Board of Supervisors

1.                   Letters of Appreciation to Val Martinez and Barbara Groom for Serving on the Workforce Investment Board. (Supervisor Lovelace)

RECOMMENDATION: Authorize Chair to sign Letters of Appreciation.

2.                   Resolution Authorizing Road Closures for the Garberville Rodeo Parade on June 18, 2011. (Supervisor Clendenen)

RECOMMENDATION: Adopt the Resolution.

3.                   Letter to California Boating and Waterways Commission Thanking them for their Support of Projects in Humboldt County. (Supervisor Smith)

RECOMMENDATION: Authorize Chair to sign letter.

4.                   Approval of Board Orders - Meeting of May 17, 2011.

RECOMMENDATION: That the Board of Supervisors approve the Board Orders from the Meeting of May 17, 2011.

Community Development Services

5.                   Howard/Dimmick Merger/Lot Line Adjustment/Joint Timber Management Plan and Guide Application; File No. APN 033-221-10 et al., Case Nos.: LLA-10-07/JTMP-10-01, Benbow Area.

RECOMMENDATION: That the Board of Supervisors approves the Howard/Dimmick Merger and Lot Line Adjustment (Merger/LLA) to result in Parcels 1 and 2 of approximately 50 and 320 acres respectively, subject to the findings and conditions in staff's report, and approve the division of assessor parcels, portions of which are zoned Timberland Production Zone (TPZ) into parcels containing less than 160 acres and for which a Declaration of Covenants, Conditions and Restrictions (Declaration) (Attachment A) has been executed and for which a Joint Timber Management Plan (JTMP) and Guide (Attachment B) have been prepared pursuant to Section 51119.5 of the California Government Code (C.G.C.); Direct the Community development Services - Current Planning Division to record the Declaration with the JTMP; Direct the Clerk of the Board to give notice of the decision to Bob Howard, Tom and John Dimmick, the County Assessor's Office and any other interested party.

Health and Human Services - Social Services Branch

6.                   Termination of Lease with Area 1 Agency on Aging for Office Space at 434 Seventh Street, Eureka, CA.

RECOMMENDATION: That the Board of Supervisors approves the termination of the lease with Area 1 Agency on aging (A1AA) for office space at 434 Seventh Street, and authorize the Public Works-Real Property division to send a Letter of termination to A1AA effective July 31, 2011 to terminate the lease at 434 Seventh Street, eureka and direct the Clerk of the Board to send an executed Board agenda item to the Public Works-Real Property Division.

7.                   Supplemental Budget in Fund 1160 Budget Unit 511 Social Services and Corresponding Budget transfer/Adjustment in Fund 1160 Budget Unit 508 Child Welfare Services.

RECOMMENDATION: That the Board of Supervisors adopts the attached Supplemental Budget in Fund 1160 Budget Unit 511 Social Services in the amount of $350,000 (Attachment 1); and approves the corresponding Budget Transfer/Adjustment form to increase cost applied line in Fund 1160 Budget Unit 508 Child Welfare Services in the amount of $350,000 (Attachment 2).

Public Works

8.                   Ocean Spruces Subdivision, Unit IV, APN 306-381-050, Humboldt Hill Area.

RECOMMENDATION: That the Board of Supervisors accepts and approves the subdivision map for filing with the County Recorder; accepts the dedications to the County of Humboldt of Parcel A, Parcels C-1, C-2, C-4, C=5, C-6, C-7, Parcel E, & Parcel F for public utilities, accept Parcels G-1 & G-3 for drainage, accept Parcel B for Non-vehicular access, accept Parcel H for stormwater runoff rights, reject Parcel A for public road purposes, reject Parcel C-3 for pedestrian purposes, and reject Parcel D for drainage, all as shown on the subdivision map; direct the Clerk of the Board to sign the subdivision map on behalf of the Board; authorize the Chair to execute the Conveyance and Agreement; and direct the Clerk of the Board to transmit the subdivision map and the Conveyance Agreement to the County Recorder.

9.                   Adoption of Ordinance: Amending Sections 431-48; 431-60, 431-76, and adding Sections 431-87 and 431-108.5 Relating to Parking on Harris Street, Hubbard Lane, Myrtle Avenue, Pennsylvania Avenue and Walford Avenue to Title IV of the Humboldt County Code.

RECOMMENDATION: That the Board of Supervisors adopt Ordinance No. ________ Amending Sections 431-48, 431-60, 431-76, and adding Sections 431-87 and 431-108.5 relating to parking on Harris Street, Hubbard Lane, Myrtle Avenue, Pennsylvania Avenue and Walford Avenue to Title IV of the Humboldt County Code.

10.               Janes Creek Flood Control District.

RECOMMENDATION: That the Board of Supervisors authorize expenditures of up to $16,000 for the acquisition of one acre within a proposed 16.32 acre property acquisition along Janes Creek upstream from West End Road in Arcata.

