1.                   Transfer of funds from Salaries and Wages to cover expenditures for Transportation Out of County.

RECOMMENDATION: That the Board of Supervisors approve a Budget Appropriation Transfer from 1100-113-1100, Salaries and Wages to 1100-113-2225 Transportation Out of County $6,348.00.

2.                   Certificates of Recognition to Soroptimist International of Arcata Award Winners, Jasmine Keith, Julie Leong, Maricela Resendez, and Sarah Kingstrom. (Supervisor Lovelace)

RECOMMENDATION: Ratify the Certificates of Recognition.

3.                   Informational Report on the Appointment of Lloyd Reece to the Humboldt County Human Rights Commission as a District One Representative. (Supervisor Smith)

RECOMMENDATION: Receive and file the report.

Clerk of the Board

4.                   Approval of the Board Orders - Meeting of May 24, 2011.

RECOMMENDATION: That the Board of Supervisors approves the Board Orders of May 24, 2011.

5.                   Notice of Two Alternate Position Vacancies on the Assessment Appeals Board.

RECOMMENDATION: That the Board of Supervisors receive and file this report, or take action if so desired.

Community Development Services

6.                   Supplemental Budget for Fund 1120, Budget Unit 287, Economic Development Division, Workforce Investment Unit, Community Development Services FY 2010-2011.

RECOMMENDATION: That the Board of Supervisors approves a supplemental budget in Fund 1120, Budget Unit 287, Economic Development Division of the Community Development Services Department and direct the Auditor-Controller to incorporate the supplemental budget attached.

7.                   Appointment of Three New Members to Fill Vacancies on the Humboldt County Fire Safe Council.

RECOMMENDATION: That the Board of Supervisors review nomination letters, and appoint Bill Eastwood, Jean-Louis Carmona and Rod Mendes to the Humboldt County Fire Safe Council.

8.                   Reallocate Planner I/II Position (salary range 351/378, class 0631, Position #01) in Budget Unit 289 to Senior Planner (salary range 415, class 0630, position #01).

RECOMMENDATION: That the Board of Supervisors reallocate the Planner I/II position (salary range 351/378, class 0631, position #01) currently occupied by Cybelle Immitt in budget unit 289 to Senior Planner (salary range 415, class 0630, position #01) effective the beginning of the bi-weekly pay period following approval.

Health and Human Services - Public Health Branch

9.                   Agreement with the State Water Resources Control Board for $346,697 in Fund 1175, Budget Unit 432, Local Oversight Program for fiscal year 2011-12.

RECOMMENDATION: That the Board of Supervisors approve and authorize the Chair to sign agreement #11-004-250, with the State Water Resources Control Board, in the amount of $346,697 in Fund 1175, Budget Unit 432, Local Oversight Program for fiscal year 2011-12 and direct the Clerk of the Board to return the agreement and three original signature pages to the Environmental Health Division for submission to the State Water Resources Board.

Health and Human Services - Social Services Branch

10.               Approval and Execution of UC Davis Training Contracts for Eligibility Services and Child Welfare Service Training.

RECOMMENDATION: That the Board of Supervisors approve attached contracts in the amounts of $108,680 to provide Eligibility Services training and for the amount of $29,260 for Child Welfare Training with the University of California Davis (US Davis), for the provision of training to Department of Health and Human Services - Social Services Branch (DHHS-SSB) staff for FY 2011-2012; Grant a waiver of the Nuclear Free Ordinance; and authorize the Chairperson of the Board of Supervisors to execute two (2) of each contract and return them to the DHHS-SSB Director for forwarding to UC Davis for completion.

Library Services

11.               Supplemental Budget (Fiscal Year 2010-2011) and Grant Award from the McLean Foundation for Materials, Workshops and presentations at the Fortuna Branch Library.

RECOMMENDATION: That the Board of Supervisors approve the attached Grant Agreement with the McLean Foundation for materials workshops and presentations at the Fortuna Branch Library; authorize Victor Zazueta, Director of the Library Services, to sign two (2) copies of the Grant Agreement; and adopt a supplemental budget in Fund 1500, Budget Unit 621, County Library, for fiscal year 2010-2011 and authorize the Auditor-Controller to supplement the budget as shown in Attachment 1.

