the County Administrative Officer to sign the Statement of Assurances.

2.                   CASE Zone Reclassification/Parcel Map Subdivision Application File Nos.: APN 309-051-69  Case No.: ZR-06-13/PMS-06-16. (CONTINUED FROM APRIL 5, 2011)

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ____ by title and waive further reading; open public hearing, and receive and consider the staff report and public testimony; adopt Resolution No.____ adopting the Mitigated Negative Declaration as required by Section 1507(b) of the California Environmental Quality Act (CEQA) Guidelines and making the required findings for approving the proposed Zone Reclassification and Parcel Map Subdivision application based on the submitted evidence; approve the rezone and adopt Ordinance No. _____ amending Section 311-7 of the Humboldt County Code by reclassifying an approximate 71 acres of land currently zoned Unclassified in to Agriculture Exclusive with a B-6 Special Building Site Combining Zone that sets the lot size per the parcel map of record; direct the Clerk of the Board to give notice of the decision to the applicant/owner, th County Assessor's Office and any other interested party; direct the Clerk of the Board to publish the Post-Adoption Summary of Ordinance within 15 days after passage by the Board; and direct the Community Development Services - Current Planning Division to file a Notice of Determination pursuant to CEQA.

RECOMMENDATION: That the Board of Supervisors introduce Ordinance No. ___ by title and waive further reading; Open the public hearing in the manner prescribed by law, and receive the staff report and public testimony; adopt resolution No. _____ adopting the Planning Commission’s findings; and approve the amendment of the Humboldt County Freshwater area [GPA=10-03, Blair] from Timber Production (T) and Agricultural Lands (AL) to Agricultural Rural 5-20 (AR5-20); and amend Section 4600, Solid Waste Collection Disposal, of the Freshwater Community Plan and delete Policy 4611.1 that imposed a residential density restriction of one dwelling per 20 acres for properties bordering the now closed Cummings Road landfill, subject to final adoption as part of the Minor Quarterly Amendments 2011-A package; Approve the Zone Reclassification and adopt Ordinance No. ____, amending Section 311-7 of the Humboldt County Code by reclassifying, through a 10 year non-renewal, an approximate 21 acres from Timberland Production Zone (TPZ) to Agricultural General with a Special Building Site Combing zone specifying a 5- acre minimum parcel size (AG-B-5(5)); Direct the Chair of the Board to sign and the Clerk of the Board to record a Certification of Rezoning (Notice of Timberland Production Zone Status) on the parcel pursuant to Sections 51117 and 51141 of the California Government Code, after attaching a copy of the fully executed Ordinance and Map; and direct the Clerk of the Board to give notice of the decision to the applicant/owner, the County Assessor’s Office and any other interested party, and to publish the Post-Adoption Summary of Ordinance within 15 days after passage by the Board, and direct Community Development Services – Current Planning Division to file a Notice of Exemption pursuant to the California Environmental Quality Act (CEQA).

RECOMMENDATION: That the Board of Supervisors set a date and time to conduct interviews and receive each Board Members top three rankings of candidates to be interviewed for the vacant At-Large seat on the Humboldt County Planning Commission.

2.                   Interview Candidates to Fill the Vacant Seat on the North Coast Railroad Authority Board and Consider Making Appointment from the Candidates Interviewed.

RECOMMENDATION: That the Board of Supervisors interview interested candidates for the vacancy on the North Coast Railroad Authority Board left vacant by the resignation of Linda Atkins on February 16, 2011, and consider making an appointment from the candidates interviewed.