11.               Construction of Seismic Retrofit and Rehabilitation on Klamath River Bridge (Martin's Ferry) Bridge No. 04C-007, Project No.: BRLSZD-5904(006), Contract No.: 924020B.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Seismic Retrofit and Rehabilitation on Klamath River Bridge (Martin's Ferry) Bridge No. 04C-0007; award the contract to Mercer Fraser Company, Inc for the total amount of $4,406,000.00; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0268 and transfer $4,626,300.00 to the account per the attached appropriation transfer.

12.               Storm Damage Repairs on Mattole Road (3C010) at P.M. 26.65, 27.15 & 29.55, Project No.: ER-4400 (068), (069) & (018), Contract No.: 206404, 206405, and 206259.

RECOMMENDATION: That the Board of Supervisors approves the plans and specifications; and directs the Clerk to advertise the project as required by Section 22037 of the California Public Contract Code with Bids to be opened on Tuesday, June 21, 2011 at 2:00 PM.

D.                  SPECIAL PRESENTATIONS

1.                   Presentation on the Humboldt Crabs and their Upcoming 67th Consecutive Season. (Supervisor Lovelace)

RECOMMENDATION: Hear the Presentation and take action, if required.

2.                   Proclaim May 2011 as Drive 2 Stay Alive Month in Humboldt County. (Supervisor Bass)

RECOMMENDATION: Adopt the Proclamation.

1.                   County Administrative Officer Report:  State Budget and Various Other Topics.

Health and Human Services - Administration

2.                   Patient Protection and Affordable Care Act of 2010.

RECOMMENDATION: That the Board of Supervisors receive and file a report from the Department of Health and Human Services on the potential implication of the Patient Protection and Affordable Care Act of 2010 and California's Section 1115 Medicaid Demonstration Waiver.

RECOMMENDATION: Hear the report and take appropriate action, if required.

I.                     CLOSED SESSION

1.                   Conference with Labor Negotiator - Pursuant to Government Code section 54957.6 it is the intention of the Board of Supervisors to meet in closed session to review the County's position and instruct its designated labor negotiator with respect to the various forms of compensation provided to the County's represented and unrepresented personnel.  Negotiator:  Dan Fulks. Employee Organizations:  American Federation of State, County and Municipal Employees (AFSCME local 1684), Humboldt County Attorneys Association, Humboldt Deputy Sheriffs' Organization (Law Enforcement Non-Management Unit), Humboldt Deputy Sheriffs' Organization (Law Enforcement Management Unit), Elected & Appointed County Officials, and Management & Confidential Employees

Community Development Services

1.                   Appeal of Planning Commission Approval of the Hummingbird Healing Center Conditional Use Permit Application, File No. APN 015-011-25, Case No.: CUP-09-14A, Eureka Area.

RECOMMENDATION: That the Board of Supervisors opens the public hearing and receives the staff report and public testimony.  Based on the findings in the staff report and testimony received about the project, deny the appeal and approve the Hummingbird Healing Center (HHC) Conditional Use Permit application.  Direct the Clerk of the Board to give notice of the decision to the appellant, the project applicant, the agent and any other interested party.

PUBLIC WORKS

2.                   Exclusive Franchise for Collection and Disposal of Solid Waste and Collections of Recyclables in the Willow Creek Area of Humboldt County.

RECOMMENDATION: That the Board of Supervisors opens a public hearing and receives the staff report and public comments on the proposed awarding of exclusive franchise agreement for the Willow Creek Area to Eel River Disposal and Resource Recovery, Inc. for the period July 1, 2011 to June 30, 2021 and to establish a rate schedule for the Willow Creek Area.  Close the public hearing.  Award the exclusive franchise to Eel River Disposal and Resource Recovery, Inc. for obtaining the highest percentage score after evaluation of proposal by the review committee.  Approve proposed rate adjustments for services.  Authorize the Chair to sign the Notice of Award/Certificate of Acceptance (Attachment 4) and direct the Public Works Department to require the Eel River Disposal and Resource Recovery to execute the Certificate of Acceptance of Contract within two weeks following the granting of the franchise.  Delegate authority to the Public Works Director to execute an exclusive franchise agreement with the approved rate and on the terms and conditions set forth in the franchise agreement (Attachment 7) with the Eel River Disposal and Resource Recovery, Inc. upon approval of the agreement by County Counsel, and review and approval of insurance certificates by Risk Manager.

M.                 AFTERNOON DISCUSSION ITEMS

1.                   Consider Making Appointment to Fill Vacant At-large Seat on the Humboldt County Planning Commission following input from the Applicants and Public.

RECOMMENDATION: That the Board of Supervisors receive input from the applicants and public and consider making an appointment to fill the At-Large vacancy on the Humboldt County Planning Commission.