Probation

12.               Appointment to the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC).

RECOMMENDATION: That the Board of Supervisors approve the following appointments to the Multi-Agency Juvenile Justice Coordinating Council (MAJJCC): APPOINTEE - Maura Eastman; CATEGORY - Youth Service Provider; REPLACING - Peter LaVallee.

13.               Fiscal Year 2011-12 Daily Detention Bed Rate for the Northern California Regional Facility.

RECOMMENDATION: That the Board of Supervisors adopt the fiscal Year 2011-2012 Northern California Regional Facility daily detention bed rate in the amount of $178.23 for all referring counties.

Public Works

14.               Cooperative Agreement with the California Department of Transportation (CALTRANS) for the Construction of a Fish Migration Barrier Removal Project as Mitigation for the Highway 101 Mad River Bridges.

RECOMMENDATION: That the Board of Supervisors authorizes the Department of Public Works to enter into a cooperative agreement with Caltrans for the construction of a fish migration barrier removal project at Mill (Watek) Creek.

15.               Bid Award and Supplemental Budget for Humboldt County Courthouse Boiler System Upgrade Project, Project No. 170211.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for the Humboldt County Courthouse Boiler System Upgrade Project; award the project to the lowest responsible and responsive bidder, Niekrasz Plumbing. Inc., Eureka, California, in the amount of $217,984 for the base bid; authorize the Chairman to execute the agreement with Niekrasz Plumbing, Inc., after staff approves the bonds and insurance; adopt the attached supplemental budget in FY 2010/11 to provide funds for the Courthouse Boiler System Upgrade project.

16.               Storm Damage Repairs on Alderpoint Road (F6B165) PM 12.0-12.2 Project No.: ER 4400(040), Contract No.: 206371.

RECOMMENDATION: That the Board of Supervisors receive and file the bids for Construction of Storm Damage Repairs on Alderpoint Road (F6B165) PM 12.0-12.2; award the contract to Wylattie Resource Management, Inc. for the total amount of $135,082; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0267 and transfer $141,836 to the account per the attached appropriation transfer.

17.               Storm Damage Repairs on Alderpoint Road (F6B165) PM 41.0, 45.78-46.15, 46.95, Project No.: ER 4400(047), (058), (059), Contract No.: 206416, 206420, 206387.

RECOMMENDATION: That the Board of Supervisors receives and files the bids for Construction of Storm Damage Repairs on Alderpoint Road (F6B165) PM 41.0. 45.78-46.15, 46.95; Award the contract to G.R. Wilcox, Inc. for the total amount of $148,603; authorize the Chairman to execute the project agreement upon submittal of the appropriate bonds and insurance; and direct the Auditor-Controller to establish a new contract account 1200321-0266 and transfer $156,033 to the account per the attached appropriation transfer.

18.               Rental Arrears to the Russ Estate Trust for the Russ Rock Quarry Site No.1 and Stockpile Site and an Updated License Agreement for the Russ Rock Quarry Site No.1 and Stockpile Site.

RECOMMENDATION: That the Board of Supervisors approve rental arrears payment to the Russ Estate Trust for annual site rent for the Russ Rock Quarry No. 1 and stockpile site covering the last four previous fiscal years of 2010/2011, 2009/2010, 2008/2009, and 2007/2008 in the amount of $2,400; Direct the Department of Public Works to cause a check for rental arrears for the last four fiscal years at $600 per fiscal year for the amount of $2,400, made payable to the Russ Estate Trust; authorize the Chairperson to execute, in duplicate, the License Agreement between the County of Humboldt and Judy L. Dixon and James T. Russ, Co - Trustees of the Patricia R. Davis Trust, Stanley L. Dixon and Judith L. Dixon, and James T. Russ and Katie C. Russ; direct the Clerk of the Board to return both executed License Agreements to the Department of Public Work's Land Use Division for further processing.

19.               Financial Assurances for Reclamation of Quarry Sites.

RECOMMENDATION: That the Board of Supervisors adopt the attached Resolution, which authorizes the annual adjustment of the funds pledged by the Public Works Department to complete reclamation of rock and gravel quarry sites.

County Administrative Office

1.                   Update on County Budget Development for Fiscal Year (FY) 2011-12

RECOMMENDATION: That the Board of Supervisors direct the Personnel Director to rescind any layoff notices that have been issued and cease the issuance of any pending layoff notices, for the following positions: a. 1.00 full-time equivalent (FTE) Investigator (District Attorney) (class 0412), 1.00 FTE Deputy District Attorney I/II/III/IV (Class 0602), and 1.00 FTE Victim Witness Specialist (class 0689) positions in budget unit 211, b. 3.00 FTE Deputy Public Defender I/II/III/IV (class 0440) positions in budget unit 219, c. 1.00 FTE Legal Office Assistant I/II (class 0178) and 9.00 FTE Deputy Sheriff I/II (class 0416) positions in budget unit 221, and d. 1.00 FTE Animal Shelter/Care Attendant I/II (class 0440) position in budget unit 278; Direct the County Administrative office not to designate the above positions as allocation type F0 in the Proposed budget for FY 2011-12; Cease reallocation of 1.00 FTE Supervising Legal Secretary (class 0114, position 01) position, 1.00 FTE Senior Legal Secretary (class 0140, position 01) position, and four (4) 1.00 FTE Deputy Public Defender I/II/III/IV (class 0604, positions 01,02,03,04) positions to 0.95 FTE in budget unit 246; and approve a temporary reduction in salary for the position of County Administrative Officer, beginning with the pay period that commences June 12, 2011, and terminating at the end of the pay period ending June 23, 2012, in the amount of five percent (5%) of base salary.

District Attorney

2.                   Request for Exception to Hiring Freeze for Deputy District Attorney Position.

RECOMMENDATION: That the Board of Supervisors approve a request for exception to the County Hiring Freeze to allow for the filling of a vacant Deputy District Attorney I/II/III/IV position (job class 0602; position #05, salary range 404/439/470/503) in budget unit 205 - District Attorney.

Elections

3.                   Redistricting.

RECOMMENDATION: That the Board of Supervisors receives and files the report, provides staff with direction as necessary, and directs staff to prepare for a public hearing at a specified date on the recommended supervisorial district lines.

L.                   PUBLIC HEARINGS

DHHS - Public Health

1.                   Public Hearing on Proposed Reduction in Health Services at Eureka Clinic.

RECOMMENDATION: That the Board of Supervisors open the public hearing, receive report from staff on proposed reductions in Health Services at the Eureka Clinic, receive comments from the public, close the public hearing, find that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations; Section 15061(b)(3), in that it is not a project which has the potential for causing a significant effect on the environment; Section 15378(b)(2) that the activity involves continuing administrative activities such as personnel related actions, general policy and procedures; Section 15378 (b)(5) the activity involves organizational or administrative activities of the County that will not result in direct or indirect physical changes in the environment. The exemptions are set forth in the Notice of Exemption attached hereto at Attachment 1; direct Health and Human Services, Public Health Branch Staff to file for posting the Notice of Exemption, Attachment 1, with the Humboldt County Clerk; and approve the proposed reduction in health services at the Eureka Clinic consisting of Adult Health Services.

M.                 AFTERNOON DEPARTMENTAL ITEMS

1.                   Consider Making Appointment to Fill the Vacant Seat on the North Coast Railroad Authority Board following input from the applicants and the public.  (CONTINUED FROM THE MAY 17, 2011 BOARD OF SUPERVISORS MEETING).

RECOMMENDATION: That the Board of Supervisors receives input from the applicants and the public and considers making an appointment to fill the vacancy on the North Coast Railroad Authority Board left vacant by the resignation of Linda Atkins on February 16, 2011, and consider making an appointment from the candidates interviewed.

2.                   Memorandum of Understanding between the Humboldt Waste Management Authority and Certain of its Member Agencies to Participate in a Recyclable Materials Processing Contract.   (Estimated time for staff report - 15 minutes; Estimated time for Public Testimony - 2 hours

RECOMMENDATION: That the Board of Supervisors approves the attached Memorandum of Understanding (MOU) between the Humboldt Waste Management Authority  (HWMA) and certain of its member agencies to participate in a Recyclable Materials Processing Contract; authorize the Chair to execute three original copies of the MOU referenced above for the County's Participation in the recyclable materials processing contract and forward the signed copies to HWMA; Delegate to the Public Works Director the authority to determine which franchise collection haulers will be referred to Solid Waste of Willits pursuant to Section 2 of the HWMA MOU; and authorize and direct the Public Works Director to negotiate and pursue a contract between the County of Humboldt and Solid Waste of Willits for the processing of the County's recyclables if the HWMA Board does not approve the contract with Solid Waste of Willits by June 30, 2011.
